NOT READY FOR APPROVAL.
REGULAR AGENDA ITEMS:
CONDITIONAL EXCEPTION NO. 86-62
Applicant: Robert J. and Ste hanie J. Williams
A request to permit the reduction of a front yard setback from the
required fifteen feet (15') to twelve feet (12'). Subject property
is located at 18042 Shoreview Circle (East side of Shoreview Circle
approximately one hundred thirty feet (1301) North of Lakeview
Drive),
This request is covered by Categorical Exemption, Class 5,
California Environmental Quality Act, 1984.
So that a "conflict of interest" could not be construed, Board
member Daryl Smith excused himself from this portion of the meeting
because he was a resident of the tract in which this particular
property was located.
Staff reported this was a request to encroach three feet (31) into
the front yard setback for an addition to an existing single family
residence. Staff did not feel this encroachment would impact
adjacent properties since there were other properties -with
variances. These parcels are adjacent to the Central Park area and
were granted fifteen foot (15') setbacks instead of twenty foot
(201) setbacks. Staff recommended approval with conditions.
Glen Godfrey commented about the variations in the setback line from
seventeen feet (171) in some areas to twelve feet (121) in others,
and Tom Poe asked if the open space requirements would be met.
Staff replied in the affirmative. Staff also called to the Board's
attention letters which were in the file from adjacent property
owners in support of the variance.

The Public [fearing was opened by Chairman Tom Poe and the applicant,
Robert J. Williams, was present. Mr. Williams said he was ready to
proceed with construction as soon as he received approval from the
Board. He further stated he needed the expansion to give their
young daughters more living space at the rear of the residence and
the addition in the front portion would be used by his wife and
himself.
There was no one else present wishing to speak for or against the
project so the Public Hearing was closed.
UPON MOTION BY KREJCI AND SECOND BY GODFREY, CONDITIONAL EXCEPTION
NO. 86-62 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS,
BY THE FOLLOWING VOTE:
FINDINGS FOR APPROVAL:
1. The establishment and maintenance of the proposed twelve foot
(12') front yard setback in lieu of the required fifteen foot
(151) front yard setback will not be detrimental to:
a. The general welfare of persons residing or working in the
vicinity;
b. Property and improvements in the vicinity of such use or
building.
2. Because of special circumstances applicable to the subject
property,'including size, shape, topography, location or
surroundings, the strict application of the Zoning Ordinance is
found to deprive the subject property of privileges enjoyed by
other properties in the vicinity and under identical zone
classifications.
3. The granting of Conditional Exception No. 86-62 is necessary in
order to preserve the enjoyment of one or more substantial
property rights.
7. The granting of Conditional Exception No. 86-62 will not be.
materially detrimental to the public welfare, or injurious to
property in the same zone classifications.
8. The granting of Conditional Exception No. 86-62 will not
adversely affect the General Plan of the City of Huntington
Beach.

SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated
August 8, 1986, shall be the approved layout.
2. Proposed structures shall be architecturally compatible with
existing structures.
3. Natural gas shall be stubbed in at the locations of cooking
facilities, water heaters, and central heating units.
4. Low -volume heads shall be used on all spigots and water faucets.
5. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be dispc3ed of at an
off -site facility equipped to handle them.
6. Prior to issuance of building permits, the property owner shall
sign, notarize, and record with the County Recorder a "Letter
of Agreement" assuring that the single family residence will be
maintained as one (1) dwelling unit.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions of
the Ordinance Code, Building Division, and Fire Department.
2. All applicable Public Works fees shall be paid prior to
issuance of building permits.

CONDITIONAL EXCEPTION NO. 86-55
USE PERMIT NO. 86-62
Applicant: Dewayne Brown
CE REQUEST: To permit the reduction of a required fifteen foot
(15 rear yard setback to eleven feet (111).
UP REQUEST: To permit the construction of a 9,809 Square Foot
industrial building.
Subject property is located at 5602 Research Drive (South side of
Research Drive approximately three hundred feet (3001) East of
Graham Street).

This request is covered by Environmental Impact Report No. 73-16.
Staff reported the request was to reduce,the;rear"setback to allow
construction of an industrial building. 'The'setback'was established
to provide a buffer for adjacent residential properties. Staff also
stated there was a ten foot (10') utility easement at the rear which
would provide additional Open space -between the properties. Staff
further informed the Board that Tentative Parcel Map 86-317 was in
conjunction with this request., If.the Board,approved this site
plan, which indicated*a ninety -pine foot (991)''lot in lieu of the
one hundred foot (100') lot, the Code was so structured that the map
could then --be approved. Staff'iecommended approval of the project
with minor revisions.. TT
Tom Poe stated that an automatic fire sprinkler system `or the
building would be satisfactory in place of additional re
hydrants. Glen Godfrey expressed concerns over the "man -door" at
the rear of-'the"building and requested a condition restricting it to
emergency use, only. ..Bill Pat_apoff also asked that a soils analysis
be required. There was; also a discussion relative to the wall and a
turn -around- area. for -'the -lot.., ' Daryl- Smith -felt the wheel stops
would be more appropriate than berming and at
this industrial , site. ''.Glen 'Godfr.ey also -asked;that the "hours. for,

The Public Hearing was opened and Robert Brown was present to
represent the applicant. Mr. Brown-,said.•he_liked the -suggestion of
revising the turnaround area but`he would'prefer'having the wheel
stops in lieu'of-'the�raise�"pavement'and`berming. He further stated
he had no objtection to limiting,the,hours,ofi,loading.�and unloading
trucks. :f

FINDINGS FOR APPROVAL - USE PERMIT NO
1. The establishment, maintenance and operation of the proposed
9,809 Square Foot industrial building will not be detrimental
to:
a. The general welfare of persons residing or working in the
vicinity;
b. Property and improvements in the vicinity of such use or
building.
2. The granting of Use Permit No. 86-62 will not adversely affect
the General Plan of the City of Huntington Beach.
SPECIAL CONDITIONS OF APPROVAL - USE PERMIT NO. 86-62
1. The site plan, floor plans, and elevations received and dated
July 15, 1986, shall be revised and shall be resubmitted
depicting the modifications described herein:
a. Designate turn -around area at the far end parking space
shown on the site plan dated July 15, 1986, as Space No. 1.
b. Adjust parking space widths to comply with Article 960 (Off
Street Parking).
2. Prior to issuance of building permits, the property owner shall
file a parcel map establishing the subject parcel. Said map
shall be recorded prior to final inspection.

3. Prior to issuance of building permits, the applicant shall
submit the following plans:
a. Landscape and irrigation plan to the Department of
Development Services and Public Works for review and
approval.
b. Rooftop Mechanical Equipment Plan. Said plan shall
indicate screening of all rooftop mechanical equipment and

13. If lighting is"included in the parking lot, high-pressure lamps
shall be used -for -energy savings. All outside lighting shall
be directed to prevent "spillage".;onto ;adjacent :properties.
14. No servicing or repair of automobiles shall be permitted on the
site such as engine,or auto body, work.
15. Loading or unloading of trucks shall be restricted to between
the.hours of 7:00 A.M. and"10:00-P.M. „
15. The "man" door located on the rear wall shall remain closed and
designated "EMERGENCY EXIT ONLY" per Fire Department approval.

INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions of
the Ordinance Code, Building Division, and Fire Department.
2. The applicant shall obtain the necessary permits from the South
Coast Air Quality Management District.
3. All signs shall be brought into compliance with Article 961 of
the Huntington Beach Ordinance Code.
4. The Board of Zoning Adjustments reserves the right to revoke
this Use Permit if any violation of these conditions of the
Huntington Beach Ordinance Code occurs.
5. The applicant shall meet all applicable local, Sta,.e, and
Federal Fire Codes, Ordinances, and standards.
6. A detailed soils analysis shall be prepared by a registered
Soils Engineer. This analysis shall include on -site soil
sampling and laboratory testing of materials to provide
detailed recommendations regarding grading, chemical and fill
properties, foundations, retaining walls, streets, and
utilities.
7. All applicable Public Works fees shall be paid prior to
issuance of building permits.

TENTATIVE PARCEL MAP NO. 86-317
Applicant: James F. Casey
A request to establish two (2) parcels to coincide with Orange
County Assessor's lot description. Subject property is located at
5602 Research Drive (South side of Research Drive approximately
twenty feet (201) East of Commerce Lane.
This request is covered by Categorical Exemption, Class 15,
California Environmental Quality Act, 1984.
Staff reported that in 1971 a parcel map was recorded with the
County which conveyed eight feet (81) of Lot 86 in Tract 7090. In
that conveyance, it established this lot as a ninety-nine foot (99')
frontage. The applicant wants to establish both lots so it can be
transferred, and he has been advised he needs to establish a legal
subdivision before he can sell the property. This action will.
establish the legal description. Staff again reminded the Board

that their action in approval of the site plan under Conditional
Exception No. 86-55 and Use Permit No. 86-62 would allow approval of
this request. Staff recommended approval with conditions.
The applicant, James F. Casey, was present and agreed, to the
conditions as presented by Staff.
Glen Godfrey asked if the utilities were'uriderground and the
applicant stated they were.

TENTATIVE PARCEL MAP NO. 86-315
Applicant: James M. Briggs
A request to permit the consolidation of six (6) lots into one (1)
lot. Subject property is located at 225 Fifth Street (Southwest
corner of Olive Avenue and Fifth Street).
This request is covered by Categorical Exemption, ClasE 5,
California Environmental Quality Act, 1984.
Staff reported this property was located in the downtown
redevelopment area and Staff had been working with Mike Adams of the
Redevelopment Department. Alley dedication at this time would cause
a problem with the rear of the building. This consolidation is a
follow up on a Conditional Use Permit and the property is also
involved with the seismic requirements for downtown business
structures.
Tom Poe inquired about the note on the map with reference to use for
automotive repairs. Glen Godfrey explained the on -going situation
with Pristine Porsche and the nonconforming use of the location. He
further explained the old drug store was only granted permission for
sale of automobile parts - not car repairs or sales. Mr. Godfrey
added that the buildings should be identified on the map and that
Note No. 3 should be stricken from the map for further clarification
of the Board's action.
Daryl Smith stated he would like the Minutes to reflect this Board's
action would not affect any seismic decisions specifically made by
City Council for this site. Dennis Krejci verified this statement
for Mr. Smith.
The applicant, James M. Briggs, was present. Mr. Briggs explained
he was being required to file this map in order to obtain a building
permit for the seismic renovation required by the City. Mr. Briggs
also explained the corner radius and alley dedication would cost him
approximately $6,000.00. After further discussion, Mr. Briggs
agreed to the conditions as amended.
