Mr. Strange left the meeting immediately after the vote. REGULAR AGENDA ITEMS: CONDITIONAL EXCEPTION NO. 87-22 USE PERMIT NO. 87-15 ARD'Icant: Pacific? Community Hospital CE REQUEST: To permit reduction of thirteen (13) spaces in required parking - from one hundred nine (109) to ninety-six (96). UP REQUEST: To provide temporary space for portable magnetic resonance equipment to be used one (1) day per week in Pacifica Community Hospital parking lot. Subject property is located at 18792 Delaware Street (East side of Delaware Street approximately eight hundred seventy five feet (875') North of Garfield Avenue). This request is covered by Categorical Exemption, Class 4, California Environmental Quality Act, 1986. The Staff member, Laura Phillips, reported the applicant was requesting permission to locate temporary medical equipment in the Minutes, H. B. Board of Zoning Adjustments April 1, 1987 Page 2 parking lot at Pacifica Community Hospital. The equipment will be located in a trailer outside the emergency access at the hospital and will require that thirteen (13) parking spaces be cordoned off. The Fire Department will require spaces for fire access lanes. This hospital has a reciprocal parking arrangement with the convalescent hospital and the adjacent office building. Staff recommended approval for the temporary use with conditions since the use will provide needed services for the community. Tom Poe asked what hours the equipment would be in use and Staff said the applicant could best answer that question. The Public Hearing was opened by Chairman Dennis Krejci. The applicant's representative, Jack D. Kleindeter, was present. He said the hours of operation would be from 9:00 A.M. to 5:00 P.M.; however, the company would move the trailer in at their convenience which could be any time from six to eight o'clock in the morning. Tom Poe stated the parking spaces would have to be cordoned off prior to the time employees and visitors arrived for the day. Mr. Kleindeter said the spaces would be blocked off to protect the general public from the magnetic field; and, if the equipment was not in use, it would not have -to be done. Mr. Poe continued his explanation that the cars would have to be moved if they parked there before the trailer arrived, and he suggested cordoning off the spaces the previous night. Mr. Kleindeter agreed to such an arrangement. There was no one else present wishing to speak for or against the request so the Public Hearing was closed. Dennis Krejci asked if there was a limitation on the number of weeks for this temporary arrangement, and Ms. Phillips replied it was being recommended for once a week for a period of five (5) years. Les Evans stated he understood the equipment was to provide a service to the area but he wanted to remind the Board members that this was one of the most heavily impacted areas in the City insofar as parking, traffic congestion, cars attempting to cross the streets, senior citizen pedestrian traffic, etc. He added hardly a day passed that his department did not receive at least one complaint about the situation in that area. Mr. Evans added he could not vote for anything that would reduce parking on that lot since it was already so inadequate. Glen Godfrey said he would make a motion for approval of both requests with Findings and Conditions as outlined by Staff and that the parking spaces be cordoned off the previous night. Also, if a problem should develop, a Parking Management Plan providing parking off -site would be required of the hospital. -2- 4/1/87 - BZA Minutes, H. B. Board of Zoning Adjustments April 1, 1987 Page 3 Daryl Smith arrived at the meeting at this time - 1:40 P.M. Upon questioning by Tom Poe, Mr. Kleindeter stated they had a medical building diagonally across the street where some employees could be required to park. He added occupancy of that lot was presently at sixty percent (60%) or less. Mr. Godfrey said he would "couch" his motion that the same number of employees be required to park on the adjacent lot as the number of spaces being eliminated by the trailer use. Tom Poe said he would second the motion with those stipulations. Mr. Krejci asked the applicant's representative if he would agree to such an arrangement and Mr. Kleindeter replied in the affirmative. UPON MOTION BY GODFREY AND SECOND BY POE, CONDITIONAL EXCEPTION NO. 87-22 AND USE PERMIT NO. 87-15 WERE APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS FOR APPROVAL - CONDITIONAL EXCEPTION NO 87 22'. 1. Because of special circumstances applicable to the subject property, including size, shape, topography, location or surroundings, the strict application of the Zoning Ordinance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classifications. The surrounding convalescent home and office buildings provide reciprocal access and parking. 2. The granting of Conditional Exception No. 87-22 will not be materially detrimental to the public welfare, or injurious to property in the same zone classifications. 3. The granting of the Conditional Exception will not adversely affect the General Plan of the City of Huntington Beach. 4. The reduction in spaces will occur only one (1) day per week. SPECIAL CONDITIONS OF APPROVAL - CONDITIONAL EXCEPTION NO 87 22: 1. The conceptual site plan received and dated March 23, 1987, shall be the approved layout. 2. All Conditions of Approval of Use Permit No. 87-15 shall be applicable. FINDINGS FOR APPROVAL - USE PERMIT NO 87-15: 1. The general welfare of persons residing or:working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of Use Permit No. 87-15 will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the goals and objectives of the City's General Plan and Land Use Map. SPECIAL CONDITIONS OF APPROVAL.- USE PERMIT NO..-87-15. 1. The conceptual site plan ..received:and-dated March 23, 1987, shall be the approved layout. 2. This Use -Permit shall remain in effect for a period of five (5) years from the date of approval. 3. Service roads and fire lanes, as determined by the Fire Department; shall.be posted -and marked. _. 4. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. 5. On the evening prior to use of the trailer, the emergency fire access lanes, as determined by the Fire Department, shall be delineated by' -stanchion and swag or other appropriate means. 6. On those days when the trailer is in use, a minimum of thirteen (13) employees (the same number -.of spaces-,as,_the-amount of parking -removed by the trailer' use) .shall- park. in off -site parking lots as designated by the applicant. INFORMATION ON SPECIFIC -_CODE REQUIREMENTS - USE -PERMIT -NO. 87-15: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and -Fire Department. 2. The Board of Zoning.Adjustments reserves the right to revoke Use Permit No. 87-15 if any violation of these conditions of the Huntington Beach Ordinance -Code occurs. _ AYES: Godfrey, Krejci, Poe NOES: Evans ABSENT: None ABSTAIN: Smith -4- 4/1/87 - BZA Minutes, H. B. Board of Zoning Adjustments April 1, 1987 Page 5 USE PERMIT NO. 87-9 Applicant: Louis Hernandez A request to permit a total of five (5) apartment units. Four (4) apartment units allowed plus one (1) unit density bonus - twenty-five percent (25%) density bonus. Subject property is located at 2219 Florida Street (West side of Florida Street approximately fifty feet (50') North of Jay Circle). This request is covered by Categorical Exemption, Class 3, California Environmental Quality Act, 1986. Staff reported this was a five (5) unit apartment project which would be located in an R-2 Zone. Four (4) units would be allowed on this parcel and the applicant is asking for the fifth unit under a twenty-five percent (25%) density bonus. The project complies with Code for parking, site coverage, etc., and the applicant will provide the one (1) unit for moderate or low income housing. The adjacent property owners were notified but Staff received no comments for or against the request. Staff recommended approval with conditions. Dennis Krejci said it was his understanding the development came very close to being allowed the five (5) units without the density bonus. Ms. Phillips said the project was at 4.95 units but it was "rounded down" to the four (4). The Public Hearing was opened and Louis Hernandez, the applicant, was present. Mr. Hernandez said he had no comments other than the drawings indicated what they were trying to do. Glen Godfrey asked Mr. Hernandez if the property owner was present and Omar Nabahani identified himself as the owner. Mr. Godfrey asked if he would object to using heavy shadow asphalt shingles on the project and Mr. Nabahani agreed to do so. R. L. Kirkland, 18792 Delaware Street, was present and stated he had not received a notice of the meeting - that he had been advised by another resident. Ms. Phillips checked the file and found his name among those having been notified but he again said he did not receive the notice. Mr. Godfrey said our records indicated mailing the letter - but there was another "agency" involved in delivery of such letters. Staff check further and found that Mr. Kirkland's letter had been returned to the City as "Undeliverable - No Such Address" - even though it was correctly addressed. Mr. Kirkland continued that he thought the policy of requiring a density bonus for the fifth unit was absurd when it was so close. Mr. Godfrey reiterated Staff's explanation that it had been a departmental policy to "round down" the number of units rather than allowing more on a parcel. There was no one else present wishing to speak for -or against the project so the Public -Hearing -was closed. UPON MOTION BY SMITH AND SECOND BY EVANS, USE PERMIT NO. 87-9 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE -- FOLLOWING VOTE: FINDINGS FOR APPROVAL:, 1. The establishment, maintenance and operation of the use will not be detrimental -to: - a. The general -welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of .Use- Permit.No..- 87-9--will- not adversely affect the General -Plan of the City of Huntington -Beach. 3. Prior to -issuance of building permits; the -applicant shall provide proof of legal lot creation or file a parcel map to legalize the existing parcel.-Said.map shall -,be -,recorded prior to final inspection and a copy submitted to the Department of Development Services,. 3. Prior to issuance of building permits, the applicant shall submit the following plans: a. Landscape and irrigation -plan to the Department _of Development Services and Public Works for review and approval. b. Rooftop Mechanical Equipment Plan. Roofing material shall consist of shadow asphalt shingles. 6. An automatic fire sprinkler system shall be approved and installed pursuant to Fire Department regulations. 7. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 8. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 9. Low -volume heads shall be used on all spigots and water faucets. 10. If lighting is included in the parking lot, high-pressure sodium vapor lamps shall be used for energy savings. All outside lighting shall be directed to prevent "spillage" onto adjacent properties. 11. All applicable Public Works fees shall be paid prior to issuance of building permits. 12. The applicant shall enter into an agreement to provide one (1) unit (twenty-five percent (25%) density bonus) for persons of low or moderate income, subject to the provisions of Government Code Section 65590(d). The agreement shall be reviewed by the City Attorney's Office as to form and content, and shall be approved by the Director of Development Services. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all. applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. Landscaping shall comply with Article 912 of the Huntington Beach Ordinance Code. 4. The Board of Zoning Adjustments reserves the right to revoke Use Permit No. 87-9 if any violation of these conditions of the Huntington Beach Ordinance Code occurs. Tucker A request to permit -a thirty-five hundred (3,500) Square foot addition to an existing building used -for lawnmower service and sales. Subject property is located at 17031 Palmdale Street (West side of Palmdale Street approximately fifty feet (50')-Nor-th of Cain Avenue). This request is covered by Categorical Exemption,,Class 1, California Environmental Quality -Act, 1986. This is a request to expand Mr.-B's Lawnmower Shop and is' - essentially -the same as approved by the Board in"198-5,-which approval expired before the applicant -could construct -the building. The applicant will be -required to -install the 'same -street improvements -and a' -new driveway. -In the new plans, -he has also incorporated -the turnaround -area, handicapped parking, -wheel stops, and the reciprocal -arrangement for driveway and parking easements with the properties to the South -and East which are -zoned M-1. The applicant, James E. Tucker, was present and agreed to the conditions as presented -by Staff. -- Les Evans discussed with the applicant the matter -of curbs and gutters, sidewalks, and other street improvements on Palmdale Street. Dennis Krejci introduced the subject of rain water going into the storm drain and a d-iscussion was -held concerning the problems of organic materials, -oil, etc.-, draining- into -the sewers. Les Evans said-the`Health Department would require a separator. Dennis Krejci explained the applicant would need a rain water diversion system to prevent rain water- from entering the -drains and that this system could be installed inside -an enclosed building. Mr. Krejci also explained to the applicant 'that this- was --an expensive -procedure. Glen Godfrey said the applicant'had-indicated some sales and asked if the units would be new -or used. The applicant-said.he would be selling both. Mr. Godfrey asked what percentage of- the business would be in sales and the applicant replied approximately twenty-five percent (25%). Mr. Godfrey asked that the Minutes reflect this information. UPON MOTION BY EVANS AND SECOND BY KREJCI, ADMINISTRATIVE REVIEW NO. 87-9 WAS APPROVED, WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated February 25, 1987, shall be the approved layout. -8- 4/1/87 - BZA Minutes, H. B. Board of Zoning Adjustments April 1, 1987 Page 9 2. Prior to issuance of building permits, applicant shall file a parcel map consolidating all parcels. Said map shall be recorded prior to final inspection and a copy submitted to the Department of Development Services. 3. Prior to issuance of building permits, the applicant shall submit the following plans: a. Landscape and irrigation plan to the Department of Development Services and Public Works for review and approval. b. Rooftop Mechanical Equipment Plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. 4. Installation of required landscaping and irrigation systems shall be completed prior to final inspection. 5. Prior to issuance of building permits, the owner of the subject property shall offer to dedicate irrevocable reciprocal driveway and parking easements between the subject site and adjacent properties as generally designated on the site plan. A copy of the legal instrument shall be approved by the City Attorney as to form and content and, when approved, shall be recorded in the Office of the County Recorder. A copy shall be filed with the Department of Development Services prior to occupancy. 6. Prior to issuance of building permits, street improvements, including street lights, shall be installed to the satisfaction of the Public Works Department. 7. Maximum separation between building wall and property line shall not exceed two inches (2"). 8. Driveway approaches shall be a minimum of twenty-seven feet (271) in width and shall be of radius type construction. 9. There shall be no outside storage or displays of any kind. 10. All repair work shall be conducted wholly within the building. 11. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 12. AYES: Evans, Godfrey, Krejci, Poe, Smith NOES: None_ ABSENT: None ADMINISTRATIVE REVIEW NO. _- 87-12...-- Applicant: Mola Development Corporation A request to create a sales office and model home complex. Subject property is located at 20291 Seabright Lane (South side of Adams Avenue approximately seven hundred-feet.-(700.') East. -of Beach Boulevard). This request is covered by Categorical Exemption, Class 3, California Environmental Quality Act, 1986. Staff explained this was a proposal for a sales office and model home complex which would provide seventeen-(17) parking spaces, landscaping and signage for a condominium project. It would be located on Seabridge Lane off Beach Boulevard and Adams Avenue. The -10- 4/l/87 -- BZA Minutes, H. B. Board of Zoning Adjustments April 1, 1987 Page 11 applicant would need to provide a $1,000.00 cash bond for each sales office and model home complex. Staff recommended approval with conditions. The applicant's representative, Denise Snider, was present from the Marketing Department of Mola Development. Ms. Snider explained they would be using the units as models and would not be creating a sales office in another location. She added her company felt an $8,000.00 cash bond was an excessive amount. Glen Godfrey explained it would be $1,000.00 for each complex for a total of $2,000.00 - not $8,000.00. Ms. Snider said that would be agreeable. UPON MOTION BY SMITH AND SECOND BY GODFREY, ADMINISTRATIVE REVIEW NO. 87-12 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated March 9, 1987, shall be the approved layout. 2. Prior to issuance of building permits, the applicant shall submit the following plans: a. Landscape and irrigation plan for models and parking areas to the Department of Development Services and Public Works for review and approval. 3. Installation of required landscaping and irrigation systems shall be completed prior to final inspection. 4. Security fencing, gates, locking devices, and ingress and egress from streets and parking areas shall be reviewed and approved by the Fire and Police Departments prior to issuance of building permits. 5. A site plan and elevations delineating various directional signs and model identification signs shall be submitted to the Department of Development Services and Public Works for review and approval. Subdivision directional signs shall comply with Section 9610.9 (c) of the Huntington Beach Ordinance Code, and shall be installed prior to final inspection. 6. All roads (including fire access) shall be of hard surface, all weather construction meeting Public Works requirements and installed prior to combustible construction. 7. All water lines and fire hydrants shall be installed and approved by the Fire Department prior to issuance of permits for any temporary or permanent structures. -11- 4/1/87 - BZA Minutes, H. B. The office use shall be discontinued within thirty (30) days following sale of the last on -site unit. A surety bond of $1,000.00-shall be posted with the City for each model_home complex (for a total of $2,000.00) to guarantee compliance with all provisions of the Code and the Huntington Beach Ordinance Code and Building Code. Such model homes shall only serve the tract specified in subject Administrative Review application. 10. Provide handicap parking spaces and access to the sales office and model -homes per -.;Building Division requirements. 11. All bui.lding spoils, such as unusable_ lumber, wir-e,_ppe, and other surplus -or unusable material, shall be -disposed of at an off -site facility equipped to handle them. 12. Fire lanes, as determined by the Fire Department, shall be posted and marked. 13. Subject property is located at 1505 Palm Avenue (Southwest corner of Palm Avenue and Fifteenth Street). This request is covered by Categorical Exemption, Class 5, California Environmental Quality Act, 1986. �1 -12- 4/1/87 - BZA Minutes, H. B. Board of Zoning Adjustments April 1, 1987 Page 13 According to Staff, this was a request for consolidation of two (2) parcels into one (1) parcel. There are three units currently located on the property and the applicant proposes to construct a two-story room addition and a carport with a sundeck over it. The applicant has indicated the property will remain as a three (3) unit project. Staff recommended approval with conditions. The applicant's representative, Bill Earl, was present and said he was the applicant's brother. Mr. Earl said this was quite a large lot for the area and the units had been built in 1971 or 1972. He continued that they were just making a small room addition and a carport with sundeck. Mr. Earl said he did not understand all of the conditions and asked for clarification. The Board members explained the items to him. There was a discussion between Les Evans and Mr. Earl relative to street dedication and street improvements. Glen Godfrey explained a Waiver could be granted if all the items had been completed. Daryl Smith suggested the motion for approval could be "couched" to allow a Waiver if everything was done. Mr. Earl agreed to the conditions for the Waiver. UPON MOTION BY EVANS AND SECOND BY SMITH, TENTATIVE PARCEL MAP NO. 87-175 WAS APPROVED FOR A WAIVER WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF APPROVAL FOR WAIVER: 1. The proposed consolidation complies with the requirements as to area, improvement and design, flood and water drainage control, appropriate and approved public roads, sewer and water facilities, environmental protection, and other requirements of Article 992 of the Subdivision Section of the Ordinance Code. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL(S) FOR ANY PURPOSE: 1. The Tentative Parcel Map received by the Department of Development Services on March 16, 1987, shall be the approved layout (with the amendments as noted thereon). 2. The applicant shall file, through the Huntington Beach City Clerk's office, and have recorded with the Orange County Recorder's Office, a Certificate of Compliance in conjunction with the approved plat map.
