Applicant: Pacific Coast Corporation
A request to permit an 113,000 Square Foot mini -storage facility.
Subject property is located on the North side of Center Street just
East of Gothard Street and adjacent to SPPR right-of-way.
This request is covered by Negative Declaration No. 85-15.
Staff.member, Robert Franklin, stated a letter had been received
from the applicant requesting another two -week continuance based on
' the fact the development agreement is being formed and may soon be
approved by the Redevelopment Agency. Staff recommended approval of
the continuance.

CONDITIONAL EXCEPTION NO. 86-51
Applicant: Gerald Sy Golub
A request to permit a nine foot (91) driveway width in lieu of ten
foot (101) width, and to permit a guest parking space to be located
within the front yard setback area. Subject property is located at
8092 La Palma Avenue (South side of La Palma Avenue approximately
eighty feet (801) East of Patterson Lane).
This request is covered by Categorical Exemption, Class 5,
California Environmental Quality Act, 1984.
Staff reported this request was very similar to a Conditional
Exception approved by the Board in 1985. The applicant's plans were
in plan check but time has expired on that request. There )re, the
applicant is reapplying for approval of the Conditional Exception.
Staff would recommend approval with the same basic conditions as
previously imposed.
Upon questioning by Dennis Krejci, Staff explained he had made
several unsuccessful attempts to contact the applicant by telephone
to apprise him of the conditions; and the applicant had just arrived
at the meeting so he was not aware of the conditions until they were
read at the meeting.
Glen Godfrey asked if the applicant had been successful in obtaining
a reciprocal driveway agreement with the adjoining neighbor and
Staff replied that, to his knowledge, there had been no such
agreement filed.
The Public Hearing was opened by Vice Chairman Dennis Krejci and the
applicant , Gerald Sy Golub, was present. The applicant explained
their proposal to attach the garage to the existing residence at the
roof with a small breezeway patio area between the two buildings.
The two (2) unit addition at the rear would be attached to the
existing dwelling and there would be intensified landscaping on the
site. The applicant stressed the fact the entire area would be
improved and upgraded by the addition of these structures.
Jim Vincent expressed concern over the length of the driveway and
the distance from an available fire hydrant. Mr. Vincent suggested
the rear unit would be need fire sprinklers and the applicant
replied that would be no problem. Glen Godfrey inquired about the
fence which had existed and Dennis Krejci stated there was nothing
to prevent the adjacent neighbor from rebuilding the fence on the
property line along the driveway area. Mr. Godfrey stated the only
feasible way of handling the situation was with the reciprocal
driveway easement.

There was no one else present wishing to speak for or against the
project so the Public Hearing was closed.
There were further discussions regarding the nine foot:.(9') width of
the driveway, the need for a reduction of two feet (2') in the front
yard setback area to accommodate an on -site guest parking space, and
the need for sprinklering the new units on the rear of the site.
VINCENT MOVED FOR APPROVAL OF CONDITIONAL EXCEPTION NO. 86-51 WITH

1. Because of the size, configuration, shape and lack of unique
topographic features of the subject property, there does not
appear to be exceptional or extraordinary circumstances or
conditions applicable to the land, buildings or premises
involved that does not apply generally to property or class of
uses in the same district.
2. Granting of Conditional Exception No. 86-51 would constitute a
special privilege inconsistent with limitations upon properties
in the vicinity.
3. Exceptional circumstances do not apply that deprive the subject
property of privileges enjoyed by other properties in the same
zone classifications.
4. Encroachment into the required setback is not compatible with
setbacks established for properties to the East and would
constitute a special privilege inconsistent with limitations
upon those properties.

Glen Godfrey asked that the Minutes reflect his vote against the
project was consistent with his original vote for Denial since he
felt the only way the project could work was with a reciprocal
driveway easement.

CONDITIONAL EXCEPTION NO. 86-53
Applicant: Sandra J. Roe
A request to permit the placement of a six foot (6') high fence at a
three foot (31) front setback (Code requires twelve feet). Subject
property is located at 604 Sixteenth Street (East side of Sixteenth
Street approximately twenty-five feet (25') North of Acacia Avenue).
This request is covered by Categorical Exemption, Class 5,
California Environmental Quality Act, 1984.
According to Staff, the request is to recognize an existing wood
fence at the three foot (3') front setback in lieu of twelve feet
(12!) which is required by Code, and to allow the applicant to
replace it with a six foot (61) high fence. Staff further sk ted he
had researched the address and had found a building permit issued in
1977 for the fence. The current situation is in conflict with the
present Zoning Code since the dwelling was built under the Town Lot
requirements. Staff stated he could find no special circumstances
for granting a Conditional Exception and recommended Denial.
Glen Godfrey asked how this situation had been brought to light and
Staff replied it was through checking of the area by Land Use The
applicant had then requested the Conditional Exception.
The Public Hearing was opened and the applicant, Sandra J. Roe, was
present. Ms. Roe stated they needed the new six foot (61) high
fence to allow a patio area for privacy and also that they had two
(2) large dogs which could jump the J ower fence. Ms. Roe further
explained that a dog in the area had recently jumped a fence and
bitten a neighbor, and that the Postal Department had informed them
they would not deliver mail.
Mark Chernoff stated he lived across the street from Ms. Roe and he.
was in favor of allowing the higher fence because of all the
problems the neighborhood was experiencing with teenagers running
across the yards, throwing debris and trash into the yards, punk
rock problems, etc. Mr. Chernoff felt the higher fences would be a
safety factor for better protection of their families and property.
There was no one else present wishing to speak for or against the
request so the Public Hearing was closed.
Dennis Krejci asked what Planning Staff's position would be
concerning solid fencing interspiced with wrought iron. Glen
Godfrey stated that type of fencing would not be architecturally
compatible with the residence.

Les Evans stated he did not see how the Board could approve such a
variance request since it would be setting a precedent and that the
applicant had the right of appeal to the Planning Commission and
City Council. Mr. Evans stated the Board should either deny it or
request a Code change. Jim Vincent suggested referring the item to
the Planning Commission. Mr. Evans said a referral would indicate
the Board's approval of this type of variance and a Code change, and
he did not feel that way. Mr. Vincent did not agree with Mr. Evans'
interpretation.

A request to permit a triplex (which includes a one (1) unit density
bonus) on two (2) adjacent lots. Subject property is located at
7822-7832 Alhambra Drive (South side of Alhambra Drive approximately
seven hundred twenty-five feet (7251) West of Beach Boulevard).
This request is covered by Negative Declaration No. 86-38.

Staff reported he had received a letter from the applicant
requesting that the item be tabled until conclusion of City Council
action on a zoning change for the area. If the zone change is
approved, the applicant will still need a Use Permit but would be
allowed to have a triplex on each lot. Staff is supporting the
applicant's request with conditions...
Dennis Krejci asked if the project would automatically be approved
if not acted upon by September 13, 1986. Mr. Franklin felt the
mandatory processing date would be waived and Glen Godfrey stated
the tabling would not validate the mandatory processing time.
Les Evans suggested that the Board might table the application at
the applicant's request; and, if the application was not withdrawn
or reactivated within the time limit, the Board's action wc,1d be
Denial. Staff said the Use Permit and Negative Declaration should
both come back to the Board for their action.
The Public Hearing was opened and there was no one present to
represent the applicant. There was no one else present wishing to
speak for or against the project and the Public Hearing was left
open.

USE PERMIT NO. 86-52
Applicant: Ed Giardina/St. Bonaventure Church
A request to permit an annual carnival on October 10, 11, and 12,
1986, at the St. Bonaventure Church. Subject property is located at
16400 Springdale Street (Northeast corner of Springdale Street and
Heil Avenue).
This request is covered by Categorical Exemption, Class 4,
California Environmental Quality Act, 1984.
According to Staff, this request is the same as made last year for a
three (3) day carnival at a Church site surrounded by residential
buildings. Staff has checked with the Police and other departments,
and memos have been received agreeing to approval of the request
with the same conditions as imposed last year.

The Public Hearing'was'bpened and Ed Giardina was present to
represent St. Bonaventure Church. Mr. Giardina stated the only
question they had was on the hours of operation and requested they
be allowed to open at 1:00 P.M. on Sunday rather than 2:00 P.M.
Virginia Mason, 6071 Orlando Drive, was present and objected to the
change in hours of operation as requested by Mr. Giardina.
Ms. Mason stated the time should remain at 2:00 P.M. because of the
parking and traffic problems created by people leaving Mass services
and arriving at the carnival at the same time. She also expressed
concerns relative to shift changes of the Police Department
personnel. According to Ms. Mason, the arriving officers were not
properly advised by the departing officers of procedures to be
followed in directing traffic, streets to be barricaded, etc.
Josephine Peck Calkin, 16342 Angler Lane, said the City Council had
told the Church they could have the carnival for one year mealy, and
wanted to know why the residents had to go through this herring
every year. Bob Franklin explained this type of temporary event
request did not even require a Public Hearing and the neighbors were
notified only as a courtesy. Glen Godfrey explained the City
Council had only suggested the affair might be getting too big for
-the neighborhood and, if there were serious problems, another
location might have to be found for the event. However, Mr. Godfrey
said he did not believe it was the intent of the City Council to
limit it to just one year.
Another resident, Joan Armstrong, 16382 Bradbury Lane, expressed
concern over problems created previously by construction on the
Church site at the same time of the carnival. Mr. Giardina assured
her there would be no construction going on and they had just
resurfaced the parking lot.
There was no one else present wishing to speak for or against the
project so the Public Hearing was closed.
In compliance with Ms. Mason's request, Glen Godfrey suggested the
starting hours on Sunday remain at 2:00 P.M. and Jim Vincent
concurred. Also, Mr. Godfrey felt the Police officers should be
directed by their Supervisors as to the proper procedures for
uniformity in changing shifts.

CONDITIONS OF APPROVAL:
1. Prior to the event, the following shall be complet is
a. All necessary electrical permits shall be obtained.
b. The applicant shall obtain clearance from the Public
Liability•Claims Coordinator, Administrative Services
Department, and/or shall provide a Certificate of Insurance
and Hold Harmless Agreement to be executed"at least five
(5) days prior to the event.
c. An on -site inspection by the Fire Department shall be
required prior to the event. The applicant shall apply for
a Fire Department permit at least seven (7) days prior to
the event to allow for this inspection and to allow
sufficient time for final documents to be issued. The
applicant shall also submit, along with the application, a
detailed site plan indicating fire lanes and booth, ride,
and large equipment locations. The applicant shall meet
with a Fire Department representative at time of issuance
of permit to receive approval of the submitted site plan.
The site shall be inspected for compliance prior to
10:00 A.M. on the opening day.
d. Submittal of a written agreement form the Redeemer Lutheran
Church across the street for the provision of one hundred
fifty (150) spaces in addition to the three hundred eleven
(311) parking spaces provided on the Church site itself.
e. Prior to operation of any equipment used in conjunction
with the amusement rides, the City shall be in receipt of
State certification and permits, showing inspection within
one (1) year period, stating that the rides meet all
requirements of the State Industrial Safety Division.

f. The Church shall provide a name and telephone number of a
contact person with whom the local residents may make
contact about any complaints they may have on the festival
activities between the dates of October 10 through
October 12, 1986.
g. The Church shall distribute a letter to the affected
residents indicating the contact person's name and a map
showing what streets will be barricaded.
h. A Certificate to Operate shall be issued by the Director of
Development Services.
2. The hours of operation of the festival shall be limitrx to the
following: Noon to 9:30 P.M. on Friday, 10:00 A.M. t.
9:30 P.M. on Saturday, and 2:00 P.M. to 9:30 P.M. on Sunday.
3. All operations of the festival, including machinery other than
necessary refrigeration units, shall desist between the hours
of 9:30 P.M. and 8:00 A.M.
4. Use of amplifiers, speakers, musical instruments, and playing
of recorded music are to be discontinued as of 9:00 P.M. each
evening.
5. All activity on the site or clean-up activity off site shall be
shut down by 11:00 P.M. All activities shall conform to the
provisions of the Huntington Beach Ordinance Code regarding
noise.
6. In number, as determined by the Police Chief, uniformed
officers shall be provided on site during the operation hours
of the event except that there shall be a minimum of ten (10)
security officers and one (1) supervising officer on site from
6:00 P.M. to the close of the event on Friday, October 10,
1986, and from 2:00 P.M. to closing on Saturday and Sunday,
October 11 and 12, 1986. The contract for the officers shall
include an one-half hour period before and after the scheduled
duty time for briefing and travel time. Where there may not be
a sufficient number of Huntington Beach Police officers, the
applicant shall hire private security guards. The applicant
shall be required to meet with the Patrol Sergeant to ensure
standard enforcement between shifts.
7. Two (2) people from the Church shall patrol the adjacent
surrounding neighborhoods during the hours of the festival
operation to control trespassing and littering from occurring;
and additional Church personnel shall monitor Springdale Avenue
to deter patrons from jaywalking to reach the carnival or
parking lot.

8. The Board recommends that an announcement be made in the Church
to ask the parishioners not to park on the neighborhood
streets, and that workers at the event itself be encouraged to
park in the Lutheran Church parking lot.
9. The following traffic, circulation, and on -site parking
provisions shall be made during the event:
a. Barricades shall be placed at the intersections of
Springdale Street and Brassie Circle, Springdale Street and
Orlando Drive, Heil Avenue and Bradbury Lane, Orlando Drive
and Bradbury Lane, and Orlando Drive and Angler Lane. The
applicant shall provide, at their expense, uniformed police
officers to man the barricades at all times du ing the
hours of operation at all locations except Or! ndo Drive
and Angler Lane, one (1) hour prior to the opening of the
festival to the close of each day (to be approved by the
Traffic Engineer and Traffic Division of the Police
Department). Barricades shall be delivered and available
for placement one (1) day prior to the event.
b. Appropriate signs (temporary) for the direction of traffic
and on -site parking shall be provided by the applicant.
Said signs, location, and content to be as recommended by
the Traffic Division of the Police Department.
c. The vehicular access off Orlando Drive and Bradbury Lane
shall be secured and not used for ingress/egress to the
site except for emergency purposes.
d. All vehicular ingress and egress to the site shall be via
the Church driveway located mid -block on Springdale Street.
e. Vehicular parking shall be prohibited on the driveway
leading to Orlando Drive so that emergency access will not
be impeded.
f. Some additional temporary fencing shall be erected along
Bradbury Lane to close off any access from that street into
the festival grounds.
g. Any refrigeration truck to be placed on site shall be
located as near as possible to the intersection of
Springdale Street and Heil Avenue to minimize noise from
the unit.
h. The police shall place barricades at the left turn lane on
Orlando Drive to prevent any turning into the Church
property at this location.

10. All equipment and manpower required by Condition Nos. 6 and
9. a. shall be provided at the applicant's expense.
11. No structures, booths, etc., shall be erected on the site
sooner than two (2) weeks prior to the event, and all evidence
of the activity (booths, rides, and other material shall be
completely removed from the site within two (2) weeks of
closing of the festival. All rental equipment shall be removed
from the site within one (1) week of closing of the festival.
12. The applicant shall provide professional clean-up crews to
clear the adjacent streets of trash and debris each evening
after closing of the activity.
13. All trash, debris, and garbage, as well as special dL.ipsters,
shall be removed from the site within two (2) days of the
closing of the festival.
14. Alcoholic beverage sales are subject to review and approval of
the Alcoholic Beverage Control Board and issuance of a license.
15. In the event there are any violations of the foregoing
conditions or any violations of live safety codes, the festival
activity will be terminated and not permitted to reopen.

USE PERMIT NO. 86-57
Applicant: Bill F. Mathis
A request to permit an outdoor sale in an existing parking area from
August 9 to August 23, 1986. Subject property is located at
17881 Beach Boulevard (West side of Beach Boulevard approximately
four hundred feet (4001) North of Talbert Avenue).
This request is covered by Categorical Exemption, Class 11,
California Environmental Quality Act, 1984.
Staff explained this request was for an outdoor sale for fifteen
(15) days and the request has been circulated to the Police and
other departments. The display will utilize four (4) parking spaces
but there is ample parking in the rear of the building. The Fire
Department has concerns regarding location of the tents and the
tents must be of non-flammable construction. Staff would recommend
approval with conditions.

The Public Hearing was opened and Bill F. Mathis, the applicant, was
present. Mr. Mathis explained he had conducted this same type of
sale for several years at his location in another city without any
problems. He further stated the tents would have openings on each
side, would be placed in front of the store, the store would be
closed for remodeling during the sale, and a security guard would
protect the area at night.
Jim Vincent stated he had very serious concerns over the number and
placement of the tents and clearance for fire truck access.
Mr. Vincent said he had been at the location and did not fc:al there
was ample space for six (6) tents. He further requested a more
detailed site plan and suggested limiting the tents to four (4)
rather than six (6). Mr. Mathis said he had measured the location
and there was room for the six (6) tents. Les Evans stat( he had
not been to the location and would defer to Mr. Vincent and
Mr. Krejci in this decision.
Dennis Krejci broached the subject of remodeling the building and
reminded the applicant he would need to obtain building permits.
Mr. Mathis said he was trying to coordinate all facets of the
procedure.
There was no one else present wishing to speak for or against the
project so the Public Hearing was closed.
The Board was reminded the appeal period, would not be over before
the applicant started the outdoor sale and a discussion followed.
The applicant agreed to cease all operations at the site in the
event an appeal was filed.
UPON MOTION BY KREJCI AND SECOND BY GODFREY, USE PERMIT NO. 86-57
WAS APPROVED WITH AMENDED FINDINGS AND CONDITIONS, BY THE FOLLOWING
VOTE:
CONDITIONS OF APPROVAL:
1. A detailed site plan shall be provided and shall be subject to
approval of the Fire Department.
2. The applicant shall obtain clearance from the Public Liability
Claims Coordinator, Administrative Services Department, and/or
shall provide a Certificate of Insurance and Hold Harmless
Agreement to be executed at least five (5) days prior to the
event.
3. A Certificate to Operate, as required by 5.9730.80 of the
Ordinance Code, shall be issued prior to the event.

4. The applicant shall provide for clean up of the area after the
closing of the event.
5. The applicant shall obtain all applicable permits.
6. Tents shall be made of flame resistant material.
7. The applicant shall be restricted to placement of only four (4)
tents - two (2) on the North side of the walkway and two (2) on
the South side of the walkway.
8. The walkway from front entrance to the sidewalk shall remain
free and clear to the sky.
9. The applicant shall close down the operation and r nove all
tents and merchandise from the site in the event any interested
person shall appeal during the ten (10) day appeal period.
10. A revised site plan shall be submitted to the satisfaction of
the Fire Department.

TENTATIVE PARCEL MAP NO. 86-288
Applicant: Erich Ziebarth
A request to consolidate two (2) parcels into one (1) parcel.
Subject property is located at 1008 Huntington Street (East side of
Huntington Street approximately fifty-five feet (551) North of
Joliet Avenue).
This request is covered by Categorical Exemption, Class 5,
California Environmental Quality Act, 1984.
Staff explained the request is for consolidation of two (2) parcels
into one (1) parcel so the applicant can add onto an existing
structure. Staff has reviewed the map with Public Works and the
alley dedication is on record. The existing garage at the rear of
the property will be removed and Staff is recommending approval of a
waiver.
The applicant's representative, Carol Herd Southern, was present and
accepted the conditions as read.

1. The proposed consolidation complies with the requirements as to
area, improvement and design, flood and water drainage control,
appropriate and approved public roads, sewer and water
facilities, environmental protection, and other requirements of
Article 992 of the Subdivision Section of the Ordinance Code.

Staff assured Les Evans improvements were installed. Mr. Evans said
he would vote for approval of the Waiver but would not sign the map
until he had verified the information.
The applicant, Jeff Palmer, was present and agreed to the conditions
as presented.
