CONSENT CALENDAR: - Civic Center California A Schumacher MINUTES OF JANUARY 20, 1988 PLANNING COMMISSION MEETING A MOTION WAS MADE BY LIVENGOOD, SECOND BY PIERCE, TO APPROVE MINUTES OF JANUARY 20, 1988 PLANNING COMMISSION MEETING, AS SUBMITTED, BY THE FOLLOWING VOTE: AYES: Pierce, Livengood, Silva, Leipzig, Higgins NOES: None ABSENT: Schumacher ABSTAIN: Bourguignon MOTION PASSED B. ORAL COMMUNICATIONS Donald Alvarado, representing Smart and Final, addressed issues of the proposed code amendment regarding alcoholic beverage sales. He stated that the zone his store is located in (Industrial District) allows wholesale sales only and that they will be proposing to sell alcoholic beverages at wholesale prices. However, the ABC requires that the sales be retail to grant a license. He requested that the code be amended to include such sales in this zone. C. PUBLIC HEARING ITEMS C-1 ZONE CHANGE NO 87-16/NEGATIVE DECLARATION NO. 87-49_ APPLICANT: HUNTINGTON BEACH COMPANY Zone Change No. 87-16 is a request by the Huntington Beach Company to rezone 55.5 gross acres which are presently designated with three different zoning classifications. The request is to change the zoning as follows: (1) Approximately 43 acres from RA-01 (Residential Agricultural combined with Oil Production) to R1-(2)-01-10,000 (Low Density Residential-2 units per acre -with a minimum 10,000 square foot lot size -Combined with Oil Production); (2) Approximately .5 acres from RA-0-CZ (Residential Agricultural combined with Oil Production in the Coastal Zone) to R1-(2)-0-10,000-CZ (Low Density Residential-2 units per acre -with a minimum 10,000 square foot lot size -Combined with Oil Production in the Coastal Zone); and (3) Approximately 12 acres from RA-01-CZ (Residential Agricultural combined with Oil Production and Drilling in the Coastal Zone) to R1-(2)-01-10,000-CZ (Low Density Residential-2 units per acre -with a minimum 10,000 square foot lot size -Combined with Oil Production and Drilling in the Coastal Zone). The zone change request is consistent with the General Plan land use designation of Estate Residential- 2 Units per Acre. ENVIRONMENTAL STATUS: Pursuant to the environmental regulations in effect at this time the Department of Community Development posted draft Negative Declaration No. 87-47 for ten days, and no comments, either verbal or written were received. An Environmental Initial Study was completed to analyze potential adverse environmental impacts associated with the proposed zone change and it was determined that a mitigated negative declaration (Negative Declaration No. 87-49) in lieu of an Environmental Impact Report could be considered by the Planning Commission. STAFF RECOMMENDATION: (A) Determine Negative Declaration No. 87-49 to be inadequate because it does not sufficiently address potential environmental impacts and not accept it; and (B) Deny Zone Change No. 87-16 based on findings. PC Minutes - 2/17/88 -2- (0184d) THE PUBLIC HEARING WAS OPENED Bill Holman, representing the Huntington Beach Company, gave a brief history of the zone change application. He stated that several environmental impact reports had been completed on the site and that a denial of the request would be preferred rather than a continuance. Mary Bell, representing Equestrian Trails 100, spoke in support of staff's request for a continuance. She feels that time is needed in order to complete further studies of the site especially regarding equestrian activities. She stated that if the Ellis-Goldenwest Specific Plan is not adopted equestrian activities will not be allowed. Tom Harman, representing Huntington Beach Tomorrow, spoke in support of a denial of the zone change. He feels that it is premature to develop the site before the boundary lines are determined for the linear park. Lorraine Faber, representing Amigos de Bolsa Chica, stated that she feels an environmental impact report is needed before changing the zone. She feels that if public ownership is eventually obtained there will be a lot of questions that need to be answered. She further stated that this site contains maybe the only linear park that District 2 will ever have. Pat Ware, 6171 Hamshire Drive, spoke in support of a denial of the zone change or a continuance in order to complete an environmental impact report. Michael Rubin, representing the Huntington Beach Company, stated that it was his understanding that a tiered environmental impact report was being completed on the site and that it was at the land use and intensity stage. He feels that a "Q" zoning could be adopted without readvertising the request and approval could be given with conditions. Mary Lou Rosczyk, 16172 Ballantine Lane, stated that she felt the zone change should be denied and that the open space and linear park should be the first priority. There were no other persons to speak for or against the zone change and the public hearing was closed. A lengthy discussion ensued among the Commission regarding the zone change. Commissioner felt that the property owner was entitled to a request for a zone change and that action should be taken. Other Commissioners felt that an environmental impact report was needed because the site is a potential, significant archaeological resource that needs careful evaluation and favored a continuance. They felt that if the zone change was approved it would set legal boundaries which would include 75 percent of the County's proposed linear park. PC Minutes - 2/17/88 -3- (0184d) The applicant stated that instead of a continuance he would prefer a denial. Commissioners Higgins and Bourguignon stated that they would be abstaining from the vote due to a potential conflict of interest. Pursuant to Section 21002 of the California Environmental Quality Act, 1986, an environmental impact report should be prepared which would provide feasible alternatives or feasible mitigation measures which would substantially lessen the significant environmental effects of future projects. Negative Declaration No. 87-49 has been determined to be inadequate because significant environmental concerns such as grade differential, archaeological resources, seismic, oil operations, circulation, and recreation (linear park) have not been addressed. Archaeological sites (No. 88, 365 and 366) indicate that 50 percent of the site is a potential, significant archaeological resource that needs careful evaluation in an environmental impact report. 3. Further environmental evaluation of the site is needed since past studies (Environmental Impact Report No. 83-2) show up to 50 percent of the property should be excluded from development. 4. The proposed zone change will establish linear park boundaries which are inconsistent with Resolution No. 5652 which was approved by the City Council on March 24, 1986. C-2 ZONE CHANGE NO, 87-17/USE PERMIT NO, 87-84/NEGATIVE DECLARATION NO, 87-50 APPLICANT: KERNVIEW OIL CORPORATION Zone Change No. 87-17 is a request to place an "01" suffix on a 15,000 square foot portion of a 40 acre parcel of land presently used for oil production and agriculture. Use Permit No. 87-84 is a request to drill one new well on the 100 foot by 150 foot site. The applicant has requested that Zone Change No. 87-17, Use Permit No. 87-84 and Negative Declaration No. 87-50 be continued to the April 19, 1988 Planning Commission meeting to allow time for the applicant to complete certain technical matters. STAFF RECOMMENDATION: Continue Zone Change No. 87-17, Use Permit No. 87-84 and Negative Declaration No. 87-50 to the April 19, 1988 Planning Commission meeting per the applicant's request. A petition in opposition to the zone change was submitted by a group of residents from the neighborhood adjacent to the site. ",X PC Minutes - 2/17/88 -5- (0184d) C-3 SITE PLAN AMENDMENT N0, 88-4 APPLICANT: NEIL FRIEDMAN Site Plan Amendment No. 88-4 is a request to modify the plans approved by Conditional Use Permit No. 87-15 by adding approximately 1,600 square feet of floor area and rearranging certain rooms (uses), including the commissary at 17752 Beach Boulevard. ENVIRONMENTAL STATUS: The proposed project is exempt Class 1 (existing facilities) Section 15301(e) from the provisions of the California Environmental Quality Act. REDEVELOPMENT STATUS: The project area is within the Beach Boulevard Redevelopment Survey area. STAFF RECOMMENDATION: Approve Site Plan Amendment No. 88-4 with findings and conditions of approval. THE PUBLIC HEARING WAS OPENED Beth Kovacs, representing the applicant, spoke in support of the request. There were no other persons present to speak for or against the request and the public hearing was closed. It was suggested by the Commission that no signage denoting the commissary be exposed to Beach Boulevard. A MOTION WAS MADE BY SILVA, SECOND BY PIERCE, TO APPROVE SITE PLAN AMENDMENT NO. 88-4 WITH FINDINGS AND REVISED CONDITIONS OF APPROVAL, BY THE FOLLOWING VOTE: AYES: Pierce, Livengood, Silva, Leipzig, Higgins, Bourguignon NOES: None ABSENT: Schumacher ABSTAIN: None MOTION PASSED FINDINGS FOR APPROVAL: 1. Site Plan Amendment No. 88-4 to add approximately 1,600 square feet of additional floor area and modify approved floor plans pursuant to Conditional Use Permit No. 87-15 does not constitute a substantial change to the originally approved plan. PC Minutes - 2/17/88 -6- (01840) 2. The use of the property as a medical office building and an out -patient surgery center remains the same. 3. The revision to the site plan which includes a 1,600 square foot addition, rearranged floor plan, revised landscaping and new parking layout results in an improved development. 4. The revision shall comply with all applicable provisions of the Huntington Beach Ordinance Code. CONDITIONS OF APPROVAL: 1. The floor plans and elevations dated February 5, 1988, shall be the approved layout. 2. The site plan dated February 5, 1988, shall be revised to reflect the following recommendation of the Design Review Board: a. The applicant shall work with the Landscape Division of Public Works to modify and increase the planter adjacent to the turnaround space at the southwest corner of the site. 3. All conditions of approval for Conditional Use Permit No. 87-15 shall remain in effect. 4. No external signs shall be allowed advertising the commissary. C-4 CONDITIONAL USE PERMIT NO. 88-2 IN CONJUNCTION WITH CONDITIONAL EXCEPTION (VARIANCE) NO. 88-3 APPLICANT: NATIONAL PEDIATRIC SUPPORT SERVICES Conditional Use Permit No. 88-2 is a request by National Pediatric Support Services to operate a daycare center and preschool for 126 children at a closed elementary school (Burke Elementary) located at 9700 Levee Drive, pursuant to Section 9630(D) of the Huntington Beach Ordinance Code. The facility will provide regular care for 122 children ranging from six weeks to eight years of age, and will also provide special care for a maximum of four mildly ill children. Conditional Exception (Variance) No. 88-3 is a request to provide chainlink fencing around a portion of the outdoor play area in lieu of a masonry wall, as required by Section 9635(1) of the Huntington Beach Ordinance Code. ENVIRONMENTAL STATUS: The proposed project is exempt Class 1 Section 15301 from the provisions of the California Environmental Quality Act. i PC Minutes - 2/17/88 -7- (0184d) STAFF RECOMMENDATION: Approve Conditional Use Permit No. 88-2 and Conditional Exception (Variance) No. 88-3 with findings and conditions of approval. THE PUBLIC HEARING WAS OPENED Frank Hoskins, applicant, spoke in support of the request. He requested that the hours of operation be changed from 7:00 AM to 6:00 PM to 6:45 AM to 7:15 PM to accommodate travel time for his customers. He stated that he concurred with the 126 enrollment number however would like to have it expanded in the future. He further stated that he was concerned with Condition #4 regarding his license from Orange County Social Services. He said that he has approval but does not have the actual license and has been told that it would take several weeks. He requested permission to operate with verbal approval. There were no other persons present to speak for or against the request and the public hearing was closed. A MOTION WAS MADE BY LIVENGOOD, SECOND BY HIGGINS, TO APPROVE CONDITIONAL USE PERMIT NO. 88-2 IN CONJUNCTION WITH CONDITIONAL EXCEPTION (VARIANCE) NO. 88-3, WITH FINDINGS AND REVISED CONDITIONS OF APPROVAL, BY THE FOLLOWING VOTE: AYES: Pierce, Livengood, Silva, Leipzig, Higgins, Bourguignon NOES: None ABSENT: Schumacher ABSTAIN: None FINDINGS FOR APPROVAL - CONDITIONAL USE PERMIT NO, 88-3: 1. The establishment, maintenance and operation of the preschool and daycare center will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of the conditional use permit for a preschool and daycare center will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposed daycare center and preschool are consistent with the goals and objectives of the City's General Plan and Land Use Map because the property was originally developed as a school site. The access to and parking for the proposed use does not create an undue traffic problem because adequate parking and drop-off areas are provided on site, and no excessive traffic will be generated. FINDINGS FOR APPROVAL - CONDITIONAL EXCEPTION (VARIANCE) NO. 88-a: 1. The use of a chain link fence surrounding the outdoor play area in lieu of the required masonry wall will not be detrimental to the general welfare of persons residing or working in the vicinity. There will be no adverse noise impacts on adjacent properties due to the daycare/preschool's location within a former school site, and the fact that the nearest adjacent residence is separated from the school yard by a 6 foot high block wall. 2. The granting of Conditional Exception (Variance) No. 88-3 will not adversely affect the General Plan of the City of Huntington Beach. 3. The strict application of the Zoning Ordinance creates a hardship for the applicant because block wall requirements are meant to attenuate noise from daycare centers located in single family homes. This project is located at a former school site. CONDITIONS OF APPROVAL: 1. The site plan and floor plans received and dated January 27, 1988, shall be the approved layout. 2. Hours of operation shall be limited to between 6:30 AM to 6:30 PM, Monday through Friday. A maximum of four evening open house/seminars per year shall be permitted. 3. The total combined preschool and daycare enrollment shall not exceed 126 children per day. Any expansion in number shall require approval of the Planning Commission. 4. Prior to operation, the applicant shall obtain approval from Orange County Social Services Department. Applicant shall file with the Department of Community Development a copy of the license issued by the Social Services Department within 90 days of approval. If the applicant fails to obtain license from Orange County Social Services Department this conditional use permit/conditional exception shall be revoked with all monies spent at applicant's risk. 5. Applicant shall obtain a business license from the City of Huntington Beach prior to operation. PC Minutes - 2/17/88 -9- (0184d) 6. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 7. The preschool and daycare center shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 8. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 9. A fire alarm system shall be required pursuant to Fire Department Standards. 10. A review of the use shall be conducted within twelve (12) months of the date of this approval to verify compliance with all conditions of approval and applicable Articles of the Huntington Beach Ordinance Code. If, at that time, there is a violation of these conditions or code sections, the conditional use permit may become null and void. 11. The Planning Commission reserves the right to revoke this conditional use permit if any violation of these conditions or the Huntington Beach Ordinance Code occurs. C-5 USE PERMIT NO. 87-77 APPLICANT: DEY'S DONUTS & CROISSANTS Use Permit No. 87-77 is a request to allow an existing donut shop located at 6494 Edinger Avenue to open at 5:00 AM in lieu of 7:00 AM. Condition of Approval No. 14 of Use Permit No. 85-70, approved by the Planning Commission in 1985 for the commercial center, limits all business hours from 7:00 AM to 10:00 PM. On October 14, 1987, the Zoning Administrator referred Use Permit No. 87-77 to the Planning Commission because they approved the original development. ENVIRONMENTAL STATUS: The proposed project is exempt Class 5 Section 15305 from the provisions of the California Environmental Quality Act. STAFF RECOMMENDATION: Approve Use Permit No. 87-77 with findings and conditions of approval. THE PUBLIC HEARING WAS OPENED Molyvann Hong, applicant, spoke in support of the request and stated that he was available for any questions. Allowing a change in the hours of operation (5:00 AM in lieu of 7:00 AM) for a donut shop will not be detrimental to: a. The general welfare of persons residing or working in the vicinity because the building has no doors or windows at the rear of the building or access to the adjacent residential land use. b. Property and improvements in the vicinity of such use or building because a security fence and gate prevent access from the front of the building to the rear. 2. The granting of Use Permit No. 87-77 will not affect the General Plan of the City of Huntington Beach. 3. The proposal to change opening hours of operation for a donut shop to 5:00 AM in lieu of 7:00 AM is consistent with the goals and objectives of the City's General and land use map. 4. The granting of Use Permit No. 87-77 will not be materially detrimental to the public welfare, or injurious to property in the same zone classifications. CONDITIONS OF APPROVAL: 1. All conditions of approval for Use Permit No. 85-70 shall apply with the exception of the business hours of operation in Condition No. 14 which shall be limited to 5:00 AM to 10:00 PM. 2. The Planning Commission reserves the right to revoke Use Permit No. 87-77 if any violation of these conditions or the Huntington Beach Ordinance Code occurs. PC Minutes - 2/17/88 -11- (0184d) C-6 APPEAL - COASTAL DEVELOPMENT PERMIT NO, 87-34 APPLICANT: D'AMBRA, INC. On January 13, 1988, the Zoning Administrator approved Coastal Development Permit No. 87-34, a request for an approximately 1,500 square foot second story addition to an existing 2,095 square foot single family home located at 3502 Gilbert Drive. On January 21, 1988, Mr. John Gerry, an area resident, appealed the Zoning Administrator's approval on the basis that the proposed addition will block his view of the channel and the horizon, and will set a precedent for development of two-story homes along the channel. ENVIRONMENTAL STATUS: The proposed project is exempt Class 1 Section 15301 from the provisions of the California Environmental Quality Act. COASTAL STATUS: The proposed second story addition is subject to approval of a coastal development permit because it is located within the coastal zone under appeal jurisdiction to the California Coastal Commission. STAFF RECOMMENDATION: Deny'the appeal and uphold the Zoning Administrator's approval of Coastal Development Permit No. 87-34 with findings and conditions of approval. THE PUBLIC HEARING WAS OPENED Jerome Lindsay, property owner, spoke in support of the request and urged the Commission to approve. He stated that there were no CC&R's that represented the inland residences as view property and that there were no restrictions regarding the heights of trees. He further stated that to deny a second story addition because of view blockage would be setting a precedent. Lillian Sampson, 16652 Somorset Drive, stated that as of June 1984 inland harbor lots were not sold as view lots and that there are several two story homes on the harbor side. Dallas Moran, 3542 Courtside Circle, stated that view lots were not promised to any Huntington Harbor residents. Ted Shepherd, 16672 Wellington Circle, stated that he paid a premium to live on the hill with a view lot. He said that his inland home does have a view of the channel and boating activities and presents an uncrowded feeling. He is concerned that with two story homes being approved that the hill will be surrounded and views blocked. He is also concerned with two story homes being converted to second units and bringing the value of the homes down. PC Minutes - 2/17/88 -12- (0184d) Richard Munch, 16691 Melville Circle, stated that he supported Ted Shepherd's views and was opposed to allowing two story homes along the harbor side. John Gerry, appellant, said that Gilbert Island is the only raised island in Huntington Harbor and that if the views were taken away it would lower their property values. He feels that the open feeling and the present quality of life that they enjoy should be preserved. Isola Gerry, 16672 Melville Circle, spoke in support of preserving the quality of life now enjoyed by the people living on the hill on Gilbert Island. She stated that she is a social scientist and that the open feeling she enjoys is very important to her and would hate to see a wall of two story homes constructed around her. Lou DeCandido, 5802 Carbeck Drive, builder of the proposed two story home, spoke in support of the request. Amber Lindsay, 6761 Bridgewater, property owner/applicant, spoke in support of the request. She stated that she has four children and needs more room. She further stated that she has lived in the proposed house all of her life and was never promised a view. There were no other persons present to speak for or against the request and the public hearing was closed. Commissioner Silva stated that he would be abstaining from the vote due to possible conflict of interest. A MOTION WAS MADE BY PIERCE, SECOND BY HIGGINS, TO DENY THE APPEAL AND UPHOLD THE ZONING ADMINISTRATOR'S APPROVAL OF COASTAL DEVELOPMENT PERMIT NO. 87-34 WITH FINDINGS AND CONDITIONS OF APPROVAL, BY THE FOLLOWING VOTE: AYES: Pierce, Livengood, Leipzig, Higgins, Bourguignon NOES: None ABSENT: Schumacher ABSTAIN: Silva MOTION PASSED FINDINGS FOR APPROVAL: 1. The proposed 1,500 square foot, second story addition to a single family residence conforms with the plans, policies, requirements and standards of the Coastal Element of the General Plan. 2. The Coastal Development Permit is consistent with the CZ suffix zoning requirements, the R1 Zoning District, as well as other provisions of the Huntington Beach Ordinance Code applicable to the property. At the time of occupancy, the proposed single family residence can be provided with infrastructure in a manner that is consistent with the Coastal Element of the General Plan. No public improvements are required. 4. The proposed single family residence with addition conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. 5. Failure to grant the coastal development permit would deprive the applicant of rights enjoyed by others in the general vicinity under identical zoning classification. CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated February 2, 1988, shall be the approved layout. 2. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 3. Proposed structures shall be architecturally compatible with existing structures. 4. Low -volume heads shall be used on all spigots and water faucets. 5. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 6. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. D. ITEMS NOT PUBLIC HEARING D-1 REQUEST BY FHP, INC. FOR EXPANDED HOURS OF OPERATION APPLICANT: FHP, INC. FHP, Inc. is now requesting to operate on Saturdays, from 8:00 AM to 6:00 PM and to temporarily locate its Ophthalmology Department to its senior facility located at 19066 Magnolia Street for a period of six weeks while the Fountain Valley facility is remodeled. The Ophthalmology Department will schedule some evening appointments. The proposed Saturday hours will not cause the center to exceed its total permitted enrollment of 10,000 members. PC Minutes - 2/17/88 -15- (0184d) E-2 PROPOSED CODE AMENDMENT - ALCOHOLIC BEVERAGE SALES Straw votes were passed to include convenience markets, liquor stores and bars in Neighborhood Commercial with a requirement of a conditional use permit if located within 300 feet of residential and to require a conditional use permit for restaurants if liquor sales exceeded 50 percent of their revenues. Staff was requested to survey other cities regarding alcoholic beverage sales (e.g. Fullerton, Fountain Valley and Westminster). E-3 PROPOSED CODE AMENDMENT - UNCLASSIFIED USES - ARTICLE 963 The Commission was satisfied with the proposed code amendment regarding unclassified uses pertaining to child care facilities, bed and breakfast inns and clinics over 2,500 square feet. They requested that housing projects consisting of five or more dwelling units require Planning Commission approval for the granting of density bonuses.
