Jim Vincent arrived at the Meeting at this time - 1:35 P.M. REGULAR AGENDA ITEMS: CONDITIONAL EXCEPTION NO. 85-4 (UP 84-84) (ND 84-45) Cont. from 2 20 85 Applicant: Iraj Mavandadi CE REQUEST: A request to permit six (6) unit apartment project with private open space in lieu of common open space. UP REQUEST: To permit a six (6) unit apartment building. Minutes, H. B. Board of Zoning Adjustments February 27, 1985 Page 2 Subject property is located at 17232 Ash Street (East side of Ash Street approximately 385 feet South of Cypress Avenue). These requests are covered by Negative Declaration No. 84-45. Ms. Pierce reminded the Board it would be necessary to adopt Negative Declaration No. 84-45 in conjunction with Conditional Exception No. 85-4 and Use Permit No. 84-84. The applicant has met the Code requirements with the exception of open space, and Fire Department has asked that the two units at the rear of the complex be fire sprinklered. Trees shall be installed per the Conditions listed and standard conditions shall be imposed. Daryl Smith opened the Public Hearing and the applicant was present. The applicant inquired about the requirement for sprinklering the two (2) units and he was informed it would not be required. There was no one else present to speak so the Public Hearing was closed. EVANS MOVED, SECONDED BY VINCENT, FOR ADOPTION OF NEGATIVE DECLARATION NO. 84-45, AND APPROVAL OF CONDITIONAL EXCEPTION NO. 85-4 AND USE PERMIT NO. 84-84 WITH THE FOLLOWING FINDINGS AND CONDITIONS AS PRESENTED BY STAFF. Glen Godfrey asked if the Maker and Seconder of the Motion would consider a change in the elevations presented. Mr. Godfrey stated he would like an additional condition that revised elevations be submitted depicting shadow shingle type roof material, said material to be subject to approval of the Department of Development Services, with sample submitted prior to submittal of working drawings. Mr. Evans and Mr. Vincent agreed to the additional condition. MOTION PASSED BY THE FOLLOWING VOTE: CONDITIONAL EXCEPTION - FINDINGS FOR APPROVAL: 1. The size of the lot and its ratio of depth to width are such to impose physical restraints upon its development. The applicant has provided a total square footage of open space greater than that required by the Huntington Beach Ordinance Code. 2. Precedence for exception of open space requirements has been established in this neighborhood. 3. The granting of a conditional exception is necessary in order to preserve the enjoyment of one or more substantial property rights. -2- 2/27/85 - BZA 1 Minutes, H. B. The granting of a conditional exception will not be materially detrimental to the public welfare of injurious to property in the same zone classification. 5. The granting of the conditional exception will not adversely affect the General Plan of the City of Huntington Beach. CONDITIONAL EXCEPTION - CONDITIONS OF APPROVAL 1. The site plan received January 30, 1985, shall be the approved layout. USE PERMIT - FINDINGS FOR APPROVAL: 1. The establishment, maintenance and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of the use permit will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. USE PERMIT - CONDITIONS OF APPROVAL 1. The site plan and floor plans received and dated January 30, 1985, shall be the approved layout. Revised elevation plans shall be submitted depicting shadow shingle type roofing material. Said material shall be subject to the satisfaction of the Department of Development Services with sample submitted prior to submittal of working drawings. 2. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 3. Driveway approaches shall be a minimum of twenty-seven feet (27') in width and shall be of radius type construction. 4. Prior to the issuance of building permits, the applicant shall submit a landscape and irrigation plan to the Departments of Development Services and Public Works for review and approval. -3- 2/27/85 - BZA Minutes, H. Board of Zoning Adjustments February 27, 1985 Page 4 Said landscape plan shall include one (1) fifteen gallon tree per landscape pocket area adjacent to north property line, two (2) twenty-four inch box trees in front yard area, and one (1) fifteen gallon tree in each private yard area. 5. A hose bibb and gas line stub shall be installed within each private yard area. 6. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 7. Low -volume heads shall be used on all spigots and water faucets. 8. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 9. The structures on the subject property, whether attached or detached, shall be constructed in compliance with the State acoustical standards set forth for units that lie within the 60 CNEL contours of the property. Evidence of compliance shall consist of submittal of an acoustical analysis report, prepared under the supervision of a person experienced in the field of acoustical engineering, with the application for building permit(s). 10. If lighting is included in the parking lot, high-pressure sodium vapor lamps shall be used for energy savings. All outside lighting shall be directed to prevent "spillage" onto adjacent properties. 11. A detailed soils analysis shall be prepared by a registered Soils Engineer. This analysis shall include on -site soil sampling and laboratory testing of materials to provide detailed recommendations regarding grading, chemical and fill properties, foundations, retaining walls, streets, and utilities. 12. If foil -type insulation is to be used, a fire retardant type shall be installed as approved by the Building Division. Board of Zoning Adjustments February 27, 1985 Page 5 MISCELLANEOUS AGENDA ITEMS: ADMINISTRATIVE REVIEW NO. 84-50 Applicant: M. U. and B. U. Patel A request to permit construction of a thirty-five (35) unit motel with Manager's living quarters to be located on the East side of Beach Boulevard 300 feet North of Ellis Avenue. This request is covered by Negative Declaration No. 84-18. Scott Hess reported this is a thirty-five (35) unit motel on Beach Boulevard which has received prior approval by the Board of Zoning Adjustments. The applicant has retained a new Architect and is presenting a revised parking plan for'plan check. Mr. Martinez is requesting the Board to review the revised plan. Glen Godfrey stated the applicant would lose some landscaping, trash receptacle would have to be moved, and a new turnaround would be required. Scott Hess said Staff was recommending approval of the plan. Ms. Pierce said Minutes should reflect approval of the Site Plan dated January 28, 1985, if Board approves. Daryl Smith questioned the location of the handicapped parking space in relation to the handicapped unit. Mr. Martinez called attention to the fact the applicant was deleting one unit and converting the space to a storage/laundry area. Glen Godfrey asked the Board to include a stipulation that only a service sink be permitted in any of the other storage areas in the building. UPON MOTION BY GODFREY AND SECOND BY SMITH, ADMINISTRATIVE REVIEW NO. 84-50 (AMENDED) WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. A revised site plan and floor plans shall be submitted depicting the modifications described herein: a. Changes in parking spaces and trash receptacle location. b. No commode or water closet and shower or tub shall be permitted in any unit designated as storage room. Any storage room on Second Floor and/or Third Floor shall be limited to storage and service sink only. d. Building shall be limited to thirty-five (35) units plus the Manager's living quarters. 2. All Conditions of Approval of the previously approved Administrative Review No. 84-50 shall remain in effect.
