ACTING ZONING ADMINISTRATOR PRESENT: Mike Strange STAFF MEMBERS PRESENT: Kelly Main Laura Phillips REGULAR AGENDA ITEMS: USE PERMIT NO. 87-91 Applicant: Oshman's Sporting Goods Use Permit No. 87-91 is a request to permit a temporary tent in the parking lot for a maximum of seven days for the purpose of a 15-hour, one -day sale located at 15021 Goldenwest Avenue. This request is covered by Categorical Exemption, Class 4, California Environmental Quality Act, 1986. Staff member, Kelly Main, reported that this is a request for 40 x 60 foot tent. The applicant has had two previous tent sales in the past two years with no problems. The Fire Department and Public Works Department reported that they have no problems. Staff is recommending approval of Use Permit No. 87-91. The public hearing was opened and Allen Fawcett, applicant, was present. He stated that he concurred with the findings and conditions. There was no one else present to speak for or against the request so the public hearing was closed. USE PERMIT NO. 87-91 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS: FINDINGS FOR APPROVAL: 1. The establishment, maintenance and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of the Use Permit No. 87-91 will not adversely affect the General Plan of the City of Huntington Beach. -1- 3. The proposal is consistent with the goals and objectives of the City's General Plan and Land Use Map. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated December 10, 1987 shall be the approved layout. 2. The applicant shall provide for clean up of the area after closing of the event. 3. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. 4. The applicant shall obtain clearance from the Public Liability Claims Coordinator, Administrative Services Department, and/or shall provide a Certificate of Insurance and Hold Harmless Agreement to be executed at least five (5) days prior to the event. 5. Provide a minimum of thirty (30) feet back up area for parking space bay located to the south of the tent. 6. Sidewalks shall be maintained at a clear width of four feet (41). INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 2. A Certificate to Operate shall be issued by the Department of Community Development as required by Section 9730.8 of the Huntington Beach Ordinance Code prior to the event. 3. The applicant may erect the tent and have the sale provided that all conditions of approval have been met. Should Use Permit No. 87-91 be appealed, all activity shall cease immediately and the area restored to its previous condition. 4. The Zoning Administrator reserves the right to revoke this Use Permit No. 87-91 if any violation of these conditions of the Huntington Beach Ordinance Code occurs. ADMINISTRATIVE REVIEW NO. 87-40 Applicant: Seawind Cove Partnership Administrative Review No. 87-40 is a request to permit a temporary sales trailer on -site located at 8120 Garfield Avenue. This request is covered by Categorical Exemption, Class 4, California Environmental Quality Act, 1986. Staff member, Kelly Main, reported that the applicant intends on having four models located on the site with a sales trailer. The project will be done in three phases. The applicant intends to leave the trailer until the last unit is sold in phase one. At the present, they only have one sign on the side of the trailer, staff recommended that any future signs on the site will have to be reviewed by the Zoning Administrator. -2- Mr. Patin asked the applicant, Tom Bruttomesso, the estimated time period to complete phase 1 of the development. Applicant stated the project would be completed sometime in June of 1988. Mr. Patin questioned handicapped access into the sales office. Applicant stated that the units are not equipped for the handicapped. He stated that he discussed this with staff and suggested that a doorbell be placed at the bottom of the steps leading to the sales trailer or show them literature. Mr. Patin stated that code requires access for the handicapped to the sales trailer and also the applicant provide a handicap access parking space. Applicant concurred. ADMINISTRATIVE REVIEW NO. 87-40 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS: SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated December 15, 1987 shall be the approved layout. 2. Prior to issuance of building permits, applicant shall submit the following plans: a. Landscape and irrigation plan for models and parking areas to the Department of Development Services and Public Works for review and approval. 3. Installation of required landscaping and irrigation systems shall be completed prior to final inspection. 4. Security fencing, gates, locking devices, and ingress and egress from streets and parking areas shall be reviewed and approved by the Fire and Police Departments prior to issuance of building permits. 5. A site plan and elevations delineating various directional signs and model identification signs shall be submitted to the Department of Development Services and Public Works for review and approval. Subdivision directional signs shall comply with the Section 9610.9 (c) of the Huntington Beach Ordinance Code, and shall be installed prior to final inspection. 6. All roads (including fire access) shall be of hard surface, all weather construction meeting Public Works requirements and installed prior to combustible construction. 7. All water lines and fire hydrants shall be installed and approved by the Fire Department prior to issuance of permits for any temporary or permanent structures. 8. The sales office shall not be converted or expanded into a general business office. 9. The office use shall be discontinued within thirty (30) days following sale of the last on -site unit. A surety bond of $1,000.00 shall be posted with the city for each model home complex (for a total of $2,000.00) to guarantee compliance with all provisions of the code and the Huntington Beach Ordinance Code and Building Code. Such model homes shall only serve the tract specified in subject Administrative Review application. 10. Provide handicap parking spaces and access to the sales office per Building Division requirements. -3- 1 11. All building spoils, such as unusable lumber, wire, pipe and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 12. Fire lanes, as determined by the Fire Department, shall be posted and marked. 13. All applicable Public Works fees shall be paid prior to issuance of building permits. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The Zoning Administrator reserves the right to revoke this Administrative Review No. 87-40 if any violation of these conditions of the Huntington Beach Ordinance Code occurs.
