ROLL CALL Present: Winchell, Mays, Finley, Kelly, Erskine, Green, Absent: Bannister CLOSET! SESSION Mayor Kelly called a Closed Session of Council pursuant to Government Code Section 54956.9 (a) to confer with its attorney regarding pending litigation which -has been initiated formally and to which the city is a party. The title of the litigation is Concerned Citizens of Huntington Beach vs. Citz of Hunt- ington Beach and John Thomas. Orange County Superior Court Case No. 5 1-- 5. The Mayor also stated that a Closed Session would be held pursuant to Govern- ment Code Section 54956.6 to give instructions to the City's negotiator regarding negotiations with A. C. Marion concerning the purchase of the pro- perty located at the northwest cornet' of Ellis Avenue and Goldenwest Street. Recess - Reconvene The Mayor called a recess of Council at 6:09 P.M. The meeting was reconvened at 6:40 P.M. Concerned Citizens of Huntington Beach vs. City of Huntington Beach and John Thomas, Orange County Superior Court Case No. 5071-35 The Mayor stated that consideration by Council will be given to the Concerned Citizens of Huntington Beach vs. City of Huntington Beach and John Thomas, Orange County Superior Court Case No. 5071-35 during Closed Session at an adjourned meeting to be called for January 5, 1987. A C Marion Property Acquisition - Approved On motion by Erskine, second Winchell, Council directed staff to complete the acquisition of the A. C. Marion Property per the purchase price and terms out- lined in the agreement from the City Attorney's Office, with the option charge set at 7.5% and further to approve said agreement, as amended, and authorize execution of same by the Mayor and City Clerk. The motion carried by the following roll call vote: AYES: Winchell, Mays, Finley, Erskine, Green NOES: Kelly ABSENT Bannister Page 2 - Council Minutes - December 22, 1986 A motion was made by Erskj.­�, second Winchell to authorize appropriation of $1,000,000 from the Gcneral Fund representing partial payment to A. C. Marion for his property located at the northwest corner of Goldenwest Street and Ellis Avenue. The motion carried by the following roll call vote: AYES: Winchell, Mays, Finley, Kelly, Erskine, Green NOES: None ABSENT: Bannister SCHOOL DEVELOPMENT FEES The City Administrator informed Council that they had been provided with copies of his Council -Administrator Communication 86-132 dated December 19, 1986 transmitting a letter from the Huntington Beach City School District dated December 18, 1986, regarding School Development Fees. lie reported on the school district's request that the City collect School Development Fees on behalf of the school districts through the city's building permit issuing office. The City Administrator recommended that should the Council approve said request, a decision be made as to the amount of collec- tor's fee which the city should charge and entering into an agreement to hold the city harmless in regard to certain liabilities which may occur. Councilman Erskine clarified that he had addressed the Huntington Beach Ele- mentary School District &,,ard as a representative of the Building Industry Association and not as a City Councilmember. A motion was made by Mays, seconded Finley, that the city accept the responsi- bility for collecting school development fees for the Huntington Beach Union High School District and the City and that a minimum of 5% administration charge be assessed to the school district for providing the collection ser- vices and further that provisions be made to insure that the city is held harmless by the school districts for any liabilities which may be incurred by providing said service. The motion carried by the following vote: AYES: Winchell, Mays, Finley, Kelly, Erskine, Green NOES: None ABSENT: Bannister ADJOURNMENT Mayor Kelly adjourned the adjourned regular meeting of the City Council of the City of Huntington Beach to Monday, January 5, 1987 at 6:00 P.M. in Room B-8, Civic Center.
