R1:GULAR AGENDA ITEMS: Staff requested that the second item, Use Permit No. 87-88, be heard first due to the lengthy involvement of ' the first item, Use Permit No, 87-82. Both applicants complied with the request and Use Permit No. 87-88 was heard first. USE PERMIT NO. 87-88 Applicant: Daniel Montoya Use Permit No. 87-88 is a request to add a second story addition to a non -conforming residence located - at 1848 Lake Street. This request is covered by Categorical Exemption, Section 15301, Class 1, California Environmental Quality Act, 1986. Staff member, Kelly Main, reported that- the project is a one story non -conforming structure, with •a request to add a second story. She stated that the structure does not meet the required sideyard setbacks. The second story addition will conform with current `code. The ',applicant meets all.. the requirements, but staff recommends that the applicant's second story addition' be setback 5 feet in.lieu of the 3 feet 6 inches from the alley and with' this adjustment, staff is recommending approval. Thet public hearing was opened and Daniel Montoya, -applicant, was present. There was discussion the staff recommendation for the five foot setback from the alley. The applicant questioned why staff was treating a private alley like a public access which would require the setback. Staff responded that the alley is frequently used and when the tract was created, the alley was treated for all purposes except maintenance as a public alley. In addition, all the garages along the street were setback 7.5 ft. from the alley as Is required from a public alley, to preserve the openness and consistency; on the block, a 5 f t. 2nd story setback should be observed. There was no one else preset to speak for or against the project so the public hearing was closed. USE,PERMIT NO. 87-88 WAS APPROVED BY THE ACTING ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS: FINDINGS FOR APPROVAL: 1. The 'establishment, maintenance and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements In the vicinity of such use or building. 2. The granting of the use permit will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the goals and objectives of the City's General Plan and Land Use Map. SPECIAL CONDITIONS OF APPROVAL: - 1. The site plan, floor plans, and elevations received and dated December 3, 1987 shall be the approved layout, subject to the modifications described herein: a. Provide S feet for rear setback from alley easement. 2. All building spoils,, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall beAlsposed of at an off -site facility equipped to handle them. 3. Proposed structures shall be architecturally compatible with existing structures. 4. Natural gas shall be stubbed In at the locations of water heaters, and central heating units. 9. Low -volume heads shall be used on all spigots and water faucets. G; Prior to issuance of building permits, the property owner shall sign, notarize, and record with the County Recorder a "Letter of Agreement" assuring that the single family residence will be maintained as one (1) dwelling unit. 7. All applicable Public Works fees shall be paid prior to issuance of building permits. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. t' 2. The applicant shall- meet • all applicable local, State, and Federal Fire Codes, Ordinances,`a,nd standards. 3. Landscaping shall comply with Article 913 of the Huntington Beach Ordinance Code. 4. ' The Zoning Administrator reserves the right to revoke this use permit if any violation of these conditions of the Huntington Beach Ordinance Code occurs. -2- J. . USE -PERMIT NO. 87-82/ENVIRONMENTAL ASSESSMENT NO. 87-48 Applicant: .'.David Mendelsohn/Richard Goldstein Use Permit No. 87-82 is a request to construct a 13,936 square foot multi -tenant automotive center on a parcel with an existing Bekins Warehouse. This request is covered by Environmental Assessment No. 87-48. Staff member, Kelly Main, reported that this is a request to build an auto center within an existing warehouse on Warner Avenue and Nicols Street. The proposed auto center will be 14,000 sq. ft. and shares the site with Bekins Warehouse, where goods that have not been claimed by the owners are stored. Ms. Main reported that there are trucks stored on' the site which come in and out of Bekins everyday. The applicant has proposed 11 tenants for this center. Because of the residential property located across the street along with the intense use anticipated on this site, staff is recommending a 25 ft. setback in front rather then the 10 'ft. -required by code. The applicant was required to get a noise report because the aYea is zoned fbr residential use. Staff is also proposing that 15 feet be added to the back ,of the rear portion of the building. The applicant is presently providing more than adequate parking, however staff will have to reevaluate the parking situation because of the 25 foot setback. Staff has also decided to allow the applicant to take out the landscaping between the parking bays to make room for more parking. Staff is requesting 25 feet of landscaping and a 6 foot retainer wall in the front of the property for screening the noise from the activity. The public hearing -was opened and David Mendelsohn, applicant, was present. Staff and the applicant discussed the purpose of the noise report and its conclusion. Mr. Strange asked the applicant if the businesses would be automotive repair. The applicant stated yes, -adding that he would be willing to put the auto body shop toward the back third of the building, and the general tune up, work in the front. Mr. Strange expressed concern about work being done in the parking lot and inoperable vehicles and cars being stored in the parking lot. Mr. Strange asked the applicant ' if he would oppose the city conditioning that only six major automotive businesses be allowed and the remainder of the eleven be minor businesses. Applicant agreed. Staff requested one tree per planter. Limit the hours., of operation from 7:00 ,a.m. to 8:00 p.m. Monday through-.5aturday and Sunday the business hours will be. regulated by the Municipal Code. Applicant agreed. Applicant will be required to go to the Design Review Board for colors, elevations, roof lines and materials. Staff and applicant agreed, that the wall will be four feet high. Staff requested a parking management plan showing the detail of the parking area. There was no one else present to speak for or against the project so the public hearing was closed. A, 4, foot wall,which extends from the auto center to the driveway entrance along the front setback. c. .Two interior planters among the parking spaces which line the auto center. One of the planters shall,be,located,at the front end (Warner side) of the parking bay. Each of the two, planters.shall contain at least one tree. d. An extension to the rear of the auto center to compensate for the increased setback requirement. The extension shall not impede into required drive aisle width -or lire lane area. e. A trash area suf ficient for the number of auto center tenants and the Bekins Warehouse and centrally, located. 'The 'walls of ''the trash area should be compatible with , the " building and the screening wall in . the front of the property. The trash enclosure shall meet all applicable codes and standards. Corrected measurements from property line to the center line of Warner Avenue (from -45.5 feet to 60.5 feet)... 2.: Prior to issuance of building permits, the applicant shall file a parcel map or parcel .;,map waiver request to legalize the existing parcel. The parcel map or plat map and notice shall be recorded with the Orange County Recorder and a copy of the recorded map or plat filed with' the -Department of Community Development prior to final inspection or occupancy or provide proof of legal lot. 3. Prior to issuance of building permits, the applicant shall submit the following plans: a. Landscape and irrigation plan to the Department of Community Development and Public Works for review and approval including revised landscape plans for the 10 foot front setback of Bekins. Trees on site shall be minimum of 24 inch box or greater per landscaping code. . b. Rooftop Mechanical Equipment Plan. Automatic sprinkler systems will be installed throughout to comply with Huntington Beach Fire Department and Uniform Building Code Standards. Shop drawings will be submitted to and approved by the Fire Department prior to installation. 22. Fire extinguishers will be installed and located in areas to comply with Huntington Beach Fire Code Standards. 23. One (1) fire hydrants will be installed prior to combustible construction. .Shop drawings will be submitted to the Public Works Department and approved by the Fire Department prior to installation. 24. Fire lanes will be designated and posted to comply with Huntington Beach Fire Department Standard No. 415. 25. Address numbers will be installed to comply with Huntington Beach Fire Code Standards. The size 'of the numbers will be the following: a. The number for the building will be sized a minimum of ten (10) inches with a brush stroke of one and one-half (1-1/2) inches. b. Individual units will be sized a minimum of four (4) inches with a brush stroke of one-half (1 /2) inch. 26. A needed fire flow shall be not less than 4000 GPM. 27: West perimeter of fire- lane and "hammerhead" -turnaround shall be painted on the asphalt and be kept clear at all times. 28. Natural gas shall be stubbed in at the locations of water heaters, and central heating units.. 29. Low -volume heads shall be used on all spigots and water faucets. 30. If lighting is included in the parking lot, high-pressure sodium vapor lamps shall be used for energy savings. All outside lighting shall be directed to prevent "spillage" onto adjacent properties. 31. All applicable Public Works fees shall be paid prior to issuance of building permits. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The applicant shall comply with noise standards pursuant to the Municipal Code, Section 8.40 4. If any hazardous materials are to be used on site, the business must comply with Chapter 1758 of the City's Municipal Code which requires any business that handles, *'-stores hazardous materials, including waste, to inventory the hazardous materials on site and prepare a business emergency plan in case of an accidental release of toxic material. Additionally, all hazardous materials, including waste, must be handled and stored in accordance with the Uniform Fire Code. Waste oil is considered a hazardous waste. 5. A detailed soils analysis shall be prepared by a registered Soils Engineer. This analysis shall include on -site soil sampling and laboratory testing of materials to provide detailed recommendations regarding grading, chemical and fill properties, foundations, retaining walls, streets, and utilities. 6. Landscaping shall comply, with Articles 960 and 953 " of the Huntington Beach Ordinance Code. 7. Prior to issuance of building permits the applicant shall submit a parking management plan. 8. The Zoning Administrator reserves the right to revoke this use permit if any violation of these conditions of the Huntington Beach Ordinance Code occurs.
