REGULAR AGENDA ITEMS:
USE PERMIT NO. 88-11
Applicant: David and Gloria Berry
This request is covered by Categorical Exemption, Class 5, Class 5, California
Environmental Quality Act, 1986.
Staff member, Kelly Main, reported that this is a request to permit a sandwich shop of
1,380 sq. ft with seating greater than 12 located at 18342 Beach Blvd. Ms. Main stated
that although the site meets parking requirements, any additional restaurants coming into \
the center with seating over 12 would result in an inadequate number of parking spaces
being available.
The public hearing was opened and David Berry, applicant was present and spoke in
support of the request.
There was no one else present to speak for or against the request so the public hearing
was closed.
Mr. Palin stated that a Use Permit is required for restaurants with seating over 12. In
that way, staff will be able to check parking.
USE PERMIT NO. 88-11 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE
FOLLOWING FINDINGS AND CONDITIONS:
FINDINGS FOR APPROVAL:
1. The establishment, maintenance and operation of the use will not be detrimental to:
a. The general welfare of persons residing or working in the vicinity;
b. Property and improvements in the vicinity of such use or building.
2. The granting of the Use Permit will not adversely affect the General Plan of the
City of Huntington Beach.

3. The proposal is consistent with the goals and objectives of the City's General Plan
and Land Use Map.
4. The access to and parking for the proposed use does not create an undue traffic
problem.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan and floor plan received and dated March 7, 1988 shall be the approved
layout.
2. All conditions from Conditional Use Permit No. 86-45 shall apply.
3. Plans for a modified fire sprinkler system shall be submitted for review and approval
by the Fire Department.
4.
There shall be no outside storage of vehicles, vehicle parts, equipment or trailers.
5.
All repair work shall be conducted wholly within the building.
6.
All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable
material, shall be disposed of at an off -site facility equipped to handle them.
7.
The owner of the subject property shall provide proof of recordation of a reciprocal
driveway easement with the adjacent property to the north, as required by Condition
No. 15 of Conditional Use Permit No. 86-45, prior to a Certificate of Occupancy
being issued for any of the suites.
8.
Natural gas shall be stubbed in at the locations of cooking facilities, water heaters,
and central heating units.
9.
Low -volume heads shall be used on all spigots and water faucets.
10. All applicable Public Works fees shall be paid prior to issuance of building permits.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions of the Ordinance Code,
Building Division, and Fire Department.
2. The applicant shall meet all applicable local, State, and Federal Fire Codes,
Ordinances, and standards.
3. The applicant shall obtain the necessary permits from the South Coast Air Quality
Management District.
4. All signs shall comply with the Huntington Beach Ordinance Code, Article 976.
5. The Zoning Administrator reserves the right to revoke this Use Permit if any
violation of these conditions of the Huntington Beach Ordinance Code occurs.

This request is covered by Categorical Exemption, Class 5, California Environmental
Quality Act, 1986.
Staff member, Kelly Main, reported that this is a request to install a medical/service
facility in an industrial zone. The facility will provide MRI scans, catscans and analysis
located at 17952 Lyons Circle. Ms. Main stated that staff is recommending approval.
The public hearing was opened and Scott McPherson, applicant, was present and spoke in
support of the request.
There was no one else present to speak for or against the request so the public hearing
was closed.
Mr. Palin stated that prior to the opening of the 2nd MRI Scan, a document of parking
should be provided to the city.
USE PERMIT NO. 88-17 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE
FOLLOWING FINDINGS AND CONDITIONS:
FINDINGS FOR APPROVAL:
1. The establishment, maintenance and operation of the use will not be detrimental to:
a. The general welfare of persons residing or working in the vicinity;
b. Property and improvements in the vicinity of such use or building.
2.
The granting of the Use Permit will not adversely affect the General Plan of the
City of Huntington Beach.
3.
The proposal is consistent with the goals and objectives of the City's General Plan
and Land Use Map.

The location, site layout, and design of the proposed use properly adapts the
proposed structures to streets, driveways, and other adjacent structures and uses in
a harmonious manner.
12.
The access to and parking for the proposed use does not create an undue traffic
problem.
SPECIAL CONDITIONS OF APPROVAL:
1.
The floor plans received and dated March 4, 1988 shall be the approved layout.
2.
On -site fire hydrants shall be provided in number and at locations specified by the
Fire Department.
3.
An automatic fire sprinkler system shall be approved and installed pursuant to Fire
Department regulations.
4.
Fire access lanes shall be maintained. If fire lane violations occur and the services
of the Fire Department are required, the applicant will be liable for expenses
incurred.

accordance with the Uniform Fire Code. Waste oil is considered a hazardous waste.
8. The use must comply with Chapter 1758 of the City of Huntington Beach's Municipal
Code, which requires any business that handles or stores hazardous materials,
including waste, to inventory the hazardous materials on -site and prepare a
"Business Emergency Plan" in case of an accidental release of toxic materials.
9. Any expansion of the proposed use shall require a new use permit and public hearing.
10. Use Permit No. 88-17 shall be granted only to this applicant at the subject site. Any
change in tenant or site would require a new public hearing and use permit.
11. Any conference or seminars being held on the site after hours shall be limited to a
maximum of 10 people.
12. Prior to second MRI being installed in the subject building, documentation of parking
shall be provided to the city.
13. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters,
and central heating units.
14. Low -volume heads shall be used on all spigots and water faucets.

USE PERMIT NO. 88-18
Applicant: Randy Boelsems
This request is covered by Categorical Exemption, Class 11, California Environmental
Quality Act, 1986.
Staff member, Kelly Main, reported that this is a request for a temporary outside event
permit for a one day sale on April 13, 1988, located at 7372 Prince. Ms. Main stated that
there was a concern about the tent being flame retardant. Staff is recommending
approval.

The public hearing was opened and Randy Boelsems, applicant, was present and spoke in
support of the request. He stated that he had a flame retardant test done on the tent and
would submit the documents to staff.
There was no one else present to speak for or against the request so the public hearing
was closed.
USE PERMIT NO. 88-18 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE
.FOLLOWING FINDINGS AND CONDITIONS:
FINDINGS FOR APPROVAL:
1. The establishment, maintenance and operation of the use will not be detrimental to:
a. The general welfare of persons residing or working in the vicinity;
b. Property and improvements in the vicinity of such use or building.
2. The granting of the use permit will not adversely affect the General Plan of the
City of Huntington Beach.
3. The proposal is consistent with the goals and objectives of the City's General Plan
and Land Use Map.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan received and dated April 7, 1988 shall be the approved layout.
2. Applicant shall provide for clean-up of the area after closing of the event.
3. Applicant shall provide for private security for crowd control and traffic
management.
4. Fire access lanes shall be maintained. If fire land violations occur and the services
of the Fire Department are required, the applicant will be liable for expenses
injured.
5. The applicant shall obtain clearance from the Public Liability Claims Coordinator,
Administrative Services Department, and/or shall provide a Certificate of Insurance
and Hold Harmless Agreement to be executed at least five (5) days prior to the
event.
6. The applicant shall provide a Certificate of Flame Retardance for the tent subject
to the review and approval of the Fire Department and prior to the event .
INFORMATION ON SPECIFIC.CODE REQUIREMENTS:
1. The use shall comply with all applicable provisions of the Ordinance Code, Building
Division, and Fire Department.
2. The applicant shall meet all applicable local; State, and Federal Fire Codes,
Ordinances, and standards.

3. A Certificate to Operate shall be issued by the Department of Community
Development as required by Section 9730.80 of the Huntington Beach Ordinance
It, Code.
4. The Zoning Administrator reserves the right to revoke this use permit if any
violation of these conditions of the Huntington Beach Ordinance Code occurs.
ADMINISTRATIVE REVIEW NO. 88-2/ENVIRONMENTAL ASSESSMENT NO. 88-8
Applicant: McDonnel Douglas
This request is covered by Negative Declaration No. 88-8.
Staff member, Kelly Main, reported that this is a request to construct storage and
manufacturing structures totalling 30,000 square feet, (with manufacturing space of 2,500
square feet and 625 additional parking spaces located at 5301 Bolsa Ave.
Mr. Palin questioned the proposed 625 parking spaces. Ms. Main responded that the
applicant has applied for a use permit that will be coming before the Zoning
Administrator soon. That application will propose 625 parking spaces on the northern end
of the site. Meanwhile, to meet the parking requirements for the additional 30,000 sq. ft.,
McDonnell Douglas is proposing an alternative parking area. If the future use permit and
parking spaces are approved, this alternative will not be necessary. Mr. Palin stated that
staff will have to restrict the use of the additional square footage until the completion of
the 625 spaces in the north, or sufficient parking at the alternate location is provided to
satisfy the required parking for the new facilities.
Dean Fronk, representing McDonnel Douglas, stated that they have sufficient parking for
whoever wants to park on the site, it is just not a place they would prefer to park. Mr.
Palin stated that the storage units could not be used until an alternate parking site was
finished.
ADMINISTRATIVE REVIEW NO. 88-2/ENVIRONMENTAL ASSESSMENT NO. 88-8 WAS
APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS:
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan received and dated March 22, 1988 shall be the approved layout with
the following modifications:
a. The approved "Towers Project" and proposed West Coast University project
shall be included on the site plan.
b. Alter site plan to correctly reflect "project area not part of this application."
2. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable
material, shall be disposed of at an off -site facility equipped to handle them.
3. Proposed structures shall be architecturally compatible with existing structures.
4. If foil -type insulation is to be used, a fire retardant type shall be installed as
approved by the Building Department.
5. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters,
and central heating units. This requirement may be waived provided that the
applicant will provide an energy efficient alternative subject to the review and
approval of the Department of Development Services.

6.
Low -volume heads shall be used on all spigots and water faucets.
7.
If lighting is included in the parking lot, high-pressure sodium vapor lamps shall be
"spillage"
used for energy savings. All outside lighting shall be directed to prevent
onto adjacent properties.
8.
A grading plan shall be submitted, to be accompanied by an erosion control plan,
when determined to be necessary by the Director of Public Works.
9.
All hazardous materials, including waste, must be property handled and stored in
accordance with the Uniform Fire Code. Waste oil is considered a hazardous waste.
10.
The use must comply with Chapter 1758 of the City of Huntington Beach's Municipal
Code, which requires any business that handles or stores hazardous materials,
including waste, to inventory the hazardous materials on -site and prepare a
"Business Emergency Plan" in case of an accidental release of toxic materials.
11.
Information on equipment or facilities which may generate air pollutants shall be
submitted to the South Coast Air Quality Management District staff for their
review and for any necessary permits prior to the issuance of building permits.
12.
The following buildings may be required to be protected by an automatic fire
sprinkler system pursuant to Fire Department review: A-1, A-4, A-6, A-7, A-8, A-9,
A-10, and A-11. This is due to the storage of flammable and hazardous materials
and the square footage of these buildings.
13.
All storage of material and liquids shall comply with Article 79 of the Huntington
Beach Fire Code. Prior to issuance of building permits, a plan for storage shall be
submitted for approval to the Fire Department.
14.
Prior to the issuance of building permits, a list of building materials shall be
submitted for review and approval by the Fire Department.
15.
Prior to issuance of building permits, floor plans and elevations shall be submitted to
the Department of Community Development and the Fire Department for review
and approval.
16.
Prior to the issuance of building permits, a landscape and irrigation plan for the
proposed parking lot shall be submitted to the Department of Community
Development and Public Works for review and approval.
17.
Storage and manufacturing facilities cannot be occupied until parking is provided for
the additional square footage.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1.
The development shall comply with all applicable provisions of the Ordinance Code,
Building Division, and Fire Department.

4. A detailed soils analysis shall be prepared by a registered Soils Engineer. This
analysis shall include on -site soil sampling and laboratory testing of materials to
provide detailed recommendations regarding grading, chemical and fill properties,
foundations, retaining walls, streets, and utilities.
5. Landscaping shall comply with Articles 951 and 960 of the Huntington Beach
Ordinance Code.
6. This approval in concept of Administrative Review No. 88-2 pertains only to
structures Al-11 and proposed parking and does not constitute approval of anything
else on the site plan.
7. The Zoning Administrator reserves the right to revoke this Administrative Review if
any violation of these conditions of the Huntington Beach Ordinance Code occurs.
COASTAL DEVELOPMENT PERMIT NO. 88-6/ADMINISTRATIVE REVIEW NO. 88-6
Applicant: Kar Kare Parking Systems, Inc.
This request is covered by Categorical Exemption, Class 11, California Environmental
Quality Act, 1986.
Staff member, Kelly Main, reported that this is a request to permit a seasonal parking lot
on the north side of Pacific Coast Highway between 2nd Street and 3rd Street. She stated
that staff has concerns regarding an interpretation of the code on seasonal parking lots.
Staff stated that the applicant has been operating the lot for more than five years and
staff is not sure what type of application this request requires.
Mr. asked staff to get an opinion from the City Attorney's office on this issue.
The public hearing was opened and continued to the next Zoning Administrator Meeting
for determination of the type of application required.
COASTAL DEVELOPMENT PERMIT NO. 88-6 WAS CONTINUED BY THE ZONING
ADMINISTRATOR FOR A DETERMINATION ON WHAT TYPE OF APPLICATION WAS
REQUIRED FOR THIS REQUEST.
TENTATIVE PARCEL MAP NO. 88-130
Applicant: Vince Mola
This request is covered by Categorical Exemption, Class 5, California Quality Act, 1986.
Staff member, Thomas Rogers, reported that this is a request to consolidate two lots into
one located at 1416 Huntington Street (southeast corner of Oswego and Huntington
Streets). Mr. Rogers reported that the recommendation is for approval and the applicant
has seen the Conditions of Approval.
The applicant, Vince Mola, was present and spoke in support of the request.

1. The Tentative Parcel Map received by the Department of Community Development
on March 25, 1988 shall be the approved layout (with the amendments as noted
thereon).
2. A parcel map shall be filed with and approved by the Department of Public Works
and recorded with the Orange County Recorder.
3. Public Works improvements shall be removed and replaced to City standards.
4. Water supply shall be through the City of Huntington Beach's water system at the
time said parcel is developed.
5. Sewage disposal shall be through the City of Huntington Beach's sewage system at
the time said parcel is developed .
6. All utilities shall be installed underground at the time said parcel is developed.
7. Compliance with all applicable City Ordinances.
8. The applicant shall file, through the Huntington Beach City Clerk's office, and
have recorded with the Orange County Recorder's Office, a Certificate of
Compliance in conjunction with the approved plat map. A copy of the recorded
Certificate of Compliance and plat map shall be filed with the Department of !"l

development on subject parcel.
10. All vehicular access rights along Oswego Avenue and Huntington Street shall be

Zoning Administrator.
TENTATIVE PARCEL MAP NO. 88-182
Applicant: Cetech Engineering
This request is covered by Categorical Exemption, Class 5, California Environmental
Quality Act, 1986.
Staff member, Thomas Rogers, reported that this is a request to record a one lot
subdivision on an existing piece of property that was not a legally created parcel located
at 7522 Slater Avenue.
Mr. Palin stated that the conditions of approval of prior administrative review shall apply
and that the subject parcel map would need to be recorded prior to occupancy.
Additionally, since the lot had been subdivided illegally, State law mandates that no
waiver to the Final Map could be granted.
