This request is covered by Negative Declaration No. 87-18. Staff member, Thomas Rogers, reported that this is a request to grant a one-year extension to permit five (5) industrial buildings (for a total of 43,128 sq. ft.) located on the north side of Talbert Avenue approximately 436 ft. east of Gothard Street. Mr. Rogers stated that it took the applicant longer than a year due to a change in partners or ownership of the land. Staff recommendation is approval with findings and conditions as previously placed on this request. The extension will be to May 20, 1988. Negative Declaration standards are the same as the last application. AN EXTENSION OF TIME (ONE YEAR) FOR ADMINISTRATIVE REVIEW NO. 87-21 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS: SPECIAL CONDITIONS OF APPROVAL: 1. The floor plans and elevations received and dated April 29, 1987, shall be the approved layout, and the site plan received and dated May 19, 1987, shall be the approved layout with modifications described herein: a. Incorporate landscape area North of Building "D" into structure; or pave said area with access from man -door on Building "D"; or incorporate said area into adjacent parcel. 2. Prior to issuance of building permits, the applicant shall file a parcel map or parcel map waiver request. The parcel map or plat map and notice shall be recorded with the Orange County Recorder and a copy of the recorded map or plat filed with the Department of Development Services prior to final inspection or occupancy. 3. Prior to issuance of building permits, the applicant shall submit the following plans: a. Landscape and irrigation plan to the Department of Development Services and Public Works for review and approval. b. Rooftop Mechanical Equipment Plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. 4. Installation of required landscaping and irrigation systems shall be completed prior to final inspection. 5. The applicant shall resurface/pave the adjacent railroad track area to the satisfaction of the Public Works Department. 6. Rolling emergency access gates shall remain closed except during emergencies, and shall be installed to Fire Department Standards. 7. On -site fire hydrants shall be provided in number and at locations specified by the Fire Department. 8. An automatic fire sprinkler system shall be approved and installed pursuant to Fire Department regulations. 9. Service roads and fire lanes, as determined by the Fire Department, shall be posted and marked. 10. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. 11. Maximum separation between building wall and property line shall not exceed two inches (211). 12. There shall be no outside storage of vehicles, vehicle parts, equipment or trailers. 13. All repair work shall be conducted wholly within the building. 14. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 15. Private access roadway shall be constructed to the standards and satisfaction of the Public Works Department. 16. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 17. Low volume heads shall be used on all spigots and water faucets. 18. If lighting is included in the parking lot, high-pressure sodium vapor lamps shall be used for energy savings. All outside lighting shall be directed to prevent "spillage" onto adjacent properties. 190 If foil -type insulation is to be used, a fire retardant type shall be installed as approved by the Building Department. 20. Prior to the issuance of a grading permit, a grading plan shall be submitted to the City's Department of Public Works. A plan for silt control for all water runoff from the property during construction, and during initial operation of the project, may be required by the Director of Public Works if deemed necessary. 21. All applicable Public Works fees shall be paid prior to issuance of building permits. - INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. Information on equipment or facilities which may generate air pollutants shall be submitted to the South Coast Air Quality Management District staff for their review prior to the issuance of a Certificate of Occupancy for any use within the building. 4. If any hazardous materials are to be used on site, the business must comply with Chapter 1758 of the City's Municipal Code which requires any business that handles or stores hazardous materials, including waste, to inventory the hazardous materials on site and prepare a Business Emergency Plan in case of an accidental release of toxic material. Additionally, all hazardous materials, including waste, must be handled and stored in accordance with the Uniform Fire Code. Waste oil is considered a hazardous waste. 5. Landscaping shall comply with Article 960 of the Huntington Beach Ordinance Code. 6. The Board of Zoning Adjustments reserves the right to revoke Administrative Review No. 87-21 if any violation of these conditions of the Huntington Beach Ordinance Code occurs. CONDITIONAL EXCEPTION NO. 88-83 IN CONJ. WITH PREVIOUSLY APPROVED COASTAL DEVELOPMENT PERMIT NO. 88-19 Applicant: Mr. Danny Jones Staff member, Kelly Main, reported that this is a request to allow eaves at a 2 ft. 6 in. rear setback in lieu of the required 5 ft. setback located at 16402 Ardsley. Ms. Main stated that the Zoning Administrator approved a basic addition on this house two weeks ago with one problem in the plan. The eaves intruded on the rear yard setback of 5 ft* from the bulkhead leaving only 2 ft. 6 in. setback from the bulkhead. She stated that the applicant has applied for a variance from this 5 ft. setback only on the rear approach. She stated that due to the hardship and design of the plan, staff is recommending approval. The public hearing was opened and Don Hartfelder, architect representing the applicant, was present and spoke in support of the request. There was no one else present to speak for or against the request so the public hearing was closed. CONDITIONAL EXCEPTION NO. 88-83 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS: FINDINGS FOR APPROVAL: 1. Because of special circumstances applicable to the subject property, including the shape of a portion of the subject lot and the surrounding channel, the strict application of the Zoning Ordinance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classifications. 2. The granting of a Conditional Exception is necessary in order to preserve the enjoyment of one or more substantial property rights. 3. The granting of Conditional Exception No. 88-83 will not be materially detrimental to the public welfare, or injurious to property in the same zone classifications. 4. The granting of the Conditional Exception will not adversely affect the General Plan of the City of Huntington Beach. 5. The granting of the Conditional Exception will not constitute a granting of special privilege inconsistent upon other properties in the vicinity and under an identical zone classification. 6. Granting of Conditional Exception No. 88-83 will allow the proposed structure to be compatible with the existing structure. CONDITIONS OF APPROVAL: 1. With the exception of Condition No. 1-d, all conditions of approval for Coastal Development Permit No. 88-19 shall apply. 2. The variance for a 216" setback for eaves from rear property line shall only apply tothe proposed addition and not to any future additions. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. Any replacement or addition to decking over the channel shall require Coastal Commission approval and is not included in the approval of this request. 3. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 4. The Zoning Administrator reserves the right to revoke Conditional Exception No. 88-83 if any violation of these conditions of the Huntington Beach Ordinance Code " occurs. USE PERMIT NO. 88-43 Applicant: ENVIPCO California, Inc. This request is covered by Categorical Exemption, Class3, Section 15303, California Environmental Quality Act, 1986. Staff member, Thomas Rogers, reported that this is a request to install three reverse vending machines at the Lucky Market located at 9051 Atlanta Avenue. He stated that the reverse vending machine would recycle cans and bottles. He stated the machines meet code; therefore, staff is recommendings approval. Mr. Rogers stated that Daryl Smith, Public Works, expressed concern about the materials that will be used to clean and maintain the machings. Applicant stated that the machines are maintained with an over the counter cleaning fluid. The public hearing was opened and Renee Benoit-Shandley, representing the applicant, spoke in support of the request. There was no one else present to speak for or against the request so the public hearing was closed. USE PERMIT NO. 88-43 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS: FINDINGS FOR APPROVAL: 1. The establishment, maintenance and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of Use Permit No. 88-43 will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the goals and objectives of the City's General Plan and Land Use Map. 4. The location, site layout, and design of the proposed use properly adapts it to streets, driveways, and other adjacent structures and uses in a harmonious manner. 5. The combination and relationship of one proposed use to another on a site are properly integrated with relation to subject use. 6. The access to and parking for the proposed use does not create an undue traffic problem. 7. The proposed use meets requirements for recycling facilities and this approval does not set precedent for ordinary vending machines. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan received and dated July 21, 1988 shall be the approved layout. 2. The reverse vending machines: a. Shall be established in conjunction with a commercial use or community service facility which is in compliance with the zoning, building and fire codes of the City of Huntington Beach. b. Shall not occupy parking spaces required by the primary use. c. Shall occupy no more than 50 square feet of floor space per installation, including any protective enclosure, and shall be no more than eight (8) feet in height. d. Shall be constructed and maintained with durable waterproof and rustproof material. e. Shall be clearly marked to identify the type of material to be deposited, operating instructions, and the identity and phone number of the operator or responsible person to call if the machine is inoperative. f. Shall be maintained in a clean, litter -free condition on a daily basis. g. Operating hours shall be at least the operating hours of the host use. h. Shall be illuminated to ensure comfortable and safe operation if operating hours are between dusk and dawn. i. Shall not obstruct handicap access or circulation or site. 3. This use permit may be reviewed by the Zoning Administrator should any problems arise with the proposed use. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The applicant shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The Zoning Administrator reserves the right to revoke this Use Permit if any violation of these conditions of the Huntington Beach Ordinance code occurs. USE PERMIT NO. 88-44 Applicant: ENVIPCO California, Inc. This request is covered by Categorical Exemption, Class 3, Section 15303, California Environmental Quality Act, 1986. Staff member, Thomas Rogers, reported that this is also a request to install three reverse vending machines at the Lucky Market located at 16600 Bolsa Chica. He stated that this is basically the same request as discussed in the previous case of Use Permit No. 88-43. He stated that staff is recommending approval. The public hearing was opened and Renee Benoit-Shandley spoke in support of the the request. There was no one else present to speak for or against the request so the public hearing was closed. USE PERMIT NO. 88-44 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS: FINDINGS FOR APPROVAL: 1. TENTATIVE PARCEL MAP NO. 88-310 Applicant: James Mosich This request is covered by Categorical Exemption, Class 15, Section 15315, California Environmental Quality Act, 1986. Staff member, Thomas Rogers, reported that this is a request to subdivide one (1) parcel into two (2) parcels located at 112 and 114 8th Street. Staff stated that a Conditional Use Permit has already been granted for the 22.5 foot wide lot, and this parcel map is a condition of approval for the Conditional Use Permit. Staff is recommending approval. TENTATIVE PARCEL MAP NO. 88-310 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITION: CONDITIONS OF APPROVAL A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL(S) FOR ANY PURPOSE: 1. The Tentative Parcel Map received by the Department of Community Development on July 19, 1988 shall be the approved layout (with the amendments as noted thereon). 2. A parcel map shall be filed with and approved by the Department of Public Works and recorded with the Orange County Recorder. 3. The alley shall be dedicated to City standards. 4. Water supply shall be through the City of Huntington Beach's water system at the time said parcels are developed. 5. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time said parcels are developed. 6. All utilities shall be installed underground at the time said parcels are developed. 7. Compliance with all applicable City Ordinances. 8. A copy of the recorded parcel map shall be filed with the Department of Community Development. 9. All vehicular access rights along 8th Street shall be dedicated to the City of Huntington Beach except at locations approved by the Zoning Administrator.
