REGULAR AGENDA -ITEMS: CONDITIONAL EXCEPTION NO. 86-99 USE PERMIT NO. 86-86 (Cont. from 12/17/86) Applicant: John David King CE REQUEST: To permit 1) thirteen foot, two inch (13'-211) exterior side yard in lieu of required minimum fifteen foot (151) with average twenty foot (201) side yard, and 2) private yards to fulfill common open space requirement. UP'REQUEST: To permit a six (6) unit apartment complex. Subject property is located at the Southeast corner of Elm'Street and Cypress Avenue. This request is covered by Categorical Exemption, Class 3, California Environmental Quality Act, 1986. The Staff member, Laura Phillips, stated this request had been continued from the previous meeting to allow the applicant to meet requirements of the Redevelopment Department. The applicant has made changes to the plans which were required by Redevelopment and he is requesting a further continuance of one (1) week to readvertise the project. UPON MOTION BY POE AND SECOND BY EVANS, CONDITIONAL EXCEPTION NO. 86-99 AND USE PERMIT NO. 86-86 WERE CONTINUED, AT THE REQUEST OF THE APPLICANT, TO THE REGULAR MEETING OF DECEMBER 31, 1986, BY THE FOLLOWING VOTE: AYES: Evans, Godfrey, Krejci, Poe, Smith NOES: None ABSENT: None CONDITIONAL EXCEPTION NO. 86-108 ADMINISTRATIVE REVIEW NO. 86-56 NEGATIVE DECLARATION NO. 86-63 Applicant: Cavan Associates, Ltd. CE REQUEST: To permit zero foot (0') setback from City easement in lieu of required five foot (51) setback. AR REQUEST: To permit construction of eight (8) industrial buildings (total of 54,687 Square Feet). Subject property is located on Metzler Lane at cul-de-sac (Northeast of Talbert Avenue and Gothard Street). This request is covered by Negative Declaration No. 86-63. Staff reported this was a request for eight (8) industrial buildings with access from Metzler Lane and a private drive. We have several concerns - one of which would be the City's requirement for two (2) access points because of the easement at the rear of the property. Staff would recommend continuance of the request for further study and amendments. Chairman Tom Poe opened the Public Hearing. The applicant's representative, Bill Borden, was present, along with Jon Lundstrom and R. Hastings, Architects for the project. Mr. Borden asked if the Board could address some of the concerns Staff had so the problems could be resolved by the next meeting if the request was granted a continuance. Tom Poe said the Fire Department wanted another access besides Metzler Lane and Glen Godfrey reiterated Staff's concerns relative to an alternative additional access. This was followed by a discussion between Les Evans and the applicant's representatives concerning the time span involved for correcting the plans. Glen Godfrey stated a revised site plan would have to be submitted indicating landscaping, new access point, etc. The applicant's -2- 12/24/86 - BZA 1 Minutes, H. B. Board of Zoning Adjustments December 24, 1986 Page 3 representative inquired about street standards and Mr. Evans advised him to check with Public Works Department for specific information. After further discussion, Mr. Borden requested a one (1) week continuance. The Public Hearing remained open. UPON MOTION BY POE AND SECOND BY SMITH, CONDITIONAL EXCEPTION NO. 86-108, ADMINISTRATIVE REVIEW NO. 86-56, AND NEGATIVE DECLARATION NO. 86-63 WERE CONTINUED TO THE MEETING OF DECEMBER 31, 1986, BY THE FOLLOWING VOTE: AYES: Evans, Godfrey, Krejci, Poe, Smith NOES: None ABSENT: None USE PERMIT NO. 86-88 Applicant: Casa del Sol Investments, et al A request to permit addition of leasing/management building to existing appartment complex. Sub]'ect property is located at 21661 Brookhurst Street (West side of Brookhurst Street approximately one hundred fifty feet (1501) South of Hamilton Avenue). This request is covered by Categorical Exemption, Class 3, California Environmental Quality Act, 1986. According to Staff, a request is being made to add a 1,724 Square Foot leasing office to an existing apartment complex. The applicant wants two (2) curb cuts on Brookhurst Street but Staff recommended that parking be provided from the existing drive. Based on Staff's calculations, there are three (3) more parking spaces than required for the apartments and the applicant would be providing three (3) additional spaces. Staff would recommend approval of the request. Tom Poe asked the distance from the addition to Brookhurst Street and Staff replied it would be eighty-two feet (821). Upon further questioning by Mr. Poe, Ms. Phillips replied the buildings were two (2) story. Dennis Krejci inquired about the distance from the parking spaces to the leasing office and apartment units and expressed concern that prospective tenants might not park properly. The Public Hearing was opened and William Walker was present to represent the applicant. Mr. Walker stated the applicant had hoped for the additional curb cut in order to better utilize the parking spaces. -3- 12/24/86 - BZA Minutes, H. B. Board of Zoning Adjustments December 24, 1986 Page 4 Tom Poe wanted to know if anyone would be living in the leasing unit and Mr. Walker said no - it would only be occupied during the eight (8) hour business day. There was a further discussion about shifting the parking spaces and meeting the open space requirements and it was determined a revised site plan would be necessary. There was no one else present wishing to speak for or against the project so the Public Hearing was closed. Les Evans stated he would move for approval of the request and Daryl Smith said he would second it. Glen Godfrey then asked if the maker and seconder of, the motion would entertain an amendment that the parking spaces should be designated for use by the leasing office. The maker and seconder of the motion agreed to the amendment. UPON MOTION BY EVANS AND SECOND BY SMITH, USE PERMIT NO. 86-88 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS FOR APPROVAL: 1. The establishment, maintenance and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of Use Permit No. 86-88 will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the goals and objectives of the City's General Plan and Land Use Map. SPECIAL CONDITIONS OF APPROVAL: 1. The floor plans and elevations received and dated November 26, 1986, shall be the approved layout. 2. A revised site plan shall be submitted depicting the modifications described herein: a. Show three (3) parking spaces to rear of the leasing office. Location of the parking spaces shall be subject to approval of the Department of Development Services. -4- 12/24/86 - BZA Minutes, H. B. Board of Zoning Adjustments December 24, 1986 Page 5 3. Parking spaces for the leasing office use shall be designated as such. . 4. Prior to issuance of building permits, the applicant shall submit the following plans: a. Landscape and irrigation plan to the Department of Development Services and Public Works for review and approval. b. Rooftop Mechanical Equipment Plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. 5. Installation of required landscaping and irrigation systems shall be completed prior to final inspection. 6. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 7. Proposed structures shall be architecturally compatible with existing structures. 8. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 9. Low -volume heads shall be used on all spigots and water faucets. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1.. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. All new construction shall comply with the standards of construction for the FP2 Flood Plain District 4. Landscaping shall comply with Articles 912 and 960 of the Huntington Beach Ordinance Code. 5. The Board of Zoning Adjustments reserves the right to revoke Use Permit No. 86-88 if any violation of these conditions of the Huntington Beach Ordinance Code occurs. -5- 12/24/86 - BZA Minutes, H. B. Board of Zoning Adjustments December 24, 1986 Page 6 AYES: Evans, Godfrey, Krejci, Poe, Smith NOES: None ABSENT: None USE PERMIT NO. 86-93 Applicant: Sina Yerushalmi A request to permit alteration of a structure with nonconforming side yards. Subject property is located at 808 Alabama Street (East side of Alabama Street approximately eighty feet (801) North of Hartford Avenue). This request is covered by Categorical Exemption, Class 1, California Environmental Quality Act, 1986. Staff reported this application required a Use Permit because the applicant wished to make a one hundred forty-six (1461) Square Foot addition to an existing single family residence with nonconforming side yards. The addition would be used for a bathroom and closet space. Staff is recommending approval since the project would not further impact the side yard setbacks. Les Evans stated the two and one-half foot (2-1/21) alley dedication would need to be made. The Public Hearing was' opened and the applicant, Sina Yerushalmi, was present. Mr. Yerushalmi stated he had no questions or concerns regarding the project. There was no one else present wishing to speak so the Public Hearing was closed. Dennis Krejci reminded the applicant that Building Code corrections might still be necessary and the Board was only approving the conceptual plan. Mr. Yerushalmi stated he understood Mr. Krejci's statement. UPON MOTION BY SMITH AND SECOND BY EVANS, USE PERMIT NO. 86-93 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS FOR APPROVAL: 1. The granting of Use Permit No. 86-93 will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the goals and objectives of the City's General Plan and Land Use Map. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated• December 11, 1986, shall be the approved layout. 2. Provide proof of legal subdivision or submit a Tentative Parcel Map. 3. An alley dedication of two and one-half feet (2-1/2') shall be made to the City of Huntington Beach prior to issuance of building permits. 4. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 5. Proposed structures shall be architecturally compatible with existing structures. 6. Low -volume heads shall be used on all spigots and water faucets. 7. Prior to i.ssuance of building permits, the property owner shall sign, notarize, and record with the County Recorder a "Letter of Agreement" assuring that the single family residence will be maintained as one (1) dwelling unit. 8. All applicable Public Works fees shall be paid prior to issuance of building permits. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. Landscaping shall comply with Article 913 of the Huntington Beach Ordinance Code, 3. The Board of Zoning Adjustments reserves the right to revoke Use Permit No. 86-93 if any violation of these conditions of the Huntington Beach Ordinance Code occurs. -7- 12/24/86 - BZA Minutes, H. B. Board of Zoning Adjustments December 24, 1986 Page 8 AYES: Evans, Godfrey, Krejci, Poe, Smith NOES: None ABSENT: None After the Board had completed voting, Mr. Yerushalmi asked about the alley dedication and Les Evans explained the requirements. Daryl Smith asked if the secretary made notations in the Minutes regarding statements by the Board members to alert applicants to the fact there might be future problems and that the Board was only approving a conceptual plan. Glen Godfrey indicated that the "Conceptual Site Plan" stamp would take care of that matter. SITE PLAN AMENDMENT NO. 86-18 Applicant: V. R. Bonfanti A request to amend Use Permit No. 86-29 (Acura Dealer) to incorporate adjacent parcel for parking and office use. Subject property is located at 19131 Beach Boulevard (West side of Beach Boulevard approximately three hundred twenty-five feet (3251) North of Clay Avenue). This request is covered by Categorical Exemption, Class 1, California Environmental Quality Act, 1986. Staff reminded the Board of the previous entitlement for the car dealership at this location and that the plans had been amended in November to remove the subterranean parking structure included in the original request. The applicant is now requesting permission to provide parking on the adjacent lot which has been purchased by the Acura dealership. The lot will be used primarily for parking or storing new cars. The adjoining property owners have been notified of this request but Staff has received no verbal or written comments. Furthermore, Redevelopment has no comments and Staff would recommend approval with conditions. Tom Poe reminded Staff the aisleways should be twenty-seven feet (271) wide and four (4) parking stalls would have to be removed for fire equipment passage. Dennis Krejci asked if there would be off-street parking for the two (2) story office structure and Staff replied there would be adequate parking on the site even after meeting the Fire Department's concerns. The applicant, V. R. Bonfanti, was present and agreed to the proposed changes. Dennis Krejci asked the applicant if he was proposing any alterations to the location of the driveway cut and Mr. Bonfanti replied negatively. There was a discussion about the past requirement for the reciprocal driveway. It was determined the drive would no longer be required since the applicant had purchased the adjacent property. -8- 12/24/86 - BZA Minutes, H. B. Board of Zoning Adjustments December 24, 1986 Page 9 Glen Godfrey noted the adjacent property owners had been notified of the Site Plan Amendment as a courtesy since they had originally expressed so many concerns about the project. UPON MOTION BY SMITH AND SECOND BY GODFREY, SITE PLAN AMENDMENT NO. 86-18 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS FOR APPROVAL: 1. The establishment, maintenance and operation of the proposed car dealership will not be detrimental to: a. The general welfare of persons residing or working the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of Site Plan Amendment No. 86-18 will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. SPECIAL CONDITIONS OF APPROVAL: 1. The floor plans and elevations received and dated April 24, 1986, shall be the approved layout. 2. The site plan received and dated December 16, 1986, shall be the approved layout, with the following modifications: a. Aisleways adjacent to existing two (2) story building shall be a minimum of twenty-seven feet (271) wide. 3. Prior to issuance of building permits, the applicant shall file a parcel map or parcel map waiver request to consolidate APN 159-161-06 and APN 159-161-03. The parcel map or plat map and notice shall be recorded with the Orange County Recorder and a copy of the recorded map or plat filed with the Department of Development Services prior to final inspection or occupancy. 4. Outside speakers and amplified telephone bells shall be prohibited. 5. Truck loading and unloading of vehicles shall be done completely on -site, not on or from Beach Boulevard. -9- 12/24/86 - BZA Minutes, H. B. Board of Zoning Adjustments December;24, 1986 Page 10 6. Vehicle services loading lines shall be completely on -site. 7. Prior to issuance of building permits, the applicant shall submit the following plans: a. Landscape and irrigation plan to the Department of Development Services and Public Works for review and ,approval. b. Rooftop Mechanical Equipment Plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. 8. Service roads and fire lanes, as determined by the Fire Department, shall be posted and marked. 9. Applicant shall pursue CalTrans approval of radius type driveways on Beach Boulevard. 10. On -site fire hydrants shall be provided in number and at locations specified by the Fire Department. 11. An automatic fire sprinkler system and standpipe shall be approved and installed pursuant to Fire Department regulations. 12. All repair work shall be conducted wholly within the building. 13. Installation of.required landscaping and irrigation systems shall be completed within twelve (12) months. 14. Natural gas shall be stubbed"in at the locations of cooking facilities, water heaters, and central heating units. 15. Low -volume heads shall be used on all spigots and water faucets. 16. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to -handle them. 17. If lighting is included in the parking lot, high-pressure sodium vapor lamps shall be used for energy savings. All outside lighting shall be directed to prevent "spillage" onto adjacent properties. 18. If foil -type insulation is to be used, a fire retardant type shall be installed.as approved by the Building Division. 19. Where an existing tree is to be removed, the applicant shall provide a twenty-four inch (24") tree on a one for one basis planted on the West end of the property. 21. The Redevelopment Staff shall review exterior colors and materials. 22. An eight foot (81) block wall (decorative and compatible with existing adobe wall) shall be provided at rear property line along with dense plant materials, subject to review and approval of the Department of Development Services. 23. There shall be no openings or entrances to the service area on the West wall of the building. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. Landscaping shall comply with Article 960 of the Huntington Beach Ordinance Code. 3. The applicant shall meet all.applicable local, State, and Federal Fire Codes, Ordinances, and standards. 4. All signs shall comply with Article 961 of the Huntington Beach Ordinance Code. All free-standing signs shall be low -profile, monument -type. 5. The Board of Zoning Adjustments reserves the right to revoke Site Plan Amendment No. 86-18 if any violation of these conditions of the Huntington Beach Ordinance Code occurs. There was no further business to be presented to the Board for their review.
