BOARD MEMBERS PRESENT: Evans, Godfrey, Smith, Sampson STAFF MEMBERS PRESENT: Pierce MINUTES: UPON MOTION BY GODFREEY AND SECOND BY SMITH, MINUTES OF THE MEETING OF FEBRUARY 6, 1985, WERE DEFERRED TO THE MEETING OF FEBRUARY 271 1985, FOR LACK OF VOTING MEMBERS, BY THE FOLLOWING VOTE: AYES: Evans, Godfrey, Smith NOES: None ABSTAIN: Sampson ABSENT: Cranmer Susan Pierce reported that the applicant for Conaitional Exception No. 85-4 and Use Permit No. 84-84 had called to request that his project be heard later in the meeting than scheaulea because the applicant's representative would be appearing in Court. Board agreed to grant this request. REGULAR AGENDA ITEMS: CONDITIONAL EXCEPTION NO. 84-74 (UP NO. 84-85) (Cont. from 2/6/85) Applicant: Diversified Shopping Centers A request for reduction in parking (from 259 to"235 spaces) and joint use parking for subject property located at 16552-16600 Bolsa Chica Street (Southeast corner of Bolsa Chica Street and Heil Avenue) This request is -covered by Categorical Exemption, Class 5, California Environmental Quality Act-, 1970. Mr. Guiltinan said he was sure everyone was aware that the shopping center had existed when the fourplexes were built. He indicated that Diversified Shopping Centers was willing to work with the Board and adjacent property owners to resolve the problems. Stratton Matinas, one of the adjacent property owners, stated the noise factor is the worst problem. He requested some form of noise buffer such as fencing and/or trees, limiting hours of deliveries, and restricting trucks from waiting behind Lucky's with motors running. Jan Petersen clarified the length and type of fencing involved between the shopping center and adjacent property. Glen Godfrey broached the possibility of blocking off the area behind the stores with a locked chain; however, the Board decided against that type of action at present. There was no one else present to speak so the Public,Hearing was closed. UPON MOTION BY EVANS AND SECOND BY GODFREY, CONDITIONAL EXCEPTION NO. 84-74 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS FOR APPROVAL: 1. Granting of reduction in parking is based on the original approval depicting 186 required and 195 provided parking spaces. Project actually constructed less square -footage whereby the required parking was reduced to 173. New,addition and existing 1400 Square Foot building to be converted to retail now bring the minimum parking requirement to 209 spaces (226 with restaurant and beauty shop). A revised'site plan will be submitted depicting the 226 parking spaces. 2. The applicant proposes'to modify the parking layout to incorporate compact parking spaces. The addition of compact spaces will allow more intense uses in the existing center. 3. Granting of reduction in parking bay layout will not be detrimental due to the one-way nature of the drive aisle. 4. The granting of the conditional exception is neCessaty in order to preserve the enjoyment of one or more substantial property rights. 6.- The granting of Conditional Exception No. 84-74 will not be materially detrimental to the public welfare or injurious to property in the same zone classification. 7. The granting of the conditional exception will not adversely affect the General Plan of the City of Huntington Beach. 8. The granting of the conditional exception will be consistent with previous approvals to upgrade older, existing shopping centers in the City of Huntington Beach. CONDITIONS OF APPROVAL: 1. A revised site plan shall be submitted depicting the modifications described herein: a. Reflect the change of compact parking to be full size parking at 600 angle; b. Aisleway that lies between 600angle parking and planters shall be a minimum of twenty-four feet (241) in width; C. First parking space from Bolsa Chica Street at the Northerly driveway shall be a minimum of fifty feet (501) from the North property line; d. Radiuses shall be provided to satisfaction of the Fire Department. Subject property is located at 16552-16600 Bolsa Chica Street (Southeast corner of Bolsa Chica Street and Heil Avenue). Board of Zoning Adjustments February 20, 1985 Page 4 Bill Sampson stated Condition No. 8 should 'be ,changed.to read "Service roads and tire lanes, as determined by.the Fire Department, shall be designed, posted and marked to Fire Department standards." The Public Hearing was opened by Daryl Smith and the applicant's representative-haa no turther_questions. There was no one else wishing to speak -so the Public Hearing was closed. UPON MOTION BY EVANS AND SECOND BY SMITH, USE PERMIT NO. 84-85 tivAS APPROVED WITH-THE"FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS FOR APPPOUAT.- 1. The establishment, maintenance and operation of the use will not be detrimental to: a.. The general welfare of persons residing or working in the vicinity; b. Property and improvements in -the vicinity_of,such use or building. 2. The granting of.the use permit-will'not'a*dversely.affect the -General 'Plan of,the City'of Huntington -Beach. 3. The proposal is consistent -with the City's General Plan of Land 'Use. 4. Measures have been incorporated into the project to add additional landscaping, additional parking and buffering from adjacent residential property. CONDITIUNS nF APPROVAT. 1. A revised site plan shall be submitted to theSecretaryof the Board for approval aepicting the modifications'described in Conditional Exception No. 84-74. Elevations submitted January 25, 1985, shall be the approved conceptual plans. 2. Prior to issuance of building permits, the applicant shall submit the following plans: a. Landscape, tree screening and irrigation plans to the Department of Development Services and Public Works for review and approval. -4- 2/20/85 - BZA Minutes, H. February 20, Page 5 B. Board of Zoning Adjustments 1985 b. Rooftop Mechanical Equipment Plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. c. Addition of an extension wall three feet (31) in height to the existing wall along the easterly property line. This extension shall be placed from the most southerly line to a point 285 feet northerly or to the existing split face block wall. The existing wall and the extension wall shall be designed to incorporate and be installed with all-weather acoustical sound -absorbing material approved by an Acoustical Engineer and the Department of Development Services. 3. The development shall comply with.all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 4. Service roads and fire lanes, as determined by the Fire Department, shall be designed, posted and marked to Fire Department standards. 5. Driveway approaches shall be a minimum of twenty-seven feet (271) in width and shall be of radius type construction. 6. (in -site fire hydrants shall be provided in number and at locations specified by the Fire Department. 7. An automatic fire sprinkler system shall be approved and installed pursuant to Fire Department regulations in all areas of the addition. 8. All signs shall comply with Article 976 of the Huntington Beach Ordinance Code. 9. Proposed structures shall be architecturally compatible with existing structures. 10. Scheduled loading and unloading shall be limitea to the hours Of 6:00 A.M. to 8:00 P.M. and deliveries shall not be accepted before 7:00 A.M. or after 10:00 P.M. Non -adherence to these hours may result in further review for additional conditions by the Board of Zoning Adjustments. 11. The parking or standing of vehicles, trucks or trailers at the most southeasterly parking area shall be prohibited between the hours of 10:00 P.M. and 7:00 A.M. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site -facility equipped to handle them. 14. If.new lighting is included -in -the parking lot, high-pressure sodium vapor lamps shall be used for energy savings. All outside lighting shall be directed to prevent "spillage" onto adjacent -properties. 15. If foil -type insulation_is to be used, a fire retardant type shall be -installed as approved by the Building.Division. 16. The subject property owners shall enter into irrevocable reciprocal driveway and parking easements between the sites. A copy of the legal instrument shall be approved by the City Attorney as to form and�content.and,:when approved, -shall be recorded in the Office of the County Recorder and a copy filed with the Department of Development Services. Subject property is located on South side of Main Street approximately 171 feet Northeast of Florida Street. This request is covered by Categorical Exemption, Class 1, California Environmental.Quality Act, 1970. Staff reported the plan submitted by the applicant had been reviewed and meets parking and landscaping requirements. Staff would recommend -that property be -consolidated into one (1) parcel or have reciprocal parking, ingress and egress. Tim Forhan was present and stated he was amenable to the reciprocal arrangement. Glen Godfrey inquired as to whether the applicant planned to erect a sign and Mr. Forhan said it would be a monument type of sign. -6- 2./20/b5 - BZA Minutes, H. B. Board of Zoning Adjustments February 20, 1985 Page 7 UPON MOTION BY GODFREY AND SECOND by SMITH, ADMINISTRATIVE REVIEW NO. 85-2 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The site plan, floor plans and elevations received and aated February 19, 1985, shall be the approved layout. 2. Approval of Administrative Review No. 85-2 modifies the site plan approved unaer Administrative Review 78-17. 3. Prior to issuance of building permits, the applicant shall submit the following plans: a. Landscape and irrigation plan to the Department of Development Services and Public Works for review and approval. b. Rooftop Mechanical Equipment Plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. 4. Prior to issuance of building permit for the garage, elevations shall be submitted to the Secretary of the Board. 5. The development shall comply with all applicable provisions of the Ordinance Code, building Division, and Fire Department. 6. This analysis'shall,include on -site soil sampling and laboratory.testing-of materials to provide detailed recommendations regarding grading, chemical 'and fill properties, foundations, retaining walls, streets, and utilities. 13. If foil -type insulation is to.be-used, a fire retardant type shall,be.installe d as.approved-by the Building.Division.' 14. The subject property shall enter into irrevocable reciprocal driveway and parking easement••between the.subject site -and adjacent property. A copy-of-the.legal instrument shall;be approved -by the City Attorney as to form and content and, when approved, shall be recorded in the office of the County Recorder and a copy filed with Department -of Development -the Services. " AYES: Evans, Godfrey, Smith, Sampson NOES: None ABSENT: Cranmer USE PERMIT NO. 85-1 Applicant: Michael Capacillo= A request to permit -a restaurant within an existing commercial center-to:be located at 17236•-Pacific Coast Highway (East side of street approximately 125 feet North of Warner Avenue). This request -'is covered" -by Negative -Declaration No. 77-136., Ms. Pierce reported the applicant would require additional parking spaces or be required to limit -his business hours of operation or business days. Based on information presentea, Staff woula recommend denial; however, the applicant could request'a continuance to see -if additional parking could be arranged ott-site. After a discussion of the problems involved, Daryl Smith opened the Public Hearing. The applicant,' -Michael Capacillo, was present. An adjacent resident, Jeanene Duncan; "17052 Bluewater Lane, Huntington Beach, California 92647,-stated she shared the concerns -of the Board as to parking -but she also had comments"relative to the noise factor in the area. Ms. Duncan stated she would prefer to see the building occupied if problems -could be worked out. Daryl Smith requested that Ms. Duncan's complaint regarding noise be referred to Land Use for investigation. There was no one else to speak for or against the project, Mr. Capacillo requested a continuance to the meeting of February 27, 1985, so the Public Hearing remained open-. -8- 2/20/85 - BZA Minutes, H. Board of Zoning Adjustments February 20, 1985 Page 9 UPON MOTION BY SAMPSON AND SECOND BY SMITH, AND THE APPLICANT, USE PERMIT NO. 85-1 WAS CONTINUED FEBRUARY 27, 1985, BY THE FOLLOWING VOTE: AYES: Evans, Godfrey, Smith, Sampson NOES: None ABSENT: Cranmer TENTATIVE PARCEL MAP NO. 84-1204 Applicant: Hoelscher -Guggenheim WITH CONCURRENCE OF TO THE MEETING OF A request to permit a two (2) parcel Parcel Map for property located on the West side of Magnolia Street approximately 516 feet North of Warner Avenue (at intersection of San Diego Freeway). This request is covered by Categorical Exemption, Class 5, California Environmental Quality Act, 1970. Staff stated they would recommend one change on this map and that would be that the parcel line show the zoning line for Parcels 1 and 2. The applicant's representative, John Mandrell, was present. Mr. Mandrell said he would have no problem with that stipulation. UPON MOTION BY EVANS AND SECOND BY SMITH, TENTATIVE PARCEL MAP NO. 84-1204 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS FOR APPROVAL: 1. The proposed subdivision of two (2) parcels for purposes of residential and industrial use in compliance with the size and shape of property necessary for that type of development. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation of this type of use. 3. The property was previously studied for this intensity of land use at the time the land use designation for community business district allowing commercial buildings was placed on the subject property. 4. The size, depth, frontage, street width and other design and improvement features"of the proposed subdivision are proposed to be constructed in compliance with standards plans and specifications on file with the City as well as in compliance with the State Map Act and supplemental City Subdivision Ordinance. -9- 2/20/85 - BZA Minutes, H. (Parcel lines to conform to zone lines). 2•. A parcel map shall be�filed with'and approvea by the Department of Public Works and recurded with the Orange County Recoraer. 3. Warner Avenue and Magnolia Street shall be dedicatea to City standards. 4. Water supply shall -be -through the City of huntington Beach's water system at the time said parcel(s) is/are aeveloped (if such systems exist within 200 feet of said parcel(s).' 5. Sewage disposal shall be through the City of huntington Beach's sewage system at the time said parcel(s) is/are developed (if such systems exist within 200 feet of-said-parcel(s). 6. All utilities shall be -installed underground at -the time said parcel(s) is/are•aeveloped. 7. Compliance -with all-applicable'City Ordinances. 8. The applicant's representative, Arlene Thomas, was present and stated she.had filed the documents three weeks ago. UPON MOTION BY EVANS AND SECOND BY GODFREY, TENTATIVE PARCEL MAP NO. 85-129 (WAIVER) WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS FOR APPROVAL: 1. The proposed consolidation complies with the requirements as to area, improvement and design, flood and water drainage control, appropriate and approved public roads, sewer and water facilities, environmental protection, and other requirements of Article 992 of the Subdivision Section of the Ordinance Code. CONDITIONS OF APPROVAL: 1. The Tentative Parcel Map received by the Department of Development Services on February 1, 1985, shall be the approved layout (with the amendments as noted thereon). 2. The applicant shall file, through the Huntington Beach City Clerk's Office, and have recorded with the Orange County Recorder's Office, a Certificate of Compliance in conjunction with the approved plat map. A copy of the recorded Certificate of Compliance and plat map shall be filed with the Department of Development Services prior to final inspection on the subject property.
