Palin PJA„EF MEMBERS PRESENT: Laura Phillips MINUTES: MINUTES OF THE REGULAR MEETING OF JULY 29, 1987, WERE APPROVED BY THE ZONING ADMINISTRATOR, AS TRANSCRIBED. 1 COASTAL DEVELOPMENT PERMIT NO. 87-20 Applicant: Bertram and Helen Ross A request to permit a second story addition to an existing single family residence. Subject property is located at 16721 Bolero Lane (North side of Bolero Lane approximately five hundred feet (5001) South of intersection with Baruna. Lane). This request is covered by Categorical Exemption, Class 5, California Environmental Quality Act, 1986. The Staff member, Laura Phillips, reported this was a request to add approximately two thousand (2,000) Square Feet to the second story of a single family residence. The balcony addition on the rear will need to be reduced by one foot (11) and the applicant has agreed to do this. Notices were sent to the adjacent property owners but Staff received no comments. The project is located in the Coastal Zone and is appealable to the California Coastal Commission. Staff recommended approval with conditions. The Public Hearing was opened by the Zoning Administrator, James W. Palin, and the applicants, Bertram and Helen Ross, were present. Mr. Ross stated Staff had accurately presented the request and he had no further comments. There was no one else present wishing to speak for or against the project so the Public Hearing was closed. Mr. Palin explained the request was appealable to the California Coastal Commission and that the Commission's appeal period would begin on the date they received the City's letter outlining the Conditions of Approval. Office of Zoning Administrator August 5, 1987 Page 2 COASTAL DEVELOPMENT PERMIT NO. 87-20 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS: FINDINGS FOR APPROVAL: 1. The proposed addition to a single family residence conforms with the plans, policies, requirements and standards of the Coastal Element of the General Plan. 2. The Coastal Development Permit is consistent with the CZ suffix zoning requirements, the R1.,Zoning-District, as well as other provisions of the Huntington.Beach Ordinance7Code applicable to the property. 3. At the time of occupancy, the --proposed single family residence can be provided with infrastructure in a manner that is consistent with the Coastal Element of the General Plan. 4. The proposed single family residence conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated June 30, 1987, shall be the approved layout, subject to the modifications described herein: a. Balcony shall be set back five feet (51) from -the rear property line 2. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall -be disposed of at an off -site facility equipped to handle them. 3. Proposed structures shall be architecturally compatible with existing structures. 4. Natural gas shall be stubbed in at the locations of water heaters and central heating units. 5. Low -volume heads shall be used on all spigots and water faucets. 6. Prior to issuance of building permits, the property owner shall sign, notarize, and record with the County Recorder a "Letter of Agreement" assuring that the single family residence will be maintained as one (1) dwelling unit. 1 (8803d) -2- 8/5/87 - OZA Minutes of Meeting H. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The Zoning Administrator reserves the right to revoke Coastal Development Permit No. 87-20 if any violation of these conditions of the Huntington Beach Ordinance Code occurs. USE PERMIT NO. 87-52 Applicant: SS Simon and Jude Catholic Church A request to permit an annual Church festival on October 2, 3 and 4, 1987. Subject property is located at 20444 Magnolia Street (Northeast corner of Magnolia Street and Indianapolis Avenue). This request is covered by Categorical Exemption, Class 4, California Environmental Quality Act, 1986. Staff stated this was a request for a temporary outdoor event - the annual fall festival sponsored by the Church as a means of fund raising. This event has been approved in the past but there were objections presented by the adjacent property owners. Last year, after approval by the Board of Zoning Adjustments, the request was appealed to the Planning Commission. Staff recommended approval with the same basic conditions as those placed on the request last year by the Planning Commission since the neighbors felt last year's operation -created no major problems with traffic, noise or hours. Staff said the Church had agreed to abide by these same conditions. Mr. Palin inquired about the hours of operation listed in the Findings. Staff explained there had been a typographical error in the Findings shown in the Planning Commission minutes and the closure time should be 10:00 P.M. The Public Hearing was opened by the Zoning Administrator. Tony Joos, Chairman,.and Jim Lange, Co -Chairman, were present to represent the applicant. Upon questioning by Mr. Palin, both Mr. Joos and Mr. Lange agreed to and concurred with the conditions as presented by Staff. Mr. Lange said they had been attempting to reach someone in the City who could grant them permission to park in the bicycle lane on Magnolia Street and on Indianapolis Avenue. Prior to issuance of a permit, a layout and circulation plan shall be approved by the Fire Department. Fire access lanes shall be maintained. 6. When the site is ready for the event, an on -site inspection shall be made by the Departments of Community Development and Fire. If all site conditions are met, a Certificate to Operate shall be issued. The festival shall not commence until the Certificate to Operate has been issued. 7. Prior to the issuance of a permit, appropriate signs (temporary) for the direction of traffic and on -site parking shall be provided by the applicant. Said signs, location and content to be as recommended by the Traffic Division of the Police Department. Barricades shall be placed on both sides of the intersection of Kelvingrove Lane and Indianapolis Avenue and at the intersection of Magnolia Street with Bedel Drive and Village Drive. The applicant shall provide, at their expense, uniformed police officers to man the barricades from one (1) hour prior to the opening of the festival to the close of each day. (To be approved by the Traffic Engineer and Traffic Division of the Police Department). 8. In a number as determined by the Police Chief, uniformed officers shall be provided on -site during the hours of operation - not less than four (4) officers at any time. Cost of this and Condition No. 7 shall be borne by the applicant. 9. Breakdown of stands, equipment, apparatus and rides shall be prohibited after 10:00 P.M. on Sunday. Breakdown of the wooden booths shall be allowed until 1:00 A.M. 10. Use of amplifiers, speakers, musical instruments and playing of recorded music are to be discontinued as of 10:00 P.M. each evening. Speakers located in the Garden Dining Area will be permitted until closing hours each day and shall be in conformance with the City of Huntington Beach Noise Ordinance. Speakers shall not be directed towards any housing area. 11. The carnival, and all related activities, shall comply with all applicable sections of the Municipal Code requirements pertaining to the Noise Ordinance. 12. Office of Zoning Administrator August 5, 1987 Page 7 USE PERMIT NO. 87-63 Applicant' Faces Nite Club A request to permit an outdoor event on August 8, 1987, from noon until evening, including classic car display, games, food, and live music. Subject property is located at 18582 Beach Boulevard (East side of Beach Boulevard approximately three hundred feet (300') South of Ellis Avenue). This request is covered by Categorical Exemption, Class 4, California Environmental Quality Act, 1986. Staff explained this was a request for a one (1) day outdoor event in a shopping center on August 8, 1987. This event is being co -sponsored by the Orange County Cruisin' Association and would consist of a classic car display, booths, and entertainment outside in the parking lot. The applicant was unable to obtain permission for parking in an adjacent shopping center lot but there will be additional parking at the rear. Staff recommended approval with conditions. Mr. Palin inquired whether the Fire Department had indicated how many fire lanes would be needed and Staff replied she had received no comments. However, normally the fire lanes were indicated with ropes or other movable structures. The Public Hearing was opened by the Zoning Administrator and Jerry Tammen was present to represent the applicant. Mr. Palin asked where the games, music, food booths, etc., would be located. Mr. Tammen said they had revised the number of cars expected and they were, allocating one hundred fifty (150) spaces for parking. Mr. Tammen added there would be no live entertainment outside except for the disk jockey and no alcoholic beverages would be served except in the club itself. He said most of the businesses would be open and several places would have booths. Upon questioning by Mr. Palin, Mr. Tammen explained the Orange County Cruisin' Association was a group of 1,100 members whose families had classic cars - cars which dated up to the 1960's. Mr. Palin explained it was unfortunate the organization had chosen this particular time since the OP Surfing Championships would be in town this week -end and traffic on Beach Boulevard would be very extensive. The Zoning Administrator further suggested that, in the future, the applicant check with City departments to determine if other major events were scheduled so additional traffic problems could be prevented. TENTATIVE PARCEL MAP NO. 87-314 Applicant: Nick Baker A request to consolidate two (2) lots into one (1) lot for commercial purposes. Subject property is located on the Southwest corner of Bolsa Avenue and Springdale Street. This request is covered by Categorical Exemption, Class 5, California Environmental Quality Act, 1986. The Zoning Administrator asked if the applicant had received a copy of the suggested conditions. Nick Baker was present and stated he had not received them. He was given a copy of the conditions and, after reading, stated he agreed to the conditions. Mr. Baker asked if he could proceed with building plans. Mr. Palin stated the conditions did not stipulate "prior to issuance of building permits" and was usually considered to be "prior to occupancy". NOTE: File records indicated a copy of the Suggested Conditions of Approval was mailed to Mr. Becker by Certified Mail and received at his office by Jim Cott on July 29, 1987. TENTATIVE PARCEL MAP NO. 87-316 Applicant: Frank A. Merenda A request to legalize an existing parcel in accordance with Conditions of Approval for Administrative Review No. 87-14. Subject property is located at 17222-17242 Gothard Street (East side of Gothard Street approximately one hundred ten feet (110') South of Cedar Avenue). This request is covered by Categorical Exemption, Class 5, California Environmental Quality Act, 1986. The Zoning Administrator asked if the applicant was present and Gene Kraus of Kraus Construction said he was representing the applicant. George Kerns, an engineer, was also present and stated they had received a copy of and did concur with the suggested conditions. Mr. Palin stated there was a discrepancy between the figures shown on the Tentative Parcel Map and those on the Assessor's Map - that the Assessor's Map showed 275 feet with thirty feet (30') to the center line and their Parcel Map showed 285 feet with 30 feet to the center line of Gothard Street. We will stipulate that it be shown as two hundred seventy-five feet (275') in depth with forty feet (40') to the center line of Gothard Street. Mr. Palin added the City did not have a copy of the Winterburg Tract map but would obtain one from the County. George Kerns asked if they could get a Waiver and Certificate of Compliance and Ms. Phillips said they could after the improvements were installed. Mr. Palin stated the City would require that at least a plat map be filed and Mr. Kerns asked why this would be necessary. Mr. Palin said it would be required because this was the third parcel within Lot "G". He added that this dedication should be made on Gothard Street in accordance with Standard Plan 104, adopted as Resolution No. 4620 by City Council on June 5, 1978, and only a minimum filing of a plat map and/or parcel map would be acceptable.
