BOARD MEMBERS PRESENT: Evans, Godfrey, Krejci, Poe, Smith STAFF MEMBERS PRESENT: Phillips MINUTES: UPON MOTION BY EVANS AND SECOND BY SMITH, MINUTES OF THE MEETING OF DECEMBER 17, 1986, WERE APPROVED AS TRANSCRIBED, BY THE FOLLOWING VOTE: AYES: Evans, Godfrey, Krejci, Smith NOES: None ABSENT: None ABSTAIN: Poe REGULAR AGENDA ITEMS: COASTAL DEVELOPMENT"PERMIT NO. 86-36 Applicant: Dwayne Carter Designs A request to permit a two thousand, one hundred twenty-four (2,124) Square Foot addition to a single family residence (total 4,364 Square Foot dwelling plus 746 Square Foot garage). Subject property is located at 16632 Baruna Lane (East side of Baruna Lane at intersection with Bolero Lane). This request is covered by Categorical Exemption, Class 11 California Environmental Quality Act, 1986. Laura Phillips, Staff member, reported the request was to remodel and add a second story to an existing residence. The addition would bring the residence (including the garage) to a total of 5,110 Square Feet. In this particular area and with a house of this magnitude, the Fire Department would require that residential fire sprinklers be installed. Notification was made to the adjacent property owners and the neighbor to the North has concerns that the proposed addition will shield their pool and solar panels on the roof. The residence, as proposed, meets Code requirements and Staff recommended approval. Minutes, H. B. Board of Zoning Adjustments January 7, 1987 Page 2 Tom Poe reiterated Staff's statement that the project met the Code in terms of setbacks, lot coverage, open space requirements, etc.; it was only before the Board because it was located in the Coastal Zone as delineated by the California Coastal Commission. The Public Hearing was opened by Chairman Tom Poe and the applicant's representative, Dwayne Carter, was present. Mr. Carter stated he had been cognizant of the pool area in designing the addition but was unaware of the solar panels on the roof. Nadia Anabtawi, the adjacent resident, said the solar panels had been installed to heat their pool and they did not have gas available in the pool area. Without the benefit of solar panels, they would have an unheated pool. Ms. Anabtawi also expressed concern over location of the side windows which, she felt, would destroy their privacy and hamper their life style. According to Ms. Anabtawi, the previous owner had "pushed" the dock into an "L" shape and "went outside the dock". She asked if that was a legal procedure. Tom Poe asked if that situation had been checked and Ms. Phillips replied she had been unaware of any problem with the dock. Nadia Anabtawi then also added comments about the fireplace adjacent to her pool area. Daryl Smith stated he would like to have the Land Use Division of Development Services check out the situation with the boat dock At Daryl Smith's request, Dwayne Carter drew diagrams to show Board members the locations about which Ms. Anabtawi had expressed concern. There was a further discussion about the effect the addition would or would not have on the solar panels and the pool area, and Mr. Smith said he could not see how the addition could create any problem. Glen Godfrey asked Ms. Anabtawi if she had a two story residence also and she replied in the affirmative. There was no one else present wishing to speak for or against the project so the Public Hearing was closed. Daryl Smith said he would move for approval of the request and Les Evans stated he would second the motion. Dennis Krejci then requested clarification on criteria for approval of the Coastal Development Permit and Glen Godfrey offered the information. Mr. Krejci asked the applicant if he would be willing to investigate the location of the panels and make minor changes if necessary. Mr. Carter said he would check to see what coverage there would be. -2- 1/7/87 - BZA 1 I- Minutes, H. B. Board of Zoning Adjustments January 7, 1987 Page 3 UPON MOTION BY SMITH AND SECOND BY EVANS, COASTAL DEVELOPMENT PERMIT NO. 86-36 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS FOR APPROVAL: 1. The proposed single family residence conforms with the plans, Policies, requirements and standards of the Coastal Element of the General Plan. 2. The Coastal Development Permit is consistent with the CZ suffix zoning requirements, the R1 Zoning District, as well as other provisions of the Huntington Beach Ordinance Code applicable to the property. 3. At the time of occupancy, the proposed single family residence can be provided with infrastructure in a manner that is consistent with the Coastal Element of the General Plan. 4. The proposed single family residence conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan and floor plans received and dated December 18, 1986, and elevations received and dated November 17, 1986, shall be the approved layout. 2. An automatic fire sprinkler system shall be approved and installed pursuant to Fire Department regulations. 3. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 4. Low -volume heads shall be used on all spigots and water faucets. 5. Prior to issuance of building permits, the property owner shall sign, notarize, and record with the County Recorder a "Letter of Agreement" assuring that the single family residence will be maintained as one (1) dwelling unit. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. Board of Zoning Adjustments January 7, 1987 Page 4 CONDITIONAL EXCEPTION NO. 86-112 Applicant: Frank and Donna George A request to permit a garage addition to encroach one foot (1') into required five foot (5') side yard setback. Subject property is located at 17178 Courtney Lane (South side of Courtney Lane at intersection with Westport Drive). This request is covered by Categorical Exemption, Class 5 (a), California Environmental Quality Act, 1986. Staff stated the applicant proposes to add an eleven foot (111) wide garage to the side of,a,single family residence. A portion of the garage would encroach one foot.(11) into the required five foot (5') side yard setback. Due to the angle of the lot, the encroachment would only be for a space of ten feet (101) in length and then revert back to the required five feet.(51). All the other Code requirements will be met. The adjacent neighbors were notified and Staff has received no comments. Due to the configuration of this parcel, Staff is recommending approval with conditions. The Public Hearing was opened and Frank George, the applicant, was present. Mr. George explained he had originally planned a ten foot (101) wide garage but found it would not be wide enough. The garage length will be twenty-five feet.(251) and the encroachment will only be for ten feet (10') of that area. Mr. George added the only neighbor to be affected would be the one adjacent to the garage and he had obtained a letter of approval from them which was in the file. There was no one else present wishing -to speak.so the Public Hearing was closed: UPON MOTION BY SMITH AND SECOND BY KREJCI, CONDITIONAL EXCEPTION NO. 86-112 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS FOR APPROVAL: 1. Because of special circumstances applicable to the subject property, including size, shape, topography, location or surroundings, the strict application of the Zoning Ordinance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classifications. 2. The granting of Conditional Exception No. 86-112 will not be materially detrimental to the public welfare, or injurious to property in the same zone classifications. -4- 1/7/87 - BZA Minutes, H. B. Subject property is located at 215 Indianapolis Street (North side of Indianapolis Avenue approximately two hundred feet (2001) East of Alabama Street. This request is covered by Categorical Exemption, Class 5, (c), California Environmental Quality Act, 1986. Ms. Phillips said this was a request to consolidate two (2) lots into one (1) parcel. One lot is twenty-five feet (251) wide and the other is twenty feet (201) which will create a new forty-five foot (451) parcel. The original lots were created prior to 1946. Staff recommended approval with conditions. Glen Godfrey asked how the twenty foot (201) lot had been created and the applicant, James McKay, explained a seventy-five foot (751) parcel of land had existed with a house located on it. Mr. McKay continued that the owner sold the house in 1943 and gave the new -5- 1/7/87 - BZA Minutes, H. B. Board of Zoning Adjustments January 7, 1987 Page 6 owner the forty-fivs foot (451) lot. Mr. Godfrey asked Mr. McKay if he was legalising the parcel by consolidating it and Mr. McKay•said he was. - Tom Poe asked if Mr. McKay accepted the conditions. Mr. McKay inquired about installation of the underground utilities, specifically the Edison Company power lines. Les Evans explained the lines would have to be placed underground from the nearest pole which was across the alley.- Mr. McKay stated he understood and agreed. UPON MOTION BY EVANS AND SECOND BY SMITH, TENTATIVE PARCEL MAP NO. 86-408 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS FOR APPROVAL: 1. The proposed consolidation of two (2) parcels for purposes of residential use in compliance with -the size and shape of property necessary for that type of development. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation of this type of use. 3. The property was previously studied for this intensity of land use at the time the land use designation for community residential district allowing residential buildings was placed on the subject property. 4. The size, depth, frontage, street width and other design and improvement features of the proposed consolidation are proposed to be constructed in compliance with standards plans and specifications on file with the City as well as in compliance with the State Map Act and supplemental City Subdivision Ordinance. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL(S) FOR ANY PURPOSE: 1. The Tentative Parcel Map.received by the Department of Development Services on December 12, 1986, shall be the approved layout (with the amendments as noted thereon). 2. A parcel map shall be filed with and approved by the Department of Public Works and recorded with the Orange County Recorder. 3. Water supply shall be through the City of Huntington Beach's water system at the time said parcel is developed (if such systems exist within 200 feet of said parcel. 5. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time said parcel is developed (if such systems exist within 200 feet of said parcel. 6. All utilities shall be installed underground at the time said parcel(s) is/are developed. 7. Compliance with all applicable City Ordinances. 8. A copy of the recorded parcel map shall be filed with the Department of Development Services. 9. All vehicular access rights along Indianapolis Avenue shall be dedicated to the City of Huntington Beach except at locations approved by the Board of Zoning Adjustments.
