CONDITIONAL EXCEPTION NO. 87-31
Applicant: Robert Glanville
A request to permit a reduction in minimum required open space
dimension from twenty-five feet (251) to sixteen feet and four
inches (16'-411). Subject property is located at 21082 Chubasco Lane
(East side of Chubasco Lane approximately one hundred eighty feet
(180') South of Orient Drive).
This request is covered by Categorical Exemption, Class 5,
California Environmental Quality Act, 1986.
The Staff member, Laura Phillips, reported the applicant was
requesting a family room addition to the rear of an existing single
family residence. The minimum open space requirement would be met
but the minimum open space dimensions would not satisfy Code
requirements. In 1979, an exception was granted in the neighborhood
because'of an irregularly -shaped lot; however, this particular lot
is a standard sized lot. Staff is recommending denial of the
request because there'is no land -related hardship.
The Public Hearing was opened by Chairman Dennis Krejci. The
applicant, Robert Glanville, stated they needed the additional
living space because of a recent addition to their family.

Mr. Glanville added he had considered making the addition on the
front of the residence but actually needed the space nearer the
kitchen and bedroom areas. The applicant said he had letters from
many of the adjacent property owners who had no objections to his
addition, and he also mentioned the previous property in the
neighborhood which had been granted a variance. Mr. Glanville
requested approval of his project by the Board.
Dennis Krejci asked that the letters referred to by Mr. Glanville be
submitted to the Board for reference and inclusion in the file.
There was no one else present wishing to speak for or against the
project so the Public Hearing was closed.
Bill Patapoff asked about the previous variance. Staff replied it
had required only nine hundred (900) Square Feet and was on an
irregularly -shaped lot. There was a discussion about the time
variation between the original submittal date and the hearing date.
The applicant explained the addition had been approved by the
Building Division but not the Planning Division because it did not
meet the Zoning Code.
MOTION WAS MADE BY GODFREY FOR DENIAL OF CONDITIONAL EXCEPTION
NO. 87-31 WITH FINDINGS AS PRESENTED BY STAFF. MOTION DIED FOR LACK
OF A SECOND.
Upon further questioning by Bill Patapoff and examination of records
by Staff, it was determined that the previous variance had been
granted for a standard sized lot.
UPON MOTION BY KREJCI AND SECOND BY PATAPOFF, CONDITIONAL EXCEPTION
NO. 87-31 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS,
BY THE FOLLOWING VOTE:
FINDINGS FOR APPROVAL:
1. Granting of reduction in open space minimum dimension and
minimum open space area will not reduce the required total open
space area (1200 Square Feet).
2. The granting of a Conditional Exception is necessary in order
to preserve the enjoyment of one or more substantial property
rights.
3. The granting of Conditional Exception No. 87-31 will not be
materially detrimental to the public welfare, or injurious to
property in the same zone classifications.
4. The granting of the Conditional Exception will not adversely
affect the General Plan of the City of Huntington Beach.

SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated
May 4, 1987, shall be the approved layout.
2. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at an
off -site facility equipped to handle them.
3. Proposed structures shall be architecturally compatible with
existing structures.
1. The development shall comply with all applicable provisions of
the Ordinance Code, Building Division, and Fire Department.
2. The applicant shall meet all applicable local, State, and

Glen Godfrey asked that the Minutes reflect his "NO" vote was
because findings could not be made for the variance before the Board
today since the previous exception was granted for a much smaller
variance.
CONDITIONAL EXCEPTION NO-. 87-32
NEGATIVE DECLARATION NO. 87-11
Applicant: Hobbs Associates
A request to permit 1) three hundred forty-four (344) parking spaces
in.lieu of three hundred ninety-one (391) spaces, 2) a five foot
(5') side yard setback in lieu of a ten foot (10') side yard
setback, 3) a reduction in required landscaping from six percent
(6%) to four percent (0), 4) a sixty foot (60') long main entrance
drive in lieu of an one hundred foot (1001) long main entrance
drive, and 5) a compact car parking bay in lieu of even distribution
of compact stalls throughout the parking area. Subject property is
located at 7227 Edinger Avenue (North side of Edinger Avenue
approximately two hundred twenty feet (2201) West of Gothard Street).
This request is covered by Negative Declaration No. 87-11.
Staff stated these variances were being requested for remodeling the
former Handyman site to accommodate the new Home Express business.
The applicant will add a new area for shopping and will alter the
parking area and landscaping. Staff reiterated the numerous
variances being requested and recommended approval with conditions.

Glen Godfrey inquired about the forty-two foot drive aisle at the
rear and the compact parking bay. Tom Poe stated the drive aisle
was wider than,required by the Fire Department but the corner radius
would need to be twenty-eight feet (28').
The Public Hearing was opened and the applicant's representative,
James Elrod, was present. Mr. Elrod explained they had shown the
compact parking in the rear area because of the width rather than
depth of the stalls. He added -this could-be;designated as employee
parking, whereupon Dennis Krejci asked if the employees only drove
compact cars. Glen Godfrey suggested restriping the parking lot
with compact spaces interspersed with standard sized spaces and
requiring a Parking.Management-Plan submittal stipulating employee
parking in the rear locations.
William E. Myers, Myers Building Industries,,.,Limited,:and
Mitchell J. Sapovich, Keystone Development Associates, each spoke in
favor of the project.
There was no one.else present wishing to speak for or against the
project so the Public Hearing was closed.
There was a lengthy discussion regarding the compact parking spaces,
restriping the parking lot, requiring a Parking Management Plan,
reducing the number of spaces to coordinate.with,warehouse space in
lieu of actual shopping area, not allowing�any.restaurant with over
twelve (12) seats in the area,.and the length of the main.,entrance
drive.
Bill Patapoff introduced elimination of.the easterly driveway
entrance and the problems,involved-in making right-and,left turns
into and out of the property. After further discussion, it was
determined the driveway would have to be striped and posted per
requirements of the Public -Works Department., Mr. Patapoff.also
reminded the applicant that any sidewalks;.curbs or�gutters damaged
by removal of trees would have to be,repaired or -replaced and that
on -site water mains should be dedicated,to.the City;of Huntington
Beach.
UPON MOTION BY POE AND SECOND BY PATAPOFF, NEGATIVE DECLARATION
NO. 87-11 AND CONDITIONAL EXCEPTION NO. 87-32 WERE APPROVED WITH THE
FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE:
FINDINGS FOR APPROVAL:
1. Because of special circumstances applicable to the subject
property, including size, shape, topography, location or
surroundings, the strict application of the Zoning Ordinance is
found to deprive the subject property of privileges enjoyed by
other properties in the vicinity and under identical zone

classifications. Adjacent R-1 property (Golden West College)
is not residential in nature and the existing location of
buildings and reciprocal access limits potential building
configurations.

3. The granting of Conditional Exception No. 87-32 will not be
materially detrimental to the public welfare, or injurious to
property in the same zone classifications.
4. The granting of the Conditional Exception will not adversely

5. The location, site layout, and design of the proposed use
properly adapts the proposed structures to streets, driveways,
and other adjacent structures and uses in a harmonious manner.
6. The access to and parking for the proposed use does not create
an undue traffic problem.
SPECIAL CONDITIONS OF APPROVAL:
1. The site.plan received and dated April 22, 1987, shall be
revised to depict the modifications described herein:
a. Parking spaces along northerly property line shall be eight
and one-half feet (8.51) wide.
b. Parking spaces shall not block required exits.
c. Parking spaces to the North of Home Express building shall
be nineteen feet (19') in length.
2. The floor plans and elevations received and dated April 22,
1987, shall be the approved layout.
3. Prior to issuance of building permits, the applicant shall file
a parcel map or parcel map waiver request to legalize the
existing parcel. The parcel map or plat map and notice shall
be recorded with the Orange County Recorder and a copy of the
recorded map or plat filed with the Department of Development
Services prior to final inspection or occupancy.
4. Prior to issuance of building permits, the applicant shall
submit the following plans:

a. Landscape and irrigation plan to the Department of
Development Services and Public Works for review and
approval.
b. Rooftop Mechanical Equipment Plan. Said plan shall
indicate screening,of all rooftop mechanical equipment and
shall delineate,the type of material proposed to screen
said equipment.
5. Installation of required landscaping and irrigation -systems
shall be completed prior to final inspection.
6. Restaurants with more than twelve (12) seats shall be
prohibited.
7. Prior to issuance of a grading.permi.t, a.grading.plan shall be
submitted to the Department of Public Works. A plan for silt
control for,all water runoff from the,property during
construction and during initial operation of,,,the project may be
required if deemed necessary by the Public Works Department.
8. A planned sign program shall be approved for all signing. Said
program shall be approved prior to the first sign request.
9. On -site fire hydrants shall be provided,.in number and at
locations ,specified by,tfe Fire Department..
10. An automatic fire sprinkler system shall be approved and
installed pursuant to Fire Department regulations.
11. Service roads and fire lanes, as determined by the Fire
,Department, shall be posted and marked.
12. Fire access lanes shall be maintained. If fire lane violations
occur and the services of the Fire Department are required, the
applicant will be liable for expenses incurred..
13.. Driveway approaches shall be a. minimum of twenty-seven feet
(271) in width and shall be of radius type construction.
14. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at an
off -site facility equipped to handle them.
15. Proposed structures shall,be architecturally compatible with
existing structures.
16. The applicant shall dedicate on -site water facilities to the
City of Huntington Beach.

17. Prior to issuance of building permits, the applicant shall
submit a Parking Management Plan to the Department of
Development Services to provide for employee parking in the
northerly parking area.
18. Applicant shall remove trees within public right-of-way and
replace any damaged sidewalks, curbs and gutters, per
requirements of the Department of Public Works.
19. The easterly driveway shall be posted and striped per
appropriate left/right turning to the satisfaction of the
Public Works Department.
20. Natural gas shall be stubbed in at the locations of cooking
facilities, water heaters, and central heating units.
21. Low -volume heads shall be used on all spigots and water. faucets.
22. If lighting is included in the parking lot, high-pressure
sodium vapor lamps shall be used for energy savings. All
outside lighting shall be directed to prevent "spillage" onto
adjacent properties.
23. Prior to issuance of building permits, the subject property
shall enter into irrevocable reciprocal driveway easement(s)
between the subject site and adjacent properties to the East.
A copy of the legal instrument shall be approved by the City
Attorney as to form and content and, when approved, -shall be
recorded in the Office of the County Recorder. A copy shall be
filed with the Department of Development Services prior to
occupancy.
24. All applicable Public Works fees shall be paid prior to
issuance of building permits.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions of
the Ordinance Code, Building Division, and Fire Department.
2. The applicant shall meet all applicable local, State, and
Federal Fire Codes, Ordinances, and standards.
3. Asbestos on site shall be removed in compliance with all
applicable City, County, State and Federal regulations prior to
occupancy.
4. A detailed soils analysis shall be prepared by a registered
Soils Engineer. This analysis shall include on -site soil
sampling and laboratory testing of materials to provide

detailed recommendations regarding grading, chemical and fill
properties, foundations, retaining walls, streets, and
utilities.
5. Landscaping shall comply with Article 960 of the Huntington
Beach Ordinance Code.

USE PERMIT NO. 87-24
NEGATIVE DECLARATION NO. 87-12
Applicant; John E. Schwartz
A request to add a drive-thru lube and oil facility to an existing
drive-thru coin -operated car wash. Subject property is located at
5841 Warner'Avenue (North side of Warner Avenue approximately four
hundred twenty feet (420') West of Springdale Street):)
This request is covered by Negative -Declaration Noi 87-12.
According to Staff, this was a request to add a drive-thru lube and
oil facility to an existing drive-thru car wash which is adjacent to
an existing shopping center. The project meets Code insofar as
setbacks, landscaping, and parking are•concerned. -In previewing
previous applications; the Board -has -applied service station
standards which require that bay doors not face the street. The way
this building is proposed on the site, the bay doors will be facing
the public right-of-way and•this is prohibited by those Code
standards. Staff recommended denial of the request as proposed.
There was a discussion between Glen Godfrey, Bill Patapoff and Staff
about relocating the building on the lot.and/or providing _
intensified landscaping to eliminate viewing the bay doors from the
street. Glen Godfrey also introduced the subject of a Site Plan
Amendment or Tentative Parcel Map to clarify recordation of the
parcels involved. I I.,

The Public Hearing was opened and the applicant, John Schwartz, was
present. Mr. Schwartz said he could understand Staff's concern with
the bay doors but the overall project would be an improvement to the
area. He mentioned that placement on the triangular -shaped lot
would be difficult, if not impossible, to prevent viewing the bay
doors and he would-be installing new signs, mansard --type roof, etc.,
to improve the appearance of the existing building.
Tom Poe reminded the applicant he would have to meet Fire Department
standards for disposing of oil and other wastes. Dennis Krejci
broached the subject of a soils study regarding settlement of the

ground in the area. Glen Godfrey mentioned the requirement for a
reciprocal access agreement between the applicant's property and the
adjacent shopping center.
The owner of the adjacent shopping center, Evan Kitsigianis, spoke
in objection to the project unless some means could be provided for
prevention of water flow onto his property. His suggestion was for
installation of a catch basin.
There was no one else present wishing to speak for or against the
project so the Public Hearing was closed.
There was an extensive discussion between the Board members, the
applicant, and the shopping center owner regarding solution of the
water flow problem, and Bill Patapoff stated a grading and drainage
plan would need to be submitted and approved by Public Works.
UPON MOTION BY KREJCI AND SECOND BY GODFREY, NEGATIVE DECLARATION
NO. 87-12 AND USE PERMIT NO. 87-24 WERE APPROVED WITH THE FOLLOWING
FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE:
FINDINGS FOR APPROVAL:
1. The establishment, maintenance and operation of the use will
not be detrimental to:
a. The general welfare of persons residing or working in the
vicinity;
b. Property and improvements in the vicinity of such use or
building.
2. The granting of Use Permit No. 87-24 will not adversely affect
the General Plan of the City of Huntington Beach.
3. The proposal is consistent with the goals and objectives of the
City's General Plan and Land Use Map.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans and elevations received and dated
April 16, 1987, shall be revised to depict the modifications
described herein:
a. Show handicap parking space

subject to approval -of the Departments of Development

Tube and oil facility service bays
2. Prior to issuance of building permits, the applicant shall file
a parcel map to legalize -the existing lot. The•parcel map
notice shall be recorded with the Orange County Recorder and a
copy of the recorded map or plat filed with the Department of
Development.Services prior to final inspection'or occupancy.
Alternatively, the applicant shall show proof that the
previously approved Tentative Parcel Map (No. 76-64) was
legally recorded.
3. Prior to issuance of-building"permits, the applicant shall
submit the following plans:
a. Landscape and Irrigation Plan to the Departments of
Development Services -and Public Works'for;review and
approval.
b. Rooftop Mechanical Equipment Plan. Said plan shall

Federal Fire Codes, Ordinances, and standards.
3. Development shall meet all local and State regulations
regarding installation and operation of all underground storage
tanks.
4. Landscaping shall comply with Article 960 of the Huntington
Beach Ordinance Code.
5. If any hazardous materials are to be used on site, the business
must comply with Chapter 1758 of the City's Municipal Code
which requires any business that handles or stores hazardous
materials, including waste, to inventory the hazardous
materials on site and prepare a Business Emergency Plan in case
of an accidental release. Waste oil is considered a hazardous
waste.

6. The Board of Zoning Adjustments reserves 'the''right to 'revoke
Use Permit No. 87-24 .if any violation of -these conditions of
the Huntington Beach Ordinance Code occurs.

Applicant: Humana Hospital- Hunting_ton�Beach
A request to permit an "Open House" for new critical care wing on
May 21, 1987, from 5:00 P.M.•to 7:00 P.M.- Subject property is
located at 17772 Beach Boulevard (Easttzide of Beach Boulevard
approximately,six hundred and two -feet (6021)1 Northlof Talbert
Avenue.
This request is covered by Categorical Exemption;"Class 4;1-'-
California Environmental Quality Act,: 1986. '" "
Staff said the applicant wanted to hold a temporary outdoor event on
the evening of.May 21, 1987. A thirty foot by thirty foot
(30' x 30') canopy would be installed in the hospital parking lot
for an "Open,House".,event in -honor -of opening�theinew critical care
wing. Staff recommended approval of the request.
Upon questioning by -Glen .Godfrey, .Tom Poe ,said the , canopy,•''a's
proposed, would be,in the fire lane and would have to be relocated.
The applicant's representative,.,Susan-Alex, stated.the canopy could
be moved to another location on the lot. Dennis Krejci suggested a
condition that the location would be subject to approval of the Fire
Department.

occur and the services of the Fire Department are required, the
applicant will be liable for expenses incurred.
4. The applicant shall obtain clearance from the Public Liability
Claims Coordinator, Administrative Services Department, and/or
shall provide a Certificate of Insurance and Hold Harmless
Agreement to be executed at least five (5) days prior to the
event.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The use shall comply with all applicable provisions of the
Ordinance Code, Building Division, and Fire Department.
2. The applicant shall meet all applicable local, State, and
Federal Fire Codes, Ordinances, and standards.
3. A Certificate to Operate shall be issued by the Department of
Development Services as required by Section 9730.80 of the
Huntington Beach Ordinance Code.
4. The Board of Zoning Adjustments reserves the right to revoke
Use Permit No. 87-21 if any violation of these conditions of
the Huntington Beach Ordinance Code occurs.

North of Pacific Coast Highway.

This request is covered by Categorical Exemption, Class 11,
California Environmental Quality Act, 1986.
Staff reminded the Board this same type of request had been approved
by the Board in previous years for this location. The parking lot
would be laid out in the same configuration but the.driveway would
vary slightly at the request,of Fire and Public.Works.Departments.
Staff recommended approval with conditions. -
The applicant's representative, Robert London Moore, Jr., was
present. Mr. Moore agreed to,the.conditions as presented.by Staff.

CONDITIONS OF APPROVAL:
1. The parking lot shall be totally enclosed prior to opening of
the parking lot in May, 1987, to prevent indiscriminate
pedestrian access to Newland Street..
2. Boundaries of such lots shall be marked off and secured by
chain. or ,cable,, with posts -a„ minimum, of .,three.i£eet (31) ; in
height,, solidly built. At,,a,minimum;�postsishall:consist of -
four inch by four inch (4" x 4") wood or equivalent metal posts
a minimum of one and,one-half.,inches;(1-1/2":);in diameter
securely set in the ground and-placed.eight•ifeet-(8'),on
center. The posts shall be connected with at least one (1)
strand of one-half inch (1/2") cable or chain securely fastened
to each post. An opening shall be provided to accommodate
vehicle access during business hours. A means of closing and
locking of the access.opening after business,hours shall be
provided.
3. Lots shall be surfaced.to meet-specifications.of the Public
Works, Fire and Development,Services.Departments for support of
vehicles and to provide dust control.
4. All aisle dimensions, bay depths,.driveway widths, circulation
and turning radii shall comply with Article 960 and Fire
Department requirements. Median lines of parking bays shall be
marked off by a physical barrier such as,concrete wheel
bumpers, telephone poles or equivalent.
5. All striping shall be accomplished and approved prior to the
opening of the lot for business.

6. The site shall be maintained in a clean condition free from
trash and debris. Trash containers shall be placed on the site
sufficient to accommodate and store all trash that accumulates
on the lot.
7. Lots shall be secured to prevent overnight parking between the
closing hour of one business day and the opening hour of the
following business day.
8. An attendant shall be on duty at all times during business
hours.
9. Directional and informational signs shall be displayed on -site
to provide identification of entry into the parking lot and
charges for parking and hours of operation. Such signs shall
be located at the entrance in a copy size visible to motorists
entering the parking lot. On -site signs shall not exceed
twelve (12) Square Feet and shall not be more than eight feet
(81) high nor less than six feet (61) high. Said signs shall
be removed from the site each season no later than the third
weekend of September.
10. An approved fire extinguisher shall be provided on the premises
during business hours.
11. A Certificate of Insurance and a Hold Harmless Agreement, in an
amount deemed necessary by the Administrative Services
Department, shall be filed with them at least five (5) days
prior to opening the parking lot.
12. The conceptual site plan received and dated April 23, 1987,
shall be approved by the Traffic Division of the Department of
Public Works for internal circulation and ingress and egress.
13. An inspection shall be made by Land Use and the Public Works
Department to insure that the above -imposed conditions have
been met prior to opening of business.
14. Surfacing and/or oiling of the parking lot shall be to the
satisfaction of the Department of Public Works.
15. No signs, swags, cables, post -signs, etc., shall be allowed in
the public right-of-way.

TENTATIVE PARCEL MAP NO. 87-213
Applicant: Harvey S. Feinstein
A request to consolidate two (2) parcels into one (1) parcel.
Subject property is located at 706 and 708 Delaware Street (East
side of Delaware Street approximately fifty-four feet (54') North of
Geneva Avenue).
This request is covered by Categorical Exemption, Class 5,
California Environmental Quality Act, 1986.
Staff informed the Board this was a request for consolidation of two
(2) parcels into one (1) parcel and was a requirement of a previous
approval by the Board for a residence. Staff recommended approval
with conditions.
Bill Patapoff mentioned that the utilities would have to be
underground and the alley dedication made.
The applic.3nt's representative, Dennis D'Ambra, was present and
reminded Mr. Patapoff that this was an established neighborhood and
the utilities were already overhead. Mr. Patapoff clarified the
information that utilities running on the parcel from one building
to another would have to be underground. Mr. D'Ambra agreed to the
conditions as presented.
UPON MOTION BY POE AND SECOND BY KREJCI, TENTATIVE PARCEL MAP
NO. 87-213 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS,
BY THE FOLLOWING VOTE:
FINDINGS FOR APPROVAL:
1. The proposed consolidation of two (2) parcels for purposes of
residential use in compliance with the size and shape of
property necessary for that type of development.
2. The General Plan has set forth provisions for this type of land
use as well as setting forth objectives for implementation of
this type of use.
3. The property was previously studied for this intensity of land
use at the time the land use designation for community
residential district allowing residential buildings was placed
on the subject property.
4. The size, depth, frontage, street width and other design and
improvement features of the proposed consolidation are proposed
to be constructed in compliance with standards plans and .

specifications on file with the City as well as in compliance
with the State Map Act and supplemental City Subdivision
Ordinance.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL(S) FOR
ANY PURPOSE:
1. The Tentative Parcel Map received by the Department of
Development Services on April 27, 1987, shall be the approved
layout (with the amendments as noted thereon).
2. A parcel map shall be filed with and approved by the Department
of Public Works and recorded with the Orange County Recorder.
3. The alley shall be dedicated to City standards.
4. Water supply shall be through the City of Huntington Beach's
water system at the time said parcel(s) is/are developed (if
such systems exist within 200 feet of said parcel(s).
5. Sewage disposal shall be through the City of Huntington Beach's
sewage system at the time said parcel(s) is/are developed (if
such systems exist within 200 feet of said parcel(s).
6. All utilities shall be installed underground at the time said
parcel(s) is/are developed.
7. Compliance with all applicable City Ordinances.
8. Public improvements shall be installed per requirements of the
Public Works Department.
9. A copy of the recorded parcel map shall be filed with the
Department of Development Services.
10. All vehicular access rights along Delaware Street shall be
dedicated to the City of Huntington Beach except at locations
approved by the Board of Zoning Adjustments.
