BOARD MEMBERS PRESENT: Cranmer, Evans, Strange, Smith, Vincent STAFF MEMBERS PRESENT: Hess, Poe MINUTES: UPON MOTION BY CRANMER AND SECOND BY EVANS, MINUTES OF THE REGULAR MEETING OF JULY 31, 1985, WERE APPROVED AS TRANSCRIBED, BY THE FOLLOWING VOTE: AYES: Cranmer, Evans, Smith, Vincent NOES: None ABSENT: None ABSTAIN: Strange REGULAR AGENDA ITEMS: USE PERMIT NO. 85-55 Applicant: Dewayne Brown A request to permit construction of an 11,160 Square Foot industrial building for the purpose of operating an automotive minor repair facility. Subject property is located at the Northwest corner of Electronic Lane and McFadden Avenue. This request is covered by Categorical Exemption, Class 1, California Environmental Quality Act, 1984. Scott Hess stated he had recommended continuance of this request to give the applicant and Staff more time to work out some problems with the plans. The applicant is proposing an automotive repair facility. Staff has looked at the aesthetics of the building and layout and, after doing so, the Planning Staff does not feel the overhead doors should face McFadden Avenue since it is an arterial highway. The applicant has not had an opportunity to review Staff's recommended changes. Daryl Smith asked if the applicant would lose square footage with these revisions and Mr. Hess said he would. Mr. Hess further stated that if the Board should approve the project, the landscaping should be -intensified. Minutes, H. B. Board of Zoning Adjustments August 21, 1985 Page 2 Chairman Smith opened the Public Hearing and the applicant, Dewayne Brown, was present. Mr. Brown explained that the lessee of the property had indicated he definitely wanted the building in the configuration which had been presented. Alan Workman, the proposed tenant, was also present and verified Mr. Brown's statement. There was no one else present to speak for or against the project so the Public Hearing was closed. Les Evans said he would move for approval with the addition of berming or a decorative wall along McFadden Avenue to screen the shop's area where visible from McFadden Avenue. UPON MOTION BY EVANS AND SECOND BY VINCENT, USE PERMIT NO. 85-55 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS FOR APPROVAL: 1. The establishment, maintenance and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL 1. The site plan and floor plans received and dated August 13, 1985, shall be the approved layout. 2. Revised elevations shall be submitted depicting the modifications described herein: a. Specify all building materials and colors to be reviewed and approved by the Development Services Director. 3. Prior to issuance of building permits, the applicant shall submit the following plans: a. Landscape and irrigation plan to the Department of Development Services and Public Works for review and approval including berming and/or decorative wall to scree the shop area visible from McFadden Avenue. -2- 8/21/85 - BZA 7 ,J Minutes, H.•B. 'Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. 4. Landscaping shall comply with S. 9730.58.2.3 and 979 of the Huntington Beach Ordinance Code. ' 5. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, Fire Department, and Public Works Department. 6. Maximum separation between building wall and property line shall not exceed two inches 7. Driveway approaches shall be a minimum of twenty-seven feet (271) in width. 8. There shall be no outside storage of vehicles, vehicle parts, equipment or trailers. 9. All repair work shall be conducted wholly within the building. 10. The applicant shall obtain the necessary permits from the South Coast Air Quality Management District. 11. The applicant shall meet all applicable local, State, and Federal Fire Codes,.Ordinances, and standards. 12. A review of the use shall be conducted within six (6) months of the date. of this approval to verify compliance with all conditions of approval and applicable sections of Article 951 of the Huntington Beach Ordinance Code. If, at that time, there is -a violation of these conditions or Huntington Beach Ordinance Code, Use Permit No. 85-55 may become null and void. 13. All signs shall comply,with Articles 948 and 976 of the Huntington Beach Ordinance Code. 14. All automobile repairs shall be limited to minor repairs only as described in Section 9700.1(6) of the Huntington Beach - Ordinance Code. Major auto repairs are strictly prohibited. 15. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 16. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 18. If lighting is included in the parking lot, high-pressure sodium vapor lamps shall be used for energy savings. All outside lighting shall be directed to prevent "spillage" onto adjacent properties. AYES: Cranmer, Evans, Strange, Smith, Vincent NOES: None ABSENT: None COASTAL DEVELOPMENT PERMIT NO. 85-20 Applicant: Warren I. Mitchell A request to add a 1,413 Square Foot, second story addition to an existing 2,415 Square Foot, single family residence within the Coastal Zone. Subject property is located at 16921 Bolero Lane (West side of Bolero Lane approximately 20 feet South of Finisterre Drive). This request is covered by Categorical Exemption, Class 1, California Environmental Quality Act, 1984. According to Staff, the subject property is located in R-1- Coastal Zone and, as'such, requires a Coastal Development Permit. Staff is recommending approval with the condition that the addition match the existing building in terms of architectural material and colors. Les Evans asked that a condition be added to.prevent any surcharge being allowed within ten feet (101) of the existing bulkhead. Scott Hess stated that would supersede the Code because the Code allowed five feet (51) but without bearing, and Ross Cranmer said the Board was worried about the weight of any construction on the bulkhead, The Public Hearing was opened by Chairman Smith and the applicant, Warren I. Mitchell, was present. However, he was represented by his Architect, Don Hartfelder. Mr. Hartfelder explained they would be building a balcony -type deck with a wind screen and the remainder of the residence would be back the required ten feet (101). There was no one else present to speak so the Public Hearing was closed. UPON MOTION BY EVANS AND SECOND BY CRANMER, COASTAL DEVELOPMENT PERMIT No. 85-20 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: -4- 8/21/85 - BZA . Minutes, H. B. The proposed single family residence addition conforms with the plans, policies, requirements and standards of the Coastal Element of the General Plan. 2. The Coastal Development Permit is consistent with the CZ suffix zoning requirements, the R1 Zoning District, as well as other provisions of the Huntington Beach Ordinance Code applicable to the property. 3. At the time of occupancy, the proposed single family residence can be provided with infrastructure in a manner that is consistent with the Coastal Element of the General Plan. 4. The proposed single family residence conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. CONDITIONS OF APPROVAL: 1. The proposed addition shall match the existing development in terms of building materials, colors and architecture. 2. The addition shall comply with the Huntington Beach Ordinance Code and Building Code. 3. No surcharge shall be permitted within ten feet (101) of the bulkhead. AYES: Cranmer, Evans, Strange, Smith, Vincent NOES: None ABSENT: None COASTAL DEVFLOPMENT PERMIT NO. 85-22 Applicant: Jeanne Sprague A request to add a 1,600 Square Foot, second story addition to an existing residence within the Coastal Zone. Subject property is located at 17085 Edgewater Lane (South side of Edgewater Lane approximately 150 feet East of Waverly Lane). This request is covered by Categorical Exemption, Class 1, California Environmental Quality Act, 1984. Staff stated he was recommending approval of the application based on findings and conditions that the addition meet the Huntington Beach Ordinance Code and be compatible with the existing building. -5- 8/21/85 - BZA Minutes, H. Daryl Smith opened the Public Hearing and Jeanne Sprague was present. At her request, Les Evans explained the suggested conditions. There was no"one else present to speak so'the Public Hearing was closed. UPON MOTION BY VINCENT AND SECOND BY CRANMER, COASTAL DEVELOPMENT PERMIT NO.,85=22 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE"FOLLOWING VOTE: FINDINGS FOR APPROVAL: 1. Board of Zoning Adjustments August 21, 1985 Page 7 ADMINISTRATIVE REVIEW NO. 85-40 (NEGATIVE DECLARATION NO. 85-52) Applicant: Dewayne Brown A request to permit construction of one 7,700 + Square Foot industrial building and one 11,100 Square Foot —industrial building pursuant to Section 9530.01 PERMITTED USES of the Ordinance Code. Subject property is located on Gritfin Lane (East side of Griffin Lane approximately 200 feet South of Slater Avenue). This request is covered by Negative Declaration No. 85-52. According to Staff, this project is in a redevelopment area and subject to the conditions outlined. Staff would ask that a revised plan be submitted to conform with these conditions. Tom Poe asked that a condition be added to require fire hydrants per the Fire Department requirements and also that service roads and fire lanes be posted and marked. The applicant, Dewayne Brown, was present. He said designating Parking Space No. 40 was no problem and they would meet the other conditions as necessary. Scott Hess reminded Mr. Brown it would be necessary to file a parcel map on this subject property. UPON MOTION BY EVANS AND SECOND BY SMITH, NEGATIVE DECLARATION NO. 85-52 AND ADMINISTRATIVE REVIEW NO. 85-40 WERE APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. Revised plans shall be submitted depicting the modifications described herein: a. Specify all building material and colors. b. Show all four (4) sides of each building. C. Architectural treatment shall be provided along the South side of Building No. 2 and shall be approved by the Development Services Director. d. Landscaping shall be a minimum of eight percent (8%) of the site. e. Designate Parking Space No. 40 for turn -around area only. 2. Landscape and irrigation plan to the Department of Development Services and Public Works for review and approval. b. Rooftop Mechanical Equipment Plan. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, Fire Department and Public Works Department. 4. Service'roads and fire lanes, as determined by the Fire Department, shall be posted and marked. 5. Maximum separation between building wall and property line shall not exceed two inches (2"). 6. Driveway approaches shall be a minimum of twenty-seven feet (271) in width. 7. On -site fire hydrants shall be provided in number and at locations specified by the Fire Department. 8. If necessary, an automatic fire sprinkler system shall be approved and installed pursuant to Fire Department regulations. 9 There shall be no outside storage of any vehicles, equipment or materials. 10. All signs shall comply with Article 976 of the Huntington Beach Ordinance Code. 11. If foil -type insulation is to be used, a fire retardant type shall be installed as approved by the Building Division. 16. The property owner shall enter into irrevocable reciprocal driveway and parking easement(s) between the two parcels. A copy of the legal instrument shall be approved by the City Attorney as to form and content and, when approved, shall be recorded in the office of the County Recorder and a copy filed with the Department of Development Services. 17. Prior to issuance of building permits, the property owner shall file a parcel map or parcel map waiver request to consolidate Lot Nos. 3 and 4 of Tentative Parcel Map No. 79-567. The parcel map or plat map and notice shall be recorded with the Orange County Recorder and a copy of the recorded map or plat filed with the Department of Development Services prior to final inspection or occupancy. Armstrong A request to permit exterior remodeling of an existing restaurant located at 5005 Warner Avenue (Northeast corner of Warner Avenue and Bolsa Chica Street). This request is covered by Categorical Exemption, Class 1, California Environmental Quality Act, 1984. Scott Hess said there were several recommended changes to this request and the applicant does not seem to be in the audience. UPON MOTION BY STRANGE AND SECOND BY SMITH, ADMINISTRATIVE REVIEW NO. 85-41 WAS CONTINUED TO THE REGULAR MEETING OF AUGUST 28, 1985, BY THE FOLLOWING VOTE: AYES: Cranmer, Evans, Strange, Smith, Vincent NOES: None ABSENT: None TENTATIVE PARCEL MAP NO. 85-309 (W) Applicant: Rudi Van Mil A request to create three (3) parcels from two (2) parcels. Subject property is located at 17481 - 17491 Beach Boulevard (Northwest corner of Beach Boulevard and Slater Avenue). -9- 8/21/85 - BZA Minutes, H. B. Board of Zoning Adjustments August 21, 1985 Page 10 This request is covered by Categorical Exemption, Class 15, California Environmental Quality Act, 1984. Staff explained the history of this piece of property. In 1978, the applicant filed to consolidate three (3) parcels into one (1) designated as Parcel 1 on this Parcel Map. Then, as part of the approval of the Kentucky Fried Chicken application, one of the conditions was to consolidate Parcel 1 with the two parcels along Slater Avenue or divide the two parcels into legal building sites. The applicant has included the original Parcel 1 with the two parcels along Slater Avenue as part of this Tentative Parcel Map request. Staff would recommend waiver of the final map for all three (3) parcels since all street improvements are in, but the City will need the reciprocal parking and driveway agreements. Les Evans said he would have no problems with the waiver as long as the applicant could show it was for lease purposes only. The applicant, Rudi Van Mil, was present and agreed to the conditions as suggested. UPON MOTION BY EVANS AND SECOND BY VINCENT, TENTATIVE PARCEL MAP NO. 85-309 (W) WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS FOR APPROVAL: 1. The proposed consolidation complies with the requirements as to area, improvement and design, flood and water drainage control, appropriate and approved public roads, sewer and water facilities, environmental protection, and other requirements of Article 992 of the Subdivision Section of the Ordinance Code. CONDITIONS OF APPROVAL: 1. The Tentative Parcel Map received by the Department of Development Services on July 29, 1985, shall be the approved layout. 2. The applicant shall file, through the Huntington Beach City Clerk's office, and have recorded with the Orange County Recorder's Office, a Certificate of Compliance in conjunction with the approved plat map. A copy of the recorded Certificate of Compliance and plat map shall be filed with the Department of Development Services prior to issuance of building permits on the subject property. 3. Cheatham, Jr A request to permit a temporary outdoor event (outside sales) on August 24 and 25, 1985. Subject property is located at 8909 Adams Avenue (North side of Adams Avenue approximately 100 feet West of Magnolia Street) - Pat's Ski Shop. This is, reported Mr. Hess, a request to permit a temporary outdoor sale of ski and sports equipment, which is an annual event, at Pat's Ski Shop, and Staff is -recommending approval with conditions. Staff also reminded the Board that it was a three (3) day temporary affair and would not require a Public Hearing. The applicant, Milton R. "Buddy" Cheatham, was present but had no questions or comments. UPON MOTION BY EVANS AND SECOND BY STRANGE, USE PERMIT NO. 85-58 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The,conceptual site plan received August 14, 1985, shall be the approved layout. 2. A certificate of insurance form shall be filed in the Administrative Services Department in an amount deemed necessary by the Public Liability Claims Coordinator, along with a Hold Harmless Agreement executed by the insured, at least three (3) days prior to the event. 3. A Certificate to Operate, as required by 5.9730.80 of the Ordinance Code, shall be issued prior to the event. Board of Zoning Adjustments August 21, 1985 Page 12 REQUEST FOR RECONSIDERATION OF USE PERMIT NO. 85-41 Applicant: Slater/Metzler Industrial A request to construct three (3) industrial buildings (5,600 SF, 101920 SF, and 7,488 SF) for minor automobile repair and manufacturing uses with a variance to permit one building to encroach five feet (51) into the required five foot (51) setback from a fifteen foot (151) wide storm drain easement along the East side of the property. Subject property is located at Southeast corner of Slater Avenue and Metzler Lane. Staff reported the applicant had filed an appeal to the Planning Commission; however, Staff is recommending that these items be reviewed by the Board prior to sending to the Planning Commission. If the Board decides to reconsider the request, the items can be addressed. Daryl Smith stated he would prefer not to go into detail on the items at this meeting but rather consider them at the Monday morning Study Session. Staff reported these items would need variances and would have to be readvertised. The applicant's representative, Paul Riggs, was present. Mr. Rigg said the main item of interest was the Slater Avenue access. Les Evans said new evidence had been presented to the Public Works Department that apparently promises had been made to Zoran Imports, who had been relocated to this area from the downtown redevelopment area, for access off Slater Avenue. UPON MOTION BY EVANS AND SECOND BY SMITH, RECONSIDERATION OF USE PERMIT NO. 85-41 WAS APPROVED FOR THE MEETING OF SEPTEMBER 41 1985, BY THE FOLLOWING VOTE: AYES: Cranmer, Evans, Strange, Smith, Vincent NOES: None ABSENT: None CONDITIONAL EXCEPTION NO. 85-44 Applicant: Robert and Marlene Anderson Staff reported it had been called to the attention of several City Staff members that City Council had deleted the particular section of Indianapolis Avenue adjacent to Mr. Anderson's property as an arterial highway. This portion of Indianapolis Avenue was not included as an arterial highway in the City's General Plan Circulation Element on December 5, 1983; therefore, Indianapolis Avenue would only be sixty feet (60') wide and not the eighty feet (801) wide as was understood at the time of the first hearing of Conditional Exception No. 85-44. -12- 8/21/85 - BZA Minutes, H.
