Scott Simons, 422 loth. Street, and Michael B. McMahon, 416 loth.
Street, addressed their complaints regarding disturbances resulting
from wedding receptions being held at the Huntington Beach Women's
Club, which is located in their neighborhood. They stated the
situation is getting out of hand and presenting health problems to
many residents in the neighborhood and becoming a public nuisance.
They requested assistance from the Commission to alleviate the
problems.
Barbara Milkovich, 6032 Dundee, representing the Historic Resources
Board, spoke in support of the relocation of the structure at 200
Orange. She stated that the structure is listed as a "C" structure
on the historic resources survey.

C-1 CODE AMENDMENT NO, 87-13 - UNCLASSIFIED USES, COMMERCIAL USES,
AND NEW DEFINITIONS (CONTINUED FROM THE APRIL 19, 1988
PLANNING COMMISSION MEETING)
APPLICANT: CITY OF HUNTINGTON BEACH
A request to amend Articles 908, 922 and 963 of the Huntington Beach
Ordinance Code to add new definitions, expand the uses permitted in
commercial districts and amend required provisions pertaining to
unclassified uses.
This item was continued from the April 5, 1988 Planning Commission
meeting. Code Amendment No. 87-13 proposes to expand and amend uses
permitted by conditional use permit listed under Unclassified Uses -
Article 963 and uses permitted by use permit in Commercial
Districts - Article 922 and add new definitions to Article 908.
This code amendment was informally discussed at the February 17,
1988 Planning Commission meeting.
ENVIRONMENTAL STATUS:
The proposed code amendment is categorically exempt pursuant to
Section 15300.4 from the provisions of the California Environmental
Quality Act.
STAFF RECOMMENDATION:
Continue Code Amendment No. 87-13 to the May 17, 1988 Planning
Commission meeting to allow additional time to revise the proposed
ordinance as directed by the Planning Commission.

APPLICANT: WEST COAST UNIVERSITY
OWNER: MC DONNELL-DOUGLAS CORPORATION
Conditional Use Permit No. 88-1 is a request to construct a 31,684
square foot private university, pursuant to Section 9630(c) of the
Huntington Beach Ordinance Code. West Coast University is an
evening college designed to educate working adults.

McDonnell -Douglas Corporation will also use the facility during
daytime hours for meetings and seminars and employee training. The
request also includes joint use of parking with the adjacent
McDonnell -Douglas site.
The university is proposed to be constructed in two phases; only
Phase I is under consideration at this time. Phase I consists of
the 31,684 square foot Building "A" along with the adjacent parking
areas and landscape planters. The building will house classrooms,
laboratories, office and conference areas, and a large auditorium.
The second phase is planned to include three buildings (B, C and D)
of which Building D is proposed for multi -tenant industrial uses.
Buildings B and C are intended for educational use, but may be
industrial until enrollment warrants their conversion.
ENVIRONMENTAL STATUS:
Pursuant to the environmental regulations in effect at this time,
the Department of Community Development posted draft Negative
Declaration No. 88-2 for ten days, and no comments, either verbal or
written were received.
With regard to potential traffic impacts, the 1987 Environmental
Impact Report and traffic study for the McDonnell -Douglas office
tower project included an analysis of the subject site at MI -A
(Restricted Manufacturing) build out. Traffic generated by the
proposed use is less than that generated by industrial uses.
Therefore, the mitigation measures outlined in the McDonnell -Douglas
EIR will adequately mitigate any impacts of this project.

THE PUBLIC HEARING WAS OPENED
Mark Lord, architect for the project, spoke in support of the
request. He questioned conditions regarding the replacement of
trees and the number of fire hydrants required by the Fire
Department.
Don Vestal, City of Westminster, requested that the condition
stipulating hours of the university be clarified to state "from 7:00
PM to 10:00 PM" to avoid conflicts with other uses and to avoid
additional traffic problems.
There were no other persons present to speak for or against the
request and the public hearing was closed.
The Fire Department stated that they would work with the applicant
regarding the number of hydrants to be required and would make the
final determination (probably would be 3 or 4).

The Commission agreed that the hours should be clarified to avoid
any traffic or parking conflicts.

FINDINGS FOR APPROVAL:
1. The establishment, maintenance and operation of a private
university with'joint use of parking with McDonnell -Douglas
will not be detrimental to:
a. The general welfare of persons residing or working in the
vicinity;
b. Property and improvements in the vicinity of such use or
building.

2. The granting of•the conditional use permit for a private
university with -joint use -of parking with McDonnell -Douglas,
will not adversely affect the General Plan of the City of
Huntington Beach.
3. The proposed private university is consistent with the goals
and objectives of the City's General Plan and Land Use Map.
4. The-access`to,and'parking for the proposed private university
does not create an undue traffic problem, because there is
adequate parking -available for both daytime and nighttime uses.
CONDITIONS OF APPROVAL:
1. The site plan received and dated April 7, 1988, and the floor
plans received and dated January 19, 1988, shall be the
approved layout. Elevations shall be subject to review and
approval by the Design Review Board to determine compatibility
with the approved McDonnell -Douglas office towers.

2. Prior to issuance of building permits, the applicant shall
submit the following:
a. A recorded covenant restricting the hours of use relative
to the University site for West Coast University (from 7:00
PM to 10:00 PM, Monday through Friday, except for daytime
administrative uses) and McDonnell -Douglas (from 7:00 AM to
7:00 PM). A copy of the legal instrument shall be approved
by the City Attorney as to form and content and a recorded
copy filed with the Department of Community Development.
b. Landscape and irrigation plan to the Department of
Community Development and Public Works for review and
approval in compliance with Article 951 and 960 of the
Huntington Beach Ordinance Code. Existing mature trees on
the site shall be retained and incorporated into the site
plan if feasible. Any existing mature tree that must be
removed shall be replaced at a 2 to 1 ratio with 24 inch
box trees which shall be incorporated into the project's
landscape plan.
c. Prior to the removal of any trees from the subject site, a
tree survey noting existing trees (size, caliper, and
species), and those planned to be removed, in addition to a
landscape plan, shall be submitted to and approved by the
Director of Community Development.
d. Submit a Rooftop Mechanical Equipment Plan which shall
indicate screening compatible with the building of all,
rooftop mechanical equipment and delineate the type of
material proposed to screen said equipment.
e. The subject property shall enter into irrevocable
reciprocal driveway and parking easement(s) between the
subject site and adjacent McDonnell -Douglas "Parking Lot
H".. A copy of the legal instrument shall be approved by
the City Attorney as to form and content and, when
approved, shall be recorded in the Office of the County
Recorder. A copy shall be filed with the Department of
Community Development prior to occupancy.
f. All applicable Public Works fees shall be paid.
g. A detailed soils analysis shall be prepared by a registered
Soils Engineer. This analysis shall include on -site soil
sampling and laboratory testing of materials to provide
detailed recommendations regarding grading, chemical and
fill properties, foundations, retaining walls, streets, and
utilities.

The Fire Department requirements are as follows:
a. Fire hydrants (number of hydrants to be determined by the
Fire Department) shall be installed prior to combustible
construction. Shop drawings shall be submitted to Public
Works and.approved by Fire Department prior to installation.
b. An automatic fire sprinkler system shall be approved and
installed pursuant to Fire Department regulations.
c. Fire extinguishers will be installed and located in areas
to comply with Huntington Beach Fire Code standards.
d. A fire alarm system shall be installed to comply with
Huntington Beach Fire Department and Uniform Fire Code
standards.
e. Service roads and fire lanes, as determined by the Fire
Department, shall be posted and marked.
f. Fire access lanes shall be maintained. If fire lane
violations occur and the services of the Fire Department
are required, the applicant will be liable for expenses
incurred.
g.- Address numbers shall be installed to comply with
Huntington Beach Fire Code standards.
h. The applicant shall meet all applicable local, State, and
Federal Fire Codes, Ordinances, and standards.
4. The Public Works Department requirements are as follows:
a. On -site water system shall be dedicated to the City.
b. All public works requirements shall be improved pursuant to
Public Works standards.
c. Driveway approaches shall be a minimum of twenty-seven feet
(271) in width and shall be of radius type construction.
d. The driveway on Bolsa Chica Street shall be limited to
right -turn in and right -turn out.
e. Water main shall be extended to project site from Bolsa
Avenue and Bolsa Chica Street to provide water service.
f. Sewer shall be extended to the project site from Bolsa
Avenue and Bolsa Chica Street.
g. Prior to issuance of a grading permit, a grading plan shall
be submitted to the City's Department of Public Works. A
plan for silt control for all water runoff from the
property during construction and during initial operation
of the project may be required by the Director of Public
Works if deemed necessary.

5. The structures on the subject property, whether attached or
detached, shall be constructed in compliance with the State
acoustical standards set forth for units that lie within the
60 CNEL contours of the property. Evidence of compliance shall
consist of submittal of an acoustical analysis report, prepared
under the supervision of a person experienced.in the field of
acoustical engineering, with the application for.building
permit(s),.
6. If foil type insulation is to be used, a fire retardant type
shall be installed as approved by the Building Division.
7. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at an
off -site -facility equipped to handle them.
8. Low -volume heads shall be used on all spigots and water faucets.
9. If lighting is -included in the parking lot, high-pressure
sodium vapor lamps shall be used for energy savings. All
outside lighting shall be directed to prevent "spillage" onto
adjacent properties.
10. All utility apparatus such as, but not limited to,.,backflow
devices and•Edison transformers, shall be prohibited in the
front yard and -exterior sideyards.
11. The development shall comply with all applicable provisions of
the Ordihance•Code, Building Division, and Fire Department.
12. Installation of required landscaping,and-.irrigation systems
shall be completed prior to final inspection.
13. Should the hours of operation for either user of the facility
change, or the use of the building change, a new conditional
use permit will be required.
14. The Planning Commission reserves the right to revoke this
conditional use.permit if any violation of these conditions or
the Huntington Beach Ordinance Code occurs..

APPLICANT: AHMAD MOZAFFARI AND LISA GARRETT
Conditional Use -Permit No.' 88-11 is a request to operate a
convenience store with beer and wine sales in an existing shopping
center approximately 200 feet northeast of the corner of Slater
Avenue and Beach Boulevared in a space previously occupied by a Stop
and Go Market that was licensed to sell beer and wine from 1962 to
1982 and general liquor from 1982 to May 1987. Because the market
has not had a valid liquor license for over six months the applicant
is required to obtain the above entitlement.

ENVIRONMENTAL STATUS:
The proposed project is exempt Class 1 Section 15301 from the
provisions of the California Environmental Quality.Act..
Approve Conditional Use Permit No. 88=11 with findings and
conditions of approval.
THE PUBLIC HEARING WAS OPENED
Dr. Marie Heng, 17456 Beach Boulevard,.spoke in opposition to the
request. She stated her opposition to any further beer or wine
sales in the -area because she feels it causes unsafe situations
detrimental to health and it creates problems in the adjacent
parking lots. -She feels that there is excessive licensing for beer
sales in the area. She also addressed the problem of the telephone
in front of the convenience market. She -feels that the phones
afford drug dealers/users the opportunity to conduct business on
site and suggested that they be moved.
Arthur Jan Ho, 17456 Beach Boulevard, spoke in opposition to the.
additional sale'of liquor. He stated that he does not oppose the
convenience.marketjjust the 'sale of beer .and wine.- He feels that
additional alcohol sales -will increase the already present problems
occurring in the center (vagrants sleeping in trash bins, people
urinating in'the parking lot, trash/debris; noise, etc.).
Lisa Garrett, applicant; spoke in support of the request. She said
a large investment -has been made to operate,the'convenience market
and that she does not feel she should be penalized because other
uses in the center -cause violations. She further stated that she is
willing to cooperatetin_any way to clean up the -center and work with
the owners to make it a successful operation.
Ahmad Mozaffari, applicant, spoke in support of the request. He
stated his desire to cooperate with the owners and the City in
making the center, especially his market,ksuccessful,-
There were no other persons present to speak for or against the
request and the public hearing was closed.
The Commission discussed the potential code and health violations
occurring in..the center. They agreed that the -applicant should not
be penalized for the hazardous conditions of the center and that if
there -were vandal/drug problems occurring that it was a police
matter. Staff was asked to follow-up on the following: history of
Police Department activity related to the market and also the center
in general; what types of complaints are received by the City;
whether the unenclosed trash bins contribute to problems associated
with loitering and transients in the area; improvement in exterior

lighting in order to reduce loitering and associated problems and
improve security; removal or relocating of outdoor phone booths
immediately adjacent to the front door of the market.

Code Amendment No. 87-15, a request to allow electronic readerboard
signage by amending the list of prohibited signs in the Huntington
Beach Ordinance Code, was denied by the Planning Commission with
findings on February 2, 1988. The Planning Commission appointed a
subcommittee to further study the issue and look into the
possibility of allowing electronic readerboards in return for
minimizing existing signage. The subcommittee met and drafted a
list of possible restrictions which could be applied to electronic
readerboards. The City Council on March 28, 1988 (acting on an
appeal of the Planning Commission's denial) continued the item to
June 20, 1988, and referred the code amendment to the Planning
Commission for evaluation and recommendation upon an alternative
ordinance that would allow electronic readerboards to certain
location and design standards as recommended by the Planning
Commission Subcommittee.

Jeff Lebow, 18271 Pammy Lane, spoke in opposition to electronic
readerboards. He is a resident in the adjacent neighborhood to
Wilson Ford and stated that he objects to any kind of electronic
advertisement.
Eric Weber, 18292 Pammy Lane, stated that as a member of the
subcommittee he assisted in recommendations for criteria regarding
electronic readerboards but still is in opposition to electronic
advertisement.
There were no other persons present to speak for or against the
request and the public hearing was closed.
It was felt by some Commissioners that a happy medium could be
reached regarding electronic readerboards and that the businessmen
in the City should be afforded the opportunity to stay competitive
in their advertising.
The Commission reviewed suggested criteria and agreed on the

APPLICANT: DENNIS NICOLE
Site Plan Review No. 88-2 is a request to relocate an existing
single family dwelling from 200 Orange Street (northeasterly
intersection of Orange Street and Third Street) to a 50 foot wide
lot fronting Pacific Coast Highway between Eleventh and Twelfth
Streets.
The structure will conform with all requirements of the Downtown
Specific Plan and will be required to conform with the adopted
Downtown Design Guidelines.

STAFF RECOMMENDATION:
Approve Site Plan Review No. 88-2 with conditions of approval.
Commissioner Bourguignon stated that he would be abstaining from
voting on Site Plan Review No. 88-2 due to the fact that by
approving it would create a non -conforming use by eliminating
p,arking area being used by adjacent real estate office.

CONDITIONS OF APPROVAL:
1. The site plan dated and received April 28, 1988,- shall be the
conceptually approved plan.
2. Elevations shall be reviewed and approved:by the:Design Review
Board so as to assure compliance with the adopted Downtown
Design Guidelines.
3. Prior to issuance of building permits, applicant shall file a
tentative parcel map. Said map shall.be recorded prior to
final inspection and a copy submitted,to the Department of
Community Development.
4. Alley dedication per Department of Public Works shall be
required.
5. Review and replace public right-of-way improvements per
Department of Public Works requirements.
6. Notification shall be provided to the Historical Resources
Board prior to relocation in order to document the structure at
its present location.
E. DISCUSSION ITEMS._
A subcommittee was formed to study issues relative to the
Ellis/Goldenwest Specific Plan. Commissioners appointed to the
subcommittee included Geri Ortega, Roger Slates and Ken
Bourguignon.

E-2 HUNTINGTON BEACH WOMEN'S CLUB
After testimony was presented regarding the disturbances
resulting from the expanded use of the Huntington Beach Women's
Club, staff was directed to prepare a letter to the City
Council from the Planning Commission advising them that it is
the opinion of the Commission that the expanded use is creating
a public nuisance and they feel immediate action should be
taken to alleviate the problem.
