UPON MOTION BY EVANS AND SECOND BY GODFREY, TENTATIVE PARCEL MAP NO. 83-564 WAS CONTINUED, AT REQUEST OF THE APPLICANT, TO THE MEETING OF JULY 17, 1985, BY THE FOLLOWING VOTE: AYES: Cranmer, Evans, Godfrey, Smith, Vincent NOES: None ABSENT: None REGULAR AGENDA ITEMS: CONDITIONAL EXCEPTION NO. 85-30 USE PERMIT NO. 85-30 NEGATIVE DECLARATION NO. 85-28 Applicant: Selleck Properties CE REQUEST: To permit revised parking lot layout with modified commercial entrance, reduction from°six percent (6%) to 5.4 percent (5.4%) landscaping, 'and reduction of two (2) parking spaces. Also, to allow forty percent (40%) of building area to be calculated at warehouse ratio. UP REQUEST: To permit remodel of existing shopping center and addition of 33,860 Square Feet of building area.:. Subject property is located at 5922 Edinger Avenue (Southwest corner of Edinger Avenue and Springdale Street). Minutes, H. B. Board of Zoning Adjustments July 10, 1985 Page 2 These requests are covered by Negative Declaration No. 85-28. Scott Hess reported the property is in Zone C2 and the applicant has worked with Staff to resolve the concerns of the Board at the previous hearing. Today, they submitted a revised plan to indicate these changes and Staff would recommend approval of both requests based on the Findings and Conditions presented to the Board. Jim Vincent requested that a condition be added that all fire access lane radiuses meet the Fire Department requirements. Daryl Smith opened the Public Hearings for both Conditional Exception No. 85-30 and Use Permit No. 85-30. The applicant's representative, Robert Chase, Architect, was present and Mr. Chase reiterated the items which had been changed to conform with the Board's stipulations. Charles Hall, Vice President of Real Estate for the Sav-On Company endorsed the applicant's proposed project and stated he felt it would be a definite improvement in the traffic circulation and appearance of the center. He further said he felt the management.of Von's agreed to the concept of the development. There was no one else present to speak for or against the project s the Public Hearing was closed. Daryl Smith stated that, if the Board did approve these applications, he wanted it understood that the Board would be approving a conceptual plan and he wanted to reserve the right to review the landscaping plan for conformance. Mr. Smith added it was the Board's understanding an employee parking plan would be submitted showing employees' parking located at the rear of the property. Mr. Hill stated that it might be difficult to enforce this type of parking but Mr. Smith stated the Board would want that done. It was requested by Jim Vincent that the trash enclosure location be shown on the site plan. Les Evans said that, even though this project would be an improvement in the appearance of the shopping center and would benefit the developer and the City economically, he felt the traffic circulation and parking would be far worse than what presently exists. -2- 17/10/85 - BZA Minutes, H. Board of Zoning Adjustments July 10, 1985 Page 3 UPON MOTION BY GODFREY AND SECOND BY CRANMER, NEGATIVE DECLARATION NO. 85-28, CONDITIONAL EXCEPTION NO. 85-30, AND USE PERMIT NO. 85-30 WERE APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS FOR APPROVAL - CONDITIONAL EXCEPTION: 1. The granting of a conditional exception is necessary in order to preserve the enjoyment of one or more substantial property rights. 2. The granting of Conditional Exception No. 85-30 will not be materially detrimental to the public welfare, or injurious to property in the same zone classifications. 3. Landscaping and parking overhangs into the required landscaped areas meet the intent of the Code and are therefore acceptable. 4. The granting of the conditional exception will not adversely affect the General Plan of the City of Huntington Beach. 5. The applicant has proposed changes to bring the nonconforming shopping parking to within one (1) space of meeting current parking regulations, to provide a new entrance as a modified commercial entrance, and to provide five percent (5%) landscaping in lieu of six percent (6%). 6. Parking shall be based on one (1) space for each 200 Square Feet of gross building area used for retail uses except that ten percent (10%) of the gross building area may be based on a ratio of one (1) space for each 1,000 Square Feet for warehouse purposes. CONDITIONS OF APPROVAL - CONDITIONAL EXCEPTION: 1. The site plan received and dated July 10, 1985, shall be the conceptual approved layout subject to a revised site plan, landscape plan, and irrigation plan being submitted depicting the modifications described herein: a. Fully dimensioned b. Trash areas c. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of the use permit will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL - USE PERMIT: 1. The site -plan -received and dated July 10, 1985, showing 30-1410 Square Feet of additional building area shall be the conceptual approved layout subject to a revised site plan being submitted depicting the modifications described herein prior to issuance of building permits: a. Fully dimensioned b. Trash areas c. Fire access lanes with widths and dimensions shown and approved by the Fire Department 2. A parking management plan shall be submitted for review and approval by`the Development Services Department prior to the issuance of building permits to assure employee parking in the rear. 3. Prior to issuance of building permits, the applicant shall submit the following plans: a. Landscape and irrigation plan to the Department of Development Services and Public Works for review and approval. b. Rooftop Mechanical Equipment Plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. -4- 7/10/85 - BZA Minutes, H. B. Elevations depicting such shall be subject to approval by the Secretary of the Board prior to issuance of building permits. 5. A planned sign program shall be approved for all signing within the commercial center pursuant to S.9760.43 of the Huntington Beach Ordinance Code. 6. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 7. Service roads and fire lanes, as determined by the Fire Department, shall be posted and marked. 8. Driveway approaches shall be a minimum of thirty feet (30') or more in width and shall be of radius type construction unless otherwise noted on plans. 9. On -site fire hydrants shall be provided in number and at locations specified by the Fire Department. 10. An automatic fire sprinkler system shall be approved and installed in those areas determined necessary pursuant to Fire Department regulations. 11. All signs shall comply with Article 976 of the Huntington Beach Ordinance Code within ninety (90) days. 12. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. 13. Low -volume heads shall be used on all spigots and water faucets. 14. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 15. If lighting is included in the parking lot, high-pressure sodium vapor lamps shall be used for energy savings. All outside lighting shall be directed to prevent "spillage" onto adjacent properties. 16. A detailed soils analysis shall be prepared by a registered Soils Engineer. This analysis shall include on -site soil sampling and. laboratory testing of materials to provide -5- .7/10/85 - BZA Minutes, H.-B. Board of Zoning Adjustments July 10, 1985 Page 6 detailed recommendations regarding grading,.chemical and fill properties,'foundations, retaining walls, streets, and -utilities. 17. If foil -type insulation is to be used, a fire retardant type shall be installed as approved by the Building Division. 18. The subject property shall enter into an irrevocable reciprocal driveway -easement between the subject site and adjacent property. A copy of the legal instrument shall be approved by the City Attorney as to form and content and, when approved, shall be recorded in the office of the County Recorder and a copy filed with the Department of Development Services. AYES: Cranmer, Godfrey, Smith, Vincent NOES: Evans ABSENT: 'None TENTATIVE PARCEL MAP NO. 85-266 Applicant: Richard Warner A request to permit consolidation of two (2) lots into one (1) parcel. Subject property is located at 16175 Whitecap Lane at the intersection of Whitecap Lane and Stillwater. This request is -covered by Categorical Exemption, Class 5, California Environmental Quality Act, 1970. Staff reported this application is a continuance from last week's meeting. The applicant is proposing the consolidation of these two (2) lots into one (1) parcel for residential purposes. Staff recommends approval of the request and Waiver of the Final Map. Larry Truman was present to represent the applicant and stated he had no comments. Mr. Smith asked if he had read the conditions and Mr. Truman said he had not, whereupon Mr. Smith suggested he do so. The applicant's -representative read and agreed to the conditions. UPON MOTION BY SMITH AND SECOND BY GODFREY, TENTATIVE PARCEL MAP NO. 85-266 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS FOR APPROVAL: 1. The proposed consolidation of two (2) parcels into one (1) parcel for purposes of residential use in compliance with the size and shape of property necessary for that type of development. -6- 7/10/85 - BZA Minutes, H. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation of this type of use. 3. The property was previously studied for this intensity of land use at the time the land use designation for community residential district allowing residential buildings was placed on the subject property. 4. The size, depth, frontage, street width and other design and improvement features of the proposed consolidation are proposed to be constructed in compliance with standards plans and specifications on file with the City as well as in compliance with the State Map Act and supplemental City Subdivision Ordinance. CONDITIONS OF APPROVAL: 1. The Tentative Parcel Map received by the Department of Development Services on July 9, 1985, shall be the approved layout. 2. The applicant shall file, through the Huntington Beach City Clerk's office, and have recorded with the Orange County Recorder's Office, a Certificate of Compliance in conjunction with the approved plat map. A copy of the recorded Certificate of Compliance and plat map shall be filed with the Department of Development Services prior to issuance of building permits - on the subject property. 3. All previous Conditions of Approval of Tract No. 12054 shall be applicable. AYES: Cranmer, Evans, Godfrey, Smith, Vincent NOES: None ABSENT: None ADMINISTRATIVE REVIEW NO. 85-30 NEGATIVE DECLARATION NO. 85-7 Applicant: Architects Orange A request to permit construction of eight (8) industrial buildings at the Southwest corner of Harriman Avenue and Gothard Street. This request is covered by Negative Declaration No. 85-7. This is a similar plan, stated Staff, to one reviewed by the Board for this location a couple of months ago. It has a new applicant and new property owner and conforms to the Zoning Ordinance Code. -7- 7/10/85 - BZA Minutes, H. B. Board of Zoning Adjustments July 10, 1985 Page 8 The project has been reviewed by the Design Review Board and their recommendations have been incorporated into the conditions. Daryl Smith -stated the area adjacent to the curb along Harriman Avenue shall be level to drain and shall be planted in sod only and no other trees or shrubs shall be installed in this area. The applicant's representative, Darrel Hebenstreit, was present, and he asked about the Design Review Board's changes in the elevations along Harriman Street. Scott Hess explained the Design Review Board would like to see an extended parapet or mansard type roof - that they wanted to break the continuous roof line to relieve the building's facade. Mr. Hebenstreit stated that he felt the owner would not.be.willing-,to go along with this -type of change. Mr. Hebenstreit presented photographs to the Board of similar type buildings:" Upon questioning by Daryl Smith, Glen Godfrey stated there were more concerns with Building No. 8 than with Building No. 1. Les Evans stated, in concurrence with Mr. Godfrey, that Building No. 8 should be modified along Gothard Street. UPON MOTION BY EVANS AND SECOND BY GODFREY, NEGATIVE DECLARATION NO. 85-T AND ADMINISTRATIVE REVIEW NO. 85-30 WERE APPROVED WITH THE FOLLOWING -CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The site plan and floor plans received and dated July 10, 1985, shall be -the approved layout with the following modifications as described herein: - a. One (1) additional parking space shall be provided for .Building No. 4. 2. Elevations. shall be subject to review and approval by the Design Review Board prior to the issuance of building permits. a. Building No. 8 shall be modified to include a variation in roof line. Additional relief shall be provided along the Gothard.Street frontage. 3. Prior -to issuance,of building permits, the applicant shall . submit the following plans: a. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. 4. The block wall along Harriman Avenue shall be split face slump block. 5. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 6. Service roads and fire lanes, as determined by the Fire Department, shall be posted and marked. 7. "NO PARKING" signs shall be posted per Fire Department Standard No. 415. 8. Maximum separation between building wall and property line shall not exceed two inches (21') for Building Nos. 3 and 4 and Building Nos. 5 and 6. 9. Driveway approaches shall be in accord with Public Works Department standards. 10. On -site fire hydrants shall be provided in number and at locations specified by the Fire Department. 11. Compliance with all conditions of Tentative Tract No. 12368 shall be necessary prior to the issuance of building permits. 12. An automatic fire sprinkler system shall be approved and installed in all buildings pursuant to Fire Department regulations. 13. Fire access lanes shall be maintained. To permit one enclosed parking space in lieu of -10- 7/10/85 - BZA Minutes, H. B. Board of Zoning Adjustments July 10, 1985 Page 11 two, 7-1/2 foot encroachment into 7-1/2 foot rear yard and fencing within 12 foot front yard setback and along front property line. Subject property is located at 623 Geneva Avenue (North side of Geneva Avenue approximately 135 feet West of Hill Avenue). This request is covered by Categorical Exemption, Class 5, California Environmental Quality Act, 1970. Staff reported the applicant was requesting approval of a three foot W ) encroachment in the fifteen foot (151) setback. The lot is an irregularly shaped lot - triangular in size. The applicant wishes to build a garage and a new fence. Daryl Smith opened the Public Hearing and the applicant, Dane Lussier, was present. Mr. Lussier explained that he needs to accommodate several vehicles Daryl Smith stated he was having a problem with this "front yard type parking" but Les Evans said he felt the improvements Mr. Lussier wished to make would benefit the area rather than be a detriment. Staff has notified the abutting property owners but received only one verbal objection. There was no one else present to speak for or against the project so Chairman Smith closed the Public Hearing. UPON MOTION BY EVANS AND SECOND BY GODFREY, CONDITIONAL EXCEPTION NO. 85-37 AND USE PERMIT NO. 85-36 WERE APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS FOR APPROVAL - CONDITIONAL EXCEPTION: 1. Because of special circumstances applicable to the subject property, including size, shape, topography, location or surroundings, the strict application of the Zoning Ordinance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classifications. 2. The granting of a conditional exception is necessary in order to preserve the enjoyment of one or more substantial property rights. The applicant is making an exceptional improvement to the property. 3. The granting of Conditional Exception No. 85-37 will not be materially detrimental to the public welfare, or injurious to property in the same zone classifications. 8. A revised site plan shall be submitted depicting the modifications described in attached Map No. 1: a. Intensified landscaping shall be provided in front of - garage -along Geneva Avenue.- b. The--mature-palm tree, -at the Northeast corner of the site shall be retained, if possible. c.- The proposed garage -shall match. -the -existing house in terms - of building materials and colors. AYES: Cranmer, Evans, Godfrey, Smith, Vincent NOES: None ABSENT: None Jim Vincent left the meeting at this time (2:30 P.M.) and he was replaced on the Board by Bill Sampson. USE PERMIT NO. 85-32 Applicant: Bill Maxey Toyota A request to permit construction of office/sales building and operation of automobile sales lot at 18924 Beach Boulevard (West side of Beach Boulevard approximately 100 feet North of Garfield Avenue). This request is covered by Categorical Exemption, Class 1, California Environmental Quality Act, 1970. Staff asked that the request be changed to not include the office addition and to just permit the expansion of an automobile lot and customer service. Since this would be a less intense use of the area, Staff is recommending approval of this revised request. Les Evans stressed the fact the applicant should be aware that parking on Beach Boulevard may not always be there - that it is an interim situation. Messrs. Smith and Evans asked that Item 1. b. of the conditions be altered to inform the applicant of this situation. The Public Hearing was opened and the applicant, Bill Maxey, was present. Mr. Maxey said the actual number of parking spaces had not been stipulated to him and that the owner of the property would not join the two pieces of property. Glen Godfrey then informed Mr. Maxey he would need reciprocity on the parking and aisle vehicle access. There was no one else present to speak concerning the project so the Public Hearing was closed. UPON MOTION BY EVANS AND SECOND BY SMITH, USE PERMIT NO. 85-32 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS FOR APPROVAL: 1. Eliminate southerly driveway approach and replace with full width curb and sidewalk b. Redesign to provide more customer parking and depict the actual number of parking spaces c. Widen front planter area to fifteen feet (151) in width in order to reduce the rear planter area and extend to southerly property line d. Paint "CUSTOMER PARKING ONLY" on the surface of those designated spaces e. Provide driveway arrows on the ground for better on -site circulation. f. Provide large (24-inch box) trees in rear planter area g. The rear block wall shall be repaired"14here necessary 2. Prior to use of the property, the applicant shall submit the following plans: a. Landscape and irrigation plan to the Department of Development Services and Public Works for review and approval. 3. Landscaping shall comply with S.979 of the Huntington Beach Ordinance Code. 4. All new signs shall comply with Articles 948 and 976 of the Huntington Beach Ordinance Code. 6. No outside auto repairs shall be permitted on the premises. 7. AYES: Cranmer,'Evans, Godfrey, Sampson, Smith NOES: None ABSENT: None USE PERMIT NO. 85-27 AND USE PERMIT NO. 85-28 Applicant: Donna Oliveira UP 85-27 REQUEST: To permit a four (4) unit apartment building abutting an arterial highway at 16771 Moody Circle. UP 85-28 REQUEST: To permit a four (4) unit apartment building abutting an arterial highway at 16801 Moody Circle These requests are covered by Categorical Exemption, Class 1, California Environmental Quality Act, 1970. Scott Hess said these Use Permits were being submitted because the projects abut a major arterial highway. Staff is recommending approval of both requests with findings and conditions. One condition was for a Mission tile roof and another was for submittal of a color palette of materials to the Department of Development Services for approval. Daryl Smith opened the Public Hearing for both requests. Donna Oliveira, the applicant, was present. She stated they could accept the color palette requirement but felt the Mission tile roof would not be feasible since it would basically be visible only to airplanes because of the height and slope of the roofs. Glen Godfrey stated something other than asphalt shingle would be required. Les Evans added that the color palette should be submitted to the Secretary of the Development Services Department prior to issuance of building permits. Ken Moody was present also and stated the requirements were not feasible. He further stated he had spent fourteen months processing this project through the City. Daryl Smith assured him the color palette requirement was a typical requirement of applicants. This request is covered by Categorical Exemption, Class 1, California Environmental Quality Act, 1970. Scott Hess reported the subject property is zoned M1 and is located on the East side of Gothard Street just North of Slater Avenue. There is an existing single family residence to the North. Staff is recommending approval of the project if the proposed building is moved to the Southeast corner of the property to increase the distance between the repair shop and the existing residence. Les Evans asked what is located behind the proposed building and Staff said he thought there were industrial buildings on that lot. Staff also recommended limiting the hours of operation from 7:00 A.M. to 8:00 P.M., Monday through Saturday, with no hours on Sunday, and that all repair work be done inside the building. Mr. Cella stated there is a construction company located on the property to the South and the houses across the street are at least 170 feet from his location. Garth Haskins, owner of the property to the North, was present. He was concerned about the noise and drainage problems which would be created by construction of the proposed building. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, Fire Department, and Public Works. 4. Maximum separation between building wall and property line shall not exceed two inches (2"). 5. No automobile dismantling or related uses shall be permitted. 6. All repair work shall be conducted wholly within the building. a. Air -chisel panel cutting shall be done with all overhead doors closed. 7. The applicant shall obtain the necessary permits from the South Coast Air Quality Management District. 8. USE PERMIT NO. 85-39 Applicant: Han's Assigal A request to permit a 3,325 Square Foot repair shop addition on property located at 7552 Talbert Avenue. This request is covered by Categorical Exemption, Class 1, California Environmental Quality Act, 1970. Staff reported there is an existing building there now and the applicant wishes to expand his auto repair business. Staff would recommend approval of the project if several conditions are imposed. However, Staff has also prepared findings for denial if the Board is so inclined. Staff read the conditions for approval to the Board and audience. One of Staff's concerns was the parking, repair, and storage of automobiles around the lot. Les Evans expressed concern over increasing the potential operation when they already seemed over -crowded. A general discussion followed about these problems. Daryl Smith opened the Public Hearing and the applicant, Johann Assigal. Mr. Assigal said he was attempting to get better circulation and flow of automobiles throughout the property and explained the locations for smog inspections, reception areas, etc. He further explained he was attempting to create a more efficient operation. Glen Godfrey asked how many people were employed at the location and Mr. Assigal stated from fifteen (15) to eighteen (18). Mr. Godfrey expressed concern that the available parking spaces would be utilized by the employees. Staff is recommending approval of this request with conditions, and also all previous conditions of Tentative Parcel Map No. 82-560 and Lot Line Adjustment No. 84-11 shall be applicable. The applicant's representative, Joseph Walthour, was present. Mr. Walthour stated Condition Nos. 3, 4, and 5 had already been met. His concern was with Condition No. 10 because of the Ross Store. Scott Hess explained to the Board that he had received information which indicated a Waiver could be done because the improvements were already in. Daryl Smith, however, stated that every year some new changes in this area seem to come before the Board for consideration. He expressed concern over the applicant continuing to meet the requirements for parking, landscaping, circulation, etc., with all these continuous changes. Ross Cranmer left the meeting at this time - 4:00 P.M. The applicant stated there had been only one parcel map, one lot line adjustment, and now this new map. He said the map would record before these two (2) structures are built. Glen Godfrey asked if the applicant would have Tait and Associates bring the City an "as -built" plat map in the event this application was approved, and Mr. Walthour said he would have someone from Tail and Associates get in touch with Mr. Godfrey.
