AR 86-11: A request to construct an industrial building to be located on the South side of Bolsa Avenue approximately one hundred seventy feet (1701) West of Dan Lane. AR 86-12: A request to construct an industrial building to be located on the North side of Buckingham Drive approximately three hundred forty feet (340') West of Dan Lane. TPM 86-125: A request to consolidate twelve (12) lots into three 3 lots for development of three (3) industrial buildings. Subject property is located on the Southwest corner of Bolsa Avenue and Dan Lane. These requests are covered by Environmental Impact Report No. 73-16. Minutes, H. B. Board of Zoning Adjustments April 2, 1986 Page 2 Scott Hess reported these applications were continued from the meeting of March 19, 1986, to give the applicant an opportunity to revise the plans for compact parking spaces. All three Administrative Review projects are being developed simultaneously and will be located on property covered by Tentative Parcel Map No. 86-125. Staff is recommending approval with conditions. Daryl Smith asked about a condition calling for completion "prior to final occupancy" and asked that the word "final" be deleted. Tom Poe asked that a condition be added calling for the Fire Department requirement for a seventeen foot by forty-five foot (171/451) turning radius. There was also a discussion relative to a concrete driveway being shown on the plan, and Staff recommended it be removed and replaced with landscaping. Tom Waller was present to represent Kaiser Development Company on the Administrative Review requests and he was joined by Joe Hartge in discussions relating to the Tentative Parcel Map. Mr. Waller and Mr. Hartge agreed to the conditions as revised for all requests. UPON MOTION BY SMITH AND SECOND BY POE, ADMINISTRATIVE REVIEW NO. 86-10, ADMINISTRATIVE REVIEW NO. 86-11, ADMINISTRATIVE REVIEW NO. 86-12, AND TENTATIVE PARCEL MAP NO. 86-125 WERE APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL - ADMINISTRATIVE REVIEW NO. 86-10: 1. The site plan, floor plans, and elevations received and dated March 21, 1986, shall be the conceptually approved layout. 2. Only those office uses and industrial uses described within the M1-A Industrial District (Article 951) shall be permitted. 3. Tentative Parcel Map No. 86-125 shall be recorded prior to occupancy. 4. Prior to issuance of building permits, the applicant shall submit the following plans: a. Landscape and irrigation plan to the Department of Development Services and Public Works for review and approval. b. Rooftop Mechanical Equipment Plan. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 7. Service roads and fire lanes, as determined by the Fire Department, shall be posted and marked. 8. Driveway approaches shall be a minimum of twenty-seven feet (271) in width and shall be of radius type construction. 9. An automatic fire sprinkler system shall be approved and installed pursuant to Fire Department regulations. 10. All signs shall comply with Article 976 of the Huntington Beach Ordinance Code. All free-standing signs shall be low -profile, monument -type signs. 11. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 12. Low -volume heads shall be used on all spigots and water faucets. 13. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 14. If lighting is included in the parking lot, high-pressure sodium vapor lamps shall be used for energy savings. All outside lighting shall be directed to prevent "spillage" onto adjacent properties. 15. A detailed soils analysis shall be prepared by a registered Soils Engineer. This analysis shall include on -site soil sampling and laboratory testing of materials to provide detailed recommendations regarding grading, chemical and fill properties, foundations, retaining walls, streets, and utilities. 16. If foil -type insulation is to be used, a fire retardant type shall be installed as approved by the Building Division. 17. CONDITIONS OF APPROVAL - ADMINISTRATIVE REVIEW NO. 86-11: 1. The site plan, floor plans, -and elevations received and dated March 21, 1986, shall be the conceptually approved layout. a. Delete concrete driveway and approach between —Building Nos. 2 and 3 off Buckingham Drive; a driveway may be permitted between the two,(2) buildings with access from the northerly parking area. 2. The proposed consolidation of twelve (12) parcels for purposes of industrial use in compliance with the size and shape of property necessary for that type of development. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation of this type of use. 3. The property was previously studied for this intensity of land use at the time the land use designation for community business district allowing industrial buildings was placed on the subject property. 4. The size, depth, frontage, street width and other design and improvement features of the proposed consolidation are proposed to be constructed in compliance with standards plans and specifications on file with the City as well as in compliance with the State Map Act and supplemental City Subdivision Ordinance. -7- 4/2/86 - BZA Minutes, H. B. Board of Zoning Adjustments April 21 1986 Page 8 CONDITIONS OF APPROVAL - TENTATIVE PARCEL MAP NO. 86-125: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL(S) FOR ANY PURPOSE: 1. The Tentative Parcel Map received by the Department of Development Services on February 6, 1986, shall be the approved layout (with the amendments as noted thereon). 2. A parcel map shall be filed with and approved by the Department of Public'Works and recorded with the Orange County Recorder. 3. Water supply shall be through the City of Huntington Beach's water system at the time said parcel(s) is/are developed (if such systems exist within 200 feet of said parcel(s). 4. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time said parcel(s) is/are developed (if such systems exist within 200 feet of said parcel(s). 5. All utilities shall be installed underground at the time said parcel(s) is/are developed. 6. Compliance with all applicable City Ordinances. 7. The property shall participate in the local drainage assessment district at the time said parcel(s) is/are developed. (Contact the Department of Public Works for additional information). 8. A copy of the recorded parcel map -shall be filed with the Department of Development Services. 9. Vehicular access rights to Bolsa Avenue 'shall be dedicated to the City of Huntington Beach except at locations approved by the Board of Zoning Adjustments. AYES: Evans, Krejci, Poe, Smith, Strange NOES: None ABSENT: None CONDITIONAL EXCEPTION NO. 86-18 USE PERMIT NO. 86-4 (Cont. from 3/26/86) Applicant: James Gray/G & M Oil Company CE REQUEST: Reduction in landscaped planter width from six feet 6 to four feet (41) along "A" Street. This request is covered by Categorical Exemption, Class 5, California Environmental Quality Act, 1984. -8- 4/2/86 - BZA Minutes, H. B. Board of Zoning Adjustments April 2, 1986 Page 9 UP REQUEST: To permit remodeling of an existing commercial building. This request is covered by Categorical Exemption, Class 1, California Environmental Quality Act, 1984. The subject property is located at 16922 -16952 Beach Boulevard (East side of Beach Boulevard approximately two hundred feet (200') North of Warner Avenue). Staff reported this project is located in an existing shopping center with C4 zoning. The applicant is requesting permission to remodel an existing commercial building. The applicant will restripe the parking lot for better circulation and will have six percent (6%) landscaping on the site with planters along the front. The Use Permit was continued from a previous meeting to add the Conditional Exception for reduction of the landscape planter width from six feet (61) to four feet (41) along "A" Street. Staff is recommending approval with conditions. Staff further stated the Redevelopment Department had been contacted but had no concerns; and the Design Review Board had made suggestions for the facade. The Public present to Hearing was opened for both requests and Jim Gray was represent the applicant. Mr. Gray questioned the dedication and street improvements for "A" Street but was informed they would have to be completed. Tom Poe informed the applicant a fire hydrant would have to be installed if there was not one within one hundred fifty feet (1501) of the building. Michael Strange called the Board's attention to the fact that, at the previous night's meeting, Commissioner Livengood had requested these items be referred to the Planning Commission for their meeting on April 15, 1986. Daryl Smith asked if there had been a formal vote on this request and Mr. Strange reported there had been none. Mr. Smith felt it would be an injustice to the applicant to cause such extensive delays to his project. There was no one else present wishing to speak for or against the project so the Public Hearing was closed. UPON MOTION BY SMITH AND SECOND BY POE, CONDITIONAL EXCEPTION NO. 86-18 AND USE PERMIT NO. 86-4 WERE APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS FOR APPROVAL - CONDITIONAL EXCEPTION NO. 86-18: 1. Because of special circumstances applicable to the subject property, including size, shape, location or surroundings, the strict application of the Zoning Ordinance is found to deprive -9- 4/2/86 - BZA Minutes, H. B. Board of Zoning Adjustments April 2, 1986 Page 10 the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classifications. Five feet W ) of street dedications and improvements are being made along "A" Street, thus reducing the size of the lot by approximately 747 Square Feet. In addition, the parcel is unique because it fronts two streets - Beach Boulevard and "A" Street. 2. The granting of a conditional exception is necessary in order to preserve the enjoyment of one or more substantial property rights. A reduction of two feet (2') of landscaping for a portion along "A" Street is minimal and will allow adequate room for parking and maneuvering area. Plus, a minimum of six percent (6%) of landscaping is being provided on -site where currently none exists. 3. The granting of Conditional Exception No. 86-18 will not be materially detrimental to the public welfare, or injurious to property in the same zone classifications. 4. The granting of the conditional exception will not adversely affect the General Plan of the City of Huntington Beach. CONDITIONS OF APPROVAL - CONDITIONAL EXCEPTION NO. 86-18: 1. The site plan, floor plans, and elevations received and dated March 13, 1986, shall be revised depicting the modifications described herein: a. Revised parking layout as shown on Exhibit "A". 2. All Conditions of Approval of Use Permit No. 86-4 shall be applicable. FINDINGS FOR APPROVAL - USE PERMIT NO. 86-4: 1. The establishment, maintenance and operation of the remodeled commercial building will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of the use permit will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. -10- 4/2/86 - BZA Minutes, H. B. Board of Zoning Adjustments April 2, 1986 Page 11 CONDITIONS OF APPROVAL - USE PERMIT NO. 86-4: 1. The site plan, floor plans, and elevations received and dated March 13, 1986, shall be revised depicting the modifications described herein: a. Revised parking layout as shown on Exhibit "A". b. Building colors indicated on the elevations. 2. Prior to issuance of building permits, applicant shall file a parcel map consolidating the six (6) lots. Said map shall be recorded prior to final inspection. 3. Prior to issuance of building permits, the applicant shall submit the following plans: a. Landscape and irrigation plan to the Department of Development Services and Public Works for review and approval. b. Rooftop Mechanical Equipment Plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. 4. Landscaping shall comply with Article 979 of the Huntington Beach Ordinance Code. 5. Special architectural treatment shall be provided on the rear building walls. Such treatment is subject to approval by the Department of Development Services. 6. A planned sign program shall be approved for all signing within the commercial center pursuant to S. 9760.43 of the Huntington Beach Ordinance Code. a. The major identification signs shall be removed or altered to comply with Article 976 within ninety (90) days. b. All free-standing signs shall be low -profile, monument -type signs. 7. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department except as noted under Conditional Exception No. 86-18. 8. Driveway approaches off "A" Street shall be a minimum of twenty-seven feet (27') in width and shall be of radius type construction. -11- 4/2/86 - BZA Minutes, H. B. Board of Zoning Adjustments April 2, 1986 Page 12 9. "A" Street shall be dedicated and improved per Public Works Standards. 10. On -site fire hydrants shall be provided in number and at locations specified by the Fire Department. 11. There shall be no outside storage of vehicles, vehicle parts, equipment or trailers. 12. The property owner shall agree to shift the southerly drive approach on Beach Boulevard so it straddles the southern property line creating a common driveway with the adjacent southerly parcel at such time as the adjacent gas station property is remodeled and/or recycled. 13. Reciprocal driveway access shall be maintained with the abutting southerly parcel along Beach Boulevard. 14. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 34. The building wall abutting the trash area must be a non-combustible masonry wall or provide sprinkler head from building to protect combustible wall. AYES: Poe, Smith, Strange NOES: Evans, Krejci ABSENT: None CONDITIONAL EXCEPTION NO. 86-12 Applicant: Thomas Drummond, Jr. A request to permit ten foot (10') front setback for a direct entry garage. Subject property is located at 16362 Ardsley Circle (Northeast corner of Ardsley Circle and Humboldt Drive). This request is covered by Categorical Exemption, Class 5, California Environmental Quality Act, 1984. Robert Franklin stated the applicant's original request had been for a ten foot (101) front setback in lieu of the required twenty foot (20'); however, Staff has worked with the applicant who has decided a fifteen foot (151) setback would be acceptable. This property is in R1-CZ Zone but it is exempt from a Coastal Development Permit because it is off the water. Staff further reported the proposed 4,500 Square Foot home does meet the Zoning Code but the lot has an existing swimming pool which is placing constraints on location of the residence. Staff recommended approval with conditions. -12- 4/2/86 - BZA Minutes, H. B. Board of Zoning Adjustments April 2, 1986 Page 13 There was a general discussion relative to possibilities for constructing the residence with the required setbacks since the property in question is a corner lot. Les Evans expressed definite concerns over parking problems in the driveway and Dennis Krejci suggested cantilevering a portion of the Second Floor over the garage or placing the residence closer to the swimming pool. The Public Hearing was opened by Chairman Tom Poe and Thomas Drummond, Architect, was present to represent the property owners. Mr. Drummond stressed the fact there would be roll up garage doors with automatic openers so cars would not encroach into the public right-of-way as Mr. Evans feared. The applicant further stated he had five (5) letters from owners of adjacent property stating they had no objections to the proposed construction. There was no one else present wishing to speak for or against the request so the Public Hearing was closed. Les Evans stated he could find no land -related hardship in a corner lot of approximately 7500 Square Feet in size and felt the owners should be able to place a residence on it without encroachments. Daryl Smith felt the exception should be granted since it was the last parcel to be developed in the area and the adjacent property owners did not object to the construction. SMITH MOVED FOR APPROVAL OF CONDITIONAL EXCEPTION NO. 86-12 WITH CONDITIONS AS OUTLINED BY STAFF. MOTION DIED FOR LACK OF A SECOND. SMITH MOVED FOR APPROVAL OF CONDITIONAL EXCEPTION NO. 86-12 WITH A SEVEN AND ONE-HALF FOOT (7-1/2') SETBACK ON THE GARAGE. MOTION DIED FOR LACK OF A SECOND. UPON MOTION BY EVANS AND SECOND BY KREJCI, CONDITIONAL EXCEPTION NO. 86-12 WAS DENIED WITH THE FOLLOWING FINDINGS, BY THE FOLLOWING VOTE: FINDINGS FOR DENIAL: 1. The existing swimming pool located in the rear of the lot does not constitute a land -related hardship. 2. The approximately 7,450 Square Foot lot does not exhibit special circumstances, including size, shape, topography, location, or surroundings, where the strict application of the Zoning Ordinance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classifications. -13- 4/2/86 - BZA Minutes, H. The granting of a fifteen foot (15') driveway in lieu of a twenty foot (201) driveway is not necessary to preserve the enjoyment of one or more substantial property rights. 4. The granting of Conditional Exception No. 86-12 will be materially detrimental to the public welfare, or injurious, because of the potential encroachment of automobiles into the ultimate right-of-way and potential blocking of the pedestrian walkway. AYES: Evans, Krejci, Poe, Strange NOES: Smith ABSENT: None USE PERMIT NO. 86-15 Applicant: Timothy Lan A request to permit an additional dwelling unit to an existing four (4) unit complex. Subject property is located at 2525 Delaware Street (West side of Delaware Street approximately two hundred fifty-five feet (2551) North of Yorktown Avenue). This request is covered by Categorical Exemption, Class 1, California Environmental Quality Act, 1984. The Staff member, Robert Franklin, reported a continuance was being requested for this Use Permit so it could be heard concurrently with a Conditional Exception which will require Board consideration for private open space in lieu of common open space at this complex. Upon questioning by Michael Strange, Mr. Franklin explained the applicant would more than meet the required open space; however, it would be in private patio areas rather than in common open space. It was further explained by Staff that the additional unit would place the project under apartment standards. The Public Hearing was opened and the applicant, Timothy Lan, was present. Mr. Lan explained he had thought he was purchasing a five (5) unit complex but the City representatives had informed him the fifth unit was a "bootleg" unit which would require proper permits. This formality before the Board was required to legalize his complex and he wanted to comply with the requirements. There was no one else present wishing to speak for or against the project and the Public Hearing was left open. Subject property is located at 7151 Warner Avenue (North side of Warner Avenue approximately four hundred and twenty-five feet (425') East of Golden West Street). This request is covered by Categorical Exemption, Class 11, California Environmental Quality Act, 1984. Mr. Franklin explained the applicant had conducted this type of sale previously and is requesting approval for this year's event. Since the sale is scheduled to start prior to close of the appeal period, the applicant has stated he will stop the sale immediately upon appeal by any interested party. Staff recommended approval with conditions. There was a general discussion regarding parking, traffic circulation through the shopping center, and the location of the balloon. The Public Hearing was opened by Chairman Poe and Steve Watts was present to represent the applicant. Mr. Watts reiterated the information given by Robert Franklin and assured the Board the sale would be stopped if any appeal was made. The Public Hearing was closed as there was no one else present wishing to speak for or against the project. UPON MOTION BY SMITH AND SECOND BY POE, USE PERMIT NO. 86-16 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS FOR APPROVAL: 1. The establishment, maintenance and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. CONDITIONS OF APPROVAL: 1. The conceptual site plan received and dated March 19, 1986, shall be the approved layout. 2. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. 3. Sidewalks shall be maintained at a clear width of four feet (4' ). 4. A certificate of insurance form shall be filed in•the Administrative Services Department in an amount deemed necessary by the Public Liability Claims Coordinator, along with a hold harmless agreement executed by the insured prior to the event'. 5. The applicant shall provide for clean up of the areas after the closing of the event per Orange County Environmental Health Department. 6. A certificate to operate shall be issued by the Director of Development Services as required by S. 9730.80 of the Huntington•Beach Ordinance Code prior to the event. Subject property is located at 16892 Golden West Street (East side of Golden West Street approximately four hundred seventy-five feet (475') North of Warner Avenue). Board of Zoning Adjustments April 2, 1986 Page 17 Staff explained this project was located in the same shopping center as the previous request and the building would be placed on Pad "J". The applicant's approval in 1982 has expired and they are requesting new approval. The layout is basically the same with only minor modifications. Staff recommended approval with conditions and noted that Redevelopment had no problems with the project. The applicant's representative, Paul Tomco, was present. He reiterated Mr. Franklin's statements regarding previous approval and modifications which had been made to the plans. Mr. Tomco expressed concern over the drive-thru lane curbing and parking in that vicinity. A general discussion followed relative to placement of "ONE WAY" arrows, revised corner radius at the end of the drive-thru lane, "RIGHT TURN ONLY" exiting, and traffic circulation. UPON MOTION BY SMITH AND SECOND BY POE, ADMINISTRATIVE REVIEW NO. 86-23 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE:. CONDITIONS OF APPROVAL: 1. A revised site plan shall be submitted depicting the modifications described herein: a. Revised 450 parking spaces and maintain twenty foot (201) drive aisle. b. Additional landscape area in front of 450 parking. C. Show arrow indicating "RIGHT TURN ONLY" and directional signs stating "RIGHT TURN" and "EXIT" only. 2. Prior to issuance of building permits, the applicant shall submit the following plans: a. Landscape and irrigation plan to the Department of Development Services and Public Works for review and approval. b. Rooftop Mechanical Equipment Plan. Said plan shall indicate screening of all rooftop mechanical equipmen.t and shall delineate the type of material proposed to screen said equipment. 3. All free-standing signs shall be low -profile, monument -type signs. 7. Proposed structures shall be architecturally compatible (treatment and surface materials) with existing structures in the shopping center and shall be approved by the Department of Development Services and Redevelopment Staff. 8. Natural gas shall be stubbed in at -the locations of water heaters and central heating units. 9. Low -volume heads shall be used -on all spigots and water faucets. 10. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to -handle them. 11. A detailed soils analysis shall be prepared by a registered Soils Engineer. This analysis shall include on -site soil sampling and laboratory testing of materials to provide detailed recommendations regarding grading, chemical and fill properties; foundations, retaining walls, streets, and utilities. 12. If foil -type insulation is to be used, a fire retardant type shall be installed as approved by the Building Division. 13. The Board of Zoning Adjustments reserves the right to revoke Administrative Review No. 86-23 if any violation of these conditions of the Huntington Beach Ordinance Code occurs. Staff reported the request reflected modifications to previously approved Use Permit No. 85-68. The applicant has not begun construction and would like to change their project. The basic difference is the prior plan had a curb cut and drive to the North end of the property, and the applicant is now proposing a shared drive along Edwards Street. The project will have thirteen percent (13%) landscaping when only six percent (6%) is required. Staff further explained this was a vacant parcel. Daryl Smith asked that timing be more specifically called out as to when the reciprocal drive easement would have to be filed and when other Conditions of Approval would have to be accomplished. Tom Poe stated the Fire Department would require a fire hydrant. The applicant's representative, Terry Clingan, was present and he questioned the condition calling for a maximum separation of two inches (2") between buildings. Mr. Clingan further stated he had a letter from the adjacent property owner saying he was interested in a reciprocal easement with C & H Development Company. The site plan, floor plans, and elevations received and dated March 14, 1986, shall be the approved layout. 2. No electrical panels may be permitted on the South and East building walls. 3. Driveway approaches shall be a -minimum of twenty-seven feet (271) in width and -shall be of radius type construction. a. All unused driveways shall be replaced with a full width sidewalk, curb and gutter subject to Public Works Standards. 9. On -site fire hydrants.,shall,be,provided in;number:and at locations specified by the Fire Department. 10. The applicant shall.meet all applicable local, State, and Federal Fire,Codes, Ordinances, and standards. 11. Installation of=required landscaping and irrigation -systems shall be completed within twelve (12) months. 12. Natural gas shall be stubbed in at the.locations of cooking facilities, water heaters, and central heating units. 13. Low -volume heads shall -be used on all spigots and water faucets. 14.
