ACTING ZONING ADMINISTRATOR PRESENT: Mike Strange STAFF MEMBERS PRESENT: Kelly Main Laura Phillips REGULAR AGENDA ITEMS: USE PERMIT NO. 88-1 Applicant: Oshman's Sporting Goods Use Permit No. 88-1 is a request to permit a tent in the parking lot for a maximum of seven days for the purpose of a 15-hour, one day sale located at 10072 Adams Avenue. This request is covered by Categorical Exemption, Class 4, California Environmental Quality Act, 1986. Staff member, Kelly Main, reported that the applicant will be placing a 60 ft. by 40 ft. tent outside Oshman's Sporting Goods store. She stated that there was adequate circulation on the site, and the Fire Department did not see any problem with the request. She stated that staff is'recommending approval. The public hearing was opened and John Childers, Store Manager, was present and stated that he concurred with staff's recommendation. Mr. Strange asked the applicant the hours of operation. Applicant responded 9:00 a.m. to 12:00 p.m. There was no one else present to speak for or against the request so the public hearing was closed. USE PERMIT NO. 88-1 WAS APPROVED BY THE ACTING ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS: FINDINGS FOR APPROVAL: 1. The establishment, maintenance and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of the Use Permit No. 88-1 will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the goals and objectives of the City's General Plan and Land Use Mal). SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated January 7, 1988 shall be the approved layout. 2. The applicant shall provide for clean up of the area after closing of the event. 3. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. 4. The applicant shall obtain clearance from the Public Liability Claims Coordinator, Administrative Services Department, and/or shall provide a Certificate of Insurance and Hold Harmless Agreement to be executed at least five (5) days prior to .the event. 5. The tent must be certified as meeting flame retardant requirements of the Uniform Building Code and the Uniform Fire Code. 6. Verification of flame retardance should be submitted to the Fire Department prior to erecting the tent. 7. Sidewalks shall be maintained at a clear width of four feet (49. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 2. A Certificate to Operate shall be issued by the Department of Community Development as required by Section 9730.80 of the Huntington Beach Ordinance Code. 3. The Zoning Administrator reserves the right to revoke this use permit if any violation of these conditions of the Huntington Beach Ordinance Code occurs. SITE PLAN AMENDMENT NO. 87-18 Applicant: David Priaio Site Plan Amendment No. 87-18 is a request to permit a 20 ft. by 340 ft. strip of land acquired by Lot Line Adjustment No. 84-4 for additional parking and landscaping (Amends AR 77-210) located at 5406, 5412, and 5432 Bolsa Avenue. This request is covered by Categorical Exemption, Class 5, California Environmental Quality Act, 1986. Staff Member, KellyMain, reported that this is second application for a site plan amendment for the same request approved in 1984 but the applicant never proceeded with putting the parking lot in. She stated that staff still has some questions about the actual landscaping that exists on the site. Staff is recommending continuance to the next meeting in order to meet with the applicant on these questions. 1 Mr. Strange asked the applicant if he concurred with the continuance. John DiFrancesco, representing the applicant, agreed to the continuance. SITE PLAN AMENDMENT NO. 87-18 WAS CONTINUED TO JANUARY 27, 1988 BY THE ZONING ADMINISTRATOR REVOCATION OF HOME OCCUPATION NO. 88-1 Applicant: M be L Malupo Revocation of Home Occupation No. 88-1 is to consider revocation of a home occupation permit for alleged violation of home occupation regulations with regard to parking of commercial vehicles used in conjunction with the business on the street overnight and using the garage for storing materials used by the business (Section 9730.36 (a), (b), & (h)) located at 17322 Goldenwest Street. This request is covered by Categorical Exemption, Class 5, California Environmental Quality Act, 1986. Staff member, KellyMain, reported that on December 8, 1987 there was a complaint that Malupo's tree service was violating their horne occupation permit by parking big trucks out on the street. The applicant had been warned four months previously for the same offense. Mr. Strange asked staff if the licensee had been notified of the meeting and staff stated yes. The public hearing was opened and the licensee was not present. There was no one else present to speak for or against the item so the public hearing was closed. Don Shaw, Land Use Technician, stated that he requested the revocation of the home occupation permit because the licensee has been warned previously not to park his trucks on Goldenwest or in the alley. He stated that he has documented that the licensee has been warned. Mr. Strange stated that the licensee is in violation of Section 9730.36(a)(b) & (h) of the Huntington Beach Ordinance Code. He also stated that the licensee was notified twice and did not respond. Mr. Strange stated that with the findings that the applicant has been found to be in violation (Section 9730.36(a)(b) do (h)). Revocation of licensee's home occupation permit was approved. THE MEETING WAS ADJOURNED TO THE JANUARY 25, 1987 STUDY SESSION BY THE ACTING ZONING ADMINISTRATOR. 0. .
