REGULAR AGENDA ITEMS: COASTAL DEVELOPMENT PERMIT N0, 87-9 Applicant: Musil Perkowitz Ruth, Inc. A request to permit a 9,900 Square Foot commercial building in an existing retail center. Subject property is located at 16821-16907 Algonquin Street (West side of Algonquin Street between Boardwalk and Davenport Drives) - Boardwalk Shopping Center. This request is covered by Categorical Exemption, Class 1, California Environmental Quality Act, 1986. Staff member, Laura Phillips, reported this was a request for a 9,900 square foot commercial building in the Huntington Harbor Mall. The parking area is being revamped to meet current codes for possible restaurant uses. Staff recommended approval based on findings and conditions. The Public Hearing was opened and the architect, Richard Dachman, was present. He agreed to the conditions of approval as presented by staff. Board members Smith and Godfrey arrived. Board member Smith asked if the applicant was aware of an agreement relative to a sign on the property which would be required to be reconstructed. Richard Dachman responded that an application had been filed in the Department of Development Services for a Sign Program. John Moss, representing the applicant, responded to a question of Board Member Godfrey indicating he had the signed maintenance agreement with him; however, there were some things he wanted to discuss with Public Works. Board Member Smith recommended a condition of approval be added that the landscape maintenance agreement be executed prior to the issuance of building permits. There was no one else present wishing to speak for or against the project and the Public Hearing was closed. A MOTION WAS'MADE BY SMITH AND SECOND BY GODFREY TO APPROVE COASTAL DEVELOPMENT PERMIT NO. 87-9 WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: AYES: Evans, Godfrey, Krejci, Poe, Smith NOES: None ABSENT: None MOTION PASSED FINDINGS FOR APPROVAL: 1. The proposed commercial building conforms with the plans, policies, requirements and standards of the Coastal Element of the General Plan. 2. The Coastal Development Permit is consistent with the CZ suffix zoning requirements, the C4 Zoning District, as well as other provisions of the Huntington Beach Ordinance Code applicable to the property. 3. At the time of occupancy, the proposed commercial building can be provided with infrastructure in a manner that is consistent with the Coastal Element of the General Plan. 4. The proposed commercial building conforms with the public -the access and public recreation policies of Chapter 3 of California Coastal Act. •.10•� KNO * 1. The site plan, floor plans, and elevations received and dated March 20, 1987 shall be the approved layout. 2. Prior to issuance of building permits, the applicant shall sign the landscape maintenance agreement relative to the shopping center sign which is located in the property at Warner and Algonquin. 3. Prior to issuance of building permits, the applicant shall submit the following plans: a. Landscape and irrigation plan to the Department of Development Services and Public Works for review and approval. b. Rooftop Mechanical Equipment Plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. (8008d) -2- 4/22/87 - BZA 6, 4. Installation of required landscaping and irrigation systems shall be completed prior to final inspection. 5. An automatic fire sprinkler system shall be approved and installed pursuant to Fire Department regulations. 6. Service roads and fire lanes, as determined by the Fire Department, shall be posted and marked. 7. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. 8. New/renovated driveway approaches shall be a minimum of twenty-seven feet (27•) in width and shall be of radius type construction. 9. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of -at an off -site facility equipped to handle them. 10. Proposed structures shall be architecturally compatible with existing structures. 11. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 12. Low -volume heads shall be used on all spigots and water faucets. 13. If lighting is included in the parking lot, high-pressure sodium vapor lamps shall be used for energy savings. All outside lighting shall be directed to prevent "spillage" onto adjacent properties. 14. All applicable Public Works fees shall be paid prior to issuance of building permits. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. Landscaping shall comply with Article 960 of the Huntington Beach Ordinance Code. (8008d) -3- 4/22/87 - BZA CONDITIONAL EXCEPTION NO. 87-26 in conjunction with USE PERMIT NO. 87-19 % Applicant: Willard J. Walters, AIA The conditional exception is a request to permit 1) a 0' side yard setback in lieu of a 30' setback for a warehouse building and 2) 83 parking spaces in lieu of 95 parking spaces. The use permit is a to permit an 11,300 square foot warehouse addition to an industrial building within 150' of the property zoned residential. The subject property is located at 5252 Argosy Avenue (South side of Argosy Avenue approximately 1,100 feet West of Graham Street. This request i.s covered by Categorical Exemption Calss 5, California Environmental Quality.Act, 1985. According to staff, the adjacent easterly property was approved with a reciprocal access agreement for fire access and the approval of this project would preclude -that agreement. Staff determined there was no physical hardship related to the land for granting the conditional exception request and recommended denial to the Board. The Public Hearing was opened and the applicant, Willard Walters, was present. He indicated that he -was not aware -of staff s recommendation for denial and further -was -advised over the telephone by staff that he could build a 0' setback according to the Huntington Beach Ordinance Code. He was not aware that the adjacent property owner had approval to build at 0' setback. He indicated that the building was used for storage of materials which are kept for two to three years; therefore, he felt the request for reduction in parking spaces justified. Board member Smith recommended continuance if the applicant was in agreement to work with staff and provide a revised site plan which would address code for setback and building requirements, reciprocal ingress and -egress and Fire Department access. Mr. Walters agreed to continuance which would allow him to discuss changes with the owner of the property. The public hearing was left open as staff and the applicant were requesting continuance. A MOTION WAS MADE BY SMITH AND SECOND BY EVANS TO CONTINUE CONDITIONAL EXCEPTION NO. 87-26 AND USE PERMIT NO. 87-19 TO MAY 6, 1987, BY THE FOLLOWING VOTE: AYES: Evans, Godfrey, Krejci, Poe, Smith NOES: None ABSENT: None MOTION PASSED (8008d) -4- 4/22/87 - BZA CONDITIONAL EXCEPTION 87-29 Mr. and Mrs. Gary Matsuura A request to permit a reduction in minimum required open space dimension from 25' to 15'-6". Subject property is located at 9651 Rocky Mountain Drive (North side of Rocky Mountain Drive approximately 55 feet West of McKinley Lane). This request is covered by Categorical Exemption, Class 5, California Environmental Quality Act, 1986. Staff reported that the request was to add a 285 square foot family room to an existing home. The open space can be met; however, the minimum dimensions are short. Staff recommended approval due to a precedent of a similar case which was approved in 1984, there is adequate area for the addition. The Public Hearing was opened and the applicant, Gary Matsuura, was present. He agreed to the conditions of approval as presented by staff. There was no one else present wishing to speak for or against the project and the Public Hearing was closed. A MOTION WAS MADE BY SMITH AND SECOND BY EVANS TO APPROVE CONDITIONAL EXCEPTION NO. 87-29 WITH THE FOLLOWING FINDINGS=AND CONDITIONS, BY THE FOLLOWING VOTE: AYES: Evans, Krejci, Poe, Smith NOES: Godfrey ABSENT: None MOTION PASSED FINDINGS FOR APPROVAL: 1. Granting of reduction in open space minimum dimension will not reduce the required total open space area (900 Square Feet). 2. Because of special circumstances applicable to the subject property, including size, shape, topography, location or surroundings, the strict application of the Zoning Ordinance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classifications. Irregular lot shape. 3. The granting of Conditional Exception No. 87-29 will not be materially detrimental to the public welfare, or injurious to property in the same zone classifications. 4.
