PUBLIC HEARING ITEMS C-1 LAND USE ELEMENT AMENDMENT 87-3. ZONE CHANGE NO. 87-4 AND ENVIRONMENTAL IMPACT REPORT NO. 87-3 (RECONSIDERATION) APPLICANT: CORONA DEVELOPMENT This revised request for the General Plan Amendment to Senior Residential and Zone Change to Q-R3-SR addresses a 42 unit senior citizens project proposed for the 1.14 acre subject site located on the east side of Delaware Street approximately 280 feet north of Delaware Street and Garfield Avenue. The new approach is intended to allow a senior residential project without the need to expand the Pacifica Community Plan. A senior project is an appropriate land use for the property and the limits and restrictions imposed by the proposed senior residential land use designation and Q-R3-SR zoning will preclude this project from becoming a precedent setting factor for substantial density increases in the surrounding area. ENVIRONMENTAL STATUS: The proposed project is covered by Environmental Impact Report No. 87-3. STAFF RECOMMENDATION: A. Recommend to the City Council that Environmental Impact Report No. 87-3 be certified as adequate and in conformance with the State EIR Guidelines. B. Approve General Plan Land Use Element Amendment 87-3 for a change in land use designation from Medium Density Residential to Senior Residential and recommend adoption by the City Council. C. Approve Zone Change No. 87-4, with findings, to rezone the site from R2 (maximum 15 units per acre) to Q-R3-SR (Medium -High Density with a senior suffix which would allow 25 units per acre plus a 50 percent density bonus totalling 42 units). THE PUBLIC HEARING WAS OPENED Robert Corona, applicant, spoke in support of the request. He stated concurrence with the findings by staff. He requested consideration of a pay -back system of front footage costs for future tie-ins by other developers to the improved sewer system. There were no other persons present to speak for or against the request and the public hearing was closed. The Commission requested that the corrected data to the City and County sewer lines be included in the environmental impact report and the mitigation measures for sewer problems be incorporated into the findings for approval for the zone change. PC Minutes - 1/5/88 -3- (9779d) They also suggested that staff explore the general area south of the Pacifica Community Plan district (south of the Pacifica Community Plan District and north of Garfield Avenue between Main Street and Florida Street) for possible rezoning. They further suggested that a study session be scheduled at a future date to discuss the possibilities of rezoning. As a result of the proposed project there are no measurable environmental impacts that will adversely impact the area. The required sewer connection parallelling the sewer line in Delaware Street south of the County's Newland/Delaware trunk, District 11, located at Delaware Street and Garfield Avenue will mitigate the sewer problems. ABSTAIN: None MOTION PASSED PC Minutes - 1/5/88 -4- (9779d) C-2 CONDITIONAL USE PERMIT NO, 87-44/CONDITIONAL EXCEPTION (VARIANCE) NO. 87-95/TENTATIVE PARCEL MAP 87-424/ENVIRONMENTAL IMPACT REPORT NO. 87-4 APPLICANT: MC DONNELL-DOUGLAS REALTY CO. Conditional Use Permit No. 87-44 is a request to permit the development of a 604,982 square foot mixed -use development. The subject property is located at the northeast corner of Bolsa Avenue and Bolsa Chica Street. The site is approximately 18 acres in size and will be developed by the McDonnell -Douglas Corporation, the current owners of the property. The proposed project will include an 8 and 12 story office building as well as 2 restaurants, a support retail building and parking facilities for 2,524 vehicles. Conditional Exception (Variance) No. 87-95 is a request to allow more than 50 percent of the required front yard setback to be used for surface parking. Tentative Parcel Map 87-424 is a request to create seven parcels on the 18.4 acre site. ENVIRONMENTAL STATUS: Covered under Environmental Impact Report No. 87-4. STAFF RECOMMENDATION: Certify Environmental Impact Report No. 87-4 and approve Conditional Use Permit No. 87-44, Conditional Exception (Variance) No. 87-95 and Tentative Parcel Map 87-424 with findings and conditions of approval. Staff further recommends that the Planning Commission adopt the attached Resolution 1387 setting forth the permitted uses in this mixed use development. THE PUBLIC HEARING WAS OPENED Merle Pautsch, Vice President of Development -McDonnell -Douglas, spoke in support of the project. Lorraine Faber, 15271 Nottington Lane, questioned the legal foundations of the project. She stated that she feels the zoning on the property should be changed to M1 (Office Professional) because of the proposed 120 foot height instead of 40 feet (originally approved under a previous use variance). Dean Albright, 17501 Breda Lane, member of the Environmental Board, addressed his concerns which included mitigations for sewage capacity and traffic problems. PC Minutes - 1/5/88 -5- (9779d) Hans Goldsmith, 14306 Suffolk, Westminster, spoke in opposition to the project. He feels there is too much traffic in the area and urged the Commission to consider a light at Suffolk and adding another lane to Rancho Road. He also stated that there is too much noise on the site presently and compared Bolsa Chica to a race track. Al Schmidt, 5286 Charing Cross Road, Westminster, urged the Commission to require a study of Rancho Road to mitigate the traffic problems in the area. Alfred Hanf, 5185 Victoria Place, Westminster, stated that McDonnell -Douglas is already experiencing parking problems and that there is too much noise, dust and traffic on Rancho Road. Rosalie Perconti, 5732 Kings Cross Road, Westminster, expressed her concerns with pollutants in the area and that Rancho Road was not considered in the environmental impact report as a potential problem area. John Dickerson, 6091 Kelsey Circle, expressed his concern with the height (12 stories) of the proposed buildings. He would like to see a building with less stories and perhaps a 5 story parking structure. Lee Weider, 17082 Pleasant Circle, Chairman of the Environmental Board, addressed his concerns. They included air quality, freshwater supply, circulation and the fiscal analysis. Cheryl Lane, 14431 Spa Drive, stated that she is concerned with the traffic on Rancho Road. She said that the traffic gets so bad -that drivers use alternate routes which include her drive and that there are a lot of children in the area and she is worried about a fatality. She suggested that a light be installed on Rancho Road. Mike Cormach, 14351 Spa Drive, stated that there is already too much noise from McDonnell -Douglas. He further stated that there has been a lot of dust coming from the site because it appears as though a new road is being built on the site and he questioned whether grading permits and building permits had been issued. Dennis Briscoe, 14272 Suffolk, Westminster, stated that he is concerned with the flooding from the channel on Rancho Road and that a sewer study or traffic study was not completed on the site. He requested that comments be obtained from the City of Seal Beach because they will be impacted also by the project. Marty Schmidt, no address given, stated that her field is in environmental protection and that she will not appreciate the tax revenues from the project. Her main concern is the steam generator emissions and the fact that it was not covered in the EIR. She also stated that she feels the present site should be cleaned up (including the underground storage tanks) before a new project is started. 1 PC Minutes - 1/5/88 -6- (9779d) There were no other persons present to speak for or against the project and the public hearing was closed. At the Commission's request, Wes Pringle, traffic consultant on the project, addressed the problems and mitigations covered in the EIR. The Commission discussed the concerns addressed in the public hearing and agreed that most of the concerns were covered in the conditions of approval imposed on the project. An additional finding was suggested regarding sewage capacity credit from the vacant site and additional conditions were added to include additional lights and traffic improvements. Concerns with Resolution No. 1387 were discussed by the Commission. They requested that the sale of alcohol in the proposed restaurants be subject to a new entitlement with review by the Planning Commission. She further stated that she feels the City of Huntington Beach needs developments such as this to build an economic base to generate revenue for future improvements. Commissioner Silva stated that he agreed that the traffic was bad in the area and that more conditions should be added to mitigate the problems however he feels that the City does need the income that will be generated from the project. The proposed mixed use project, with conditions of approval and mitigation measures identified in EIR 87-4, will not have a detrimental effect upon the general health, welfare, safety and convenience of persons residing or working in the neighborhood, nor will it be detrimental to the value of property and improvements in the vicinity. 2. The proposed mixed use office project which include 65 percent of the gross floor area of the buildings to be used as corporate office headquarters is consistent with the M1-A Zoning District and the General Plan Land Use designation of General Industrial. The proposed mixed use office project is compatible with existing and proposed uses in the vicinity which include general industrial to the south, Seal Beach Naval Weapons Center to the west and the McDonnell -Douglas Astronautics Facility to the north and east. 4. The location, site layout, and design of the proposed mixed use office project properly adapts the proposed structures to streets, driveways and other adjacent structures in a harmonious manner. Project entries, deceleration lanes and changes to the existing medians in Bolsa Chica Street and Bolsa Avenue have been properly designed by a Traffic Engineer in order to mitigate impacts on the existing circulation system. 5. The combination of the proposed uses on the site, as set forth in Draft Resolution No. 1387, are properly integrated on the site. 6. Access to and parking for the proposed mixed use office project will not create undue traffic problems. The new traffic signal on Bolsa Avenue at the main entry to the project will encourage employees to use this entrance. The speed ramp on the east side of the parking structure will facilitate orderly ingress and egress from the parking structure. 7. The granting of Conditional Exception (Variance) No. 87-95 to allow for more than 50 percent of the front yard setback to be used for parking will be offset by the provision of landscape on the site far in excess of code requirements, insuring that the project will not be materially detrimental to the public health, safety and welfare or injurious to the conforming land, property or improvements in the neighborhood. 8. Exceptional circumstances (the granting of the Use Variance for building heights up to 250 feet) do not apply generally to property in the same district. 9. The granting of Conditional Exception (Variance) No. 87-95 is necessary for the preservation of and enjoyment of substantial property rights. 10. The Orange County Sanitation District planned for 71,469 gallons of sewage effluent per day to be generated from this 18.4 acre site. The proposed project is projected to generate 110,447 gallons per day; a 54 percent increase over that which was planned for. It is understood that this project is utilizing a sewage capacity credit of approximately 38,978 gallons per day from the undeveloped 66 acre McDonnell -Douglas site located along Springdale Avenue. PC Minutes - 1/5/88 -9- (9779d) FINDINGS OF APPROVAL - TENTATIVE PARCEL MAP 87-424: 1. The proposed subdivision of 7 parcels for purposes of industrial use is in compliance with the size and shape of property necessary for that type of development. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation of this type of use. 3. The property was previously studied for this intensity of land use at the time the land use designation of general industrial allowing for corporate offices and the high rise node designation allowing for multi -story buildings was placed on the subject property. 4. The size, depth, frontage, street width and other design and improvement features of the proposed subdivision are proposed to be constructed in compliance with standard plans and specifications on file with the City as well as in compliance with the State Map Act and supplemental City Subdivision Ordinance. CONDITIONS OF APPROVAL - CONDITIONAL USE PERMIT NO. 87-44 AND CONDITIONAL EXCEPTION (VARIANCE) NO. 87-95: 1. The site plan received and dated December 29, 1987, shall be revised depicting the modifications described herein: a. Additional stairwells shall be provided within the parking structure per Fire Department requirements. Three stairwells shall be added to the east side and one stairway shall be added to the west side. b. Full size parking stalls on -grade shall be dimensioned as 17 feet by 9 feet with a 2 foot overhang. Additional 2 feet shall be added to the landscape planter for this overhang area. c. A deceleration lane along Bolsa Avenue shall be provided at the project's major entry. The length and design of the deceleration lane shall be subject to the review and approval of the Public Works Department. d. Building shall be accessible on two (2) sides by way of roadways (fire lanes) not less than twenty-seven (27) feet in width, with adequate turning radii. Roadway (fire lanes) shall be not be less than ten (10) feet or more than thirty (30) feet from building. Fire lanes shall provide access to a minimum of 50 percent of the ground floor perimeter of the buildings. PC Minutes - 1/5/88 -10- (9779d) e. A dedicated fire lane shall be provided on all sides of the parking structure. Fire lanes are for emergency access and must be a minimum of twenty-four (24) feet in width. f. The surface parking layout of Phase I in the location of the Phase II parking structure shall be revised to encourage efficient ingress and egress from the signalized project entry on Bolsa Avenue and discourage use of the secondary Bolsa Chica entry. The revised parking lot layout shall be subject to the review and approval of the Planning Director and Public Works Department. 2. The elevations received and dated December 29, 1987, shall be revised depicting the modification described herein: a. Greater architectural emphasis of the building base and building entrance shall be provided. The final elevations shall be subject to the review and approval of the Design Review Board. 3. Prior to the issuance of a grading plan, the applicant shall submit a hydrology report for review and approval of the Public Works Department. 4. Prior to the issuance of building permits for Phase I, 8-story office building (excluding grading and foundation permits), the applicant shall submit the following documents for the review and approval of Department of Public Works and Community Development: a. Soils analysis, prepared by a registered soils engineer. This analysis shall include on -site soil sampling and laboratory testing of materials to provide detailed recommendations regarding grading, chemical and fill properties, foundations, retaining walls, streets and utilities. b. Grading plan c. A Landscape and Irrigation Plan. The Preliminary Landscape Plan, received and dated October 28, 1987, shall be revised depicting the modifications described herein: (1) Of the sixty 36" box accent trees indicated in the applicant's preliminary landscape plan, twenty shall be upgraded to 48" box size (this would include the 8 existing coral trees to be relocated). (2) The trees in the perimeter planting area between the parking lot and arterial streets, and adjacent existing parking areas, shall be a minimum of 30" bog size. The perimeter planting area shall be bermed. PC Minutes - 1/5/88 -11- (9779d) (3) The trees within the interior of the project site shall be a minimum of 24" box size. (4) Trees of 15 gallon size or less shall not be utilized in the landscape plan. (5) The irrigation plan shall include the use of low angle sprinkler heads along the perimeter of the site and the use of drip irrigation to interior planters to minimize water runoff. (6) Phase I landscaping shall include completion of all proposed landscaping along Bolsa Avenue and Bolsa Chica Street. (7) The surface parking area on the eastern portion of the site where the proposed Phase II parking structure will be built shall be striped with landscape planters between opposing lanes of parking stalls. The status of Phase II construction shall be reviewed on an annual basis by the Planning Director to determine if landscape materials shall be installed in the temporary parking area. Landscape shall be installed in the temporary parking area within five years of the date of approval of this conditional use permit. d. A comprehensive, permanent set of convenants, conditions and restrictions covering limitations on the mixed use entitlement including a list of permitted uses and any conditions of approval for the project, and all development, performance, and management standards shall be submitted for staff review. A recorded copy shall be submitted to the Department of Community Development prior to occupancy of any building. Approval for content shall be the responsibility of the Department of Community Development and approval as to form by the City Attorney. Any modifications to the approved convenants, conditions and restrictions must be submitted to the City for approval. e. A parcel map creating leasable parcels on the site. Said map shall be recorded prior to final inspection and a copy submitted to the Department of Community Development. f. Geologist Report. An engineering geologist shall be engaged to submit a report indicating the ground surface acceleration from earth movement for the subject property. All structures within this development shall be constructed in compliance with the G-factors as indicated by the geologist's report. Calculations for fittings and structural members to withstand anticipated G-factors, shall be submitted to the City for review. PC Minutes - 1/5/88 -12- (9779d) g. A Silt Control Plan. A plan for silt control for all storm runoff from the property during construction and during initial operation of the facilities, submitted to the Department of Public Works for review. 5. Prior to commencing above grade construction the applicant shall prepare a Preconstruction Fire Plan, for review and approval of the Fire Department, which guarantees adequate access and fire protection for a building of this type of construction during all construction phases. 6. Prior to issuance of a Certificate of Occupancy for the Phase I, 8-story office building the applicant shall construct the following public right-of-way improvements per Public Works standards: a. A 100 foot left turn storage lane for eastbound traffic on Bolsa Avenue coming from Bolsa Chica Street. b. Install a traffic signal on Bolsa Avenue at the access point to the site 1,000 feet east of the Bolsa Chica signal. c. The applicant shall be responsible for providing the conduit, cable, and controller hardware necessary to coordinate the traffic signals at the intersections of Springdale and Bolsa Graham and Bolsa Bolsa and proposed pedestrian signal at McDonnell -Douglas entry on Bolsa Bolsa and new signal to be provided for this project Bolsa and Bolsa Chica This will require the installation of conduit from Springdale to Bolsa Chica. d. Construct a 150 foot westbound left turn pocket on Bolsa Avenue beginning approximately 600 feet east of the Bolsa Chica Street centerline e. Provide a second access point for the project along Bolsa Avenue with the opening beginning and ending approximately 300 and 355 feet, respectively, east of Bolsa Chica Street centerline. This access point shall be restricted to right turn only access. f. Construct a median break on Bolsa Chica Street to serve the project entry. The median break shall be designed to allow for southbound left turns into the project, but shall prohibit westbound left turns out of the project. The City may, based on traffic studies, limit or preclude left-hand turns from Bolsa Chica (southbound) onto the subject site such as by placing "no left -turns" signs during peak hours. PC Minutes - 1/5/88 -13- (9779d) g. Construct a new bus stop/turnout on westbound Bolsa Avenue adjacent to the project site and on northbound Bolsa Chica Street. The precise design and location of the turnouts shall be reviewed and approved by the Public Works Department and OCTD. The area adjacent to the turnouts shall be able to accommodate a passenger waiting area with a bus shelter and bench. A paved, lighted, handicapped accessible pedestrian accessway shall be provided between the stops and the project buildings. 7. Prior to the issuance of building permits for the Phase II, 12-story office building, or parking structure, the applicant shall submit for review and approval of the Public Works Department an interim traffic and parking plan to insure there is adequate parking on -site during Phase II construction. McDonnell -Douglas shall pay for their proportionate share of the costs for traffic improvements within the City of Westminster at the following intersections constructed as a result of the proposed development in the City of Huntington Beach. The City of Westminster anticipates improvements to the following intersections: Garden Grove Boulevard/22-405 freeway ramps Garden Grove Boulevard/Bolsa Chica Road Westminster/Springdale Westminster/Bolsa Chica Rancho Road/Bolsa Chica Cost estimates for the proposed improvements total $155,000. A study shall be undertaken to determine the percentage of traffic originating from this proposed development which impacts the intersections listed above. The payment to the City of Westminster shall be based on the percentage of traffic identified as originating from the proposed project to be mutually agreed upon by the City of Westminster and Huntington Beach. In any case, payment shall not exceed $35,000. The applicant shall divert proposed and/or existing flows to the Graham Street sewer so that the Bolsa Avenue line will ultimately flow within acceptable levels. 18. On -site sewers shall be private and sized to accommodate future flows from the north. 19. Prior to the issuance of building permits on the 66 acre McDonnell -Douglas property located at the northwest corner of Bolsa Avenue and Springdale Street, clearance shall be obtained from the Orange County Sanitation District stating that such development will not adversely impact the sewer system. Such clearance shall be in the form of a letter to the Director of Public Works and the Director of Community Development. 20. Fugitive dust shall be controlled through the use of water or other soil stabilizers during all construction activities. 21.
