Subject property is located on the North side of Center Street East of Gothard Street and adjacent to SPRR right-of-way. This request is covered by Negative Declaration No. 85-15. Staff member, Robert Franklin, stated a written request had been received from the applicant's representative, Ron Pattinson, for a two (2)'week continuance to the meeting of June 4, 1986. Staff concurred with the request. UPON MOTION BY EVANS AND SECOND BY SMITH, USE PERMIT NO. 85-29 WAS CONTINUED, AT THE APPLICANT'S REQUEST, TO THE MEETING OF JUNE 4, 1986, BY THE FOLLOWING VOTE: AYES: Evans, Godfrey, Krejci, Poe, Smith NOES: None ABSENT: None TENTATIVE PARCEL MAP NO. 86-197 (Cont. from May 14, 1986) Applicant: Richard P. Kelter A request to permit consolidation of two (2) lots into one (1) lot and Waiver of Final Parcel Map. Subject property is located on the North side of Pacific Coast Highway approximately fifty feet (501) East of Twenty-first Street. Minutes, H. B. Mr. Franklin reported Planning and Public Works Staff members had reviewed the map and recommended that proper alley dedication be made to Public Works standards. Les Evans stated the property owner is now developing the parcel and there will be other requirements such as installation of public street lights, oil well protective equipment, etc. Mr. Evans further stated the Tentative Parcel Map could be approved but not the Waiver. Glen Godfrey suggested continuing the request until after Planning Commission action on the proposed development. UPON MOTION BY POE AND SECOND BY SMITH, TENTATIVE PARCEL MAP NO. 86-197 WAS CONTINUED, AT THE APPLICANT'S REQUEST, TO THE MEETING OF JUNE 4, 1986, BY THE FOLLOWING VOTE: AYES: Evans, Godfrey, Poe, Smith NOES: None ABSENT: None ABSTAIN: Krejci CONDITIONAL EXCEPTION NO. 86-3 USE PERMIT NO. 86-6 Applicant: Foodmaker, Inc. CE REQUEST: To permit a reduction of turning radius, landscape planter less than ten feet (10'), and the number of required parking spaces proposed for a 2,500 Square Foot Jack in the Box restaurant. UP REQUEST: To demolish existing Jack in the Box restaurant and rebuild an approximate 2,500 Square Foot building. Subject property is located at 16311 Beach Boulevard (Northwest corner of Beach Boulevard and McDonald Street). These requests are covered by Categorical Exemption, Class 1, California Environmental Quality Act, 1984. Staff stated the request is to demolish an existing fast food establishment and rebuild it. The applicant proposes obtaining an adjacent lot and expanding the building; however, Staff feels the applicant is attempting to overbuild the site. Staff recommends denial of both the Conditional Exception and Use Permit requests. Glen Godfrey asked about the proximity of residential units and Staff explained there were commercial properties on two sides with an apartment building within fifty feet (50') at the rear. -2- 5/21/86 - BZA Minutes, H. B. Board of Zoning Adjustments May 21, 1986 Page 3 The Public Hearing was opened by Chairman Tom Poe and the applicant's representative, John Emanuelli, was present. Mr. Emanuelli stated his company had come before the Board of Zoning Adjustments approximately one year previously relative to this project, and the Board had advised acquiring additional adjacent property. Their company representatives have, according to Mr. Emanuelli, obtained a tentative agreement to sell their property to the adjacent property owner in exchange for a lease. The applicant's representative stated they had not reduced the size of the building because it would not be economically feasible. Another company representative, Howard Nath, reiterated their efforts to satisfy the City's requirements. Daryl Smith re-emphasized Staff's statement that the buildable parcel could not accommodate as large a project as the applicant wished to build, -and that the Board had not encouraged such expansion. Further discussion was conducted about the applicant's possibilities for this location. There was no one else present wishing to speak for or against the project so the Public Hearing was closed. UPON MOTION BY SMITH AND SECOND BY EVANS, CONDITIONAL EXCEPTION NO. 86-3 AND USE PERMIT NO. 86-8 WERE DENIED WITH THE FOLLOWING FINDINGS, BY THE FOLLOWING VOTE: FINDINGS FOR DENIAL - CONDITIONAL EXCEPTION NO. 88-3: 1. The lack of required parking spaces, proposed reduction in minimal turning radius, and proposed reduction in minimum landscape planter width will be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. Because there are no of special circumstances applicable to the subject property, including size, shape, topography, location or surroundings, the strict application of the Zoning Ordinance will not deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classifications. 3. The granting of a conditional exception is not necessary in order to preserve the enjoyment of one or more substantial property rights. -3- 5/21/86 - BZA Minutes, H. B. The granting of Conditional Exception No. 86-3 will be materially detrimental to the public welfare, or injurious to property in the same zone classifications. 5. The granting of the conditional exception will adversely affect the General Plan of the City of Huntington Beach. FINDINGS FOR DENIAL - USE PERMIT NO. 86-6: 1. The establishment, maintenance and operation of the proposed 2,500 Square Foot building will be detrimental to: a. The general welfare of persons residing or working.in the vicinity: b. Property and improvements in the vicinity of such use or building. 2. The granting of the use permit will adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is not consistent with the City's General Plan of Land Use. 4. The granting of Use Permit No. 86-6 will be materially detrimental to the public welfare or injurious to property in the same zone classifications. AYES: Evans, Godfrey, Krejci, Poe, Smith NOES: None ABSENT: None USE PERMIT NO. 86-27 NEGATIVE DECLARATION NO. 86-29 Applicant: Hopkins Development Company A request to permit construction of a 6,880 Square Foot commercial building to be located on the Southeast corner of Hamilton Avenue and Bushard Street. This request is covered by Negative Declaration No. 86-29. Staff reported the request is for construction of a retail building on a vacant site which is adjacent to a "7 - Eleven" shopping center, and the applicant has worked with many Staff members in an attempt to satisfy Code stipulations. There are adequate parking spaces to meet Code requirements but Staff has concerns over the parking arrangement and existing driveway atlthe rear of the -4- 5/21/86 - BZA Minutes, H. B. Board of Zoning Adjustments May 21, 1986 Page 5 building. Staff, has a problem with cars having to back across this driveway; however, Staff would recommend approval of the project with conditions. There was an extensive discussion relative to the entrance off Hamilton Avenue, lighting being directed away from adjacent residential areas, driveway approaches, not having restaurants located in the complex, installation of street lights, signage and landscaping. The Public Hearing was opened by Chairman Poe and the applicant's representative, Richard Mount, was present. Mr. Mount presented colored renderings of the proposed project. The statement was made by Mr. Mount that, if the size of the building had to be reduced by an additional five feet (5'), the project would not be economically feasible. Ken Reynolds, General Partner of the adjacent property to the East, spoke in favor of the project and suggested there should be a reciprocal parking arrangement between his property and that of the applicant. An owner of residential property to the South, Vernon Thomas, was concerned over the land fill and the proposed wall along the property. He also expressed concern over the noise which would be created by this development. There was no one else present wishing to speak for or against the project so the Public Hearing was closed. Les'Evans stated he would move for approval of the project and Glen Godfrey said he would second the motion if Mr. Evans would consider an additional condition - that the wall be repaired and surface treated to match the surface of the building. Mr. Evans agreed to this additional condition. UPON MOTION BY EVANS AND SECOND BY GODFREY, NEGATIVE DECLARATION NO. 86-29 WAS APPROVED BY THE FOLLOWING VOTE: AYES: Evans, Godfrey, Krejci, Poe, Smith NOES: None ABSENT: None UPON MOTION BY EVANS AND SECOND BY GODFREY, USE PERMIT NO. 86-27 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: I -5- 5/21/86 - BZA Minutes, H. B. Board of Zoning Adjustments May 21, 1986 Page 6 FINDINGS FOR APPROVAL: 1. The establishment, maintenance and operation of the proposed 6,800 Square Foot retail building will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of the use permit will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated May 21, 1986, shall be revised and resubmitted depicting the modifications described herein: a. Provide ninety degree (900) parking along the rear of the building with minimum twenty-seven foot (271) back-up space. b. Additional two foot (21) wide landscape area shall be provided along Hamilton Avenue frontage. C. Repair and resurface existing private drive. d. Repair and surface treat the existing wall along rear property line to match the proposed building. 2. Remove wall extension at end of the rear wall where Bushard Street and driveway intersect (only back to the existing pilaster). 3. Prior to issuance of building permits, the applicant shall submit the following plans: a. Landscape and irrigation plan to the Department of Development Services and Public Works for review and approval. b. Rooftop Mechanical Equipment Plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. -6- 5/21/86 - BZA Minutes, H. B. Board of Zoning Adjustments May 21, 1986 Page 7 4. Landscaping shall comply with S. 9792 of the Huntington Beach Ordinance Code. 5. A planned sign program shall be approved for all signing within the commercial center pursuant to S. 9760.43 of the Huntington Beach Ordinance Code. 6. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 7. Service roads and fire lanes, as determined by the Fire Department, shall be posted and marked. 8. Maximum separation between building wall and property line shall not exceed two inches (2"). 9. Driveway approaches on Bushard Street shall be a minimum of twenty-seven feet (271) in width and shall be of radius type construction. 10. The building wall along the East property line shall be a four (4) hour fire wall or an automatic fire sprinkler system shall be approved and installed pursuant to Fire Department regulations. 11. Installation of required landscaping and irrigation systems shall be completed within twelve (12) months. 12. All signs shall comply with Article 976 of the Huntington Beach Ordinance Code. All free-standing signs shall be low -profile, monument -type signs. 13. Proposed structures shall be architecturally compatible with existing structures. 14. Natural gas shall be stubbed in at the locations of water heaters and central heating units. 15. Low -volume heads shall be used on all spigots and water faucets. 16. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 17. If lighting is included in the parking lot, high-pressure sodium vapor lamps shall be used for energy savings. All outside lighting shall be directed to prevent "spillage" onto adjacent properties. -7- 5/21/86 - BZA Minutes, H. B. Board of Zoning Adjustments May 21, 1986 Page 8 18. If foil -type insulation is to be used, a fire retardant type shall be installed as approved by the Building Division. 19. The subject property shall enter into irrevocable reciprocal access and parking easement(s) between the subject site and adjacent properties. 20. The Board of Zoning Adjustments reserves the right to revoke this Conditional Use Permit if any violation of these conditions of the Huntington Beach Ordinance Code occurs. 21. All applicable Public Works fees shall be paid prior to issuance of building permits. 22. Restaurants shall be prohibited. 23. Trash enclosure shall have a self -closing door. 24. Wrap "sculpture" treatment on the proposed architectural "POP -Ups" around the building. 25. Street lights shall be provided on Hamilton Avenue and Bushard Street subject to approval of the Department of Public Works. 26. Provide mitigating provisions to meet the one hundred (100) year flood cycle requirements. 27. No loading shall be permitted at the rear of the building. AYES: Evans, Godfrey, Poe, Smith NOES: Krejci ABSENT: None USE PERMIT NO. 86-28 Applicant: Angelo Rinaldi A request to permit the addition of thirty-one hundred (3,100) Square Feet and rearrange the parking area of an existing commercial center. Subject property is located at 22311 Brookhurst Street (West side of Brookhurst Street at intersection with Bushard Street). This request is covered by Categorical Exemption, Class 1, California Environmental Quality Act, 1984. According to Staff, the request is for an addition to a commercial center, and the addition represents approximately one-third of the overall square footage. Staff has worked with the applicant to eliminate deficiencies in landscaping, etc., and Staff recommends approval with conditions. -8.- '5/21/86 - BZA Minutes, H. B. Board of Zoning Adjustments May 21, 1986 Page 9 After Staff's report, Glen Godfrey inquired about the height of their ground signs and Bob Franklin replied they were fifteen feet (151) high. There was also a discussion about a fire sprinkler system having to be installed throughout the entire building. The Public Hearing was opened by Chairman Poe and the applicant, Angelo Rinaldi, was present. Mr. Rinaldi asked if only the new portion of the building would have to be fire sprinklered but Mr. Poe informed him the existing portion would have to be done also. Bob Franklin informed Mr. Rinaldi the Second Floor of the new building would be restricted to general office use only. Daryl Smith expressed concern over loss of some landscaping islands but Staff explained the need for handicap ramps across portions of the islands. There was no one else present wishing to speak for or against the project so the Public Hearing was closed. UPON MOTION BY SMITH AND SECOND BY EVANS, USE PERMIT NO. 86-28 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS FOR APPROVAL: 1. The establishment, maintenance and operation of the proposed 3,180 Square Foot addition will not be detrimental to: a. The general welfare of persons residing or working in -the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of the use permit will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated May 13, 1986, shall be revised and resubmitted depicting the modifications described herein: a. Parking spaces adjacent to the building shall be full size parking spaces. c. Eliminate parallel parking spaces at the rear of the property. d. Provide minimum twenty-four foot (241) wide driveways adjacent to building except for existing nineteen foot (19') wide drive located in the rear of the property. 2. Prior to issuance of building permits, the applicant shall submit the following plans: a. Landscape and irrigation plan to the Department of Development Services and Public Works for review and approval. b. Existing mature trees located at the rear of the property shall remain. 3. Landscaping shall comply with S. 9792 of the Huntington Beach Ordinance Code. 4. A planned sign program shall be approved for all signing within the commercial center pursuant to S. 9760.43 of the Huntington Beach Ordinance Code. 5. AYES: Evans, Godfrey, Krejci, Poe, Smith NOES: None ABSENT: None ADMINISTRATIVE REVIEW NO. 86-32 Applicant: Roger Wilson/Boy Scouts of America, Troop 1 A request to permit a seasonal parking lot from May through September. Subject property is located on Pacific Coast Highway between Ninth Street and Tenth Street. This request is covered by Categorical Exemption, Class 4, California Environmental Quality Act, 1984. Staff informed the Board members this was a request to establish a seasonal parking lot and the lot has been approved for use in previous years. One special concern of the Board was that there not be any stacking of automobiles in the streets or the alley. The applicant, Roger Wilson, was present and stated that moving the cashier's booth to an interior location on the lot would be no Problem; thus alleviating stacking of any cars in the alley. Daryl Smith reiterated the statement there should be no entrance to the lot off Pacific Coast Highway. UPON MOTION BY POE AND SECOND BY EVANS,-ADMINISTRATIVE REVIEW NO. 86-32 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: -11- 5/21/86 - BZA Minutes, H. B. Board of Zoning Adjustments May 21, 1986 Page 12 CONDITIONS OF APPROVAL: 1. Operation of the parking lot covered by Administrative Review No. 86-32 shall be subject to approval by the California Coastal Commission. A letter indicating permission by said Commission shall be placed on file with the City of Huntington Beach prior to opening of the parking lot. 2. The parking lot shall be totally enclosed prior to opening of the parking lot to prevent indiscriminate pedestrian access. 3. Boundaries of such lots shall be marked off and secured by chain or cable, with posts a minimum of three feet (31) in height, solidly built. At a minimum, posts shall consist of four inch by four inch (4" x 411) wood or equivalent metal posts a minimum of one and one-half inches (1-1/2") in diameter securely set in the ground and placed eight feet (81) on center. The posts shall be connected with at least one (1) strand of one-half inch (1/211) cable or chain securely fastened to each post. An opening shall be provided to accommodate vehicle access during business hours. A means of closing and locking of the access opening after business hours shall be provided. i 4. Lots shall be surfaced to meet specifications of the Public Works, Fire and Development Services Departments for support of vehicles and to provide dust control. 5. All aisle dimensions, bay depths, driveway widths, circulation and turning radii shall comply with Article 979 and Fire Department requirements. 6. All striping shall be accomplished and approved prior to.the opening of the lot. 7. The site shall be maintained in a clean condition free from trash and debris. Trash containers shall be placed on the site sufficient to accommodate and store all trash that accumulates on the lot. 8. Lots shall be secured to prevent overnight parking between the closing hour of one business day and the opening hour of the following business day. 9. Directional and informational signs shall be displayed on -site to provide identification of entry into the parking lot and charges for parking and hours of operation. Such signs shall be located at the entrance in a copy size visible to motorists entering the parking lot. On -site signs shall not exceed twelve (12) Square Feet and shall not be more than eight feet (81) high nor less than six feet (61) high. Said signs shall be removed from the site each season no later than the third weekend each September. 11. An approved fire extinguisher shall be provided on the premises during business hours. 12. A Certificate of Insurance and a Hold Harmless Agreement, in an amount deemed necessary by the Administrative Services Department, shall be filed with them at least five (5) days prior to opening the parking lot. 13. The conceptual site plan received and dated May 7, 1986, shall be approved by the Traffic Division of the Department of Public Works for internal circulation and ingress and egress. 14. An inspection shall be made by Land Use and the Public Works Department to insure that the above -imposed conditions have been met prior to opening of business of May 24, 1986. . 15. Surfacing and/or oiling of the parking lot shall be to the satisfaction of the Department of Public Works. 16. No signs, swags, cables, post -signs, etc., shall be allowed in the public right-of-way. 17. Dust control shall be provided subject to Public Works requirements. 18. The cashier's booth shall be located so as to prevent stacking into the alley. AYES: Evans, Godfrey, Krejci, Poe, Smith NOES: None ABSENT: None ADMINISTRATIVE REVIEW NO. 86-30 Applicant: Lardas Foods, Inc. A request to permit the addition of three hundred eighty (380) Square Feet of floor area for handicap rest rooms and a cashier's booth. Subject property is located at 20362 Beach Boulevard (East side of Beach Boulevard -approximately four hundred sixty feet (4601) North of Indianapolis Avenue. -13- 5/21/86 - BZA Minutes, H. B. Staff reported a letter had been received from the applicant requesting a two (2) week continuance on their request. Staff concurred with the request. UPON MOTION BY GODFREY AND SECOND BY EVANS, ADMINISTRATIVE REVIEW NO. 86-30 WAS CONTINUED TO THE MEETING OF JUNE 41 19861 BY THE FOLLOWING VOTE: AYES: Evans, Godfrey, Krejci, Poe, Smith NOES: None ABSENT: None ADMINISTRATIVE REVIEW NO. 86-35 Applicant: The Kar Kare Company A request to permit a temporary parking lot. Subject property is located on the North side of Orange Avenue between Fifth Street and Sixth Street. This request is covered by Categorical Exemption, Class 11, California Environmental Quality Act, 1984. Staff reported the applicant had, in previous years, received approval for a parking lot at this location for operation on three' holiday weekends - Memorial Day, July 4th, and Labor Day. Staff recommended approval with conditions. The applicant's representative, Ed Bonanni, was present and reiterated the statement the lot would be in use for only ten (10) days during the -summer months. Mr. Bonanni stated that oiling the lot for only ten (10) days would be extremely expensive. Daryl Smith concurred and stated dust control should be no problem because of the heavy growth on the lot. It was suggested by Mr. Smith that the condition be amended to only require special "dust control" measures if determined by the Public Works Department to be necessary. There was a discussion, initiated by Dennis Krejci, relative to the necessity of prohibiting pedestrian access to'the lot as referred to in the suggested conditions. UPON MOTION BY SMITH AND SECOND BY GODFREY, ADMINISTRATIVE REVIEW NO. 86-35 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: -14- 5/21/86 - BZA Minutes, H. B. Such signs shall be located at the entrance in a copy size visible to motorists entering the parking lot. On -site signs shall not exceed twelve (12) Square Feet and shall not be more than eight feet (81) high nor less than six feet (61) high. Said signs shall be removed from the site each season no later than the third weekend each September. 9. A Certificate of Insurance and a Hold Harmless Agreement, in an amount deemed necessary by the Administrative Services Department, shall be filed with them at least five (5) days prior to opening the parking lot. 11. The site plan received and dated May 13, 1986, shall be the approved plan. 12. An inspection shall be made by Land Use and the Public Works Department to insure that the above -imposed conditions have been met prior to opening of business. 13. No signs, swags, cables, post -signs, etc., shall be allowed in the public right-of-way. 14. Dust control shall be provided subject to Public Works requirements.
