Meeting of November 14, 1984, were Approved as Transcribed

ADMINISTRATIVE REVIEW NO. 84-90
Applicant: Donald E. Elder
Staff reported a letter has been receivea from the applicant
requesting a continuance to the meeting of January 16, 1985.
UPON MOTIGN BY GODFREY AND SECOND BY VINCENT, ADMINISTRATIVE REVIEW
NO. 84-90 WAS CONTINUED TO THE MEETING OF JANUARY 16, 1985, BY THE
FOLLOWING VOTE:

CONDITIONAL EXCEPTION NO. 84-71
Applicant: Frea Fabre
A request to permit a reduction in two (2) open space dimensions and
areas from twenty-five feet (251) to twenty-four feet (241) and
fifteen feet (15') to 13.5 feet in width. Subject property is
located at 9431 Westcliff Drive (Northwest corner of'Westcliff Drive
and Crestview Lane).
This request is covereu by Categorical Exemption, Class 5,
California Environmental Quality Act, 1970.
Ms. Pierce reported this is a piece of property that is subject to
the 1,200 Square Foot open space requirement. Applicant is meeting
this requirement but there is a dimension problem. Staff woula
recommend denial because there is no hardship presented.

Daryl Smith opened the Public hearing and the applicant, Fred Fabre,
was present. Mr. Fabre stated he felt the hardship existea because
it was a corner lot and he was proviaing more open space.than
required. There was no-one else present to speak either for or
against the pro)ect so the Public hearing was closed.
GODFREY MOVED THAT CONDITIONAL EXCEPTION NO. 84-71 BE DENIED WITH
THE FOLLOWING FINDINGS:
1. Because of the size, configuration, shape ana_lack of unique
topographic features of the subject property, there does not
appear to be exceptional or extraordinary circumstances or
conditions applicable to the land, buildings or premises
involved that does not apply generally to property or class of
uses in the same district.
2. Since the subject property can be fully developed within
regular established setbacks, such a conditional exception is.
not necessary for the preservation and en3oyment of substantial
property rights.
3. Granting of Conditional Exception No. 84-71 would 'constitute a
special privilege inconsistent with limitations upon properties
in the vicinity.
4. Exceptional circumstances do not apply that deprive the subject
property of privileges enjoyed by other properties in.the same
zone classifications.

UPON MOTION BY EVANS AND SECOND BY VINCENT, CONDITIONAL EXCEPTICN
NO. 84-71 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS,
BY THE FOLLOWING VOTE:
FINDINGS FOR APPROVAL:
1. Granting of reduction in open space minimum dimension ana
minimum open space area will not reduce the required total open
space area (1200 Square Feet).
2. The granting of a conditional exception is necessary in order
to preserve-the.en3oyment of one or more'substantial property
rights.

3. The granting of Conditional Exception No. b4-71 will not be
materially detrimental to the public welfare or in3urious to
property in the same zone classifications.
4. The granting of the conditional exception will not aaversely
affect the General Plan of the City of huntington Beach.
CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and datea
December 13, 1984, shall be the approved layout.
2-. All necessary permits shall be obtained.
3. The development shall comply with all applicable provisions of
the Building Division and Fire Department
4. Proposed additions shall be architecturally compatible with
existing structure.

CONDITIONAL EXCEPTION NO. 84-73 (SITE PLAN AMENDMENT N0. 84-29)
Applicant: Mikkelsen/Schwartz, Ltd.
CONDITIONAL EXCEPTION REQUEST: A request to permit a 20' x 35'
walled outdoor dining area to encroach five feet (5') into the
required twenty-five foot (251) front setback.
SITE PLAN AMENDMENT REQUEST: To permit a 20' x 35' walled outdoor
dining area.
These requests are covered by Categorical Exemption, Class 5,
California Environmental Quality Act, 197'0.
Subject property is located at 17162 Beach Boulevard (East side of
Beach Boulevard approximately 300 feet South 'of Blaylock Drive).
Staff reported this project is located in Zone C-4. A stipulation
had been established several years ago calling for a fifty foot
(50') setback along Beach Boulevard and nothing can be built with a
height of over six feet (61). Based on this information, Staff
would have to recommend denial of this request.

Daryl Smith opened the Public Hearing and,the'applicant, Stephen
Schwartz, was present.
Glen Godfrey clarifiea,the fact the Boara of Zoning Adjustments aid
not have authority to grant an exception into that fifty foot (501)
setback. After a lengthy discussion concerning the project, the
applicant requested a three week continuance to allow time for
preparing new plans to meet the Board's recommendations.
There was no one else present to speak for or against this project
and the Public hearing remained open.
UPON MOTION BY GODFREY AND SECOND BY EVANS,-CONDITIONAL EXCEPTION
NO. 84-73'AND SITE PLAN AMENDMENT NO. 84-29 WERE CONTINUED TO THE
MEETING OF JANUARY 30, 1985, WITH CONCURRENCE OF THE APPLICANT, BY
THE FOLLOWING VOTE:

NOES: None
ABSENT:- None
USE PERMIT NO. 84-84 (NEGATIVE DECLARATION NO. 84-45)
Applicant: Iraj Mavandadi
A request to permit a seven (7) unit apartment builaing to be
located at 17232 Ash Street (East side of street approximately 350
feet South of Cypress Street).
This request is covered by Negative Declaration No. 84-45.
Susan Pierce recommendea that this project be tablea until amended
and acceptable plans were submitted.

AND NEGATIVE DECLARATION NO. 84-45 WERE TABLED UNTIL.AMENDED, BY ThE

Applicant: Warren Lortie
A request to construct an 11,020 Square Foot inaustrial.building to
be located on the North side of Reynolds -Circle at end of cul-de-sac
approximately 200 feet East of Sampson Lane.
This request is covered by Negative Declaration No. 79-35.

Ms. Pierce stated this project meets the requirements of the Code
and that landscape calculations has been verified.
The applicant, Warren Lortie, was present. Mr. Lortie assured the
Board that the property would be graded until essentially flat and
he would be handling his own drainage on the lot. Mr. Poe inquired
about installing sprinklers in the building and Mr. Lortie stated
the building would be sprinklered.
UPON MOTION BY EVANS AND SECOND BY SMITH, ADMINISTRATIVE REVIEW
NO. 84-91 WAS APPROVED WITh THE FOLLOWING CONDITIONS, BY THE;
FOLLOWING VOTE:
CONDITIONS OF APPROVAL:
1. The site plan receivea January 9, 1985, ana the floor plans ana
elevations received and dated December 19, 1984, shall be the
approved layout.
2. Prior to issuance of building permits, the applicant shall
submit th,e following plans:
a. Landscape ana irrigation plan to the Department of
Development Services and Public Works for review ana
approval.
b. Rooftop Mechanical Equipment Plan. said plan shall
indicate screening of all rooftop mechanical equipment and
shall delineate the type of material proposea to screen
said equipment.
3. Maximum separation between building wall and property line
shall not exceed two inches (2").
4. Driveway approaches shall be a minimum of twenty-seven feet
(271) in width and shall be of radius type construction.
5. Low -volume heaas shall be used'on all spigots and water faucets.
6. All building spoils, such as unusable.lumber, wire, pipe, .and
other surplus or unusable material,,shall'be disposea of at an
off site facility equipped to handle them.
7. If lighting is included in the parking lot, high-pressure
sodium vapor lamps shall be used for energy savings. All
outside lighting shall be airected to prevent "spillage" onto
adjacent properties.

8. A detailed soils analysis shall,be prepared by a registered•
Soils Engineer. This analysis shall -include on site soil
sampling and laboratory testing of materials to provide
detailed recommendations regarding grading, chemical and fill
properties,. foundations, retaining walls, streets, and
utilities.
9. it foil -type insulation is to be used, a fire retardant type
shall be installed as approved by the Building Division.
