DEFERRED TO THE REGULAR MEETING OF AUGUST 26, 1987,
BECAUSE THE ACTING ZONING ADMINISTRATOR WAS NOT PRESENT
TO APPROVE THE MINUTES

CONDITIONAL EXCEPTION NO. 87-58 (Cont. from 8/12/87)�
Applicant: Sun Boss Corporation
The Zoning Administrator, James,W. Palin, determined -the applicant
was not present so the request was "trailed" to the end of the
meeting.
TENTATIVE PARCEL MAP NO. 87-314 (REQUEST FOR WAIVER)
Applicant: Nick Becker
A request for Waiver of Final Parcel Map (To consolidate two (2)
lots into one (1) lot for commercial purposes). Subject property is
located on the Southwest corner of Bolsa Avenue and Springdale
Street.
This request is covered by Categorical Exemption, Class 5,
California Environmental Quality Act, 1986.
The Staff member, Laura Phillips, stated this Waiver Request was for
a Tentative Parcel Map which had been previously approved by the
Zoning Administrator. All dedications have been made to the City
and improvements have been installed. Staff recommended approval of
the request with conditions.
Upon questioning by Mr. Palin, Staff replied a Plat Map would have
to be prepared for submittal to the County for recordation.
Mr. Palin stipulated this would need to be completed pursuant to
Section 9920.1 (b) (3).

The applicant's representative, Joe Hartge, the Engineer, was
present. The applicant's representative was asked by Mr. Palin if
he had received a copy of the conditions and Mr. Hartge replied he
had not. Mr. Hartge then waived his rights to the three (3) day
notice.
NOTE: The applicant, Nick Becker, had been mailed a copy of the
suggested Conditions of Approval on August 11, 1987, by Certified
Mail. The Certified Mail return receipt had been received in the
Department of Community Development on August 14, 1987, and had been
signed by Sonja Becker.
TENTATIVE PARCEL MAP NO. 87-314 (REQUEST FOR WAIVER) WAS APPROVED BY
THE ZONING ADMINISTRATOR, WITH THE FOLLOWING FINDINGS AND CONDITIONS:
FINDINGS OF APPROVAL FOR WAIVER:
1. The proposed consolidation complies with the requirements as to
area, improvement and design, flood and water drainage control,
appropriate and approved public roads, sewer and water
facilities, environmental protection, and other requirements of
Article 992 of the Subdivision Section of the Ordinance Code.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL(S) FOR
ANY PURPOSE:
1. The Tentative Parcel Map received by the Department of
Community Development on July 15, 1987, shall be the approved
layout (with the amendments as noted thereon).
2. The applicant shall file, through the Huntington Beach City
Clerk's office, and have recorded with the Orange County
Recorder's Office, a Certificate of Compliance in conjunction
with the approved plat map. A copy of the recorded Certificate
of Compliance and plat map shall be filed with the Department
of Community Development prior to issuance of building permits
on the subject property.
TENTATIVE PARCEL MAP NO. 87-326
Applicant: Cavan Associates, Ltd.
A request to create six (6) industrial parcels. Subject property is
located on the North side of Talbert Avenue approximately six
hundred eighty feet (680') East of Gothard Street.
This request is covered by Negative Declaration No. 87-10.

Staff stated this Tentative Parcel Map was a requirement of
Administrative Review No. 87-10 and the only addition would be that
the twenty foot by twenty-five foot (20' x 25') parcel be shown on
the dedication for Talbert Avenue on Parcel No. 1.
The applicant's representative, Roger Russell, was present and asked
for clarification. Staff explained the portion in question was a
separate parcel and Mr. Russell said it had been that way when his
organization acquired the property. Mr. Palin explained that the
previously shown right-of-way was thirty feet (30') to the
centerline of Talbert Avenue but now fifty feet (50') was required.
A discussion ensued between the applicant's representative and,the
Zoning Administrator regarding the history of the parcel, vehicular
access rights, property remnants adjacent to the railroad tracks,
pedestrian access over the original parcels, etc. Mr. Palin
explained steps necessary for recordation of the map.
The Zoning Administrator stated his decision for approval of the
Tentative Parcel Map would be pursuant to a supplemental Finding
regarding fixing the location of the structures, driveway locations,
and permitting reduced frontage for the proposed Parcel Nos. 3 and 4.
TENTATIVE PARCEL MAP NO. 87-326 WAS APPROVED BY THE ZONING
ADMINISTRATOR, WITH THE FOLLOWING FINDINGS AND CONDITIONS:
FINDINGS FOR APPROVAL:
1. The proposed subdivision of six (6) parcels for purposes of
industrial use in compliance with the size and shape of
property necessary for that type of development.
2. The General Plan has set forth provisions for this type of land
use as well as setting forth objectives for implementation of
this type of use.
3. The property was previously studied for this intensity of land
use at the time the land use designation for community business
district allowing industrial buildings was placed on the
subject property.
4. The size, depth, frontage, street width and other design and
improvement features of the proposed subdivision are proposed
to be constructed in compliance with standards plans and
specifications on file with the City as well as in compliance
with the State Map Act and supplemental City Subdivision
Ordinance.
5. This approval is based on prior approval of Administrative
Review No. 87-10 fixing building locations, driveway locations,
and permitting reduced frontage for proposed Parcel Nos. 3 and 4.

ONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL(S) FOR
ANY PURPOSE:
1. The Tentative Parcel Map received by the Department of
Community Development on August 6, 1987, shall be the approved
layout (with the amendments as noted thereon). Show twenty
foot by twenty-five foot (20' x 25') dedication for Talbert
Avenue on Parcel No. 1.
2. A parcel map shall be filed with and approved by the Department
of Public Works and recorded with the Orange County Recorder.
3. Talbert Avenue and "A" Street shall be dedicated to City
standards.
4. Water supply shall be through the City of Huntington Beach's
water system at the time said parcel(s) is/are developed (if
such systems exist within 200 feet of said parcel(s).
5. Sewage disposal shall be through the City of Huntington Beach's
sewage system at the time said parcel(s) is/are developed (if
such systems exist within 200 feet of said parcel(s).
6. All utilities shall be installed underground at the time said-
parcel(s) is/are developed.
7. Compliance with all applicable City Ordinances.
8. The property shall participate in the local drainage assessment
district at the time said parcel(s) is/are developed. (Contact
the Department of Public Works for additional information).
9. All vehicular access rights along Talbert Avenue and "A" Street
shall be dedicated to the City of Huntington Beach except at
locations approved by the Zoning Administrator.
TENTATIVE PARCEL MAP NO. 87-338 (REQUEST FOR WAIVER)
Applicant: Marty and Janet Piontkowski
A request to consolidate two (2) parcels into one (1) with Waiver of
Final Map. Subject property is located at 928 Tenth Street (South
side of Tenth Street approximately one hundred fifty feet (150')
West of Lake Street).
This request is covered by Categorical Exemption, Class 5,
California Environmental Quality Act, 1986.

The applicant, Marty Piontkowski, was present and stated he had
received a copy of the suggested Conditions of Approval. The
applicant questioned the stipulation for underground utilities and
whether they should be installed just to the new structure or also
from the structure to the house. Mr. Palin explained it should also
be from the garage to the house with a double stub -out.
Mr. Piontkowski also inquired about vehicular access from Tenth
Street and the Zoning Administrator replied there would be no curb
cut allowed - that access would be from the alley as provided for'by
Code.
Ms. Phillips explained the applicant had requested a Waiver of the
Final Map but the alley dedication and other items had not been
completed. She stated the applicant could return for a Waiver after
these concerns had been handled.
The Zoning Administrator reiterated Staff's statements and said he
could approve the Tentative Parcel Map but not the Waiver.
Mr. Piontkowski agreed to the Conditions of Approval as stipulated
by Staff.
TENTATIVE PARCEL MAP NO. 87-338 (REQUEST FOR WAIVER) WAS APPROVED
FOR THE TENTATIVE PARCEL MAP ONLY. REQUEST FOR WAIVER WAS DENIED
BUT the TENTATIVE PARCEL MAP WAS APPROVED, WITH THE FOLLOWING
FINDINGS AND CONDITIONS:
FINDINGS FOR APPROVAL:

residential use in compliance with the size and shape of
property necessary for that type of development.

residential district allowing residential buildings was placed
on the subject property.

with the State Map Act and supplemental City Subdivision
Ordinance.

CONDITIONAL EXCEPTION NO. 87-58 (Cont. from 8/12/87)
Applicant: Sun Boss Corporation
A request to permit a pool enclosure to encroach into the side and
rear yard setbacks and into a storm drain easement, and to allow the
pool enclosure to count toward the open space requirement. Subject
property is located at 22002 Capistrano Lane (Southeast corner of
Banning Avenue and Capistrano Lane).
This request is covered by Categorical Exemption, Class 5,
California Environmental Quality Act, 1986.
The Zoning Administrator stated this request had been continued from
the previous meeting but "trailed" to the end of this meeting
because the applicant had not been present. He further stated the

Public Hearing had been left open from the previous meeting and the
applicant's representative, John Cain, was now present.
Mr. Cain explained he had just been in a discussion with
representatives of the Public Works Department and they had
suggested a continuation of the request until they could consult
with the City Attorney's office. Mr. Palin asked if Public Works
was concerned with a "Hold Harmless Agreement" from the property
owner and Mr. Cain confirmed this query. Mr. Cain further explained
the property owner would remove the light aluminum roof and side
panels if it became necessary for City personnel to work within the
easement area.
Messrs. Palin and Cain held an -extensive discussion regarding
locations of the existing wall, the pool, and proposed structure in
relation to the setbacks and existing easement. The Zoning
Administrator further stipulated that any "Hold Harmless Agreement"
signed by the property owner would have to be recorded with the
County so it would show on any title search in the event the
property was sold.
Upon questioning by Mr. Palin, Staff stated the Final Map did show
the easement. The Zoning Administrator expressed concern over
weight bearing on the underground pipes but Mr. Cain stated the
pipes were buried quite deep. The applicant's representative
presented additional sketches to Staff and stated he would have
copies made for the file.
After a discussion relative to the length of time required for
consultation with the City Attorney's office, Mr. Cain requested a
two (2) week continuance with the understanding that the Public
Works Department would follow through on this request.
There was no one else present wishing to speak for or against the
request but the Public Hearing was left open to the indicated
meeting date.
The applicant's representative, John Cain, agreed to waive the
mandatory processing date for this request since the continuation
would extend beyond the stipulated date.
CONDITIONAL EXCEPTION NO. 87-58 WAS CONTINUED BY THE ZONING
ADMINISTRATOR, AT THE REQUEST OF THE APPLICANT'S REPRESENTATIVE, TO
THE MEETING OF SEPTEMBER 2, 1987.
There was no further business to be presented to the Zoning
Administrator for review.
