Subject property is located at 16632 Baruna Lane (East side of Baruna Lane at intersection with Bolero Lane). This request is covered by Categorical Exemption, Class 1, California Environmental Quality Act, 1986. The Staff member, Laura Phillips, reported this was a request to add forty-four (44) Square Feet of living area and a balcony to a single family dwelling which had been previously approved under a Coastal Development Permit. Staff recommended approval of the project since the revised plan would still meet setbacks and other aspects of the Code. The Public Hearing was opened by Chairman Dennis Krejci and the applicant's representative, Dwayne Carter, was present. Mr. Carter stated they were just increasing the size of the proposed balcony and putting a roof on it. There was no one else present wishing to speak for or against the project so the Public Hearing was closed. Minutes, H. B. Board of Zoning Adjustments June 17, 1987 Page 2 Ms. Phillips informed the Board.that adjacent property owners had again been notified of the proposed addition but Staff had received no comments from the neighbors. UPON MOTION BY STRANGE AND SECOND BY MCKAY, COASTAL DEVELOPMENT PERMIT NO. 86-36 (REVISION) WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS FOR APPROVAL: 1. The proposed single family residence conforms with the plans, policies, requirements and standards of the Coastal Element of the General Plan. 2. The Coastal Development Permit is consistent with the CZ suffix zoning requirements, the R1 Zoning District, as well as other provisions of the Huntington Beach Ordinance Code applicable to the property. 3. At the time of occupancy, the proposed single family residence can be provided with infrastructure in a manner that is consistent with the Coastal Element of the General Plan. 4. The proposed single family residence conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. 5. The revision does not constitute a substantial change. 6. The revision will not increase the density. 7. The revision complies with applicable sections of the Huntington Beach Ordinance Code. CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated May 22, 1987, shall be the approved layout. 2. Board of Zoning Adjustments June 17, 1187 Page 3 CONDITIONAL EXCEPTION NO. 87-44 Applicant: Kenneth M. Wy eken A request to permit one (1) open space area to be eight hundred twenty-two and one-half (822.5) Square Feet in lieu of nine hundred (900) Square Feet and to have a minimum dimension of twenty-three and one-half feet (23.51) in lieu of twenty-five feet (25') feet. Subject property is located at 20081 North New Britain Lane (West side of North New Britain Lane approximately two hundred forty feet (240') South of Northport Drive). This request is covered by Categorical Exemption, Class 5, California Environmental Quality Act, 1986. Staff stated this request was for a room addition to a single family residence. The Code requires minimum open space areas as well as minimum open space dimensions. This lot has more than the required square footage of open space area but not in the proper locations. Staff recommended denial of the project since there was no land -related hardship. Staff reminded the Board she had prepared alternative Findings and Conditions for approval if the Board so desired. Michael Strange asked how much open space was located in one specific area and Ms. Phillips stated there was 822 Square Feet in one area and 595 Square Feet in another. Daryl Smith stated that in review it appeared the house had been set on the lot in such a manner.that it could not meet the minimum dimension requirements. Ms. Phillips verified Mr. Smith's statement that there might have been a mistake in placement of the house on the property. The Public Hearing was opened and the applicant, Kenneth M. Wyneken, was present. He asked Peter Toghia to speak in his behalf. Mr. Toghia said there had been an error in placement of the house on the lot and the back yard was one and one-half feet (1-1/21) less than it should have been. He added the applicant had a total open space area of 2,738 Square Feet if the side yards were included. He further stated Staff had recommend shifting the room addition to the Southwest corner of the property; however, this would place the family room addition adjacent to the bedrooms instead of the kitchen and breakfast nook. Mr. Toghia requested approval of the project as it was originally planned. There was no one else present wishing to speak for or against the project so the Public Hearing was closed. Daryl Smith said he would move for approval of the project with the additional Finding that, since the original siting of the home on -3- 6/17/87 - BZA Minutes, H. B. Board of Zoning Adjustments June 17, 1987 Page '4 - the lot does not meet the minimum dimension requirement, it would be inappropriate to apply that section of the Code at this time. UPON MOTION BY SMITH AND SECOND BY EVANS, CONDITIONAL.EXCEPTION NO. 87-44 WAS APPROVED WITH THE FOLLOWING AMENDED FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS FOR APPROVAL: 1. Granting of reduction in open space minimum dimension will not reduce the required total open space area (1,200 Square Feet). A total of one thousand,.four hundred seventeen (1,417) Square Feet will be provided in two (2) areas. 2. The granting of a Conditional Exception is necessary.in order to preserve the enjoyment of one or more substantial property rights. 3. The granting of Conditional Exception No. 87-44 will not be materially detrimental to the public welfare, or injurious to property in the same zone classifications. 4. The granting of the Conditional Exception will not adversely affect the General Plan of the City of Huntington.Beach., 5. The original placement of the structure on the lot precludes a minimum dimension of twenty-five feet (25'). SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated June 1, 1987, shall be the approved layout. 2. All building spoils, such as unusable lumber,.wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped.to handle them. .. 3. Proposed structures shall be architecturally compatible with existing structures. 4. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 5. Low -volume heads shall be used on all spigots and water faucets. 6. Prior to issuance of building permits, the property owner shall sign, notarize, and record with the County Recorder a "Letter of Agreement" assuring that the single family residence will be maintained as one (1) dwelling unit. 1 -4- 6/17/87 - BZA Minutes, H. B. Board of Zoning Adjustments June 17, 1117 Page 5' INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. AYES: Evans, Krejci, McKay, Smith, Strange NOES: None ABSENT: None TENTATIVE PARCEL MAP NO. 87-176 Agnlicant: Cavan Associates. Ltd. A request to create eight (8) parcels for development purposes. Subject property is located at end of Metzler Lane (East of Gothard Street and North of Talbert Avenue). This request is covered by previously approved Negative Declaration No. 86-63. Staff stated this map was being filed to fulfill Conditions of Approval for an industrial building on this site. Staff recommerled approval with conditions. Daryl Smith asked Staff about a condition which referred to "compliance with all applicable City Ordinances", and said it should have a notation added that "with the exception to those changes which occurred prior to other action that we have taken". Staff replied that the variances were already on record. Dennis Krejci clarified Mr. Smith's statement by adding that, if the applicant was required to comply with all City Ordinances, the exceptions would not be valid. Michael Strange said it should read "with the exception of previously approved variances". Ms. Phillips said there were not any variances noted - that the previous action had been under Administrative Review No. 86-56. The applicant's representative, William G. Borden, was present. He agreed to the suggested conditions with the exception that Metzler Lane should be dedicated to the City, and stated it was to be a cul-de-sac. Les Evans stated his concern was that the area was shown on the map as part of Parcel 6. Mr. Borden asked if the boundary did not go around the cul-de-sac and Mr. Evans indicated it went right through the cul-de-sac. He added that even if it had already been dedicated, it would have to be shown on the map. Mr. Borden also asked about another item concerning Metzler Lane and added the legal description showed the rights had been dedicated. -5- 6/17/87 - BZA Minutes, H. B. Board of Zoning Adjustments June 17, 1987 Page 6 UPON MOTION BY EVANS AND SECOND BY KREJCI, TENTATIVE PARCEL MAP NO. 87-176 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS FOR APPROVAL: 1. The proposed subdivision of eight (8) parcels for purposes of industrial use in compliance with the size and shape of property necessary for that type of development. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation of this type of use. 3. The property was previously studied for this intensity of land use at the time the land use designation for industrial business district allowing industrial buildings was placed on the subject property. 4. The size, depth, frontage, street width and other design and improvement features of the proposed subdivision are proposed to be constructed in compliance with standards plans and specifications on file with the City as well as in compliance with the State Map Act and supplemental City Subdivision Ordinance. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL(S) FOR ANY PURPOSE: 1. The Tentative Parcel Map received by the Department of Development Services on May 26, 1987, shall be the approved layout (with the amendments as noted thereon). 2. A parcel map shall be filed with and approved by the Department of Public Works and recorded with the Orange County Recorder. 3. Metzler Lane shall be dedicated to City standards. 4. Water supply shall be through the City of Huntington Beach's water system at the time said parcel(s) is/are developed (if such systems exist within 200 feet of said parcel(s). 5. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time said parcel(s) is/are developed (if such systems exist within 200 feet of said parcel(s). 6. Compliance with all applicable City Ordinances. 8. A copy of the recorded parcel map shall be filed with the Department of Development Services. 12. All vehicular access rights along Metzler Lane shall be dedicated to the City of Huntington'Beach except at locations approved by the Board of Zoning Adjustments. MINUTES: UPON MOTION BY STRANGE AND SECOND BY EVANS, MINUTES OF THE REGULAR MEETING OF JUNE 10, 1987, WERE APPROVED AS TRANSCRIBED, BY THE FOLLOWING VOTE: AYES: Evans, Krejci, Smith, Strange NOES: None ABSENT: None ABSTAIN: McKay There was no further official business to be presented to the Board for their review. Les Evans reminded those present that this was the final meeting of the Board of Zoning Adjustments. He added that he and the other Board members would like to express their appreciation for the excellent job the Staff member, Laura Phillips, and the Secretary, Janice Holmes, had done in assisting the Board in performance of their functions. Mr. Evans also thanked the Acting Board Members, Michael Strange and Jim McKay, for their assistance and the regular members, including Tom Poe and Glen Godfrey, for their past cooperation in processing the applications which had come before the Board. Chairman Dennis Krejci and Daryl Smith reiterated Mr. Evans feelings and comments.
