Palin Kelly Main Laura Phillips MINUTES: Minutes of the January 6, 13, and 20 were approved by the Zoning Administrator REGULAR AGENDA ITEMS: SITE PLAN AMENDMENT NO. 87-18 Applicant; David Prizio -11te Plan Amendment is a request to permit the use of a 20 ft. x 340 ft. strip of land acquired by Lot Line Adjustment No. 84-4 for additional parking and landscaping (Amends AR 77-210) located at 5406, 5412 and 5432 Bolsa Avenue. This request is covered by Categorical Exemption, Class 5, California Environmental Quality Act, 1986. Staff member, Kelly Main, reported that this 20 ft. x 340 ft. strip of land was added to subject property in 1984 with a lot line adjustment. The applicant at that time also applied for a site plan amendment to make the area into parking and this was'granted, but the applicant never went through with the process. This is another application to turn the area into 35 parking stalls. Staff is recommending approval. Mr. Palin asked if the applicant was present and Mike Hay stated that he was present. Mr. Palin asked the applicant if in his transaction in acquiring the strip to the south, had he discussed reciprocal parking or ingress and egress with the adjacent property owner to the south. The applicant stated that they obtained the subject strip of property before the rear property had been sold or developed and, therefore, parking on the adjacent site had not been considered. Mr. Palin expressed concern about the physical appearance of driving through and having a massive building on the property just to the rear with no parking to the rear of that building. He stated he could not understand how the project complies without having parking on this 20 ft. x 340 ft. strip. -1- OZA 2-3-88 Mr. Palin asked the applicant if he was pushed for an action today and if not, staff would like to continue this item for a week to determine whether the site to the south of the subject property meets its parking requirements without the 20 ft. x 340 ft. strip of land. Applicant concurred. SITE PLAN AMENDMENT NO. 87-18 WAS CONTINUED TO FEBRUARY 3, 1988 BY THE ZONING ADMINISTRATOR. TENTATIVE PARCEL MAP NO. 87-264 Applicant: Za er K a of Tentative Parcel Map No. 87-264 is a request to consolidate two lots into one lot with waiver of final map located at the east side of Algonquin Street approximately 300 feet south of Heil Avenue. This request is covered by Categorical Exemption, Class 5, California Environmental Quality Act, 1986. Staff member, Laura Phillips, reported that this property was originally a roadway easement that was abandoned a number of years ago. The project on the site was approved by the Zoning Administrator previously and the applicant is now applying for the tentative parcel map and the waiver. Mr. Palin asked staff if all the street improvements have been completed. Staff responded that the curb, gutter and paving are in and Public Works has agreed to the request for the waiver, but the sidewalk still needs to go in and that is a condition placed on the project by Public Works. Mr. Palin stated that staff should include a condition of approval on the waiver stipulating that all public improvements are constructed and approved by Public Works prior to recordation of the plat map. TENTATIVE PARCEL MAP NO. 87-264 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDING AND CONDITIONS: FINDINGS OF APPROVAL FOR WAIVER: 1. The proposed consolidation complies with the requirements as to area, improvement and design, flood and water drainage control, appropriate and approved public roads, sewer and water facilities, environmental protection, and other requirements of Article 992 of the Subdivision Section of the Ordinance Code. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL(S) FOR ANY PURPOSE: 1. The Tentative Parcel Map received by the Department of Community Development on January 12, 1988, shall be the approved layout (with the amendments as noted thereon). -2- OZA 2-3-88 2. The applicant shall file, through the Huntington Beach City Clerk's office, and have recorded with the Orange County Recorder's Office, a Certificate of Compliance in conjunction with the approved plat map. A copy of the recorded Certificate of Compliance and plat map shall be filed with the Department of Community Development prior to issuance of building permits on the subject property. 3. All public improvements shall be constructed and approved by Public Works Department prior to recordation of plat map. TENTATIVE PARCEL MAP NO. 87-294 Applicant: Jim and Betty Waller Tentative Parcel Map No. 87-294 is a request for a waiver of Final Map for Tentative Parcel Map 87-94 for consolidation of two lots and a portion of a third lot into one lot for development purposes located at 712 12th Street. This request is covered by Categorical Exemption, Class 5, California Environmental Act, 1986. Staff member, Kelly Main, reported that this lot separation was made prior to 1958 when the tentative parcel map requirements were put into city's code for lot creation or consolidation for 4 or less parcels. Mr. Palin stated that evidence of that was submitted to the city and has gone into the file to complete the record. Staff concurred stating that staff has a memorandum from the Acting Director of Public Works approving the waiver of the final map. Mr. Palin asked if staff had standard conditions they would be requesting. Staff stated yes, and the applicant has received and reviewed them. A copy of the recorded Certificate of Compliance and plat map shall be filed with the Department of Community Development prior to issuance of building permits on the subject property. -3- OZA 2-3-88 REVOCATION OF HOME OCCUPATION NO. 88-2 Applicant: Ray E. Hodgson Revocation of Home Occupation No. 88-2 is a request to revoke a home occupation permit for alleged violation of home occupation regulations with regard to parking of commercial vehicles used in conjunction with the business on the street overnight and the use of a storage locker in the side yard (Sections 9730.36(a)(b)(d)(e) & (h)) located at 19311 McLaren Avenue. This request is covered by Categorical Exemption, Class 5, California Environmental Quality Act, 1986. Staff member, Kelly Main reported that in early 1983 staff received a complaint that Mr. Hodgson was in violation of his home occupation permit by parking large commercial vehicles out in front of his home. The owner was informed of the violation and he ceased parking these vehicles there, however, in late November of 1987 staff received another complaint. An inspection by one of our code enforcement people revealed that the owner was parking his commercial vehicles out front. A temporary storage facility located on site was violating setback requirements, as well. Mr. Palin asked Don Shaw, Land Use Technician who inspected the site, if he checked the business license. Mr. Shaw stated yes, he did have a home occupation permit in effect. Mr. Palin questioned how many employees he listed on the business license. Mr. Shaw stated he did not know at the present time. The public hearing was opened. Jim Thompson, Mel Peninger, Margo Fell, James A. Thompson and Wes Bannister, neighbors of Mr. Hodgson, were present to support there neighbor and requested that Mr. Hodgson's home occupation permit not be revoked. Mr. Hodgson, owner, stated that he would like to clear up a few things with staff in regards to the storage of the trucks. He stated that his bucket truck, which he just purchased, was now stored on Industrial Lane in Huntington Beach and stated that it will never be parked in front of the house again. He stated that he has two small one ton pick-up trucks stating that one of them is his own personal truck and storage for the second truck is located in San Diego. He stated that the materials stored in the shed are materials for his home and the use of his neighbors stating that he is not stockpiling copper wire, conduit or any kind of building material in conjunction with the business. There was no one else present to speak for or against the request so the public hearing was closed. Mr. Palin stated that the purpose of the Zoning Administrator is not to judge the character of anyone. He suggested that the owner try to find some type of office space and storage space, adding that no employees are to come to his home. He stated that if the vehicles are not at his home, this eliminates alot of the violation. Mr. Palin stated that staff will work with Mr. Hodgson. Mr. Palin suggested that revocation of the home occupation permit be continued for two weeks to allow the applicant to work with staff on placement of the shed and a permanent arrangement for vehicle storage. Mr. Hodgson concurred. REVOCATION OF HOME OCCUPATION NO. 88-2 WAS CONTINUED BY THE ZONING -ADMINISTRATOR TO FEBRUARY 10, 1988. -4- OZA 2-3-88 THE MEETING WAS ADJOURNED TO THE FEBRUARY 1, 1987 STUDY SESSION BY THE ZONING ADMINISTRATOR.
