Goodman A request.to consolidate two (2) parcels into one (1) and Waiver of Final Map. Subject property is located at 17042 Palmdale Street (Northeast corner of Cain Avenue and Palmdale Street). This request is covered by Categorical Exemption, Class 5, California Environmental Quality Act, 1984. The Staff member, Scott Hess, reported that the request had been continued from a previous meeting because the corner radius had not been properly dedicated. Staff stated the improvements were still not completed for a Waiver of the Final Map. The applicant, William C. Goodman, was present and agreed to the conditions as presented. ` UPON MOTION BY EVANS AND SECOND BY GODFREY, TENTATIVE PARCEL MAP NO. 85-275 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS FOR APPROVAL: 1. The proposed consolidation of two (2) parcels for purposes of industrial use in compliance with the size and shape of ,property necessary for that type of development. 2. The General Plan has set forth provisions for this type of land -use as well as setting forth objectives for implementation of this type of use. 3. The property was previously studied for this intensity of land use at the time the land use designation for community business district allowing industrial buildings was placed on the subject property. 4. The size, depth, frontage, street width and other design and improvement features of the proposed consolidation are proposed to be constructed in compliance with standards plans and specifications on file with the City as well as,in compliance with the State Map Act and supplemental City Subdivision Ordinance. Water supply shall be through the City of Huntington Beach's water system at the time said parcel(s) is/are developed (if such systems exist within 200 feet of said parcel(s). 5. Subject property is located at 302 Ninth Street (Northeast corner of Ninth Street and Olive Avenue). This request is covered by Categorical Exemption, Class 5, California Environmental Quality Act, 1984. According to Staff, this application had also been continued from a previous meeting to allow time for the applicant to file for the -alley dedication and a twenty -foot (201) radius. (3 ) bays.,and _ a _snack: shop: The.. applicant submitted the request last year but needed a Zone Change. The zoning is C4 and is in the redevelopment.areai- Staff is -recommending -approval with conditions. Redevelopment; is recommending reciprocal: -driveway.:, - easements between the site and the southerly adjacent property, and they would like; to - see one. common driveway _ at _ the.,South end : of the property. Daryl Smith said a definite problem would be created_by the traffic flow into -and out of the area by the crossing of traffic.__ ,He ,said making a,common,driveway would-be4a mistake.---Les--Evans.,concurred with Mr. Smith that retaining the two (2) driveways, in this instance, would be -better_ even though ordinarily-he:would_prefer-, fewer drives.- Mr. -Evans also mentioned_that-a portion_of.the:-corner property was still owned by-CalTrans-and it would:be-:necessary for CalTrans to vacate this property. Also, part of the property on Adams Avenue has - never, -been _dedicated --to--the .City- and this -would - have to be done. Scott Hess interjected, -the, -information '_ that -a letter.had been received from CalTrans authorizing the obil Corporation to use that property, and -,the .applicant -has indicated_.they--are_ in ,the__process. of purchasing the triangular -:piece of.-property-.at_the-corner: The Public Hearing was opened by Chairman Tom Poe and the applicant's representative,_Jim-Huntsberry, was present., : Mr. Huntsberry said they, would have no --problem with the southerly parking stall being eliminated but asked about the twenty-seven foot (2.71) clearance :between- service: -bays when -they were already at twenty-nine feet (291). Scott Hess and Glen Godfrey explained that, according to -,the plans the applicant submitted, a five foot (5') sidewalk existed which would encroach into the twenty-seven foot (271) area, and the Code required this clearance. The applicant's 'represeritative also discussed the reciprocal easement and -stated -it -,would-be =difficult -to -o.btain..--He -mentioned discussing the signal -system with-Bill-Patapoff of -Public Works. There was no one else present wishing to speak for or against the project so the Public -Hearing was closed. Messrs. Godfrey and Smith each expressed questions concerning any beneficial purpose for the reciprocal easements between the two properties and felt the traffic problems-cr.eated by the common driveway would be horrendous.-- -6- 2/5/86 - .BZA. Minutes, H. B. Board of Zoning Adjustments February 5, 1986 Page 7 Daryl Smith said he would move for approval of the project with conditions. Les Evans stated he would second the motion if Mr. Smith would accept the addition of a condition that the dedication on Adams Avenue be made and installation of street lights accomplished prior to issuance of building permits. Mr. Smith so agreed. UPON MOTION BY SMITH AND SECOND BY EVANS, USE PERMIT NO. 85-73 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS FOR APPROVAL: 1. -The establishment, maintenance and operation of a service station with snack shop will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The General granting of the use permit will not adversely affect the Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: 1. -A revised site plan shall be submitted depicting the .modifications described herein: a. Delete the southwesterly parking space. b. Minimum twenty-seven feet (271) free and clear between the service bay side of building and the parking spaces. c. Elevations must be reviewed and approved by the Design Review Board. 2. Prior to issuance of building permits, the applicant shall submit the following plans: a. Rooftop Mechanical.Equipment Plan.- Said plan shall -- indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. . - 3. Landscaping shall comply with S. 9481.8 of the Huntington Beach Ordinance Code. a. Minimum four foot (41) high landscaping shall be provided in the planter adjacent to the rest room door.for-screening purposes 4. The development _shal-1 -comply. with Article 948 -and -a11 applicable_provisions.of the Ordinance Code;-Building,:Division, and Fire Department. 5. Applicant -shall--pursue CalTrans approval of radius type driveways -on Beach Boulevard. 6. Driveway approaches on Adams Avenue shall be a minimum of twenty-seven feet (271) in width and shall -be of -radius type construction.-- 7. Both driveways on Adams Avenue shall be designated "RIGHT TURN ONLY". 8. Dedications on Adams Avenue shall have been made prior to issuance of -building permits., 9. Street lights _shall be installed per Public- Works standards. 10. The sales -room shall -be :limited _to _450 Square.Feet, :-and--_the - storage -room -and -coolers related to, the. sales -room _shall : be ,- limited -to 328 Square -Feet. 11. There shall be no outside -storage of -vehicles, vehicle parts, equipment or trailers. 12. All repair work shall be conducted wholly within the building. 13. The applicant shall obtain the necessary permits from the South Coast Air Quality Management District. 14. The applicant shall -meet all applicable local, State, and Federal Fire Codes; -Ordinances, and standards:_.: I -8- 2/5/86 - BZA Minutes, H. B. Board of Zoning Adjustments February 5, 1986 Page 9 15. A review of the use shall be conducted within six (6) months of the date of this approval to verify compliance with all conditions of approval and applicable sections of the Huntington Beach Ordinance Code. If, at that time, there is a violation of these conditions or code sections, Use Permit No. 85-73 may become null and void. 16. All signs shall comply with Articles 948 and 976 of the Huntington Beach Ordinance Code. All free-standing signs shall be low -profile, monument -type signs. a. The major identification sign shall be removed or altered to comply with Article 948 within ninety (90) days. 17. Development shall meet all local and State regulations regarding installation and operation of all underground storage tanks. 18. The sale of any alcoholic beverages is prohibited per S.9730.84. 19. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 20. Low -volume heads shall be used on all spigots and water faucets. 21. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 22. If lighting is included in the parking lot, high-pressure sodium vapor lamps shall be used for energy savings. All outside lighting shall be directed to prevent "spillage" onto adjacent properties. 23. A detailed soils analysis shall be prepared by a registered Soils Engineer. This analysis shall include on -site soil sampling and laboratory testing of materials to provide detailed recommendations regarding grading, chemical and fill properties, foundations, retaining walls, streets, and utilities. 24. Board of Zoning Adjustments February 5, 1986 Page .10 Glen Godfrey and Daryl Smith asked that the -Minutes reflect the Board -had given consideration' -to Redevelopment's -request for reciprocal easements_and-a common driveway. USE PERMIT N0. 86-2 ;-_ Applicant: Linda Prith Kien A request:to.permit,beer-and_wine.sales in conjunction with an existing drive-thru_dairy-:business._ Subject property.is--located at 15492 Edwards'Street (East side of Edwards Street approximately one hundred fifty feet (1501) North of Edinger Avenue). This request is covered by Categorical Exemption, Class 1 (a), California Environmental,Quality-Act, 1984. Staff explained the subject property is zoned C4 and is currently existing -as a-drive-thru dairy.- There-appears_to-be_.no.landscaping on the site -and;-according to Code, six percent (6%) must be provided. The applicant has indicated there are no public buildings within four hundred feet (400') of -her -location. -Staff said one response had been -received in opposition to the request. Staff further stated that City Council has decreed there shall be no beer and wine sales�at service -stations -because of -the "drinking'.and-- drivin " concept -.-,-Based on these•situations-and--the•fact there are two (2}g liquor_ stores already located within three hundred feet (3001) of the applicant's place of business, Staff is -recommending denial of the request. Tom Poe -opened the.Public"Hearing and the applicant, Linda Prith Kien, was present. The applicant stated she did not understand the findings for denial ,and, for -clarification, she-was--given-a-copy to read The-applicant•said-she owns a=dairy in Cypress but.has had no problems at that location - when a customer wants to purchase beer, they just sell•it to them. Les Evans further explained the•City Council and Planning Commission's feelings relative-to--liquor-sales-in mini -markets -,-and Daryl Smith expressed concern over possible car stacking problems which could develop at the site. _ - = Dosok Yi, 6541 Edinger Avenue, Huntington Beach, spoke in opposition to the project because -of the potential traffic -problems and - accidents at the location. Norbert Waters, 12132 Morrie Lane, Garden Grove, said he had owned and operated a liquor store in the area for fifteen -years and he felt'there-were-already enough- places -10- 2/5/86 - BZA Minutes, H. B. Board of Zoning Adjustments February 5, 1986 Page 11 where liquor could be purchased. Letters were also presented to the Board from Richard E. Macklin, 4052 Humboldt Drive, Huntington Harbour, and Jim Marshall, Huntington Beach, in opposition to the request. . UPON MOTION BY SMITH AND SECOND BY GODFREY, USE PERMIT NO. 86-2 WAS DENIED WITH THE FOLLOWING FINDINGS, BY THE FOLLOWING VOTE: FINDINGS FOR DENIAL: 1. The proposed use permit to allow the sale of beer and wine in conjunction with a drive-thru dairy is inconsistent with the City's intent to prohibit beer and wine sales in conjunction with drive-thru or drive -up use. 2. Allowing the purchase of beer and wine through a drive-thru facility to customers driving a vehicle does not minimize driving and drinking. 3. Purchasing beer and wine while in a vehicle makes it difficult for the seller to detect whether or not the buyer is intoxicated or whether or not the buyer is of legal age.. 4. The sale of beer and wine is incompatible with a drive-thru dairy. 5. The dairy facility is within three hundred feet (3001) of two (2) existing liquor stores. 6. The dairy site is nonconforming to the requirements of the Zoning Code regarding landscaping and the drive-thru lane. The sale of beer and wine would constitute an expansion of a nonconforming use. AYES: Cranmer, Evans, Godfrey, Poe, Smith NOES: None ABSENT: None ADMINISTRATIVE REVIEW NO. 86-5 Applicant: Michael Schau A request to.add 725 Square Feet of office space and to permit joint use of parking for a Chiropractor's office use. Subject property is located at 8907 Warner Avenue (Northwest corner of Warner Avenue and Magnolia Street). This request is covered by Categorical Exemption, Class 1, California Environmental Quality Act, 1984. -11- 2/5/86 - BZA Minutes, H. B. Board of.Zoning Adjustments February 5, 1986 Page-12 The Staff member, Robert Franklin, reported the existing use for this project is retail and office space and the C2 Zoning is in conformance with Code. The Chiropractor's office will have a more restrictive parking -ratio than regular office use,. -There is an apartment complex to the North_ and a reciprocal driveway arrangement was imposed on that project. Daryl Smith suggested this reciprocal access arrangement should be accomplished and -the agreement filed within ninety _(-90) days of this date. Staff stated they were"recommending approval of -the -request with conditions. ---There was a discussion -concerning the -previous use by a health spa and the decreased parking required for this type of use. Also, the trade off on parking between the day time -use -by offices and the evening use by restaurants. The applicant, Michael Schau, was present and explained some of the problems encountered in obtaining the reciprocal parking and access agreements. Mr. Schau also mentioned they were adding an elevator and a corridor -which would -give access to the entire office - structure but would also reduce some -of the actual office space available for rental, thus reducing the parking requirements. Daryl Smith moved for approval of the project with amended conditions.- Glen Godfrey -stated he would second the -motion if Mr. Smith would add -a condition that "any new uses which are - proposed for this development shall have no greater parking intensity than the one (1) per khree hundred (300) ratio". Mr. Smith agreed to this amendment. --- UPON MOTION BY SMITH AND-SECOND-BY--GODFREY, ADMINISTRATIVE'REVIEW NO. 86-5 WAS APPROVED'WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF -APPROVAL: 1. A revised site plan shall be submitted depicting the modifications described herein: - a. Driveway and parking arrangement at the northern access fronting Magnolia -Street as depicted -on the -approved site plan for Conditional Use Permit No. 84-33. b. Provide five (5) handicapped parking spaces. 2. A planned sign program shall be approved for all signing within the commercial center pursuant to S. 9760.43 of the Huntington Beach Ordinance Code. -12- 2/5/86 --'BZA Minutes, H. B. Board of Zoning Adjustments February 5, 1986 Page 13 3. The northern driveway approach on Magnolia Street shall be subject to the review and approval of the Department of Public Works. 4. The major identification signs shall be removed or altered to comply with Article 948 within ninety (90) days. 5. All signs shall comply with Articles 948 and 976 of the Huntington Beach Ordinance Code. All free-standing signs shall be low -profile, monument -type signs. 6. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. 7. Low -volume heads shall be used on all spigots and water faucets. 8. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 9. If lighting is included in the parking lot, high-pressure sodium vapor lamps shall be used for energy savings. All outside lighting shall be directed to prevent "spillage" onto adjacent properties. 10. If foil -type insulation is to be used, a fire retardant type shall be installed as approved by the Building Division. 11. The subject property shall enter into irrevocable reciprocal driveway and parking easement(s) between the subject site and adjacent properties. 12. Prior to issuance of building permits, the applicant shall restripe the parking lot so that it conforms to the provisions of Article 979 of the Huntington Beach Ordinance Code. 13. Joint use parking shall require that a Joint Use Parking Agreement be recorded between property owners. A copy of the legal instrument shall be approved by the City Attorney as to form and content and, when approved, shall be recorded in the office of the County Recorder and a copy filed with the Department of Development Services. 14. A reciprocal parking and access agreement with the residential property owner to the North shall be approved as to form by the City Attorney and recorded with the County of Orange and filed with the Department of Development Services prior to issuanceof building permits. The agreement shall specify the number of -13- 2/5/86 - BZA. Minutes, H. B. Board of Zoning Adjustments February 5,-1986 Page 14 spaces which are lost to -the reciprocal -access driveway on Magnolia'Street and replaced on the property_to the North within ninety -(90)- days from this date. 15. Prior to issuance of building permits, the property owner shall sign, notarize, and record with the County Recorder a "Letter of Agreement" assuring that the single family residence will be maintained as one (1) dwelling unit. 16. Any new uses -which are proposed for this development shall have no greater parking intensity than the one (1) per three hundred (300) ratio. AYES: Cranmer; Evans, Godfrey, Poe, Smith NOES: None ABSENT: None - MISCELLANEOUS AGENDA ITEMS: ADMINISTRATIVE REVIEW NO. 86-8 Applicant: Correia and Christian - A request to permit construction -of -a 2,652 Square Foot second story addition to an existing industrial building at 17712 Crabb Lane (East side of Crabb Lane approximately 135 feet South of Liberty Avenue) . This request is covered by Categorical Exemption, Class 1, California Environmental Quality -Act, 1984 Scott Hess reported that currently.on the.site is a bui-lding-which was gutted by fire and the applicant is proposing to modernize this building and add a portion on the Second Floor. Typically, it would require a Use Permit; however, the Planning Director has given approval for the Administrative Review use because the hours of operation will be between 8:00 A.M. and 8:00 P.M. Staff is recommending approval with conditions. One would be replacement of one of the outside stairways by an inside stairway and another would be no parking spaces in front of the overhead doors. After a general discussion, the Board did not concur-with.StaffIs recommendation for enclosure of one of the stairways. The applicant was represented by Vanessa Correia and Spence Freiwald. Mr. Freiwald said the operation which would be located at this site would be Dickies, a company which supplied new and/or clean work clothing for industrial users. The cleaning operations would be done at another location and this building would be used for storage of new uniforms with office space on the Second Floor. -14- 2/5/86 --BZA- Minutes, H. B. Mr. Poe explained the alternatives. UPON MOTION BY EVANS AND SECOND BY SMITH, ADMINISTRATIVE REVIIN NO. 86-8 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated January 31, 1986, shall be revised depicting the modifications described herein: a. Indicate outside storage tanks b. No parking spaces in front of overhead doors c. Adjacent uses d. Fencing and/or walls on property lines e. Revised trash area 2. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 3. Unloading and loading of trucks shall be limited to between the hours of 8:00 A.M. and 8:00 P.M. 4. An automatic fire sprinkler system shall be approved and installed pursuant to Fire Department regulations. 5. Proposed structures shall be architecturally compatible with existing structures. 6. Prior to issuance of building permits the applicant shall restripe the parking lot so that it conforms to the provisions of Article 979 of the Huntington Beach Ordinance Code. 7. All modifications which have been conditioned by this Board shall be installed and completed prior to occupancy.
