MINUTES: Minutes of the October 79 1987 meeting were approved by the Acting,
Zoning Administrator.
TENTATIVE, PARCEL MAP NO. 87-295
Applicant: William D. Noordman „
Tentative Parcel Map No. 87-295 is a request to consolidate. three (3) parcels Into one (1)
parcel located at 413 Seventh Street (west side of Seventh Street approximately 175 feet_
south of Pecan Avenue).
This request Is covered by Categorlcal'Exemption, Class 5, California Environmental
Quality Act, 1986.
Staff member, Laura Phillips,- reported that this Item was continued from last week
because the applicant was not present at the meeting to accept the conditions for his
revised parcel map. The applicant was given the conditions last week and are standard
with the following modifications. The applicant is to show the existing lot lines for the
adjacent parcels and structures, and the parcels are to be numbered 1, 2, and 3. Also, the
applicant is to submit a letter from the adjacent property owners acknowledging the"
preparation of the tentative map expressing their intent to sign the final map. With these
conditions staff is recommending approval.
Mr. Strange asked if the applicant was present. Mr. Noordman responded yes, stating that
he has gone over the conditions and they are acceptable.
TENTATIVE PARCEL MAP NO. 87-295 WAS APPROVED BY THE ACTING ZONING
ADMINISTRATOR WITH THE FOLLOWING FIB DINGS AND CONDITIONS:
FINDINGS FOR APPROVAL
1. The proposed subdivision of three (3) parcels for purposes of medium density
residential use is in compliance with the size and 'shape of property necessary
for that type of development.
2. The General Plan has set forth provisions for this type of land use as well as
setting forth objectives for implementation of.this type of use.

3. The property was previously studied for this intensity of land use at the time
the land use designation for community business district allowing commercial
buildings was placed on the subject property.
4. The size, depth, frontage, street width and other design and Improvement
features of the proposed subdivision are proposed to be constructed in
compliance with standards plans and specifications on file with the City as
well as in compliance with the State Map Act and supplemental City
Subdivision Ordinance.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL(S) FOR
ANY PURPOSE:
1. The Tentative Parcel Map received by the Department of Community
Development on October 6, 1987, shall be the approved layout with the
amendments as noted below,
a) show existing lot lines and structures,
b) note parcel 1,2, and 3..
2. A parcel map shall be filed with and approved by the Department of Public
Works and recorded with the Orange County Recorder.
3. Alleys shall be dedicated to City standards.
4. Water supply shall be through the City of Huntington Beach's water system at
the time said parcel(s) is/are developed (if such systems exist within 200 feet
of said parcel(s).
5. Sewage disposal shall be through the City of Huntington Beach's sewage
system at the time said parcel(s) is/are developed (if such systems exist within
200 feet of said parcel(s).
6. All utilities shall be installed underground at the time said parcel(s) is/are
developed.
7. Compliance with all applicable City Ordinances.
8. Submit letter from adjacent property owners acknowledging preparation of
Tentative Parcel Map and expressing intent to sign final maps.
9. A copy of the recorded parcel map shall be filed with the Department of
Community Development.
10. All vehicular access rights along Seventh Street shall be dedicated to the City of
Huntington Beach except at locations approved by the Zoning Administrator.
CONDITIONAL EXCEPTION NO. 87-75
Applicant: Newport West Builders
Conditional Exception No. 87-75 is a request tc permit a three (3) foot side yard setback
for a front entry garage in lieu of the required twenty-two (22) foot side yard setback
located at 801 Alabama (northwest corner of A'abama Street and Hartford Avenue).

This request is covered by Categorical Exemption, Class 5, California Environmental
Quality Act, 1986.
Staff member, Laura Phillips, reported that the applicant requested that this application
be withdrawn because they will be using an alternative building design that will not
require any variances.
Mr. Strange asked staff if the applicant submitted a letter requesting the withdrawal.
Staff stated yes.
Mr. Strange stated that he accepts the withdrawal of Conditional Exception No. 87-75.
CONDITIONAL EXCEPTION NO. 87-76
Applicant: Kevin and Kris Daly
Conditional Exception No. 87-76 is a request to permit an eight (8) foot high wall (two (2)
foot retaining plus six (6) foot slumpstone) at a five (5) foot setback from the rear and
side property lines located at 19002 Milford Circle (southwest corner of Newland Street
and Garfield Avenue).
This request is covered by Categorical Exemption, Class 5, California Environmental
Quality Act, 1986.
Staff member, Laura Phillips, reported that this variance is required because the lot is a
through lot having streets on both sides and according to the code a through lot's rear
yard setback must be the same as the front yard, which is fifteen (15) feet, and applicant
is requesting to further enclose the back yard by placing a fence five (5) feet from the
rear property line: The rear yard slopes down towards Newland Street and Garfield
Avenue. Since the lot is abutting two arterial streets, and will only be a six (6) foot wall
on top of a two (2) foot retainer, staff is recommending approval of the request.
The public hearing was opened and Kris Daly ; applicant, was present.
There was no one else present wishing to speak for or against the request so the public
hearing was closed.
CONDITIONAL EXCEPTION NO. 87-76 WAS APPROVED BY THE ACTING ZONING
ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS:
FINDINGS FOR APPROVAL:
1. Because of special circumstances applicable to the subject property, including size,
shape, topography, location or surroundings, the strict application of the Zoning
Ordinance is found to deprive the subject property of privileges enjoyed by other
properties in the vicinity and under identical zone classifications. The side and rear
yards abut arterial streets, and slope downward creating a hardship.
2. The granting of Conditional Exception No. 87-76 will not be materially detrimental
to the public welfare, or injurious to property in the same zone classifications.
3. The granting of the Conditional Exception will not adversely affect the General Plan
of the City of Huntington Beach.
SPECIAL CONDITIONS OF APPROVAL:

1. The site plan and elevations received and dated September 18, 1987 shall be the
approved layout.
2. Prior to issuance of building permits, the applicant shall submit the following plans:
Landscape and irrigation plan to the Department of Community Development
and Public Works for review and approval, for area between wall and sidewalk.
3. Installation of required landscaping and irrigation systems shall be completed prior
to final inspection.
4. Walls shall comply with 25 foot corner cut off.
5. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable
material, shall be disposed of at an off -site facility, equipped to handle them.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions of the Ordinance Code,
Building Division, and Fire Department.
2. The applicant shall meet all applicable local,, State, and Federal Fire Codes,
Ordinances, and standards.
3. The Zoning Administrator reserves the right to revoke this -conditional exception if
any violation of these conditions or of the Huntington Beach Ordinance Code occurs.
USE PERMIT NO. 87-77
Applicant: Molyvann Hong
Use Permit No. 87-77 is a request to revise Condition of Approval No. 14 of Use Permit
No. 85-70, relating to the hours of operation of the shopping center located at 6494
Edinger Avenue (southwest corner of Edinger Avenue and Edwards Street).
This request is covered by Categorical Exemption,_ Class 5, California Environmental
Quality Act, 1986.
Staff member, Laura Phillips, reported that the shopping center where the Donut Shop is
located was originally approved by the Board of Zoning Adjustments and then appealed to
the Planning Commission in 1985. The Planning Commission in response to the concerns
of neighbors imposed conditions which included hours of operation to be limited to 7:00
a.m. to 10:00 p.m. Applicant wishes to open the Donut shop at 5:00 a.m. Since the
Planning Commission originally imposed the request, staff is recommending that the item
be referred back to the Planning Commission so that they may modified the condition if
they choose.
The public hearing was opened and Molyvann Hong was, present.- He stated that his donut
business depends on the morning traffic and wirhout opening from 5:00 a.m. until 7:00
p.m., it cuts his business down by 25 to 30 percent.
There was no one else present to speak for. or against the request so the public hearing
was closed.
USE PERMIT NO. 87-77 WAS REFERRED TO THE PLANNING COMMISSION BY THE
ACTING ZONING ADMINISTRATOR TO A DATE UNCERTAIN.

USE PERMIT NO. 87-70
Applicant: Houshiar Haghani
Use Permit No. 87-70 is a request to review revised elevations for an I1-unit apartment
complex (submitted at request of the Zoning Administrator) located at 7581 Warner
Avenue.
This request is covered by Categorical Exemption, Class 5, California Environmental
Quality Act, 1986
Staff member, Laura Phillips, reported that this apartment complex was approved by the
Zoning Administrator on September 23, 1987 and one of the conditions of this item was
that the applicant work with staff to revise the elevations particularly to get some more
movement in the roof line facing Warner Avenue. Applicant has worked with staff and
the Design Review Board. Applicant has complied with the DRB suggestions regarding the
roofing and materials and also the archways, therefore, staff is recommending approval of
the revised elevations.
Mr. Strange asked if the applicant was present and if he had any questions. Houshiar
Haghani, applicant, was present and stated that he did not have any questions.
Mr. Strange asked staff if the new elevations have been reviewed by the Zoning
Administrator. Staff stated no. He asked staff if the elevations comply with Jim Palin's
request to revise it and improve the roof elevations. Staff stated yes.
USE PERMIT NO. 87-70 REVISED ELEVATIONS WERE APPROVED BY THE ACTING
ZONING ADMINISTRATOR.
THE MEETING WAS ADJOURNED TO THE OCTOBER 19, 1987 STUDY SESSION BY THE
ACTING ZONING ADMINISTRATOR.
