ZONING ADMINISTRATOR PRESENT: James W. Palin STAFF MEMBERS PRESENT:. Laura Phillips MINUTES: MInutes of the October 28, 1987 meeting were approved by the Zoning Administrator. CONDITIONAL USE PERMIT NO. 87-46 Applicant: Zaher Khalaf Conditional Exception No. 87-46 is a request to permit, 1) a ten foot building separation in lieu of a fifteen foot separation, 2) backing of cars onto the street from a multi -family residence located at 16632 Algonquin Street (east side of Algonquin Street approximately 300 feet south of Heil Street). This request is covered by Categorical Exemption, Section 15305, Class 5, California Environmental Quality Act,,1986. Staff member, Laura Phillips, reported that this file came in earlier this year. The applicant was proposing to add two units on a thirty foot wide lot adjacent to the existing three units. At that time there were some problems with the site plan, and the Zoning Administrator recommended that it be referred to the Planning Commission to act on the density bonus. Since that time, the applicant has worked with, staff and has decided to come back with one unit, which is permitted on the site without a density bonus. Staff stated that there were still problems on the site, one being- the status of the lot. Staff stated that this lot is a previous street which is noted on the assessor map has being abandoned. Public Works indicates that it may have been abandoned prior to annexation to the city. The other problem is the backing of cars onto Algonquin, which Public Works recommends not be approved. Staff has asked the applicant to provide some additional information and ,is recommending that this plan not be approved until some of the problems are cleared up. Mr. Palin stated that the two major issues involved here is how the property was abandoned and the timing on the abandonment in tying it into the adjacent properties. The second being the layout design of the unit in that it would essentially allow under certain circumstances backing onto the arterial highway. The public hearing was opened and Zaher Khalaf, owner, and his architect were present.. Mr. Palin asked Mr. Khalaf if he had obtained a title report.. Mr. Khalaf stated that he would have that on Friday. He stated that the property was abandoned a few years back and at that time started paying taxes on the property. He stated that he went to court to transfer the property into his name. Mr. Palin asked the applicant if' he went to court to clear the title of the property. Applicant stated yes. Mr. Palin stated that staff would need a copy of that court action. -1- OZA 11 /4/87 There was no one else present to speak for or against the request so the public hearing was closed. Mr. Patin stated that because of the Issues here he was going to continue the item for two weeks to get together a copy of the court action and work with Public Works on an alternative layout: He also stated that the title needed to be cleared up. CONDITIONAL EXCEPTION ENO. 87-46 WAS CONTINUED TO THE NOVEMBER 18, 1987 MEETING BY THE ZONING ADMINISTRATOR. TENTATIVE PARCEL MAP NO. 86-152 Applicant: Huntington Gardens Shopping Center Bijan SassounIan Tentative Parcel Map No. 86-152 is a request to create two parcels from several parcels located':at 16369 Bolsa Chica Street. This request is covered by Categorical Exemption, Section 15305, Class 5, California Environmental Quality Act, 1986. Staff Member, Laura Phillips, reported that this is a map that was approved last year and the applicant is requesting to revise the plan. Previously, he had consolidated various parcels into one and now he is requesting to consolidate them into two separate parcels. Staff is recommending approval with the same conditions as were originally imposed, Including a condition that all previous conditions of Site Plan Amendment 86-3 and Use Permit No.,85-59 also be Included. The applicant was not present. Mr. Patin asked staff if the applicant has received notice of the hearing. Staff stated yes. Mr. Patin asked staff if the applicant has concurred with the conditions Imposed. Staff stated yes. TENTATIVE PARCEL MAP NO. 86-152 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS: FINDINGS FOR APPROVAL: 1. The proposed consolidation of several parcels for purposes of commercial use in compliance with the size and shape of property necessary for that type of development. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for Implementation of this type of use. 3. The property was previously studied for this intensity of land use at the time the land use designation for community business district allowing commercial buildings was placed on the subject property. 4. The size, depth, frontage, street width and other design and improvement features of the proposed subdivision are proposed to be constructed in compliance with standards plans and specifications on file with the City as well as in compliance with the State Map Act and supplemental City Subdivision Ordinance. -2- OZA 11 /4/87 CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL(S) FOR ANY PURPOSE: 1. The Tentative Parcel Map received by the Department of Community Development on October 6, 1987, shall be the approved layout (with the amendments as noted thereon). 2. A parcel map shall be filed with and approved by the Department of Public Works and recorded with the Orange County Recorder. 3. Street Improvements shall be completed in accordance with Department of Public Works' requirements. 4. Water supply shall be through the City of Huntington Beach's water system at the time said parcel(s) is/are developed (if such systems exist within 200 feet of said parcel(s). 5. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time said parcel(s) is/are developed (if such systems exist within 200 feet of said parcel(s). 6. All utilities shall be Installed underground at the time said parcel(s) is/are developed. 7. Compliance with all applicable City Ordinances. 8. A copy of the recorded parcel map shall be filed with the Department of Community - Development. % All vehicular access rights along Bolsa Chica and Heil shall be dedicated to the City of Huntington Beach except at locations approved by the Zoning Administrator. 106' All conditions of approval of Site Plan Amendment No. 86-3 and Use Permit No. 85-59 shall remain In effect.
