ZONING ADMINISTRATOR PRESENT: James W. Palin STAFF MEMBERS PRESENT: REGULAR AGENDA ITEMS: CONDITIONAL EXCEPTION NO. 88-7 Applicant: Max M. Johnson Conditional Exception No. 88-7 is a request to allow minimum open space dimension to the reduced to 12 ft. in lieu of 20 ft. for a portion of the required open space (318 sq. ft. of the 900 sq. ft. required) located at 5912 Donlyn Drive. This request is covered by Categorical Exemption, Class 5, California Environmental Quality Act, 1986. Staff member, Thomas Rogers, reported that this request was continued from March 23, 1988 and the applicant has brought the patio up to code by unenclosing it. The applicant has submitted a letter requesting withdrawal of the application. WITHDRAWAL OF CONDITIONAL EXCEPTION NO. 88-7 WAS APPROVED BY THE ZONING ADMINISTRATOR. CONDITIONAL EXCEPTION NO. 88-5 Applicant: Pacific Terrace, a Partnership Conditional Exception No. 88-5 is a request to provide one enclosed trash area and several unenclosed trash areas for an apartment complex in lieu of the required enclosure of all trash areas located at 6200 Edinger Avenue. Staff member, Kelly Main, reported that this item was continued from March 9, 1988. She stated that the applicant has submitted a request for withdrawal. The applicant has agreed to restore all of the trash enclosures and restore two parking spaces that they have removed. He will also remove the trash area adjacent to the RI property. Mr. Palin concurred with the withdrawal but asked staff to monitor the site for code enforcement. WITHDRAWAL OF CONDITIONAL EXCEPTION NO. 88-5 WAS APPROVED BY THE ZONING ADMINISTRATOR. ZA MINUTES 3/30/88 -1- (3026r) CONDITIONAL EXCEPTION NO. 88-9 IN CONJUNCTION WITH ADMINISTRATIVE REVIEW NO. 87-39 pp icant: Bob Stellrecht Conditional Exception No. 88-9 is a request to construct a 3-story industrial office and manufacturing building with front and side setbacks of 27 ft. and 17 ft. in lieu of the required 25 ft. and 18 ft., and to have 35 parking spaces in lieu of the required 40 and Administrative Review No. 87-39 is a request to construct an industrial building to include manufacturing and offices located on the Southeast corner of Graham Street and Buckingham Street. This request is covered by Environmental Impact Report No. 77-11. Staff member, Kelly Main, reported that the applicant submitted a letter requesting a 60-day extension. Mr. Palin stated that he would grant a 60-day extension subject to the application being readvertised at the termination of the 60 days and the applicant cover the cost of the second advertising. A 60-DAY EXTENSION FOR CONDITIONAL EXCEPTION NO. 88-9 IN CONJUNCTION WITH ADMINISTRATIVE REVIEW NO 87-39 WAS GRANTED BY THE ZONING ADMINISTRATOR. ADMINISTRATIVE REVIEW NO. 88-3 IN CONJUNCTION WITH TENTATIVE PARCEL MAP NO. 88-149/ENVIRONMENTAL ASSESSMENT NO. 88-6 Applicant: Dewayne Brown This request is covered by Negative Declaration No. 88-6. This application was continued from March 23, 1988. Staff member, Thomas Rogers, reported that Administrator No. 88-3 is a request to build five industrial buildings on four separate parcels (total 44,000 sq. ft.) and Tentative Parcel Map No. 88-149 is a request to consolidate eleven lots into four lots for industrial development located at 17750 Gothard. Staff is recommending approval. Dewayne Brown, applicant, was present. Discussion ensued on the revised plans and staff and applicant concurred with revisions. Discussion ensued on the access off Gothard, Mr. Palin stated that he concurred with Public Works recommendation and recommended the applicant work with them. Mr. Palin approved the applications subject to the applicant to close the entry drive off of Gothard Avenue. One-half shall to be utilized as a modified turn around with the other half to be landscaping with no curb cut or access from Gothard and subject to all other revisions as discussed depicted and proposed on both the site plan, the tentative parcel map and the elevations as proposed by the Design Review Board. The map also needs to be revised to reflect the maintenance easement for building 1 on parcel 1 and 2. ADMINISTRATIVE REVIEW NO. 88-3 IN CONJUNCTION WITH TENTATIVE PARCEL MAP NO. 88-1491ENVIRONMENTAL ASSESSMENT NO. 88-6 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS: ZA MINUTES 3/30/88 -2- (30260 FINDINGS FOR APPROVAL - ADMINISTRATIVE REVIEW NO. 88-3: 1. The establishment, maintenance and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. b. Property and improvements in the vicinity of such use or building. 2. The proposal is consistent with the goals and objectives of the City's General Plan and Land Use Map. 3. The location, site layout, and design of the proposed use properly adapts the proposed structures to streets, driveways, and other adjacent structures and uses in a harmonious manner. 4. The combination and relationship of one proposed use to another on a site are properly integrated. 5. The access to and parking for the proposed use does create an undue traffic problem. CONDITIONS OF APPROVAL - ADMINISTRATIVE REVIEW NO. 88-3 1. The site plan received and dated 3-17-88 shall be revised to depict the following modifications and be submitted to the Department of Community Development for approval: a. No ingress/egress shall be shown onto Gothard. Driveway on Gothard Street will instead be modified to show 5 ft. of landscaping with 5 ft. of turnaround. b. Site data shall accurately reflect proposed buildings, landscaping, net lot area, etc. c. Landscaping for each lot shall conform to the Huntington Beach Ordinance Code. d. Transformers, backflow devices and other utility apparatus shall be shown on site plan. 2. Elevations, as modified by staff, dated 3-29-88, shall be the approved building facade. 3. Prior to issuance of building permits, the applicant shall submit the following plans: a. Landscape and irrigation plan to the Department of Development Services and Public Works for review and approval. Said plans shall show a 30 inch box Carrotwood tree for every 45' along Gothard. Metzler & Belva streetscapes shall conform with project on south side of Belva. b. Rooftop Mechanical Equipment Plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. c. Landscape and irrigation plan to the Departments of Development Services and Public Works for review and approval. ZA MINUTES 3/30/88 -3- (3026r) d. A covenant and agreement setting the maximum area to be used for manufacturing and office for each building shall be submitted to the Department of Community Development for City Attorney approval as to form. Said covenant and agreement shall reflect site data shown on approved plans and be recorded with the County Recorder's Office prior to the issuance of any Certificate of Occupancy for the proposed buildings. e. Prior to the issuance of building permits, applicant shall file a parcel map. 4. Installation of required landscaping and irrigation systems shall be completed prior to final inspection. 5. Use of each building shall be restricted to one occupant. 6. Landscaping shall be subject to approval by the Design Review Board. 7. A planned sign program shall be approved by the Design Review Board for all signing. Said program shall be approved prior to the first sign request. 8. Corner cut off at trash enclosure for buildings 1 & 2 shall have an inside radius dimension a minimum of 17 feet. 9. An automatic fire sprinkler system shall be approved and installed pursuant to Fire Department regulations throughout all buildings. 10. Driveways for buildings one and two shall be designated as fire lanes and posted as such. 11. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. 12. Building addresses shall meet Fire Department specifications. 13. Maximum separation between building wall and property line shall not exceed two inches (29. 14. Driveway approaches shall be minimum of twenty-seven feet (27') in width and shall be of radius type construction. 15. There shall be no outside storage of vehicles, vehicle parts, equipment or trailers. 16. All repair work shall be conducted wholly within the building. 17. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 18. Transformers, backflow devises, and other utility apparatus shall be located behind front and side yard setbacks where possible and shall be screened from public rights of way. 19. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. ZA MINUTES 3/30/88 -4- (3026r) 20. Low -volume heads shall be used on all spigots and water faucets. 21. If lighting is included in the parking lot, high-pressure sodium vapor lamps shall be used for energy savings. All outside lighting shall be directed to prevent "spillage" onto adjacent properties. 22. All applicable Public Works fees shall be paid prior to issuance of building permits. 23. A detailed soils analysis shall be prepared by a registered Soils Engineer. This analysis shall include on -site soil sampling to the depth of native soil and laboratory testing of materials to provide detailed recommendations regarding grading, chemical and fill properties, foundations, retaining walls, streets, and utilities. 24. The Zoning Administrator reserves the right to revoke AR No. 88-3 if any violation of these conditions of the Huntington Beach Ordinance Code occurs. 25. Prior to the issuance of a grading permit, a grading plan shall be submitted to the City's Department of Public Works. A plan for silt control for all water runoff from the property during construction and during initial operation of the project may be required by the Director of Public Works if deemed necessary. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. If any hazardous materials are to be used on site, the business must comply with Chapter 1758 of the City's Municipal Code which requires any business that handles or stores hazardous materials, including waste, to inventory the hazardous materials on site and prepare a business emergency plan in case of an accidental release of toxic material. Additionally, all hazardous materials, including waste, must be handled and stored in accordance with the Uniform Fire Code. Waste oil is considered a hazardous waste. 3. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 4. The applicant shall obtain the necessary permits from the South Coast Air Quality Management District if applicable. 5. Landscaping shall comply with the Huntington Beach Ordinance Code. FINDINGS FOR APPROVAL - TENTATIVE PARCEL MAP NO. 88-149: 1. The proposed consolidation of 11 parcels into 4 parcels for purposes of industrial use is in compliance with the size and shape of property necessary for that type of development. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation of this type of use. 3. The property was previously studied for this intensity of land use at the time the land use designation for light industrial district allowing industrial buildings was placed on the subject property. The size, depth, frontage, street width and other design and improvement features of the proposed subdivision are proposed to be constructed in compliance with standards plans and specifications on file with the City as well as in compliance with the State Map Act and supplemental City Subdivision Ordinance. CONDITIONS OF APPROVAL FOR TENTATIVE PARCEL MAP NO. 88-149 1. The Tentative Parcel Map received by the Department of Community Development on March 29, 1988 shall be the approved layout (with the amendments as noted thereon). a. Show street cross sections. b. Show 5 ft. wide public utility easement along Gothard, Metzler, and Belva. 2. A parcel map shall be filed with and approved by the Department of Public Works and recorded with the Orange County Recorder. 3. Water supply shall be through the City of Huntington Beach's water system at the time said parcels are developed. 4. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time said parcels are developed. 5. All utilities shall be installed underground at the time said parcels are developed. 6. Compliance with all applicable City Ordinances. 7. A copy of the recorded parcel map shall be filed with the Department of Community Development. 8. All vehicular access rights along Gothard, Metzler, and Belva shall be dedicated to the City of Huntington Beach except at locations approved by the Zoning Administrator.
