Mayor Kelly called the Special Meeting of the City Council of the City of
Huntington Beach to order at 4 p-.m.

The City Clerk was directed to read the Call for Special Meeting.

AGREEMENT BETWEEN CITY & BURKE WILLIAMS & SORENSON - LEGAL CONSULTING
SERVICES RE: SB 1517 BERGESON & PREPARATION OF PRErANNEXATION AGREEMENT FOR
THE BOLSA CHICA
Mayor Kelly informed Council they had been provided with a communication from
the City Administrator dated March 30, 1987 regarding the city's need for the
services of an outside law firm to assist city staff in reviewing and drafting
amendments to Senate Bill 1517 (Bergeson) for Senator Marian Bergeson's con-
sideration and to assist city staff in the preparation of,a pre' -annexation
development agreement.
The Mayor stated that the Council committee had met with three legal firms and
that the committee recommended retaining the consultant services of Burke,
Sorenson & Williams.
Considerable discussion was 'held regarding the areas in which the consultant
would assist the city.
The financial aspects were discussed and it was suggested that periodic finan-
cial statements be provided to Council by the consultant selected.
The City Administrator reported on discussions with the County regarding tax
rate structure.
Discussion was held. Councilman Green referred to memorandums from the City
Administrator and City Attorney regarding anticipated consultant costs.
On motion by Green, second Erskine, Council set a cap of $75,000 for the law
firm selected to assist the city, with a biweekly report on the .accomplish-
ments, progress and financial aspects. The motion carried by the following
roll call vote:
AYES: Winchell, Mays, Finley, Kelly, Erskine, Green
NOES: Bannister
ABSENT: None
On motion by Green, second Mays, Council retained the firm of Burke, Sorenson
& Williams, with Katherine Stone and Jerry Patterson as prinicipal attorneys.
The motion carried by the following roll call vote:
AYES: Winchell, Mays, Finley, Kelly, Erskine, Green
NOES: Bannister
ABSENT: None
On motion by Mays, second Erskine, Council approved and authorized execution
of the Agreement Between the City and the Law Firm of Burke, Williams & Sorenr-
son For Legal Consulting Services Regarding the. Bolsa Chica, with Page #2--Sec-
tion (4) modified to change the $100,000 amount to $75,000. The motion car-
ried by the following roll call vote:
AYES: Winchell, Mays, Finley, Kelly, Erskine, Green
NOES: Bannister

Julie Froberg, representing Senator Bergeson's office spoke regarding proposed
Senate Bill 1517. She stated that up to this point the legislation was consi-
dered to be facilitating legislation, with regard to implementation and not a
land use planning document, but that this position could be budged from if the
city, Signal Landmark and the county could come to terms on the annexation
agreement, then the amendment to the legislation to protect all interests
could be considered. She spoke regarding avoiding certain problems relating
to the Local Coastal Plan by making many things specific in the pre -annexation
agreement and including same in the legislation.
ADJOURNMENT
The Mayor declared the Special Meeting of the City Council of the City of
Huntington Beach adjourned.
