CONSENT CALENDAR: A-1 GENERAL PLAN CONFORMANCE NO. 87-4 APPLICANT: City of Huntington Beach General Plan Conformance No. 87-4 is a request by the Public Works Department to evaluate the widening and improvement of Hamilton Avenue on the south side from Magnolia Avenue to 1,320 feet west of Magnolia for conformance with the General Plan. The purpose of the project is to improve the travel lane, bike lane and vehicle parking area. The proposed project is in conformance with the City's Master Plan of Bikeways and will serve to connect the existing bike trail along Hamilton Avenue, east of Magnolia Avenue, with the Edison strip park. The estimated cost of the project is $150,000. The project will be funded 100% by the City through the Gas Tax Reserve fund. STAFF RECOMMENDATION: Approve General Plan Conformance No. 87-4 with findings. The proposed project is in conformance with the General Plan, specifically the following policies: a. Land Use: Encourage rational use of land and other resources. b. Land Use: Provide an adequate level of Community Services, facilities, improvements and maintenance in all areas of the City. c. Circulation: Provide a transportation system that is consistent with efforts to minimize adverse environmental and aesthetic effects. d. Provide non -motorized transportation facilities, especially bike trails, pedestrian trails, equestrian trails and jogging trails. e. PUBLIC HEARING ITF,MS C-1 CONDITIONAL EXCEPTION (VARIANCE) NO. 87-61 APPLICANT: BOURESTON DEVELOPMENT Conditional Exception No. 87-61 is a request to permit the following variances for an industrial building: (1) to provide a portion of the required parking off -site in lieu of on -site as required by Section 9601 of the Ordinance Code; (2) truck wells which face residential property; (3) reduction in front yard setback from 20 feet to 15 feet as required by Section 9510.06; and (4) reduction in width of landscape planter from 10 feet to 5 feet as required by Section 9608 (c). These variances are requested as a result of a previously approved conceptual plan for an industrial building, approved by the Planning Commission as Administrative Review No. 87-15, Use Permit No. 87-34 and Negative Declaration No. 87-9 on July 7, 1987. ENVIRONMENTAL STATUS: The proposed project is covered by Negative Declaration No. 87-9, previously approved by the Planning Commission in conjunction with their approval of the conceptual site plan for the industrial building (Administrative Review No. 87-15 and Use Permit No. 87-34). Approve Conditional Exception No. 87-61 with findings and conditions of approval. THE PUBLIC HEARING WAS OPENED Robert Chrisman, applicant, spoke in support of the request. He stated that after a diligent effort working together between staff and himself he feels the plan proposed is the best for all concerned. He expressed concern with the condition limiting use of the truck bays. He feels that the limitation will set a precedent. Paul Weatherly, 7622 Talbert Avenue, addressed his concerns with the development. He owns the property north of the project and is concerned with the large piece of property that will be taken from him. He stated that he wants to develop his property as an automotive center and was told that it would have to be rezoned. He has presented plans for his property to staff and has not received any response. He further stated that he is not opposed to the development but does not want to lose his property. There were no other persons present to speak for or against the project and the public hearing was closed. PC Minutes - 8/18/87 -3- (9069d) The Commission commended, --staff and the property owners for the efforts made to develop the proposed plan however expressed concern regarding the landscaping between the building''and:the residential property and suggested that a condition be added to include an intensification of landscaping. There was discussion regarding the use of the truck bay for this use. They felt that a condition should be added with the limitations imposed and if the use was greater in the future it would have to come back to the Planning Commission for review and approval. They also requested that a conceptual p;,an of the property to the north be presented at the next meeting. The granting of Conditional Exception No. 87-61 for the following variance requests: (1) off -site parking; (2) truck wells which face residential property; (3) reduction in width of landscape planter from,10 feet to-5 feet; (4) reduction in front yard setback from 20 feet to 15 feet, will not be materially detrimental to the public welfare, or injurious to property -in the same zone classifications because any potentially adverse impacts have been considered.and mitigated. Sound barriers will be provided to minimize noise impacts. 2. The granting of Conditional Exception No. 87-61 for the following variance requests: (1) off -site parking; (2) truck wells which face residential property; (3) reduction in width of landscape planter from 10 feet to 5 feet; (4) reduction in front yard'setback from 20 feet to 15,feet, will.not adversely affect the General Plan of the City of Huntington Beach. The proposal is in conformance with the Zoning and General Plan designation for the site. 3. The location, -site layout, and design of the proposed industrial building properly adapts the proposed structures to streets, driveways, and other adjacent structures and uses in a harmonious manner. The plan provides for a connection of Redondo Circle to Kovacs Street improving access to the site and to surrounding properties. PC Minutes - 8/18/87 -4- (9069d) 1 CONDITIONS OF APPROVAL:_ 1. The site plan, floor plans, and elevations received and dated August 14, 1987 shall be the conceptually approved layout. a. Elevations shall be subject to review and approval by the 1. Design Review Board. b. Landscape plans shall be subject to review and approval by the Design Review Board. An intensified use of trees/landscaping shall be provided along the perimeter property line creating a screen between the proposed building and adjacent residential property. c. Depict full right-of-way width on site plan. 2. Prior to issuance of building permits, the applicant shall complete the following: a. Submit landscape and irrigation plan to the Department of Community Development and Public Works for review and approval. Landscaping along Redondo Circle shall include berming and comply with Article 960. b. Record a deed restriction reserving the northwesterly parcel for parking purposes. Documents shall be approved by the City Attorney's office as to form and a copy filed with the Department of Community Development. 3. All conditions of Administrative Review No. 87-15 and Use Permit No. 87-34 shall apply. 4. Prior to issuance of building permits, Tract Map 11955 as amended to show the alternative precise plan as adopted to show Redondo Circle realignment shall be approved by the City Council and recorded. 5. A screening program (walls, landsc&ping, etc.) for truck wells shall be provided to buffer noise and reduce visibility of the truck wells. 6. Use of truck wells shall be limited to between 8:00 AM and 6:00 PM Monday through Friday, 9:00 AM to 2:00 PM on Saturday and no deliveries permitted on Sunday. Deliveries shall be limited to 3 truck deliveries per day. PC Minutes - 8/18/87 -5- (9069d) C-2 CONDITIONAL USE PERMIT N0, 87-30 WITH SPECIAL PERMITS/ TENTATIVE TRACT 12947/COASTAL DEVELOPMENT PERMIT NO, 87-24/NEGATIVE DECLARATION NO, 87-30 APPLICANT: MAJID HARB Conditional Use Permit No. 87-30 with Special Permits in conjunction with Tentative Tract 12936 and Coastal Development Permit No. 87-24 is a request to develop a three-story with subterranean parking, 26-unit condominium project on a primarily vacant .712 acre site on Pacific Coast Highway in the Downtown'Specific Plan Area. There are four special permit items related to parking access width, site coverage, aggregate side yard setback and building offset. STAFF RECOMMENDATION:" Continue Conditional Use Permit No. 87-30 with Special Permits in conjunction with Tentative Tract 12947 and Coastal Development Permit No. 87-24 in order to allow staff to correctly advertise for the September 1, 1987 Planning Commission meeting. Conditional Exception No. 86-113 is a request to permit 128 feet of frontage along Beach Boulevard in lieu of the required 150 feet. ENVIRONMENTAL STATUS: The proposed project is exempt,pursuant to Class 1, Section 15301 of the California Environmental Quality Act. THE PUBLIC HEARING WAS OPENED Jeff Waitman, representing the applicant, spoke in support of the Project. He stated that the applicant is a prideful owner and that the plan provides the area with a desirable look that will benefit the City. There were no other persons present to speak for or against the project and the public hearing was closed. The Commission expressed concern with the maintenance and upkeep of the overhead planters and landscaping proposed on the plan and suggested that a review be done in a year. A MOTION WAS MADE BY SCHUMACHER, SECOND BY SILVA, TO APPROVE CONDITIONAL USE PERMIT NO. 86-34 IN CONJUNCTION WITH CONDITIONAL EXCEPTION (VARIANCE) NO. 86-113, WITH FINDINGS AND ADDED CONDITIONS OF APPROVAL, BY THE FOLLOWING VOTE: AYES: Silva, Schumacher, Higgins, Pierce, Summerell, Livengood NOES: None ABSENT: Leipzig ABSTAIN: None MOTION PASSED FINDINGS FOR APPROVAL - CONDITIONAL USE PERMIT NO, 86-34: 1. The establishment, maintenance and operation of the car wash and self -serve gas station will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The proposal to improve the existing car wash and gas station is consistent with the goals and objectives of the City's General Plan and Land Use Map. 3. The location, site layout, and design of the proposed car wash and self -serve gas station properly adapts the proposed structures to streets, driveways, and other adjacent structures and uses in a harmonious manner. PC Minutes - 8/18/87 -7- (9069d) FINDINGS FOR APPROVAL - CONDITIONAL EXCEPTION N0, 86-113: 1. The granting of Conditional Exception No. 86-113 will not adversely affect the General Plan of the City of Huntington Beach. The proposed use is in conformance with both the zoning and general plan designation on the site. 2. Because of special circumstances applicable to the subject property, namely lot dimension, the strict application of the Zoning Ordinance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classifications. 3. The granting of Conditional Exception No. 86-113 for a reduction in required frontage from 150 feet to 128 feet is necessary in order to preserve the enjoyment of one or more substantial property rights. 4. The granting of Conditional Exception No. 86-113 will not be materially detrimental to the public welfare, or injurious to property in the same zone classifications. 1. The site plan, floor plans, and elevations received and dated July 22, 1987 shall be the approved layout: 2. Prior to issuance of building permits, the following shall be completed: a. Applicant shall file a parcel map consolidating lots 17 and 18. Said map shall be recorded prior to final inspection and a copy submitted to the Department of Community Development. b. Street improvements shall be reconstructed on Garfield to eliminate the ponding of water along the Garfield Avenue gutter. This will ensure proper drainage of water run-off produced by the car wash use. c. Street lights shall be constructed as required by the Department of Public Works. d. Submit landscape and irrigation plan to the Department of Community Development and Public Works for review and approval. e. Rooftop Mechanical Equipment Plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. PC Minutes - 8/18/87 -8• (9069d) 3. Installation of required landscaping and irrigation systems shall be completed prior to final inspection. 4. To ensure adequate fire safety, a fire hydrant shall be provided pm Beach Boulevard, north of Garfield in an area approved by the Fire Department. 5. To ensure adequate fire safety, service roads and fire lanes, as determined by the Fire Department, shall be posted and marked. 6. To ensure adequate fire safety, fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. 7. To ensure fire and environmental safety, fuel installation shall comply with Article 79, Division 9 of the Uniform Fire Code. 8. A lock "knox" boa shall be installed at a location approved by the Fire Department. 9. There shall be no outside storage of vehicles, vehicle parts, equipment or trailers. 10. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 11. If lighting is included in the parking lot, high-pressure sodium vapor lamps shall be used for energy savings. All outside lighting shall be directed to prevent "spillage" onto adjacent properties. 12. All applicable Public Works fees shall be paid prior to issuance of building permits. 13. A minimum single lane aisleway providing access between the Beach Boulevard drive entry and the gas pumps adjacent to the car wash shall be maintained at all times. 14. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department except as noted herein. 15. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 16. Development shall meet all local and State regulations regarding installation and operation of all underground storage tanks. PC Minutes - 8/18/87 -9- (9069d) 17. A detailed soils Analysis shall be prepared by a registered Boils Engineer. This analysis shall include on -site soil sampling and laboratory testing of materials tb provide detailed recommendations regarding grading,�chemical and fill properties, foundations, retaining walls, streets, utilities, and status of existing underground gasoline storage tanks. 18. All signs shall be brought into conformance with the City Sign Code and separate permits shall be required. 19. Landscaping shall comply with S. 9608 of the Huntington Beach Ordinance Code. 20. Should any underground tanks be installed or removed, a permit must be secured from the Fire Department and the Orange County Health Department. 21. A Certificate to Operate shall be issued by the Department of Community Development as required by Section 9730.80 of the Huntington Beach Ordinance Code. 22. A review of the use and landscaping shall be conducted within one (1) year", -of the date'of this approval to verify compliance with all conditions of approval and applicable Articles of the Huntington Beach Ordinance Code. -If, at that time, there is a violation of these conditions or code sections, Conditional Use Permit No. 86-34 may become null and void: 23. The Planning Commission reserves the right to revoke this conditional use permit if any violation of these conditions or the Huntington Beach Ordinance Code occurs. APPLICANT: TOM RASMUSSEN- Use Permit No. 87-37 is a request to permit the display and storage of automobiles as an expansion to an existing auto sales facility. The existing vacant lot is located at 19160 Beach Blvd., adjacent to the north of an existing auto sales lot (east side of Beach Blvd. approximately 830 feet South of Garfield Avenue). The applicant intends to grade, pave, fence, light and landscape the lot. This request is covered by Negative Declaration No. 87-25. On July 8, 1987, the Zoning Administrator conditionally approved the use permit request with findings (see attached minutes). On July 17, 1987, Jerome M. Bame, on behalf of his client,, James R. Brumfield, appealed the Zoning Administrator's decision on Use Permit No. 87-37. PC Minutes - 8/18/87 -10• (9069d) On August 17, 1987, a letter was received from Jerome M. Bame, Counsel for the appellant, requesting withdrawal of the appeal based upon a negotiated settlement between the appellant and the applicant. STAFF RECOMMENDATION: Accept withdrawal on Appeal of Use Permit No. 87-37. Conditional Exception (Variance) No. 87-50 is a request to permit a variance to the code requirements of parking and site coverage. ENVIRONMENTAL STATUS: The proposed project is exempt pursuant to Class 1, Section 15301 (Conditional Use Permit) and Class 5, Section 15305 (Conditional Exception) of the California Environmental Quality Act. STAFF RECOMMENDATION: Approve Conditional Use Permit No. 87-31 and Conditional Exception (Variance) No. 87-50 with findings and conditions of approval. THE PUBLIC HEARING WAS OPENED Doyle Duggins, 1431 Ave Alvarado, Placentia, representing the applicant, was present to answer any questions. There were no other -person present to speak for or against the request and the public hearing was closed. Some of the Commissioners felt that the increased site coverage would be detrimental to the property and that the lack of parking places would create problems in the vicinity. There was also concern expressed that the added room could be converted to an apartment. PC Minutes - 8/18/87 -11-- (9069d) A MOTION WAS MADE BY SCHUMACHER, SECOND BY SILVA, TO DENY CONDITIONAL USE PERMIT NO. 87-31 AND CONDITIONAL EXCEPTION (VARIANCE) NO. 87-50, WITH FINDINGS, BY THE FOLLOWING VOTE: AYES: Silva, Schumacher, Summerell, Livengood NOES: Higgins, Pierce ABSENT: Leipzig ABSTAIN: None 9 o FINDINGS FOR DENIAL - CONDITIONAL USE PERMIT NO, 87-31: 1. The addition to the nonconforming four-plex is not necessary to secure added safety or reduce fire hazard. 2. The addition of 228 square feet to the nonconforming four-plex will create parking problems in the vicinity of the structure. FINDINGS FOR DENIAL - CONDITIONAL EXCEPTION (VARIANCE) N0. 87-50: 1. The granting of a conditional exception for increased site coverage (51%) will be detrimental to property and improvements in.,the vicinity of the structure. 2. The granting of Conditional Exception (Variance) No. 87-50 would constitute a special privilege inconsistent with limitations upon properties in the vicinity. 3. The granting of Conditional Exception (Variance) No. 87-50 for reduction in parking will be detrimental to the general welfare of persons residing in the vicinity and will be detrimental to the value of property and improvements in the neighborhood. C-6 SPECIAL SIGN PERMIT N0, 87-15 APPLICANT: GEORGE A. PEARSON Special Sign Permit 87-15 is a request to permit the installation of a seven foot high, 30 square foot, primary monument sign with signage depicting the name of the commercial center plus eight tenant titles totaling 24 words or items located at 16922/16952 Beach Boulevard. -The proposed location of the Sign is in the planter area perpendicular to Beach Boulevard at the northwest corner of the property. The Special Sign Permit is necessary because the proposed sign encroaches into the required 10 ft. by 10 ft. site angle setback when adjacent to a driveway and to increase the amount of items from a maximum of 12 to 24. PC Minutes - 8/18/87 -12- (9069d) ENVIRONMENTAL STATUS: The proposed project is exempt pursuant to Class 1, Section 15301 of the California Environmental Quality Act. ,STAFF RECOMMENDATION: Deny Special Sign Permit No. 87-15 based on findings. THE PUBLIC HEARING WAS OPENED George Pearson, applicant, stated that as owner of the property he had complied with the wishes of the tenants in the shopping center by applying for the special sign permit. He stated that he concurred with staff's findings and was prepared to work out a compromise with his tenants and staff. There were no other persons present to speak for or against the request and the public hearing was closed. The Commission requested a follow-up on the compromise that the applicant was proposing. A MOTION WAS MADE BY HIGGINS, SECOND BY PIERCE, TO DENY SPECIAL SIGN PERMIT NO. 87-15, WITH FINDINGS, BY THE FOLLOWING VOTE: AYES: NOES: ABSENT: ABSTAIN: Silva, Higgins, Schumacher Leipzig None Pierce, Summerell, Livengood 1. The proposed sign and location, behind the 10 foot site angle setback, would obstruct a driver exiting the Center from clearly seeing pedestrians and children on skateboards and bicycles. This is especially important considering the popularity of the new arcade in the Center. 2. The existing Planned Sign Program provides ample area for a sign that identifies the Center. 3. The proposed sign exceeds the maximum number of items allowed in the Code. 4. The existing wall signs on the individual business are visible from the street, from a moving vehicle, as well as from a stationary position across Beach Boulevard in front of the Warehouse record store. Therefore a monument sign with the name of the center and a maximum of 12 items on it is appropriate for that location. WINSTON CHESHIRE Conditional Exception No. 87-27 is a request to permit a reduction of the required number of parking spaces based on joint use of parking at the Town and County business center located at 18582 Beach Boulevard. Approval of the request will allow 1,600 sq. ft. expansion of the existing Emergicenter into an adjacent existing suite. Due to incorrect notification, no action by the Planning Commission may be taken and a continuance to the September 1, 1987 Planning Commission meeting is necessary. Staff will advertise accordingly. STAFF RECOMMENDATION: Continue Conditional Exception (Variance) No. 87-27 in order to allow staff to correctly advertise for the September 1, 1987 Planning Commission meeting. The above mentioned entitlements were approved by the Planning Commission on September 4, 1985 which allowed the construction of a 45 unit planned residential development in the Seacliff IV residential project at the southwest intersection of Seapoint Street and Doral Drive. A one-year extension of time construction phasing for the Subdivision, specifies that approval date of a tentative one-year extensions. RECOMMENDATION' is necessary in order to coordinate proposed project. Section 9941 (b), the Planning Commission may extend the map one year, with a maximum of three Staff recommends that the Planning Commission grant a one-year extension for Tentative Tract No. 12534, Conditional Use Permit No. 85-37, and Coastal Development Permit No. 85-26 and that all previous conditions of approval remain in effect. The letter was sent in response to concerns expressed by the Commission regarding potential parking problems during the construction phase of the project.
