HomeMy WebLinkAbout1988-01-11MINUTES CITY COUNCIL/REDEVELOPMENT AGENCY Council Chamber, City Hall Huntington Beach, California Monday, January 11, 1988 A tape recording of this meeting is on file in the City Clerk's Office Mayor/Chairman Erskine called the adjourned regular meeting of the City Coun- cil and the Redevelopment Agency of the City of Huntington Beach to order at 6 p.m. Present: Green, Finley, Erskine, Mays, Winchell, Bannister Absent: Kelly SENATE BILL 1517 (BERGESON) - BOLSA BAY HARBOR & CONSERVATION DISTRICT - STAFF RECOMMENDATION RE AMENDMENTS APPROVED Mayor/Chairman Erskine stated that the purpose of the Study Session was to review the proposed amendments to Senate Bill 1517 (Bergeson) pertaining to the Bolsa Bay Harbor & Conservation District. Julie Froeberg, representing Senator Bergeson, encouraged Council/Agency to act on as many amendments as possible at this meeting. She stated she would remain at the meeting to ans- wer questions. Jim Palin, Deputy City Administrator/Zoning Administrator informed Council/ Agency that they had been provided with copies of the Proposed Amendments for City Council Consideration at 1/11_/88 City Council Meeting; the Bolsa Chica omparative Land Use Statistics Summary dated July 1, 1987; the Outline of � L Bpi Harbor and Conservation District Budget and Funding Provisions`SB =; the Bolsa Chica Comparative Land Use Statistical Summary Preferred A]ternatime`Primary Roadway Alignment dated January 11, 1988; and Senate Bi11 No. 1517. Discussion was held regarding Page 7, Section 140(g). Mr. Patin recommended that Section 140(g) be accepted with the deletion of the last sentence refer- encing the Mello -Roos act: "Except as otherwise specified in this subsection (g), the reimbursement agreement shall comply with the requirements of Section 53314.9-of the Government Code (Mello -Roos Act)." A motion was made by Green, seconded by Finley; to accept Section-140(g) with the deletion of the last sentence pertaining to the Mello -Roos act. Warren Divan, representing Brown and Divan, addressed Council/Agency regarding provi- sions of the Mello -Roos act. Following discussion between Council/Agency and Mr. Divan, the motion was withdrawn with the understanding that no action would be taken on Section 140(g) or 792 until the January 19, 1988 Council/ Agency meeting. Page 2 Council/Agency Minutes - 1/11/88 The City Administrator suggested that Council/Agency request a two week exten- sion of time on submittal of City recommendations on the bill because of the many proposed amendments being transmitted to the City for consideration. Discussion was held regarding Page 8, Sections 144 pertaining to public trust lands. Catherine Stone, representing Burke, Williams and Sorenson, city con- sultant, stated that the city had no problem with this amendment. Mr. Russ Behrens, representing Signal Landmark, stated that the state and Signal Land- mark had no problem with this amendment. Discussion was held regarding Page 13, Section 401 pertaining to wetlands reistoration, particularly the word "obligations". It was suggested the words "contractual obligations" or "statutory and/or contractual obligations" be substituted. Mr. Behrens recommended that staff formulate a definition of the words "project proponent". Discussion was held regarding Pages 16, 17 and 18, Section 409(a) pertaining to funding the restoration of the wetlands. Mr. Palin recommended that Coun- cil/Agency take no action on this section at this time., Councilman/ Director Green:requested further information on the matter. Discussion was held regarding Page 23, Section 509 pertaining to a navigable channel and sand replenishment.' Mr. Palin presented a new subsection "h" as follows: "Nothing in this•section shall relieve any federal, state or other local agencies of its responsibilities for any currently established sand replenishment activities." Discussion was held regarding the words "navigable channel" or "ocean entrance" and the benefits, or lack of benefits, of an ocean entrance to the district. Discussion was held regarding page 27, Section 703 pertaining to the figure $100,000 for wetlands, operation and maintenance. Mayor/Chairman Erskine requested information from staff regarding the amount presently budgeted for this purpose. Discussion was held regarding page 34, Section 799(a)(3) pertaining to the use for. which proceeds from the bonds could be used. Mr. Palin reviewed the sec- tion referring to the definitions of major public works and major facilities. Mayor/Chairman Erskine requested that Bolsa Chica Street be added to the list of major arterial street, highway and bridge improvements. Carl Neuhausen, Director of Planning and Future Development for Signal Land- mark, presented a copy of a chart titled Bolsa Chica Pr ject Status to the Council/Agency. He reviewed progress on traffic, Huntington Harbor Connec- tion, Ocean Entrance, Metropolitan Water District, Supplemental Environmental Impact'Report, Linear Regional Park, City Local Coastal Plan Amendment, Senate Bill 1517 and the Pre-Annexation/Development Agreement. j Mr. Neuhausen reviewed the Land Use Plan, particularly the change to the plan made in response to the discovery that the Newport -Inglewood earthquake fault had a broader fault zone in the area than was originally estimated. He stated that the broader fault zone eliminated residential use in that area by approx- 1 0 Page 3 —,Council/Agency, Minutes.— 1/11/88 imately 30 toi 35 acres and suggested a marina recreation/public use for the area. He -recommended that the wetland area be consolidated in a central. area rather than separate areas surrounded by roads and reviewed the commercial area, proposed hotel and flood control channel. Mr. Neuhausen stated that because the residential area had been decreased the densities were increased and there were some variations in street ,configurations. Discussion was held between Council/Agency and Mr. Neuhausen regarding density and dredging. John Kain, Kunzman Associates, stated he was working on a computerized traffic ,model which was not ready for distribution. He reviewed present and future Impact of traffic; on Pacific Coast Highway, Warner Avenue above Pacific Coast Highway and portions of Goldenwest Street and addressed the issue of connector streets. D'i;scusslon was held between Council/Agency and staff regarding the daily volume of traffic on Edinger Avenue and Pacific Coast Highway at the present time and the projected increase of traffic following the 'proposed McDonnell Douglas Aircraft Company project, the proposed Meadowlark project and the development of Bolsa Chica. The City Administrator recommended one overall study of projected traffic impact from each of the three projects. Mr. Behrens reviewed page 16, Section 409 for Council/Agency pertaining to funding for restoration of the wetlands and ESHAS. He reviewed the issue of wetland restoration being tied into development, reimbursement of funds and sources of funding such as parking and marina fees. He stated the abandonment and relocation of oi,l wells was a private issue between Signal Landmark and Shell Oil Company and that there was an existing agreement. between them deal— ing with the matter. Mel Malkoff of Mel Malkoff Associates, consultants for Signal Landmark, reviewed charts covering the Wetlands Restoration Plan Operation/Maintenance; the Wetlands Restoration Plan Capital Funding Sources; and Wetland Restoration Plan Capital Costs. He reviewed plans for restoration and allocation of the $12,000,000 referred to in Section 409(a). He stated he believed a man—made harbor in this location would require constant dredging. Mr. Davis presented a copy of his letter dated, January 5, 1988, to Bolsa Marine Park, Senator Marian Bergeson, Byron Sher, et al regarding the issue. Mary Lou Rosezvk stated she believed Council should develop their own amend— ments to the bill. She stated her opposition to a navigable ocean channel. Geri Ortega stated she believed the traffic study being prepared by Kunzman Associates should have been available long ago. Lorraine Faber, representing Amigos de, Bolsa Chica, stated that phasing for wetlands" :..'restoration was;' left out. of the bi l l . Ms. Faber stated she believed development fees should be placed on the lowland as well as the upland development.' Add anne Morrison, representing Amigos de Bolsa Chica, stated she believed studies on a navigable channel should be unbiased. . She requested a public hearing on the bill and suggested the city request Sacramento to delay the deadlines. Tom Pratte, representing the Surfrider Foundation, stated his concern that the b"dI did not protect surfing recreation at the Bolsa Chita state beach. He stated he supported a non -navigable channel. ' George h1i111ams stated his concern that with five members on the Bolsa Bay Harbor & Conservation District only one member would represent the city.. He stated his concern that the Mello -Roos act did not provide for fire and police protection. Steve Holden, speaking as an individual, stated his concern regarding beach erosion. He stated there had been no studies on beach erosion and therefore there could be no estimate on the loss of sand. Bob Edmo dQ son stated his concern regarding the possible loss of surfing recre-' ation due to the project. Councilman/Director Green .stated he believed there was a need for a public hearing on the bill. Mayor/Chairman Erskine reviewed a proposed letter to Senator Bergeson. A motion was made by Mays, seconded by Erskine, to approve staff recommenda- tions on the following pages of the Proposed Amendments for City Council/ Agency Consideration at 1/11/88 City Council/Agency Meeting: 1, 2, 3, 4, 5, 6, 8, 9, 10, 11, 12, 14, 15, 18, 21, 22, 25. 26, 28, 29, 31, 32, 33 and 35; continue pages: 7, 13 and 30; take no action on pages 16 and 17; and continue because of questions or a request for information pages: 20, 23 and 27. The motion carried by the following roll call vote: AYES: Green, Finley, Erskine, Mays, Winchell, Bannister NOES: None ABSENT.:ar Kelly A motion was made by Green, seconded by Winchell, to send a letter to Senator Bergeson regarding Senate Bill 1517 as outlined by Mayor/Chairman Erskine.
