REGULAR AGENDA ITEMS:
CONDITIONAL EXCEPTION NO. 86-9
USE PERMIT NO. 86-5 (Cont. from 2/12/86)
Applicant: P. H. Walizer
CE REQUEST: To permit private patio areas to be included as part of
the open space requirement.
UP REQUEST: To add two hundred ninety (290) Square Foot office to
existing apartment complex, relocate trash enclosures and add more
parking spaces.
Subject property is located at 4922 Edinger Avenue (South side of
Edinger Avenue approximately three hundred feet (3001) West of Bolsa
Chica Street.
This request is covered by Categorical Exemption, Class 5,
California Environmental Quality Act, 1984.
Scott Hess reported the Use Permit had been continued by the Board
from a meeting two weeks ago to allow the applicant an opportunity
to file for the Conditional Exception. The office building will be
architecturally compatible with the apartment complex, and the
applicant proposed consolidating two (2) trash areas into one (1)
with access off the alley easement at the East end of the complex.

Staff further explained the variance request is to provide a portion
of the private open space area as part of the common open space
Areas. At the time the complex was built, it had more than twice
the required open space'in the form of common and private open space
but this will be reduced by the proposed construction. Staff is
recommending approval of this project with conditions.
There was a discussion, prompted by Daryl Smith, concerning the
difference between the original open space provided and today's
requirements. Glen Godfrey broached the subject of the meandering
sidewalks recommended by Staff.
The Public Hearing was opened by Chairman Tom Poe and P. H. (Phil)
Walizer, the applicant, was present. Mr. Walizer stated the "Y"
arrangement for the sidewalks would be preferable to the meandering
style; however, he did not feel a pedestrian gate would be necessary
because of the terrain of the area where the trash receptacle would
be located.
The Board members discussed the height of the wall surrounding the
trash receptacle area, the pedestrian gate, the condition of the
drainage and concrete paving inside the complex, and the necessity
for the easement on the East side of the property.
There was no one else present wishing to speak for or against the
project so the Public Hearing was closed.
UPON -MOTION BY SMITH AND SECOND BY EVANS, CONDITIONAL EXCEPTION
NO. 86-9 AND USE PERMIT NO. 86-5 WERE APPROVED WITH THE FOLLOWING
FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE:
FINDINGS FOR APPROVAL - CONDITIONAL EXCEPTION NO. 86-9:
1. Because of special circumstances applicable to the subject
property, including size, shape, location and surroundings, the
strict application of the Zoning Ordinance is found to deprive
the subject property of privileges enjoyed by other properties
in the vicinity and under identical zone classifications. The
property is narrow and deep (136' x 5181) and abuts commercial
to the Fast.
2. The granting of a conditional exception is necessary in order
to preserve the enjoyment of one or more substantial.property
rights. The development was constructed with more than twice
the required amount of common area open space in the form of
common and private open space. After the improvements are
completed as recommended by Staff, a total of approximately
8700 Square Feet of common open space will remain. Although

this is 700 Square Feet less than the required 9400 Square
Feet, there is 10,900 Square Feet of private open space for
compensation.
3. The granting of Conditional Exception No. 86-9 will not be
materially detrimental to the public welfare or injurious to
property in the same zone classifications.
4. The granting of the conditional exception will not adversely
affect the General Plan of the City of Huntington Beach.
CONDITIONS OF APPROVAL - CONDITIONAL EXCEPTION NO. 86-9:
1. The development shall comply with all applicable provisions of
Use Permit No. 86-5.
FINDINGS FOR APPROVAL - USE PERMIT NO. 86-5:
1. The establishment, maintenance and operation of the use will
not be detrimental to:
a. The general welfare of persons residing or working in the
vicinity;
b. Property and improvements in the vicinity of such use or
building.
2. The granting of the use permit will not adversely affect the
General Plan of the City of Huntington Beach.
3. The proposal is consistent with the City's General Plan of Land
Use.
CONDITIONS OF APPROVAL - USE PERMIT NO. 86-5:
1. A revised site plan shall be submitted depicting the
modifications described herein:
a. Details of the two (2) parking spaces adjacent to the
southwesterly building (one 11' x 19' and the other
9' x 19')
b. The trash area and proposed parking area abutting the
northwesterly building changed to landscaping
c. The sidewalk shall be designed with two (2) entrances off
the driveway between the parking spaces for access to the
trash area
d. Properly dimensioned office addition

2.
The development shall comply with all applicable provisions of
the Ordinance Code, Building Division, and Fire Department
except as noted in Conditional Exception No. 86-9. -
3.
Installation of required landscaping and irrigation systems
shall be completed within ninety (90) days.
4.
Proposed structures shall be architecturally compatible with
existing structures.
5.
All driveway improvements necessary to accomplish proper
drainage and all asphalt deficiencies shall be completed to the
satisfaction of the Department of Public Works prior to final
inspection.
6.
Natural gas shall be stubbed in at the locations of cooking
facilities, water heaters, and central heating units.
7.
Low -volume heads shall be used on all spigots and water faucets.
8.
All building spoils, such as unusable lumber, wire, pipe, and
other surplus -or unusable material, shall be disposed of at an
off -site facility equipped to handle them.
9.
Prior to the issuance of building permits, proof of the
adjacent easterly easement and approval for the trash gate
along the easterly wall from the adjacent easterly property
owner having interest in the easement shall be submitted to the
Development Services Department.

TENTATIVE PARCEL MAP NO. 85-344 (WAIVER)
Applicant: Hau-En Ying
A request for WAIVER of Tentative Parcel Map No. 85-344 which was
Approved by the Board of Zoning Adjustments on September 11, 1985.
Subject property is located at 8032 Warner Avenue (Southwest corner
of Warner Avenue and "A" Street).
This request is covered by Categorical Exemption, Class 5,
California Environmental Quality Act, 1984

According to tafr a letter had been received from the applicant
requestin a" giver of the Final Map for Tentative Parcel Map No. 85-341 which•had been previously reviewed and approved by this
Board. The Tentative Parcel Map was for consolidation of two (2)
parcels into one (1) with submission of the Final Map to the County
for recordation. The applicant has made all of the required street
improvements 'and is now asking for the Waiver-.
The applicant, Hau-En Ying, was present at the meeting.
UPON MOTION BY EVANS AND SECOND BY POE, TENTATIVE PARCEL MAP
NO. 85-344 (WXIVER) WAS APPROVED WITH THE FOLLOWING FINDINGS AND
CONDITIONS, BY THE FOLLOWING VOTE:
FINDINGS -OF IPPROVAL FOR WAIVER:
1. The proposed consolidation complies with the requirements as to
area, improvement and design, flood and water drainage control,
appropriate and approved public roads, sewer and water
facilities, environmental protection, and other requirements of
Article 992 of the Subdivision Section of the Ordinance Code.
CONDITIONS OF APPROVAL FOR WAIVER:
1. The Tentative Parcel Map received by the Department of
Development Services on August-221, 1985, shall be the approved
layout (with the amendments as noted thereon)..
2. The applicant shall file, through the Huntington Beach City
Clerk's office, and have recorded with the Orange County
Recorder.'s Office, a Certificate of Compliance in conjunction
with the approved plat map._ A copy of the recorded Certificate
of Compliance and plat map shall be filed with the Department
of Development Services prior to issuance of building permits
on the subject property.
3. Approval of the Waiver does not alter the expiration date of
the original approval of Tentative Parcel Map No. 85-344.
