DEVELOPMENT PERMIT NO. 86-26 (Cont. from 9/10/86)
Applicant: City of Huntington Beach
A request to permit the installation of approximately three thousand
(3,000) lineal feet of storm drain by the City of Huntington Beach.
Subject location is on Warner Avenue in a westerly direction from
Lynn Street to Edgewater Lane, then northerly on Edgewater Lane to
Courtney Lane.
This request is covered by Categorical Exemption, Class 1 (b),
California Environmental Quality Act, 1984.
Staff member, Robert Franklin, stated that Bill Patapoff of the
Engineering Section, Public Works Department, was present and would
describe the project.
Mr. Patapoff described the location of the project and said that
presently the storm sewers run down the hill and are collected in a
storm drain in the Huntington Harbour Yacht Club area which then
goes into the Bay itself. By construction of the master plan storm
drain (as shown on the L. D. King Plan adopted by City Council),
this will alleviate the situation.

Daryl Smith asked if the City proposed to provide a desiltation box
or system to prevent siltation from entering the Bay and
Mr. Patapoff replied in the affirmative. Mr. Smith then inquired
how the siltation would be removed and Mr. Patapoff replied the City
maintenance people would vacuum it out of the box.
Dennis Krejci asked Staff to read the Findings and Conditions
proposed for the project and Staff also explained the Coastal
Development Permit was required because of the cost of the project.
Daryl Smith asked that two additional restrictions be added - one
that the City provide desiltation basins at appropriate locations
and, secondly, that the desiltation basins be maintained at all
times to prevent excess siltation from entering Huntington Harbour
Bay.
The Public Hearing was opened by Chairman Tom Poe and, as previously
noted, Bill Patapoff was present to represent the applicant. A
resident of the area, John DeLeonardi, asked if the project would
alleviate the flooding on his street and Mr. Patapoff stated it
would eventually pick up everything. There was no one else present
wishing to speak for or against the project so the Public Hearing
was closed.
UPON MOTION BY SMITH AND SECOND BY POE, COASTAL DEVELOPMENT PERMIT
NO. 86-26 WAS APPROVED WITH THE FOLLOWING FINDINGS AND AMENDED
CONDITIONS, BY THE FOLLOWING VOTE:
FINDINGS FOR APPROVAL:
1. The proposed installation of the 3,000 lineal feet of storm
drain conforms with the plans, policies, requirements and
standards of the Coastal Element of the General Plan.
2. The Coastal Development Permit is consistent with the CZ suffix
zoning requirements, as well as other provisions of the
Huntington Beach Ordinance Code applicable to the property.
3. The proposed installation of the 3,000 lineal feet of storm
drain can be provided with infrastructure in a manner that is
consistent with the Coastal Element of the General Plan.
4. The proposed installation of the 3,000 lineal feet of storm
drain conforms with the public access and public recreation
policies of Chapter 3 of the California Coastal Act.
CONDITIONS OF APPROVAL:
1. The site plan dated August 19, 1986, shall be the approved
layout.

2. Provide desiltation basins at appropriate locations to
satisfaction of the Public Works Department.
3. Desiltation basin shall be maintained at all times to prevent

REVOCATION OF HOME OCCUPATION PERMIT NO. 86-2
Licensee: J & H Painting/Geri Evans Ryan
GENERAL REASON: Alleged violation of Section S. 9730.36 (a), (b),
c , an h), Huntington Beach Ordinance Code, referring to
storing of equipment and vehicles used in the business at the home
in conjunction with the Home Occupation Permit.
GENERAL LOCATION: Subject property is located at 19731 Sacramento
ane es si a of Sacramento Lane at intersection with Boise Drive).
Staff stated information had been received from the Land Use
Division indicating that there have been alleged violations of the
licensee's Home Occupation Permit. Staff explained that when a
resident wishes to conduct a business from his home, he must agree
to abide by rules and regulations stipulated in the Ordinance Code.
Everything Staff has discerned from Don Shaw, Land Use Technician,
and adjacent property owners, the licensee is in violation of these
Code requirements.
Staff read a letter which had been received from adjacent residents,
Mr, and Mrs. Paul P. Patapoff, and asked that it be entered into the
Minutes of the Meeting. It is as follows:

As per our conversation of September 11, 1986, I am sending this
letter for the Public Hearing on September 17, 1986. I am unable to
attend because of serious illness in my immediate family.

Approximately five months ago, every week day morning between
6:30 a.m. and 8:00 a.m., our R-1 neighborhood was and is invaded by
two or more paint trucks - one black, one.orange.and one.white.. The
trucks are parked illegally in the street. The men sit in the
trucks or stand around drinking beverages and/or smoking. They
knock on the door of the Sacramento Lane address above.
Conversation is carried on in front of the house on the sidewalk or
driveway with the owners and papers are passed. At times, the
garage door is opened to obtain supplies. On.occasion a truck is
left parked in the area for the day. At times, the workmen leave
their own personal vehicles parked in the neighborhood for the day.
The same procedure is followed when the workmen return at the end of
their work day. We don't need the noise and pollution in our
residential area that should be in a commercial or industrial area.
We are in favor of Revocation of Home Occupation Permit No. 86-2.

Staff reported the letter had itemized four or five things which
were in violation of the Ordinance Code covering home businesses,
and Staff is recommending that the Home Occupation Permit be revoked.
Tom Poe asked if there had been other reports of violations prior'to
this since the file seemed to indicate a ten (10) year span for this
home business. Staff explained the original permit had been
obtained in 1976 and another permit requested in 1986 because of a
transfer of ownership. Staff further said it was his understanding
from Don Shaw (who was on vacation and could not attend today's
hearing) that clearance had not been obtained from Zoning.
After a request from Les Evans, Staff read information regarding the
specific items in the Ordinance ,Code which were allegedly being
violated. Michael Strange stated the licensee had indicated'on the
application that the residence would be used for office space only not other uses.
Daryl Smith said he felt if there had been previous problems with
the licensee, the City would have received prior complaints..
Mr. Smith further stated he would hesitate to approve action which
would take a man's business away from him and suggested maybe a
thirty (30) day suspension could be granted.

The Public Hearing was opened and John T. McGlashan,
19712 Sacramento Lane, stated that the present owners (Mr. and
Mrs. Ryan) had only lived there approximately five to six months.
He further stated that since the Ryans had moved into the area, they
had made a shambles of the neighborhood. He said their workers were
coming to the Ryan's residence, trucks were parked illegally, paint
was being mixed in the garage which could cause fires in the
neighborhood, and he did not need an alarm clock because the Ryan's
workers awakened him every morning at 6:30 A.M. Mr. McGlashan
further stated he and other neighbors had previously contacted the
Planing Commission relative to these problems.
Gilbert E. Hill, Jr., 19721 Sacramento Lane, explained that the
previous owners of the residence had three (3) McDonald's
restaurants and only had an office in their home. The permit was
not for a painting business or anything like that. He further
stated the present owners are dispatching their employees from the
residence - that the employees come to the residence early in the
morning and get their assignments for the day.
Joseph J. Ryan, 19731 Sacramento Lane, stated he was speaking in
behalf of his wife, Geri Evans Ryan, who was also present. Mr. Ryan
said his wife ran the painting business which she had purchased from
her friend. According to Mr. Ryan, there was a lot of "stuff"
stored in the garage because he and Mrs. Ryan had just been married
in February and they had combined the belongings of two families
Mr. Ryan stated the painters do come to their home and pick up their
assignments but do not leave their cars or trucks parked there. He
further stated there was an one hundred and forty foot (1401) block
wall adjacent to Gil's (Mr. Hill's) property. Mr. Ryan said he
occasionally parked his personal van along that wall before Mr. Hill
addressed him with language which could not be repeated at the
meeting. Mr. Ryan mentioned he was attempting to rent an office in
Costa Mesa and would make every effort to comply with the Ordinance
Code regulations; however, he wanted the Board to be aware there
were other -people in his tract who were operating businesses from
their homes and many of them were in violation of these same
regulations.
Michael Strange and Les Evans informed Mr. Ryan those issues were
not before the Board and Mr. Ryan could, if he so desired, file an
official complaint through the Land Use Division against those
businesses.
Mrs. Ryan stated they had workers in their home because their home
was being remodeled and that was the reason paint was being mixed in
the garage. She further said her painters only did work on her home
when they did not have jobs in other locations. Les Evans attempted

unsuccessfully,to obtain a set time limit from Mrs. Ryan for
completion of the remodeling. Mr. Evans then suggested it might be
wise for Mrs. Ryan to complete the work as quickly as possible to
prevent further problems with her neighbors.
Daryl Smith asked Mr. and Mrs. Ryan, in the event the Board did
contemplate approving continuance of this Home Occupation Permit, if
they could have everything cleared up by Monday morning. Mr. Ryan
stated in the affirmative.
There was no one else present wishing to speak for or against the
Revocation so the Public Hearing was closed.

A request to permit construction of an 11,650 Square Foot industrial
building. Subject property is located on the East side of Palmdale
Street just North of Cedar Avenue.
This request is covered by Negative Declaration No. 86-45.
Staff informed the Board this application would be followed by other
Administrative Review requests for industrial buildings and a
Tentative Parcel Map for consolidation of two (2) parcels at this
location. Staff mentioned the lot sizes were ten feet (101) less
than the City requires and approval of these Administrative Reviews
would trigger approval of the lot sizes. Staff further stated he
had evaluated the overall project and minor modifications were
required to the plans which Staff felt could be addressed in the
Conditions of Approval. Staff stated he would recommend approval of
the project with conditions.
Tom Poe stated that Staff's recommendation for posting and marking
service roads and fire lanes would not be needed. Daryl Smith then
asked Staff if the plans met Code requirements except for these
minor modifications and Staff said it did. Dennis Krejci stated he
did not feel comfortable approving a site plan which was so grossly

incomplete - that the handicap parking did not appear adequate,
street widths were not correct, etc. Mr. Krejci asked Staff if the
applicant had not promised to bring a revised plan to him on the
past Monday and Staff replied in the affirmative. Mr. Krejci
suggested that a continuance might be granted to give the applicant
time to submit revised plans.
The applicant, John DeLeonardi, stated he would have no problems
meeting the minor modifications and said his Architect was out of
town when the project was first submitted. He further mentioned a
meeting which had been held in the early stages of the project with
James W. Palin, Director of Development Services, and Les Evans,
City Engineer. Mr. DeLeonardi assured the Board that if he had
problems meeting the conditions, he would reapply at a later date -
that he did not want a continuance.
Daryl Smith stated he could understand Mr. Krejci's reluctance to
approve the site plan; however, Mr. Smith felt the items could be
handled through the conditions.
UPON MOTION BY SMITH AND SECOND BY POE, ADMINISTRATIVE REVIEW
NO, 86-11 AND NEGATIVE DECLARATION NO. 86-45 WERE APPROVED WITH THE
FOLLOWING AMENDED CONDITIONS, BY THE FOLLOWING VOTE:

1. A revised site plan, floor plans, and elevations shall be
submitted depicting the modifications described herein:
a. Provide turnaround area at the end of the drive aisle.
b. Provide trash enclosure behind front setback with self
closing doors. Materials shall be architecturally
compatible with the main building.
c. Locate utility transformer behind front setback and screen
from view from the public street.
2. Elevations shall be approved by the Department of Development
Services. Submit samples of exact colors and building

14. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at an
off -site facility equipped to handle them.

8. An automatic fire sprinkler system shall be approved and
installed pursuant to Fire Department regulations.
9. There shall be no outside storage of vehicles, vehicle parts,
equipment or trailers.
10. All repair work shall be conducted wholly within the building.
11. All signs shall be brought into compliance with Article 961 of
the Huntington Beach Ordinance Code. All freestanding signs
shall be low -profile, monument -type signs.

Subject property is located on the East side of Palmdale Street
three hundred fifty feet (3501) in a northerly direction from Cedar
Avenue.
This request is covered by Categorical Exemption, Class 5,
California Environmental Quality Act, 1984.
Staff reported this parcel map covered the same project as the
Negative Declaration and Administrative Reviews which the Board had
just approved. Staff recommended approval with conditions.
There was a discussion between Staff and Les Evans relative to an
area shown on the map. Les Evans stated it would need to be
dedicated to the City as an alley.
The applicant, John DeLeonardi, was present and agreed to the
conditions for the parcel map.

approval, the applicant requested a front yard setback for an
addition to his residence. If the Board approves the parcel map,
this approval will eliminate a lot line -which runs under the
residence. Staff recommends approval -with conditions•for a�Waiver.
The applicant, Erich Ziebarth, was present and agreed to the
conditions.
