Applicant: Vaughn C. Sweet (Franklin Buccella)
A request to permit a lot line adjustment between Lots 22 - 39 of
Tract 10648. Subject property is located North of Talbert Avenue
and West of Beach Boulevard.
This request is covered by Negative Declaration No. 85-10.
Staff reported this request is necessary to adjust the property
lines for construction of the eighteen (18) industrial buildings in
Tract 10648.
Vaughn C. Sweet was present to represent Franklin J. and Virginia M.
Buccella in this project.
UPON MOTION BY VINCENT AND SECOND BY EVANS, LOT LINE ADJUSTMENT
NO. 85-3 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY
THE FOLLOWING VOTE:
FINDINGS FOR APPROVAL:
1. The Lot Line Adjustment is consistent with the criteria
outlined in Section 9811.3.1 of the Huntington Beach Ordinance
Code.
CONDITIONS OF APPROVAL:
1. The plan received April 10, 1985, shall be the approved layout.
2.1 All previous Conditions of Approval of Tentative Tract Map
No. 10648 shall remain in effect.
3. A Record of Survey shall be submitted to the City for
certification by the City Engineer, and then recorded with the
Orange County Surveyor's Office. When approved and recorded, a
copy shall be submitted prior to final inspection or occupancy
of any buildings.

This request is covered by Negative Declaration No. 85-10.
Scott Hess reported this request is, in essence, divided into two
projects. The Use Permit covers twelve (12) buildings on the East
and North sides of the property within 150 feet of residential
property, and the Administrative Review covers the additional six
(6) buildings on the West and South which are separated from the
residential area. Staff read the list of permitted uses which had
been shown on the recommended conditions.
Glen Godfrey stated the floor plans and elevations of all buildings
should be subject to'review and approval of the Design Review Board
and asked that such a condition be included in both the Use Permit
and the Administrative Review conditions.
Daryl Smith asked about the use stipulated as "auction houses or
stores" and whether automobile auctions would be allowed. Staff
said no automobile auctions would be permitted and Glen Godfrey
asked that a condition be added that "No major automobile repairs or
dismantling, or related uses, shall be permitted unless approved by
the Development Services Department."
Jim Vincent requested addition of a condition that "Trucks with
refrigeration units shall not park between the hours of 10:00 P.M
and 7:00 A.M. on the subject property" and Les Evans asked that
"Street lights shall be installed on Georgetown Lane, Woodwind
Drive, and Windfield.Drive to satisfaction of the Public Works
Department".
After a general discussion, Daryl Smith recommended that the wing
walls should only be installed if found to be necessary by the
Acoustical Engineer's report and be subject to approval by the
Director of Development Services.
Daryl Smith opened the Public Hearing and the applicant, Vaughn C.
Sweet, was present. Mr. Sweet accepted the conditions as amended by
the Board. There was no one else present to speak for or against
the project so the Public Hearing was closed.
UPON MOTION BY GODFREY AND SECOND BY EVANS, USE PERMIT NO 85-10 WAS
APPROVED AS AMENDED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY
THE FOLLOWING VOTE:

The establishment, maintenance and operation of the use will
not be detrimental- to:

a. The general welfare of persons residing or working in the
vicinity;
b. Property and improvements in the vicinity of such use or
building.
2. The proposal is consistent with the City's General Plan of Land
Use.
3. The conditions imposed herein will assure compatibility with
abutting residential uses and will eliminate or minimize
adverse environmental impacts.
CONDITIONS OF APPROVAL:
1. The site plan dated April 8, 1985, shall be the approved
layout. Floor plans and elevations of all buildings shall be
subject to review and approval of the Design Review Board.
2. Prior to issuance of building permits, the applicant shall
submit the following plans:
a. Landscape and irrigation plan to the Department of
Development Services and Public Works for review and
approval.
b. Rooftop Mechanical Equipment Plan. Said plan shall
indicate screening of all rooftop mechanical equipment and
shall delineate the type of material proposed'to screen
said equipment.
3. The development shall comply with all applicable provisions of
the Ordinance Code, Building Division, and Fire Department.
4. Fire lanes, as determined by the Fire Department, shall be
posted and marked.
5. Maximum separation between building wall and property line
shall not exceed two inches (2").
6. Driveway approaches shall be a minimum of twenty-seven feet
(271) in width and shall be of radius type construction.
7. An automatic fire sprinkler system shall be approved and
installed pursuant to Fire Department regulations for any use
utilizing hazardous materials.
8. A new fire hydrant shall be installed at the Northeast corner
of Building 10.

9. There shall be no outside storage.
10: All signs shall comply with Article 976 of the Huntington Beach
Ordinance Code.,
11. Low -volume heads shall be used on all spigots and water faucets.
12. -All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at an
offsite facility equipped to handle them.
13. The structures on the subject property, whether attached or
detached, shall be constructed in compliance with the State
acoustical standards set forth for units that lie within the
60 CNEL contours of the property. Evidence of compliance shall
consist of submittal of an acoustical analysis report, prepared
under the supervision of a person experienced in the field of
acoustical engineering prior to the issuance of building
permits.
14. If lighting is included in the parking lot, high-pressure
sodium vapor lamps shall be used for energy savings. All
outside lighting shall be directed to prevent "spillage" onto
adjacent properties.
15. If foil -type insulation is to be used, a fire retardant type
shall'be installed as approved by the Building Division.
16. An irrevocable reciprocal driveway and parking easement
agreement between Parcel Nos. 1 through 12 shall be approved -by
the City Attorney as to form and content, recorded with the
County Recorder, and submitted to the Development Services
Department prior to the issuance of building permits.
17. The block wall along the North and East property,line shall be
minimum nine feet (91) in height, measured from the adjacent
highest grade, and made of decorative, split -face block. Said
wall shall be solid grouted for sound attenuation, unless found
to be unnecessary by the Acoustical Engineer's report, and
shall be subject to approval by the Director of -Development
Services.
18. No openings of any kind are permitted along the East building
walls of Building Nos. 1 through 10, and along,the North'
building walls of Building Nos. 10, 11, and'12.

19. All uses listed on the following list shall be permitted and
must be approved by a Certificate of Occupancy prior to
occupancy:
Accessory office uses incidental to a primary industrial use
(limited to ten percent (10%) of the floor area of the
primary industrial use)*
Administrative, management, regional or headquarters offices
for any permitted industrial uses which are not primarily
intended to serve the public
Auction houses or stores
Caretakers dwelling on premises of industrial use
Carpet cleaning plants
Cleaning and dyeing plants
Cosmetic manufacturing
Creameries and dairy products manufacturing
Electrical or neon sign manufacturing
Flour mills
Food products, manufacturing, storage and processing, except
lard, pickles, sauerkraut, sausages or vinegar
Frozen food lockers
Fruit and vegetable canning, preserving and freezing

Manufacture of prefabricated buildings
Offices devoted to research and analysis*, engineering, or the

20. No major automobile repair or dismantling, or related uses,
shall be permitted unless approved by the Development Services
Department.
21. Prior to the issuance of building permits, a restrictive
covenant shall be recorded with the.land incorporating the
following:
a. Property owners and tenants shall be prohibited from
conducting truck loading and unloading activities between
the hours of 10:00 P.M. and 7:00 A.M.
b. Truck parking shall be prohibited within forty-five feet
(451) of the East and North perimeter property lines.
c. All work activities shall be conducted wholly within the
buildings.
d. Trucks with refrigeration units shall not park between the
hours of 10:00 P.M. and 7:00 A.M. on the subject property.
22. Minimum six foot (61) wide wing walls shall be provided at the
ends of the buildings closest to residential for added noise
attenuation, if found to be necessary by the Acoustical
Engineer's report, and shall be subject to approval by the
Director of Development Services.
23. A Certificate of Occupancy shall be issued for each structure
(Building Nos. 1 through 12) as per Site Plan submitted April 8,
1985, and conceptually approved April 10, 1985. Such
Certificate -of Occupancy shall require that a review of parking
be undertaken and the use approved by the Department of
Development Services. The Department of Development Services
will perform a comprehensive plan check relating to all
Ordinance Code requirements.upon submittal of your completed
structural drawings. Prior to occupancy, a noise analysis and
report prepared by a California State licensed Acoustical

Engineer shall be filed in accordance with Section 9530.17 of
the Huntington Beach Ordinance Code.
24. Street lights shall be installed on Georgetown Lane, Woodwind
Drive, and Windfield Drive to satisfaction of the Public Works
Department.
25. Turnaround area shall be added at Northeast corner of Site Plan
subject to approval of the Fire Department.

Boulevard.
This request is covered by Negative Declaration No. 85-10.
Staff recommended approval of the project with conditions as
presented. The applicant, Vaughn C. Sweet, was present and accepted
the conditions.

properties, foundations, retaining walls, streets, and
utilities.

TENTATIVE PARCEL MAP NO. 85-171
Applicant: Keith Engineering, Inc
A request to create a seven (7) parcel Parcel Map. Subject property
is located at the Southwest corner of Edinger Avenue and Golden West
Street.
This request is covered by Categorical Exemption, Class 5,
California Environmental Quality Act, 1970.
Staff recommended approval of the map with conditions as presented.
There was a discussion concerning a reciprocal parking and driveway
agreement between parcels and Glen Godfrey requested that it be made
a part of the conditions.
The applicant's representative, Jack Mandel, was present but had n
questions for the Board.
UPON MOTION BY EVANS AND SECOND BY CRANMER, TENTATIVE PARCEL MAP
NO. 85-171 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS,
BY THE FOLLOWING VOTE:
FINDINGS FOR APPROVAL:
1. The proposed subdivision of seven (7) parcels for purposes of
commercial use in compliance with the size and shape of
property necessary for that type of development:
2. The General Plan has set forth provisions for this type of la►,d
use as well as setting forth objectives for implementation of
this type of use.
3. The property was previously studied for this intensity of land -
use at the time the land use designation for community business
district allowing commercial buildings was placed on the
subject property.
4. The size, depth, frontage, street width and other design and
improvement features of the proposed subdivision are proposed
to be constructed in compliance with standards plans and

layout (with the amendments as noted thereon).
2. A parcel map shall be filed with and approved by the Department
of Public Works and recorded with the Orange County Recorder.
3. Compliance with all applicable City Ordinances.
4. A copy of the recorded parcel map shall be filed with the
Department of Development Services.
5. Proof of the reciprocal parking and driveway agreement between
parcels shall be submitted prior to final map recordation.

Applicant: We Are Sportswear
A request for a temporary Fashion Show in a Parking Lot at the
Northeast corner of Adams Avenue and Brookhurst Street.
This request is covered by Categorical Exemption, Class 11,
California Environmental Quality Act, 1970.
Staff reported this would be a Fashion Show to be held in a parking
lot on Friday, April 12, 1985, between the hours of 8:00 P.M. and
9:00 P.M., and Staff recommended approval.
The applicant's representative, Barry Corindia, was present and
agreed to the conditions presented by Staff.

occur and the services of the Fire Department -are required, the
applicant will be liable for expenses incurred.

Manager two (2)'days prior to the event.
4. A hold harmless agreement shall be filed with the Risk Manager
two (2) days prior to the event.
5. As required by S.9730.80 of the Huntington Beach Ordinance
Code, a certificate to operate shall be issued by the
Department of Development Services prior to operation of the
event.

After adjournment of the Regular Meeting, the Chairman called an
EXECUTIVE MEETING of the Board of Zoning Adjustments to discuss
possible litigation. Daryl Smith stated a memo had been sent from
the City Attorney, Gail Hutton, concerning the Adjourned Meetings
held by the Board on Monday mornings. Ms. Hutton had stated the
Board was in violation of the Brown Act by holding the subject
meetings. Glen Godfrey stated that Jim Palin, Director of
Development Services, was sending a memo back to Ms. Hutton stating
he did not feel the meetings were in violation; however, he had
asked the members to refrain from meeting on Mondays until a furthe
opinion was received from the City Attorney's Office.

The Board held a general discussion as to how projects could be
reviewed prior to the regular meeting without the pre -review
meetings. Staff was instructed to send out the Development Review
Requests to each Board member, and other involved parties, in time
to receive their replies prior to scheduling the projects for formal
review before the Board. The Board members were made aware that
this procedure will delay the hearing of projects by from one to
three weeks.
