Kelter A request to permit consolidation -of two (2) lots into one (1) lot. Subject property is located on the North side of Pacific Coast Highway approximately fifty feet (501) East of Twenty-first Street. This- request is covered by Categorical Exemption, Class 5, California Environmental -Quality Act, 1984. Staff member, Robert Franklin, reported a letter had been received from the applicant requesting that his application be tabled to a date uncertain so he might incorporate adjacent lots next to his site for approval by the Planning Commission. The applicant also stated he would waive the mandatory processing time. Staff concurred with the request The applicant was not present and the letter was accepted. Board of Zoning Adjustments June`, 18, _ 1986 Page-2.• COASTAL DEVELOPMENT PERMIT NO. 86-12 Applicant: Frank'F: Mirjahangir- A request to permit an eight hundred and five '(805) Square Foot additibn;to an existing single family dwelling. Subject property is located -at 16521 Carousel Lane (North side of Carousel Lane'at intersection with Wanderer Lane). This request is covered by Categorical Exemption, Class 1, California Environmental Quality Act, 1984. Staff stated'the,request is to'.create- an addition -to•an existing residence'in-an-R1-CZ Zone.' -The addition would include a deck with wind screewhich-constitutes whic-constitutes more-than'ten'-percent of the existing building; therefore,- the Coastal Commission requires a`'permit. The wind screen would',be-on a cantilevered area and creates a problem. Glen Godfrey asked if Staff had checked with the individual handling the City's Coastal -Commission requests to find out whether this was still the proper procedure for processing requests. Staff replied he had not. Staff said if it was not the proper procedure, it could be brought back to -the Board for further review. Daryl Smith arrived at the meeting at this point - 1:40 P.M. The Acting Chairman,'Dennis Krejci, open -ed the Public Hearing. The owner of the property, George Robins, was present to represent the applicant. -Mr. Robins stated he had no questions for -the Board as he had expected Mr.-Mirjahangir to be at the meeting.' There was no one else present wishing to speak so the Public Hearing was closed. UPON MOTION BY EVANS AND SECOND BY VINCENT, COASTAL DEVELOPMENT PERMIT NO. 86-12_WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE -FOLLOWING VOTE: FINDINGS FOR APPROVAL: 1. The proposed. 805 Square Foot addition to an existing single family residence conforms with the plans, policies, requirements and standards of the Coastal Element of the General Plan. 2. The Coastal Development Permit is consistent with the CZ suffix zoning requirements, the R1 Zoning District, as well as other provisions of the Huntington Beach Ordinance Code applicable to the property. -2- 6/18/86 - BZA J 1 Minutes, H. At the time of occupancy, the proposed single family residence can be provided with infrastructure in a manner that -is consistent with the Coastal Element of the General Plan. 4. The proposed single family residence conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. CONDITIONS OF APPROVAL: 1. The site plan, floor plan, and elevations dated June 2, 1986, shall be the approved layout. 2. The proposed addition shall match the existing development in terms of building materials, colors and architecture. 3.:. The addition shall comply with the Huntington Beach Ordinance Code and Building Code. 4.'Prior to the issuance of building permits, the property owner - shall sign, notarize, and record with the County Recorder a "Letter of Agreement" assuring that the single family'residence will be maintained as one (1) dwelling unit. AYES: Evans, Godfrey, Krejci, Vincent NOES: None ABSENT: None ABSTAIN: Smith _COASTAL DEVELOPMENT PERMIT NO. 86-18 Applicant: -Harry Jordan A request to permit a five hundred and twelve (512) Square Foot addition to an existing single family dwelling. Subject property is located at 16662 Baruna Lane (East side of Baruna Lane approximately two hundred feet (2001) North of Sea Witch Lane,). This request is covered by.Categorical Exemption, Class 1, California Environmental Quality Act, 1984. Staff reported this is a request for an addition to a two .story. residence in Huntington Harbour. The proposed structure will be well below" the lot coverage allowed by Code. The applicant desires. to enclose an existing balcony to provide space for -medical machinery which will be required. Staff recommends approval with conditions. The Public Hearing was opened and Harry Jordan, was present. Mr._Jordan reiterated the need for the space -for medical equipment and asked the Board for approval of his request. " Jim Vincent asked where the balcony was located on the residence and Staff replied it was on the North side of the building. UPON MOTION BY SMITH AND SECOND BY EVANS, COASTAL DEVELOPMENT PERMIT NO. 86-18 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS FOR APPROVAL: 1 .- The proposed 512- Square Foot addition, to .an �e`xist'ing'si'n'gl'e family residence conforms with the plans po1ic"ies, requirements and standards of therCoastai'Element of the General Plan. 2. Board of Zoning Adjustments June 18, 1986 Page 5 CONDITIONAL EXCEPTION NO. 86-29 Applicant: Charles L. Hawksford A request to permit a reduction of minimum open space dimension from fifteen feet (151) to ten feet (101). Subject property is located at 5162 Stallion Circle (South side of Stallion Circle approximately one hundred twenty-five feet (1251) East of Roosevelt Lane). This request is covered by Categorical Exemption, Class 5, California Environmental Quality Act, 1984. According to Staff, the request is for reduction of the minimum open space requirement to erect an addition at the rear of the existing residence. Staff explained his calculations under the restrictive section of the Code and the alternatives open to the applicant. He further stated the applicant would have a large open space area in the front portion of the property. Staff recommended approval of the request with conditions. Les Evans asked if any setback changes would be involved and Staff said there would be none. Glen Godfrey stated he would like to have the block wall constructed prior to final inspection on the addition. The Public Hearing was opened by Mr. Krejci and Kathy Hawksford was present to represent the applicant. Ms. Hawksford stated -the. addition would not detract from their neighborhood and, since it was a one-story addition, they would not be looking into neighbor's yards. Ms. Hawksford agreed to the conditions as discussed. There was no one else present wishing to speak so the Public Hearing was closed. UPON MOTION;BY SMITH AND SECOND BY EVANS, CONDITIONAL EXCEPTION NO. 86-29 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS FOR APPROVAL: 1. The establishment and maintenance of the reduction of the minimum open space dimension from fifteen feet (15')%to ten feet (101) will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of the conditional exception will not adversely affect the General Plan of the City of Huntington Beach. -5- 6/18/86 - BZA Minutes,- H. B. Granting of reduction in open space minimum dimension of fifteen feet (15' )' 'to ten' feet (10' ) will 'riot, reduce the required total open space area (900'Square Feet). 5. The granting,of the conditional exception will not adversely affect the.-Gene'ral= Plan of the City of Huntington Beach. CONDITIONS-OF'APPROVAL: = 1. The floor plans and elevations received and dated June 5,11986, shall -be the' approved layout." 2.- A revised site plan shall be submitted depicting the modifications described herein: = a. Four foot (41) high block wall at the fifteen foot (151) front setback shall -be constructed prior to final' - inspection -of the room addition. 3. The development shall comply with All applicable provisions of the Ordinance Code, Building Division, and Fire Department. 4.' Proposed addition shall be architecturally compatible with - existing structure. 5. Natural gas shall be stubbed in at the locations of.cooking facilities,.water-heaters, and central heating units. 6. Low -volume heads shall be used on all spigots and water faucets. 7. All -building spoils, such as -unusable lumber, -wire', pipe, -and other surplus -or --unusable material, shall -be disposed of,at an. ,off -site facility equipped.to handlethem.• 8. If foil -type -insulation is to be used,•a-fire retardant type shall be installed as.approved-by the,Building Division. 9. Board of Zoning Adjustments June 18, 1986 Page 7 CONDITIONAL EXCEPTION NO. 86-38 Applicant: Joel T. Peck A request to permit reduction of required twenty foot (201) minimum open space dimension to 12.5 feet and 10.5 feet in two (2) areas of rear yard for an addition to an existing single family dwelling. Subject property is located at 10342 Shangri-La Drive (South side of Shangri-La Drive approximately one hundred thirty-five feet (135'-) East of�Lexington Lane). This request is covered by Categorical Exemption, Class 5, California Environmental Quality Act, 1984. Staff reported the request was for reduction of the minimum open space dimension in two (2) areas of the rear yard for an addition to the residence. Staff further explained there had been a previous addition to the residence which met the Code but this addition would be in the designated open space area. The ten foot (10') rear yard setback will be maintained and everything would meet the Code with the exception of the open space requirement. The lot is of standard size and Staff can find no land -related hardship for granting the variance. Staff recommends denial of the request. Daryl Smith pointed out the applicant has twenty-six feet (261) from the rear property line to the building wall and additional space on the side. Staff again explained the open space requirements and the applicant's alternatives. The Public Hearing was opened and Joel T. Peck was present. ' Mr. Peck, said Staff had explained the case very clearly but'the"home owners feel there is a great need for this additional space. He further explained the previous addition had been for a family room which is now too small. There are teenage daughters in the family has and'the parents want them home instead of elsewhere. There -was no one else present wishing to,speak so the Public Hearing was closed. Daryl Smith stated he had difficulty understanding the difference between ,the previous request and this one, and why Staff had recommended approval of one and not the other. Furthermore, according to Mr. Smith, the applicant has a lot of open space area but not in the proper configuration and he felt the applicant's request is reasonable. Mr. Smith also said he would move for approval of the project with conditions. Glen Godfrey stated he might consider seconding the motion if Mr. Smith would.add.a condition stipulating that the architectural features be integrated so -it did not look like an "add -on'. Mr. Godfrey i suggested building the new addition with a high ceiling, but the applicant said he did not,believe that would work'. UPON MOTION BY SMITH AND,SECOND BY•GODFREY, CONDITIONAL EXCEPTION NO. 86-38 WAS APPROVED -WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING -VOTE: FINDINGS FOR APPROVAL: 1. Ellis/Seacliff Village A request to permit a temporary outdoor event on July 4, 1986, from 11:00 A.M. to 3:00 P.M. Subject property is located at 2205 Main Street,(Northwest corner of Main Street and Yorktown'Avenue). This request is covered by Categorical Exemption, Class ll, California Environmental Quality Act, 1984. Staff explained this request -is for an outdoor event on July 4th and Staff has contacted the Police and Fire Departments. The Police Department has no problem with allowing the event but the Fire Department wants their fire lanes protected. Staff would recommend approval of the request with conditions, including meeting ABC requirements for any alcoholic beverage uses, removal of signs after the event, and the Fire Department request. The applicant, William R. Ellis, was present'and stated•they had • blocked off the area in question at the previous year's event. -He- mentioned that the area between Lucky's Market and the drive-in would be roped off to comply with ABC's request. Upon questioning by Glen Godfrey, -Mr. Ellis stated there'would be entertainment at - the event similar to last year. Dennis Krejci expressed concern over the internal circulation pattern and maintaining open fire lanes. A discussion ensued" between the applicant and Board members to insure that -Fire Department concerns,were being met.1. A layout and circulation plan -shall -.be approved by the Fire Department -prior -to the event.---Fire-access-lanes-shall be maintained..:- 7. An on -site inspection by the Fire Department may be required prior to the event. 8. Appropriate temporary signs for the direction of traffic and on -site --parking shall be provided by the applicant. --The signs, location and content shall be as required by -the Traffic - Division of.. the Police .Department. The subject :signage,-shall be removed immediately after the event has.been concluded. 9. If -applicable, the applicant shall submit-to-the'Police Department a request -to operate "games of chance",for their review and approval prior to the event. 10. Any outside cooking facilities shall be approved as to type and location by the Fire Department prior to the event. 12. A Certificate to Operate shall be issued by the Department of ,Development Services prior to operation of the event. 13. An area shall be designed and roped off for beer and wine, controlled by a security person with signs. The applicant should check with the Police Department for particulars prior to the event.
