HomeMy WebLinkAbout1987-12-15MINUTES REDEVELOPMENT AGENCY Room B-8, Civic Center Huntington Beach, California Tuesday, December 15, 1987 Chairman Erskine called the adjourned regular meeting of the Redevelopment Agency of the City of Huntington Beach to order at 5:30 p.m. OLD Present: Kelly, Green, Finley, Erskine, Mays, Winchell Absent: Bannister Chairman Erskine called a Closed Session of the Redevelopment Agency pursuant to Government Code Section 54956.8 to give instructions to the Agency's nego- tiator regarding negotiations with Robert Terry concerning the purchase/sale/ exchange/lease of the property located at 112-118-122 5th Street and 411 Walnut Avenue legally described as Assessors Parcels 024-153-1, 2, 3 and 6 and 214 5th Street Assessors Parcel 04-035. RECESS RECONVENE The Chairman called a recess of Council at 5:30 p.m. The meeting was recon- vened at 5:55 p.m. ACOUISI ION OF TERRY BUICK. INC PROPERTY - APPROVED - CONTRACT OF SALE = APPROVED - MAIN -PIER REDEVELOPMENT PROJECT AREA The Chief Executive Officer presented a communication from Doug LaBelle, Director of Community Development, regarding the acquisition and Contract of Sale for parcels,in the Main -Pier Redevelopment Project Area and transmitting a proposed agreement for sale of real property between the Agency and Robert Terry. A motion was made by Kelly, seconded by Mays, to approve and authorize the acquisition of the Terry Buick, Inc. property and to approve the agreement and contract of sale which includes the following points: 1. Prepare a request to Imperial Thrift and Loan for release of beneficiary loan statement and authorization for the transaction to culminate. 2. Purchase at the fair market value from Mr. Terry on a willing seller basis pursuant to the attached map and appraisal for an amount not to exceed $1,450,000. .The $50,000 option money paid to Mr. Terry by Charles Rivers and Griffin Realty will be subtracted form this amount. Should Griffin Realty fail to perform and complete a project, the Agency will pay Mr. Terry the $50,000 to complete the purchase price. Page 2 - Redevelopment Agency Minutes - 12/15/87 3. Pay relocation costs of new automobile agency for an amount not to exceed ... $100,000 within the City of Huntington Beach. 4. Pay attorney's fees for services provided for the transfer of the dealer- ship through the California New Motor Vehicle Board for an amount not to exceed $25,000. 5. Mr. Terry upon vacating the property, shall be responsible and liable for clean up costs and hazardous soils remediation. The Agency shall provide the first $30,000 for clean up. Mr. Terry shall provide a faithful per- formance bond in the amount of $100,000 and will assume additional costs of site remediation up to that amount. The Agency will assume all costs beyond the $130,000. 6. Mr. Terry will retain 100% of the subsurface mineral rights below 500 feet. 7. The Agency will assume the first trust deed and pay off the second trust deed. 8. The Agency will provide a letter to Mr. Terry that the property is being acquired under the threat of condemnation. 9. The Agency agrees to allow Terry Buick, Inc. to rent the facilities at no rent through May 1988, and from that time forward, he would pay rent equivalent to the mortgage payment on the first trust deed on a month to month basis at the sole option of the Agency provided no sublease and no r1 assignment of lease shall be allowed and provided the use remains the same.
