ZONING ADMINISTRATOR PRESENT: Michael Strange STAFF MEMBERS PRESENT: Kelly Main Thomas Rogers REGULAR AGENDA ITEMS: TENTATIVE PARCEL MAP NO. 88-268 Applicant: Marcian Charlotte Taffy Warner A request to consolidate. one lot with a portion of an adjacent lot and to request a waiver of the final map. The subject property is located at 406 7th Street. This request is covered by Categorical Exemption, Class 5, California Environmental Quality Act, 1986. The Hearing was opened. Kelly Main, staff member, reported that the applicant could not be present at the hearing but had sent a letter stating agreement with the conditions of approval. She went on to say that Planning and Public Works staff recommended approval of the waiver. There was no one present to speak for or against the project and the Public Hearing was closed. TENTATIVE PARCEL MAP NO. 88-268 WAS CONDITIONAL APPROVED BY THE ACTING ZONING ADMINISTRATION WITH THE FOLLOWING CONDITIONS OF APPROVAL: CONDITIONS OF APPROVAL: 1. The Tentative Parcel Map received by the Department of Community Development on July 8, 1988 shall be the approved layout with the amendments as noted thereon. 2. The applicant shall file, through the Huntington Beach City Clerk's office, and have recorded with the Orange County Recorder's Office, a Certificate of Compliance in conjunction with the approved plat map. A copy of the recorded Certificate of Compliance and plat map shall be filed with the Department of Community Development prior to issuance of building permits on the subject property. COASTAL DEVELOPMENT PERMIT NO. 88-23 IN CONJUNCTION WITH CONDITIONAL EXCEPTION NO. 88-78: Applicant: Bozena Jaworski To allow a front setback of 7 feet 6 inches in lieu of 15 feet for the addition to a dwelling. The subject property is located at 16792 Intrepid Lane. This request is covered by Categorical Exemption, Class 5, California Environmental Quality Act, 1986. Tom Rogers, staff member, reported that staff recommended denial because a two story addition with a 7 1/2 foot setback would put too much bulk along the streetscape. The Public Hearing was opened and Bozena Jaworski was present and spoke in favor of the request. She indicated willingness to work with staff and revise the plans for the room addition. Mr. Strange advised the applicant that he was opposed to the existing plan and would not approve an addition with a 7' 6" front yard setback. Tom Rogers, staff member, suggested revisions to the plans with a 10' setback on the first floor and that the second floor meet code with a 15' front setback. Staff believed that the unusual configuration of this lot warranted some relief from the Code. There was no one else present wishing to speak for or against the project and Public Hearing was closed. COASTAL DEVELOPMENT PERMIT NO. 88-23 IN CONJUNCTION WITH CONDITIONAL EXCEPTION NO. 88-79 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING CONDITIONS: FINDINGS FOR APPROVAL FOR COASTAL DEVELOPMENT PERMIT NO. 88-23: 1. The proposed single family residence conforms with the plans, policies, requirements and standards of the Coastal Element of the General Plan. 2. The Coastal Development Permit is consistent with the CZ suffix zoning requirements, the R1 Zoning District, as well as other provisions of the Huntington Beach Ordinance Code applicable to the property. 3. At the time of occupancy, the proposed single family residence can be provided with infrastructure in a manner that is consistent with the Coastal Element of the General Plan. 4. The proposed single family residence conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. FINDINGS FOR APPROVAL CONDITIONAL EXCEPTION NO. 88-79 1. That because of special circumstances. applicable to the subject property, including size and shape, the strict application of the zoning ordinance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classification. 3. That the granting of a conditional exception is necessary to preserve the enjoyment of one or more substantial property rights. 4. That the granting of conditional exception will not be materially detrimental to the public welfare or injurious to property in the same zone classifications. S. That the granting of a conditional exception will not adversely affect the general plan of the City of Huntington Beach. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated June 27, 1988 shall be revised to depict the modifications described herein: a. The proposed second story addition shall have a minimum setback of 15' from the front property line. b. The proposed first story addition shall have a minimum dimension of 16-feet from the front property line. c. The proposed addition shall have a common wall a minimum of 50% in length with the existing dwelling. 2. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them,1 -:..-- 3. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central Beating units. 4. Low -volume heads shall be used on all spigots and water faucets. 5. Prior to issuance of building permits, the property owner shall sign, notarize, and record with the County Recorder a "Letter of Agreement" assuring that the single family residence will be maintained as one (1) dwelling unit. 6. All applicable Public Works fees shall be paid prior to issuance of building permits. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes,_. Ordinances, and standards. 3. The Zoning Administrator reserves the right to revoke Coastal Development_ Permit No. 88-23 and Conditional Exception No. 88-79 if any violation of these conditions of the Huntington Beach Ordinance Code occurs. ZA Minutes - 7/27,188 -3- : (3798r) USE PERMIT NO. 88-37 Applicant: D'Ambra, Inc. A request to permit an addition to the garage, continuing the existing nonconforming setback (7 1/2 feet). The subject property is located at 6851 Evening Hill Drive. This request is covered by Categorical Exemption, Class 5, California Environmental Quality Act, 1986. Tom Rogers, staff member, reported that the front setback for the tract was 7 1/2 feet when it was first constructed. He said that the request conforms with code requirements and recommended approval. The Public Hearing was opened Dennis D'Ambra was present. He said he was in agreement with the conditions of approval. There was no one else present wishing to speak for or against the project and Public Hearing was closed. USE PERMIT NO. 88-37 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING CONDITIONS: FINDINGS FOR APPROVAL: 1. The establishment, maintenance and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of the Use Permit No. 88-37 will not adversely affect the General Plan of the City of Huntington Beach. 3. The location, site layout, and design of the proposed addition properly adapts to streets, driveways, and other adjacent structures and uses in a harmonious manner. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated June 29, 1988 shall be the approved layout. 2. Any expansion of the driveway curbcut is subject to Public Works approval. 3. Tom Rogers, staff member, reported that Barker Bros. had similar temporary sales events in the past. Staff recommended approval with the same conditions as in the past. • ---. The facility will not be open to the general public and will serve only for the process of diagnostic imaging not for patient care. The great majority of analysis of the tests will take place at the referring physician's office. There will be no physicians on staff. 5. Offices in the facility will serve as administrative headquarters. No "medical office" type use will be allowed. 6. The location, site layout, and design of the proposed use properly adapts the proposed use to streets, driveways, and other adjacent structures and uses in a harmonious manner. 7. The access to and parking for the proposed use does not create an undue traffic problem. SPECIAL CONDITIONS OF APPROVAL: 1. He said they are sensitive to the neighbors and would try to control the noise even more than in the past. In a number as determined by the Police Chief, uniformed officers shall be provided on -site during the hours of operation - not less than four (4) officers at any time. Cost of this and Condition No. 7 shall be borne by the applicant. 9. Breakdown of stands, equipment, apparatus and rides shall be prohibited after 10:00 PM on Sunday. Breakdown of the wooden booths shall be allowed until 1:00 AM. 10. Use of amplifiers, speakers, musical instruments and playing of recorded music are to be discontinued as of 10:00 PM each evening. Speakers located in the Garden Dining Area will be permitted until closing hours each day and shall be in conformance with the City of Huntington Beach Noise Ordinance. Speakers shall not be directed towards any housing area. 11. The carnival, and all related activities, shall comply with all applicable sections of the Municipal Code requirements pertaining to the Noise Ordinance. 12. The applicant shall provide for clean-up of the area each evening after closing of the event. Clean-up of the site, after 10:00 PM shall not include the use: of any machinery or equipment that may disturb the residents in the area. All trash, debris and garbage, as well as special dumpsters, shall be removed from the. site, within two (2) days of closing of the event. 15. The applicant shall provide professional clean-up crews to clear the adjacent streets of trash and debris. This clean-up shall not commence prior to 7:00 AM each morning. 16. An on -site parking plan shall be submitted showing access to the number of spaces. The plan shall be approved by the Traffic Engineer and Traffic Division of the Police Department. 17. An announcement should be made to parishioners requesting that they refrain' from parking on neighborhood streets. 18. The Church shall provide Church personnel to patrol street parking areas (Magnolia Street and Indianapolis Avenue) to prevail upon those utilizing.street parking to cross streets at the intersections. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. 5. The applicant shall provide an entire site plan and floor plan for Fire Department approval showing any structures, seating areas, exit ways and obstructions. 6. The applicant shall provide information regarding tents or air supported structures. They shall comply with Article 32 of the 1985 edition of the Uniform Fire Code, such as: a. Flame retardant b. Signs for No Smoking C. Fire extinguishers d. Exit ways 7. The food vendors shall submit to the Fire Department the type of fuel devices planned for use. 8. Electrical permits required by Building Division shall be obtained before final Fire Department approval for location of generators and wiring. 9. The applicant shall restrict vehicular ingress and egress on the subject site, with barricades acceptable to the Fire Department. 10. The applicant shall obtain clearance from the Public Liability Claims Coordinator, Administrative Services Department, and/or shall provide -a Certificate of Insurance and Hold Harmless Agreement to be executed at least five (5) days prior to the event. 11. All Alcoholic Beverage Control requirements shall be met. 12. An accessway for the bicyclists shall be provided on site subject to Fire Department approval. 13. Helicopter landing site shall be approved by the Police Department prior to issuance of a Certificate to Operate. A barricade shall be provided to prevent pedestrian access to the helicopter landing site. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. Prior to starting the event, a Certificate to Operate shall be issued by, the Department of Community Development as required by Section 9730.80 of the Huntington Beach Ordinance Code. 4. The Zoning Administrator reserves the right to revoke Use Permit No. 88-45 if any violation of the above conditions.
