ACTING ZONING ADMINISTRATOR PRESENT: Mike Strange STAFF MEMBERS PRESENT: Kelly Main MINUTES: Minutes of June 15, 1988 were continued to June 29, 1988 for Zoning Administrators approval. REGULAR AGENDA ITEMS: REQUEST FOR EXTENSION ADMINISTRATIVE REVIEW NO. 87-27 Applicant: Tony Kahale Staff member, Kelly Main, reported that this is a request for extension of time for Administrative Review No. 87-27, a proposed 2,300 sq. ft. industrial building for a auto repair which was approved by the Zoning Administrator on July 22, 1988. The applicant submitted a letter on June 13, 1988 requesting an extension of time due to problems with contracting the work for the project located at 7382 Talbert Avenue. She stated that the project is up to current code. She stated that there was no request for a variance at the time of original approval. Ms. Main recommended approval for extension of Administrative Review No. 87-27. Tony Kahale, applicant, was present and spoke in support of his request. REQUEST FOR EXTENSION OF ADMINISTRATIVE REVIEW NO. 87-27 WAS APPROVED BY THE ACTING ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS: SPECIAL CONDITIONS OF APPROVAL: 1. The site plan and floor plans received and dated July 22, 1987, shall be the approved layout. Elevations shall comply with requirements outlined by the Design Review Board. 2. Prior to issuance of building permits, the applicant shall file a parcel map or parcel map waiver request to consolidate Lots 9, 10, and one-half (1/2) of abandoned alley of Tract 445. The parcel map or plat map and notice shall be recorded with the Orange County Recorder and a copy of the recorded map or plat filed with the Department of Community Development prior to final inspection or occupancy. 3. Prior to issuance of building permits, the applicant shall submit the following plans:' a. Landscape and irrigation plan to the Department of Community Development and Public Works for review and approval. ZA Minutes 6/22/88 -1- (3213r) b. Rooftop Mechanical Equipment Plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. 4. Installation of required landscaping and irrigation systems shall be completed prior to final inspection. 5. Provide dedication and improvements on Talbert Avenue as required by Public Works. 6. Maximum separation between building wall and property line shall not exceed two inches (211). 7. Driveway approaches shall be a minimum of twenty-seven feet (27;) in width and shall be of radius type construction. 8. There shall be no outside storage of vehicles, vehicle parts, equipment or trailers. On site parking shall not be used for auto storage. 9. All repair work shall be conducted wholly within the building. 10. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 11. Natural gas shall be stubbed in at the locations of water heaters and central heating units. 12. Low -volume heads shall be used on all spigots and water faucets. 13. If lighting is included in the parking lot, high-pressure sodium vapor lamps shall be used for energy savings. All outside lighting shall be directed to prevent "spillage" onto adjacent properties. 14. All applicable Public Works fees shall be paid prior to issuance of building permits. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. If any hazardous materials are to be used on site, the business must comply with Chapter 1758 of the Municipal Code which requires any business that handles or stores hazardous materials, including waste, to inventory the materials and prepare an Emergency Business Plan. Waste oil is considered a hazardous waste. 4. Landscaping shall comply with Article 960 of the Huntington Beach Ordinance 5. Code. The Zoning Administrator reserves the right to revoke Administrative Review No. 87-27 if any violation of these conditions of the Huntington Beach Ordinance Code occurs. ZA Minutes 6/22/88 -2- (32130 TENTATIVE PARCEL MAP NO. 88-109 Applicant: Marinacci Lindborg This request is covered by Categorical Exemption, Class 5, California Environmental Quality Act, 1986. Staff member, Kelly Main, reported that this is a request to consolidate two parcels into one and a request for a waiver of final map for 906-912 Florida Street. She stated that a 10 unit apartment building was approved for the site by the Zoning Administrator in July, 1987 and the request for consolidation of the two lots was a condition of approval for the project. Ms. Main stated that staff is recommending approval of both the tentative parcel map and wiaver of the final map as both the alley dedication and street improvements have been completed. Mr. Marinacci, applicant, was present and spoke in support of the request. TENTATIVE PARCEL MAP NO. 88-109 WAS APPROVED BY THE ACTING ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS: FINDINGS FOR -APPROVAL: 1. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation of this type of use. 2. The property was previously studied for this intensity of land use at the time the land use designation for residential district allowing residential buildings was placed on the subject property. 3. The size, depth, frontage, street width and other design and improvement features of the proposed consolidation are proposed to be constructed in compliance with standards plans and specifications on file with the City as well as in compliance with the State Map Act and supplemental City Subdivision Ordinance. 4. The proposed consolidation of two (2) parcels for purposes of residential use is in compliance with the size and shape of property necessary for that type of development. FINDINGS OF APPROVAL -FOR WAIVER: 1. The proposed consolidation complies with the requirements as to area, improvement and design, flood and water drainage control, appropriate and approved public roads, sewer and water facilities, environmental protection, and other requirements of Article 992 of the Subdivision Section of the Ordinance Code. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL(S) FOR ANY PURPOSE: 1. The Tentative Parcel Map dated January 14, 1988 shall be the approved layout (with the amendments as noted thereon). 2. A parcel map shall be filed with and approved by the Department of Public Works and recorded with the Orange County Recorder. ZA Minutes 6/22/88 -3- (32130 3. 2.5 feet off the alley east of Florida shall be dedicated to City standards. 4. Water supply shall be through the City of Huntington Beach's water system at the time said parcel(s) is/are developed (if such systems exist within 200 feet of said parcel(s). 5. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time said parcel(s) is/are developed (if such systems exist within 200 feet of said parcel(s). 6. All utilities shall be installed underground at the time said parcel(s) is/are developed. 7. Compliance with all applicable City Ordinances. 8. A copy of the recorded parcel map shall be filed with the Department of Community Development. 9. All vehicular access rights along Florida and the alley to the east shall be dedicated to the City of Huntington Beach except at locations approved by the Zoning Administrator. CONDITIONS OF APPROVAL FOR WAIVER- OF THE FINAL MAP: These Conditions of Approval will apply to the waiver of the final map. You must have met all Conditions of Appproval for Tentative Parcel Map No. 88-109 for the Zoning Administrator to be able to grant a waiver of final map. A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL(S) FOR ANY PURPOSE: 1. A copy of a document dedicating 2.5 ft. to the City of Huntington Beach for alley purposes shall be provided for file. 2. The Tentative Parcel Map dated January 14, 1988 shall be the approved layout (with - the amendments as noted thereon). 3. The applicant shall file, through the Huntington Beach City Clerk's office, and have recorded with the Orange County Recorder's Office, a Certificate of Compliance in conjunction with the approved plat map. A copy of the recorded Certificate of Compliance and plat map shall be filed with the Department of Community Development prior to issuance of building permits on the subject property. COASTAL DEVELOPMENT PERMIT NO. 88-18 Applicant: Jesse Raymond This request is covered by Categorical Exemption, Classl, California Environmental Quality Act, 1986. Staff member, Kelly Main, reported that this is a request to add approximately 1,170 sq. ft. to a single family dwelling (effecting both the first and second floor) located at 16711 Edgewater Lane. She stated that the request complies with California Coastal Commission and Huntington Beach Ordinance Code and that staff is recommending approval with standard conditions and some small changes on the project data list. ZA Minutes 6/22/88 -4- (32130 The public hearing was opened and Norm Parker, applicant, was present and spoke in support of the request. There was no one else present to speak for or against the request so the public hearing was closed. COASTAL DEVELOPMENT PERMIT NO. 88-18 WAS APPROVED BY THE ACTING ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS: FINDINGS FOR APPROVAL: 1. The proposed single family residence conforms with the plans, policies, requirements and standards of the Coastal Element of the General Plan. 2. The Coastal Development Permit is consistent with the CZ suffix zoning requirements, the R1 Zoning District, as well as other provisions of the Huntington Beach Ordinance Code applicable to the property. 3. At the time of occupancy, the proposed single family residence can be provided with infrastructure in a manner that is consistent with the Coastal Element of the General Plan. 4. The proposed single family residence conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. 5. The 20 ft. front setback for the proposed garage is consistent with many of the homes originally built in Tract 5360. CONDITIONS OF APPROVAL: l: The site plan, floor plans, and elevations received and dated March 25, 1988, shall be the approved conceptual layout with the following modifications: a. Project Data listed on site plan should be corrected to accurately represent additional residential square footage (approximately 1,050 sq. ft.), additional garage space (122 sq. ft.), and total existing garage area (460 sq. ft.), and total proposed garage area. b. Label 3 ft. architectural wall feature on garage as such. This area cannot be made into usable floor space. C. Show roof line with a dashed line. Eaves must meet the requirements of Article 911, Huntington Beach Ordinance Code. d. Conditions of Approval shall be printed on a 24" x 36" sheet accompanying the working drawings for plan check. 2. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 3. Proposed structures shall be architecturally compatible with existing structures. 4. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. Prior to issuance of building permits, the property owner shall sign, notarize, and record with the County Recorder a "Letter of Agreement" assuring that the single family residence will be maintained as one (1) dwelling unit. 7. Prior to issuance of building permits, the homeowner shall submit evidence that the plans have been reviewed by the appropriate Homeowners Association. 8. All applicable Public Works fees shall be paid prior to issuance of building permits. INFORMATION ON SPECIFIC CODE REQUIREMENTS 1.
