The applicant is submitting a letter to confirm their telephone call. REVOCATION OF HOME OCCUPATION PERMIT NO. 85-1 Licensee: Ronald L. Judd -and Joan K. Collins GENERAL REASON: Violation of Section 9730.36(h), Huntington Beach Ordinance Code, referring to parking of commercial vehicle or equipment. Minutes, H. B. Board of Zoning Adjustments May 22, 1985 Page 2 GENERAL LOCATION: Subject property is located at 20911 National Lane,, Huntington Beach, California. Ms. Pierce reported this revocation action was scheduled for the meeting of May 15, 1985, at which time neither the licensee, other home owners, nor Don Shaw were present. Consequently, the hearing was continued to today's meeting. Don Shaw stated the licensee had been notified on previous occasions that the City had received complaints concerning,the parking of their large truck overnight at their residence and that they were in violation of a City ordinance. The licensee apparently complied by not parking the truck there for a period of time but the City has again received complaints from the neighbors. Staff said the Board of Zoning Adjustments has now received a letter from Mrs. Judd saying their home has been sold and they will be leaving the area. Smith opened the Public Hearing and Joan Collins Judd was present. Mrs. Judd reiterated the fact their home had been sold and they would be moving within seven (7) days. She said they had attempted parking their truck in storage areas but most did not open until 7:00 A.M. Mrs. Judd presented pictures to the Board of other large trucks, vans, and vehicles parked in the immediate area of their home which, she said, had been taken the previous day. There was no one else present to speak for or against'Revocation of the Home Occupation Permit so Daryl Smith closed the Public Hearing. Upon questioning by Mr. Evans, Mrs. Judd did not agree to'refrain from committing any further violations during the upcoming seven (7) day period. UPON MOTION BY EVANS AND SECOND BY CRANMER, REVOCATION OF HOME OCCUPATION PERMIT NO. 85-1 WAS REVOKED BY THE FOLLOWING VOTE: AYES: Cranmer, Evans, Smith, Sampson NOES: Godfrey ABSENT: None USE PERMIT NO. 85-9 Applicant: Louis Hernandez A request to permit four (4) residential units abutting an arterial highway location at 707 Yorktown Avenue (North side of Yorktown Avenue approximately 400 feet West of Beach Boulevard). -2- 5/22/85 - BZA Minutes, H. B. Board of Zoning Adjustments May 22, 1985 Page 3 This request is covered by Categorical Exemption, Class 3, California Environmental Quality Act, 1970. Staff said the deed to this property was recorded in 1952 which was before the City required parcel maps. This Board can impose architectural restraints on the project because it abuts an arterial highway. Glen Godfrey said he would like to add a condition that architectural plans be reviewed by the Design Review Board since the proposed building would be in the vicinity of the Civic Center complex. Daryl Smith opened the Public Hearing. The applicant, Louis Hernandez, was not present nor was there anyone else present to speak for or against the project. The Public Hearing was closed. UPON MOTION BY GODFREY AND SECOND BY CRANMER, USE PERMIT NO. 85-9 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS FOR APPROVAL: 1. The establishment, maintenance and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of the use permit will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated May 14, 1985, shall be the approved layout. 2. Landscape and irrigation plan to the Department of Development Services and Public Works for..review and approval. b. Rooftop Mechanical Equipment Plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. 3. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 4. Driveway approaches shall be a minimum of twenty-seven feet (271) in width and shall be of'radius type construction.•.• 5. Roofing material shall be fire retardant shadow shingle. 6. Architectural plans shall be'subject to review and approval by the Design Review Board. 7. A hose bibb and stub shall be provided in each private patio area. 8. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 9. Low -volume heads shall be used on all spigots and water faucets. 10. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed"of at an off -site facility equipped to handle them. 11. The structures on the subject property, whether attached or detached, shall be constructed in compliance -"with the State acoustical standards set forth for units that lie within the 60 CNEL contours of the property. Evidence of compliance shall consist of submittal of an acoustical analysis report, prepared under the supervision of a person -experienced in the field of acoustical engineering, with the application for building permit(s). 12. A detailed soils analysis shall be prepared by a registered' Soils Engineer. This analysis shall include on -site soil sampling and laboratory testing of materials to provide detailed recommendations regarding grading, chemical and fill properties, foundations, retaining walls, streets, and utilities. -4- 5/22/85 - BZA Minutes, H. B. Board of Zoning Adjustments May 22, 1985 Page 5 13. If foil -type insulation is to be used, a fire retardant type shall be installed as approved by the Building Division. AYES: Cranmer, Evans, Godfrey, Smith, Sampson NOES: None ABSENT: None ADMINISTRATIVE REVIEW NO. 85-16 Applicant: Kreuzer, Hogue and Company, Inc. A request to permit a 4,321 Square Foot industrial building to be located on the West side of Sampson Lane approximately 425 feet South of Woodwind Drive. This request is covered by Categorical Exemption, Class 1, California Environmental Quality Act, 1970. Staff said the concern on this project was the width of the driveway which should be increased to twenty-seven feet (271), and Les Evans concurred. Daryl Smith felt the applicant should be required to install landscaping in lieu of wheel stops. The applicant was not present at the meeting. UPON MOTION BY GODFREY AND SECOND BY EVANS, ADMINISTRATIVE REVIEW NO. 85-16 WAS APPROVED WITH THE FOLLCWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The site plan received and dated May 14, 1985, and floor plans and elevations received and dated April 16, 1985, shall be the approved layout subject to the modification of a twenty-seven foot (27') wide driveway. 2. Prior to issuance of building permits, the applicant shall submit the following plans: a. Landscape and irrigation plan to the Department of Development Services and Public Works for review and approval. b. Rooftop Mechanical Equipment Plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. -5- 5/22/85 - BZA Minutes, H. B. Fire lanes, as determined by the Fire Department, shall be posted and marked. 5. Maximum separation between building wall and property line shall not exceed two inches (2"). 6. Driveway approaches shall be a minimum of twenty-seven feet (27') in width and shall be of radius type construction..- 7. Trash area shall be subject to review and approval by the Fire Department. 8. There shall be no outside storage. 9. All signs shall comply with Article 976 of the Huntington Beach Ordinance Code. 10. Low -volume heads shall be used on all spigots and water faucets. 11. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 12.' If lighting is included in the parking lot, high-pressure sodium vapor lamps shall be used for energy savings. All outside lighting shall be directed to prevent "spillage" onto adjacent properties. 13. A detailed soils analysis shall be prepared by a registered Soils Engineer. This analysis shall include -on -site soil. sampling and laboratory testing of materials -to provide detailed recommendations regarding grading, chemical and fill properties, foundations, retaining walls, streets, and - utilities. 14. If foil -type insulation is to be used, a fire retardant -type shall be installed as approved by the Building Division. 15. Board of Zoning Adjustments May 22, 1985 Page 7 ADMINISTRATIVE REVIEW NO. 85-24 Applicant: Bryce Bailey A request to permit private instruction (dancing) for children to be located at 2223 Main Street, 46-B (Seacliff Village Shopping Complex) - Northwest corner of Main Street and Yorktown Avenue. This request is covered by Categorical Exemption, Class 1, California Environmental Quality Act, 1970. Susan Pierce said that establishment of this shopping complex had been approved by the Board of Zoning Adjustments in 1974 with an excess of parking spaces. Since that time, the situation has changed. The applicant today is proposing to put in a dance studio and does have enough allocated parking for this use. Staff would recommend approval of this project. Bryce Bailey was present. Glen Godfrey asked if the applicant would be teaching classes on Sunday mornings and Mr. Bailey said he would not be. UPON MOTION BY EVANS AND SECOND BY GODFREY, ADMINISTRATIVE REVIEW NO. 85-24 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The conceptual site plan and floor plan received and dated May 14, 1985, shall be the approved layout. 2. The project shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 3. Signing for the use shall be subject to the.approved sign program for the shopping center. AYES: Cranmer, Evans, Godfrey, Smith, Sampson NOES: None ABSENT: None Daryl Smith stated the Board could take note that Jim Palin had sent a request to the City Attorney's office for a further opinion on the Board's action of holding the Monday morning Study Sessions on forthcoming projects.
