BOARD MEMBERS PRESENT: Evans, Godfrey, Krejci, Poe, Smith STAFF MEMBERS PRESENT: Phillips MINUTES: MINUTES OF THE REGULAR MEETING OF APRIL 8, 1987, WERE DEFERRED TO THE REGULAR MEETING OF APRIL 22, 1987. REGULAR AGENDA ITEMS: CONDITIONAL EXCEPTION NO. 87-21 John David King and Associates A request to permit 1) two (2) required off-street parking spaces to be located on -street and 2) a reduction in minimum required open space dimensions. Subject property is located at 510 Seventeenth Street (East side of Seventeenth Street approximately two hundred feet (200') South of Acacia Avenue). This request is covered by Categorical Exemption, Class 5, California Environmental Quality Act, 1986. The Staff member, Laura Phillips, informed the Board this was a request to develop a triplex in the Town Lot area. The City has changed the requirements for guest parking on the site, and the applicant is requesting a variance to allow two (2) on -street spaces in lieu of the required two (2) on -site spaces. A total of seven (7) spaces are needed. The applicant is also requesting a reduction in the minimum open space dimensions. Staff recommended approval of the open space reduction but denial of the parking variance because there was no land -related hardship. Staff further mentioned two (2) letters had been received in objection to the parking variance. The Public Hearing was opened by Chairman Dennis Krejci and the applicant, John David King, was present. Mr. King stated this was the last lot in the block and the triplex would be an in -fill project, Mr. King added the triplex had been designed to match the existing architecture in the area and the guest parking could not be provided on -site without going to a three (3) story building which would be out of context with the neighborhood. He further stated other triplexes did not meet the open space requirements and requested the Board's approval of both requests. Minutes, H. B. SMITH MOVED FOR APPROVAL OF BOTH REQUESTS COVERED UNDER CONDITIONAL EXCEPTION NO. 87-21 WITH FINDINGS THAT THE PROJECT WOULD NOT REDUCE THE 900 SQUARE FOOT REQUIRED OPEN SPACE, WOULD NOT BE DETRIMENTAL TO THE AREA, WOULD PROVIDE FOR GREATER DESIGN FLEXIBILITY_AND UTILITY OF THE UNITS, AND WOULD NOT AFFECT THE GENERAL PLAN OF THE CITY OF HUNTINGTON BEACH, AND WITH CONDITIONS AS PRESENTED BY STAFF WITH THE EXCEPTION OF ITEM l.a REGARDING THE ON -STREET PARKING. THE MOTION DIED FOR LACK OF A SECOND. Les Evans said he agreed the project, as designed, would better match the area architecturallly but he did not feel the on -street guest parking should be allowed. Daryl Smith stated he was not aware of the purported objections by residents since no one was present. Ms. Phillips reminded Mr. Smith that copies of the two (2) letters had been included in the Board members' packets. After Mr. Smith's review of the letters, there was a further discussion of the adjacent property owners' ojbections. Dennis Krejci suggested there might be a possibility of tandem parking on the lot with access from the alley. These parking spaces could be assigned to one unit and would increase the on -site parking to six (6) spaces, leaving only one (1) on -street guest parking space. Tom Poe said the one (1) space would still impact the adjacent neighbors. MOTION WAS MADE BY EVANS AND SECONDED BY POE THAT CONDITIONAL EXCEPTION NO. 87-21 BE APPROVED FOR THE OPEN SPACE REDUCTION BUT DENIED FOR THE TWO (2) ON -STREET PARKING SPACES. MOTION FAILED BY THE FOLLOWING VOTE: AYES: Evans, Poe NOES: Godfrey, Krejci, Poe ABSENT: None Dick Harlow requested permission from the Board to speak in behalf of the project. Mr. Harlow stated he and the applicant had discussed the possibility of providing two (2) parking spaces with access off the -alley. They agreed this could be done by providing concrete pads rather than landscaping the area and by shifting the building very slightly. -2- 4/15/87 - BZA Minutes, H. B. Board of Zoning Adjustments April 15, 1986 Page 3 Glen Godfrey moved for approval of both requests if the on -street parking was limited to the "technical" one-half space with tandem parking on the site to be approved by the Development Services Department. This motion was seconded by Daryl Smith. UPON MOTION BY GODFREY AND SECOND BY SMITH, CONDITIONAL EXCEPTION NO. 87-21 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS FOR APPROVAL: 1. Granting of reduction in open space minimum dimension and minimum open space area will not reduce the required total open space area (900 Square Feet). 2. The granting of Conditional Exception No. 87-21 will not be materially detrimental to the public welfare, or injurious to property in the same zone classifications. 3. The granting of the Conditional Exception will not adversely affect the General Plan of the City of Huntington Beach. 4. The reduction in minimum open space dimension provides for greater design flexibility and utility of the units. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated April 6, 1987, shall be revised to depict the modifications described herein: a. Provide one (1) additional tandem parking space on -site. One (1) on -street parking space will be allowed. 2. Prior to issuance of building permits, the applicant shall file a parcel map or parcel map waiver request to consolidate Lot Nos. 10 and 12, Block 516, Seventeenth Street Section of Huntington Beach Tract. The parcel map or plat map and notice shall'be recorded with the Orange County Recorder and a copy of the recorded map or plat filed with the Department of Development Services prior to final inspection or occupancy. 3. Prior to issuance of building permits, the applicant shall submit the following plans: a. Rooftop Mechanical Equipment Plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. 4. Installation of required landscaping and irrigation systems shall be completed prior to final inspection. 5. The two and one-half foot (2-1/2') alley dedication -shall be made to the City to satisfaction of the Public Works Department. 6. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be -disposed -of at an off -site facility equipped to handle them. 7. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 8. Low -volume heads shall be used on all spigots and water faucets. 9. All applicable Public Works fees shall be paid prior to issuance of building permits. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. Landscaping shall comply with Article 913 of the Huntington Beach Ordinance Code. AYES: Godfrey, Krejci, Smith NOES: Evans, Poe ABSENT: None CONDITIONAL EXCEPTION NO. 87-24 ADMINISTRATIVE REVIEW NO. 87-15 NEGATIVE DECLARATION NO. 87-9 Applicant: Boureston Development/Mike Todd CE REQUEST: To permit 1) a three and one-half foot (3-1/2') encroachment into required fourteen foot (14') front yard setback on Redondo Circle, 2) a truck well fifty feet (50') in width in lieu of twenty feet (20'), and 3) a three foot (31) wide landscape buffer in lieu of required six foot (6'). -4- 4/15/87 - BZA Minutes, H. B. Board of Zoning Adjustments April 15, 1986 Page 5 , AR REQUEST: To permit an one hundred twenty-two thousand, four hundred twenty-four (122,424) Square Foot industrial building. Subject property is located West of Beach Boulevard and South of Talbert Avenue (between the East terminus of Redondo Circle and South terminus of Kovacs Circle). This request is covered by Negative Declaration No'. 87-9. Ms. Phillips reported the requests were for construction of an industrial building with variances. Staff recommended increasing the landscape planter on the South side by decreasing the planter on the North side of the driveway if the Fire Department had no objections. Staff further mentioned letters had been received stating an Environmental Impact Report be filed rather than processing a Negative Declaration for the project; however, the Environmental Staff member feels mitigations placed on the Negative Declaration will be sufficient for the project. Staff enumerated the conditions and restrictions being placed on construction of the building. Staff recommended approval of the three requests. The Public Hearing was opened and Michael D. Todd was present to speak for Boureston Development. Others present to represent the applicant were Lee Wieder, Gary Pierson, Joe E. Robertson, and Robert Goodman. Mr. Todd stated he concurred with Staff's recommendations. Daniel G. Higman stated he was owner of Reliable Lumber Company which was located on the same street with the proposed project. Mr. Higman indicated his opposition to the construction because of additional traffic problems, truck deliveries, and the fact the street had not been continued through as promised. Mr. Higman asked that the Board deny the variances. Harold Ducate stated he was an attorney representing Reliable Lumber Company and introduced the subject of ownership of the property. He stated it was his understanding the property was owned by the City of Huntington Beach and his client had not received prior notice of hearings held by the City. Mr. Ducate further stated that, in his opinion, an Environmental Impact Report was required and indicated the application was improperly before the Board. Another Redondo Circle tenant, Bob Silver, spoke in opposition to the project because of the increased traffic and the fact the street had not been extended through as originally planned. Lee Wieder said it was his understanding the hearing was properly advertised and the appropriate parties were notified. Mr. Wieder, further stated there had been previous public hearings regarding the project, and he thanked Staff members for their assistance in -5- 4/15/87 - BZA Minutes, H. B. Mr. Ducate informed Mr. Wieder there had been other hearings but -this was the first time adjacent property owners had been notified. - Mr. Todd stated truck deliveries would be limited to three per day - one for pick up of finished products and two for delivery of new materials. He further added noise problems would not be greatly increased by operation of this facility. Mr. Higman questioned who would be monitoring deliveries and Mr. Robertson stated they would control the truck traffic. Connie Mandic reminded the Board they were approving a building which would be there for many years and might be occupied by other tenants at a later time. There was no one else present to speak for or against the project so the Public Hearing was closed. Daryl Smith asked Steven Kohler for an explanation concerning the ownership of the parcel. Mr. Kohler indicated the Redevelopment Agency of the City still owned title to the land and a -letter indicating the property owner's approval had been placed in the file. Mr. Kohler further stated the City Council had selected the applicant which was before the Board on this date.- - Upon questioning by -Daryl Smith, Ms. Phillips repeated the information she had given concerning traffic study figures used in calculations for this project, as well as'other industrial buildings. Les Evans initiated the subject of Tentative Parcel Map requirements for the project. Daryl Smith indicated he would move for approval of all three requests - the Negative Declaration, Conditional Exception and Administrative Review. Les Evans requested that the motions be made separately. B. Board of Zoning Adjustments April 15, 1986 Page 7 FINDINGS FOR APPROVAL --CONDITIONAL EXCEPTION NO, 87-24: 1. The site is located at the terminus of two industrial streets. Therefore, the reduced setback and truck well will not adversely impact surrounding residents, or impact the value of property and improvements in the vicinity. 2. Because of special circumstances applicable to the subject property, including size, shape, topography, location or surroundings, the strict application of the Zoning Ordinance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classifications. 3. The granting of Conditional Exception No. 87-24 will not be materially detrimental to the public welfare, or injurious to property in the same zone classifications. 4. The granting of the Conditional Exception will not adversely affect the General Plan of the City of Huntington Beach. SPECIAL CONDITIONS OF APPROVAL - CONDITIONAL EXCEPTION NO 87-24: 1. The site plan, floor plans, and elevations received and dated April 1, 1987, shall be the approved layout, with modifications as noted in Administrative Review No. 87-15. 2. All Conditions of Approval of Administrative Review No. 87-15 shall be applicable. The floor plans and elevations received and dated April 1, 1987, shall be the approved layout. 2. The site plan dated April 1, 1987, shall be revised to depict the modifications described herein: a. Landscape and irrigation plan to the Department of Development Services and Public Works for review and approval. b. Rooftop Mechanical Equipment Plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. 4. Installation of required landscaping and irrigation systems shall be completed prior to final inspection. 5. Grading plans shall be submitted to the Public Works Department along with plans for silt control for all storm runoff if determined to be necessary by the Director of Public Works. 6. If foil type insulation is to be used, a fire retardant type shall be installed as approved by the Building Department. 7. An automatic fire sprinkler system shall'be approved and installed pursuant to Fire Department regulations. 8. Service roads and fire lanes, as determined by the Fire Department, shall be posted and marked. 9. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. 10. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 11. The development shall comply with mitigation measures specified for " Future Industrial Activity" in the Report prepared by J. J. Van Houten and Associates, Inc., dated April 6, 1983 (attached). 12. Natural gas shall be stubbed in at the locations of water heaters and central heating units. 13. Low -volume heads shall be used on all spigots and water faucets. 14. If lighting is included in the parking lot, high-pressure sodium vapor lamps shall be used for energy savings. Prior to issuance of building permits, applicant shall file a parcel map to delineate the alignment of Redondo Circle and Kovacs Circle. Said map shall be recorded prior to final inspection and a copy submitted to the Department of Development Services. 16. All applicable Public Works fees shall be paid prior to issuance of building permits. INFORMATION ON SPECIFIC CODE REQUIREMENTS - ADMINISTRATIVE REVIEW NO, 87-15: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. Landscaping shall comply with Article 960 of the Huntington Beach Ordinance Code. 4. The Board of Zoning Adjustments reserves the right to revoke Administrative Review No. 87-15 if any violation of these conditions of the Huntington Beach Ordinance Code occurs. AYES: Evans, Godfrey, Krejci, Poe, Smith NOES: None ABSENT: None USE PERMIT NO. 87-18 Applicant: Huntington Harbour Anglers A request to permit a one (1) day charity bazaar in a shopping center parking lot on May 2, 1987. Subject property is located at 16899 Algonquin Street (West side of Algonquin Street between Davenport Drive and Boardwalk Drive). This request is covered by Categorical Exemption, Class 4, California Environmental Quality Act, 1986. Staff informed the Board the applicant's representative could not present and had requested a continuance to April 22, 1987, in the event the Board expected to alter any of the conditions placed on the request in past years. However, Staff recommended the same conditions imposed the previous year and the Board chose to hear project. Glen Godfrey asked if any negative reports had been received in previous years regarding the bazaar, and Staff replied she had received no negative comments from the Police Department. be the -9- 4/15/87 - BZA Minutes, H. Board of Zoning Adjustments April 15, 1986 Page 10 UPON MOTION BY EVANS.AND SECOND BY POE., USE PERMIT NO. 87-18 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS FOR APPROVAL: 1. The establishment, maintenance and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of Use Permit No. 87-18 will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the goals and.objectives of the City's General Plan and Land Use Map. SPECIAL CONDITIONS OF APPROVAL: 1. The conceptual site plan received and dated March 31, 1987, shall be the approved layout. 2. Sidewalks shall be maintained at a clear width of four feet (4.). - - 3. Signs shall be prohibited within the public right-of-way. 4. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. 5. The applicant shall obtain clearance from the Public Liability Claims Coordinator, Administrative Services Department, and/or shall provide a Certificate of Insurance and Hold Harmless Agreement to be executed at least five (5) days prior to the event. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The use shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. A Certificate to Operate shall be issued by the Department of Development Services as required by Section 9730.80 of the Huntington Beach Ordinance Code. 4. The Board of Zoning Adjustments reserves the right to revoke Use Permit No. 87-18 if any violation of these conditions of the Huntington Beach Ordinance Code occurs. AYES: Evans, Godfrey, Krejci, Poe, Smith NOES: None ABSENT: None ADMINISTRATIVE REVIEW NO. 87-14 NEGATIVE DECLARATION NO. 87-7 Applicant• Kraus Construction, Inc. A request to permit a twenty-five thousand (25,000) Square Foot industrial building. Subject property is located at 7412 Cedar Avenue (Property fronts on Gothard Street at about 17252 Gothard Street). This request is covered by Negative Declaration No. 87-7. Staff informed the Board the applicant had provided a revised site plan for the proposed industrial building and there were no variances being requested. Ms. Phillips explained, upon questioning by Daryl Smith, that the revised plan indicated a different street access and landscape planter location. Staff further indicated there had been a question about the length of the lot and street dedications required by Public Works. Staff recommended that colors and materials should be subject to approval of Development Services Department. The Public Hearing was opened and Gene Kraus was present. Mr. Kraus said he would like to make the driveway width larger than stipulated and Les Evans stated there would be no objection if it did not conflict with parking spaces. Mr. Kraus asked about removal and replacement of the trees. Daryl Smith and Glen Godfrey explained what would be required as to types and sizes. Tom Poe inquired about parking spaces indicated at the end of the aisleways. Ms. Phillips explained they would be fifteen foot (15') spaces and the aisleway would be twenty-eight feet (281). Mr. Poe indicated the turning radius would have to be maintained. UPON MOTION BY SMITH AND SECOND BY POE, NEGATIVE DECLARATION NO. 87-7 AND ADMINISTRATIVE REVIEW NO. 87-14 WERE APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: -11- 4/15/87 - BZA Minutes, H. B. Board of Zoning Adjustments April 15, 1986 Page 12 SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated April 13, 1987, shall be modified as described herein: a. Width of the driveway on Gothard Street shall be subject to approval of the Public Works Department but shall be no less than thirty feet (30') wide. b. Radius type corners on landscape planters at entrance to parking lot. 2. Prior to issuance of building permits, the applicant shall file a parcel map or parcel map waiver request to legalize -the existing lot. The parcel map or plat map and notice shall be recorded with the Orange County Recorder and a copy of the recorded map or plat filed with the Department of Development Services prior to final inspection or occupancy, or submit proof or legal lot creation. 3. Prior to issuance of building permits, the applicant shall submit the following plans: a. Landscape and irrigation plan to the Department of Development Services and Public Works for review and approval.. b. Rooftop Mechanical Equipment Plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. 4. Installation of required landscaping and irrigation systems shall be completed prior to final inspection. 5. Building colors and materials shall be subject to approval by the Department of Development Services. 6. If foil type insulation is to be used, a fire retardant type shall be installed as approved by the Building Department. 7. On -site fire hydrants shall be provided in number and at locations specified by the --Fire Department. 8. An automatic fire sprinkler system shall be -approved and installed pursuant to Fire Department regulations. 9. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. 11. Maximum separation between building wall and property line shall not exceed two inches (2"). 12. There shall be no outside storage of vehicles, vehicle parts, equipment or trailers. 13. All repair work shall be conducted wholly within the building. 14. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 15. Natural gas shall be stubbed in at the locations of water heaters and central heating units. 16. Low -volume heads shall be used on all spigots and water faucets. 17. If lighting is included in the parking lot, high-pressure sodium vapor lamps shall be used for energy savings. All outside lighting shall be directed to prevent "spillage" onto adjacent properties. 18. All applicable Public Works fees shall be paid prior to issuance of building permits. 19. Mature trees on -site shall, where feasible, be incorporated into the project's landscape plan. Any mature tree that is removed shall be replaced at a one-half to one (1/2 : 1) ratio with twenty-four inch (24") box trees, or at a ratio/size to the satisfaction of the Public Works and Development Services Department. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. Development shall meet all local and State regulations regarding installation and operation of all underground storage tanks for any businesses that plan to install underground tanks. 4. Landscaping shall comply with Article 953 of the Huntington Beach Ordinance Code. -13- 4/15/87 - BZA Minutes, H. B. Board of Zoning Adjustments April 15, 1986 Page 14 5. Prior --to issuance of a Certificate of Occupancy, the business/use must comply with Chapter 1758 of the City of Huntington Beach's Municipal Code which requires any business that handles or stores hazardous materials, including waste, to .inventory the hazardous materials on -site and prepare a Business Emergency Plan in case of an accidental release of toxic materials. 6. All hazardous materials, including waste, must be properly handled and stored in accordance with the Uniform Fire Code. Waste oil is considered a hazardous waste. 7. The Board of Zoning Adjustments reserves the right to revoke Administrative Review No. 87-14 if any violation of these conditions of the Huntington Beach Ordinance Code occurs.
