CONSENT CALENDAR: MINUTES OF JULY 19, 1988 PLANNING COMMISSION MEETING A MOTION WAS MADE BY LIVENGOOD, SECOND BY ORTEGA TO APPROVE MINUTES OF JULY 19, 1988 AS SUBMITTED, BY THE FOLLOWING VOTE: AYES: Livengood, Silva, Leipzig, Ortega, Higgins, Kirkland NOES: None ABSENT: Slates ABSTAIN: None MOTION PASSED B. ORAL COMMUNICATION City Councilman, Wes Bannister, presented Planning Commissioner, Jim Silva, with a plaque in recognition for his outstanding performance during the past two years as Planning Commissioner. C. PUBLIC HEARING ITEMS C-1 ZONE CHANGE NO, 87-14/ENVIRONMENTAL ASSESSMENT NO, 87-41 APPLICANT: ASCON PROPERTIES, INC. Zone Change No. 87-14 is a request to change the zoning from LUD-0-FP2 to LUD-01-CZ-FP2 to allow for new oil facilities and oil drilling activities on a .868 acre portion of the Ascon site pursuant to a conditional use permit. ENVIRONMENTAL STATUS: The proposed zone change is covered under Draft Negative Declaration No. 87-41. RECOMMENDATION• Approve Negative Declaration No. 87-41 and Zone Change No. 87-14 from LUD-O-CZ-FP2 to (Q)LUD-01-CZ-FP2 and recommend adoption by the City Council. THE PUBLIC HEARING WAS OPENED Richard Harlow, representing Ascon Properties, spoke in support of the request. He stated they had reviewed the staff report and agreed with all the conditions. He went on to say that the site is under the "0" designation which allows oil operation to continue and the request would only permit the filing of a conditional use permit for the drilling additional wells. Also the area of the site to be rezoned is 1/4 mile from any residence. William Curtis, oil businessman, spoke in support of the request. Beverly Titus, 9062 Bobbie Circle, spoke in opposition of the request. She expressed concern relative to the access onto the site and the negative impact this would create for the surrounding residences. She further recommended postponement until a full site characterization is completed. Diane Mc Cue, 9061 Niguel Circle, spoke in opposition of the request and also supported postponement until a full site characterization is completed. Chris Kerner, Chemist and Civil Engineer representing Ascon Properties, spoke in support of the request. He said an preliminary site characterization was performed and a full site characterization is to be implemented. There were no other persons present to speak for or against the request and the public hearing was closed. PC Minutes - 8/16/88 -2- (1170d) j 1 Mr. Kerner responded to a Commissioner. inquiry indicating that measures will be taken to prevent further migration of poisons or toxic substance in the site. John Lindsey, owner of Ascon Properties, responded to a Commissioner inquiry that a Remedial Action Plan addressing the clean up would be implemented after the site characterization. He also stated that there would be no detrimental affects to the community if the zone change was granted. Chairman Leipzig cautioned the applicant that approval of the zone change did not indicate any approval of sequential applications for the site. A MOTION.WAS MADE BY LIVENGOOD AND SECOND BY SILVA TO APPROVE ZONE CHANGE NO. 87-14 AND ENVIRONMENTAL ASSESSMENT NO. 87-41 WITH FINDINGS AND REVISED CONDITIONS OF APPROVAL, BY THE FOLLOWING VOTE: AYES: Livengood, Silva, Leipzig, Ortega, Higgins, Kirkland NOES: None ABSENT: Slates ABSTAIN: None MOTION PASSED FINDINGS FOR APPROVAL: 1. The proposed zone change will not be detrimental to the general welfare of persons residing or working in the vicinity nor to property and improvements in the vicinity, because the "Q" will require site characterization and additional public hearings prior to issuance of grading, oil drilling, or building permits. 2. The granting of the zone change will not adversely affect the General Plan of the City of Huntington Beach 3. The proposal is consistent with the goals and objectives of the City's General Plan and Land Use Map. 4. The zone change will allow for types of uses that would be compatible with the immediately surrounding area, which is industrial. Additionally, the proposed oil drilling area is located at least 1,300 feet from the nearest residences, and is not visible from public rights -of -way due to existing berms and distance from streets. 5. Future drilling will not adversely impact the adjacent Edison Co. property. Since the generating station is located on a geological structure susceptible to oil pumping -related subsidence, slant drilling under Edison Co. property will be prohibited. PC Minutes - 8/16/68 -3- (1170d) CONDITIONS ("O") OF THE ZONE CHANGE: The following qualifications incorporated into the zoning will mitigate any potential environmental impacts associated with the request: 1. Prior to the issuance of any permits for grading, building or drilling on the subject .868 portion of the 38 acre Ascon site, characterization of the entire 38 acre site (including access road) in accordance with recommendations from the City and other responsible agencies including Regional Water Quality Control Board, shall be completed. Depending on the results of the characterization, it shall either be verified by all responsible agencies that the portion of the site to be utilized for drilling purposes is free of contaminants and drilling activities may safely proceed without remediation of the subject portion or overall portion of the site, or the site shall be remediated to the satisfaction of all responsible agencies prior to issuance of any grading, building or drilling permits. 2. All storage tanks shall include vapor recovery systems approved by the City Fire Department. Prior to the issuance of drilling permits, fire hydrants (number and location to be determined by the City Fire Department) shall be provided on site. 3. The proposed private roadway running from Hamilton Avenue to the drilling site shall be a designated fire lane, minimum 24 foot side, and constructed in accordance with Public Works standards and criteria. The road shall be of "all weather" material. A study must be completed of roadway area for potential gas seeps, etc. and reviewed by appropriate state agencies prior to issuance of any conditional use permit. 4. Dust suppression and soil erosion mitigation measures such as watering the soils during grading, and the utilization of dikes, sandbags, etc. during construction shall be approved by the Director of Community Development and implemented. 5. Access to the site shall be taken from Hamilton Avenue only. Delivery and pick up routes shall be limited to those indicated in the proposed plan (see attached site plan and route map). Deliveries and pick ups shall be limited to the hours between 7:00 AM and 5:00 PM Monday through Friday and shall be prohibited entirely on Saturday, Sundays and holidays. 6. The project shall comply with the City of Huntington Beach Oil Code and Noise Ordinance. PC Minutes - 8/16/88 -4- (1170d) jJ 7. All safety measures and contingency plans shall be in conformance with the standards of, and approved by, the City of Huntington Beach Fire Department. A liability/performance bond shall be reviewed and approved by the Planning Commission prior to any development. 8. If lighting is included with the project, energy efficient lamps shall be used (e.g. high pressure sodium vapor, metal halide). All outside lighting shall be directed to prevent "spillage" onto adjacent properties. 9. A detailed soils analysis shall be prepared by a registered soils engineer. This analysis shall include on -site soil sampling and laboratory testing of materials to provide detailed recommendations regarding grading, chemical and fill properties, foundations, retaining walls, streets, and utilities prior to issuance of a conditional use permit. 10. Prior to the issuance of a grading permit, a grading plan shall be submitted to the City's Department of Public Works. A plan for silt control for all water runoff from the property during construction and during initial operation of the project may be required by the Director of Public Works if deemed necessary. 11. No slant -drilling shall be permitted under Edison Company property. 12. C-2 If during drilling, hazardous wastes are encountered, drilling operations must immediately cease until the hazard is defined and subsequently mitigated following an approved contingency plan. Should this situation occur, the Department of Health Services must be notified at once. A request to construct a 32,000 square foot center with variances for ;approximately 20 spaces and consolidate four parcels into one STAFF RECOMMENDATION: auto retail and service tandem compact parking parcel. PC Minutes - 8/16/88 -5- (1170d) A MOTION WAS MADE BY LIVENTOOD AND SECOND BY ORTEGA TO CONTINUE USE PERMIT NO. 88-34, CONDITIONAL EXCEPTION (VARIANCE) NO. 88-85, TENTATIVE PARCEL MAP NO. 88-275 AND NEGATIVE DECLARATION NO. 88-22 TO THE SEPTEMBER 20, 1988 PLANNING COMMISSION MEETING, BY THE FOLLOWING VOTE: AYES: Livengood, Silva, Leipzig, Ortega,:Higg,ins, Kirkland NOES:- None ABSENT: Slates ABSTAIN: None MOTION PASSED C-3 CONDITIONAL USE PERMIT NO, 88-29/CONDITIONAL EXCEPTION (VARIANCE) NO. 88-86 APPLICANT: THE HEBREW ACADEMY Conditional Use Permit No. 88-29 is a request to replace four existing modular classrooms and one caretaker's unit with new modular units and allow an expanded school enrollment from 250 students, allowed in 1977 when the school was established, to 400 students. - Conditional Exception -(Variance) No. 88-86 is a request to retain the existing number of parking spaces (41) on site and allow additional parking requirements (22) to be met by a reciprocal agreement -with the Seventh-Day Adventist_ Church across the,street and immediately east "of the school site. RECOMMENDATION: Approve Conditional Use Permit No. 88-29 and Conditional Exception (Variance) No. 88-86 with findings and conditions of approval. THE PUBLIC HEARING WAS OPENED Rabbi Joseph Newman, Director for the Hebrew Academy,. spoke in support of the request. He said the purpose for the request for structure replacement was to add -more space in the,classrooins and create a better environment for the students. Chuck Bannister, 14251 Willow Lane, spoke in opposition of the request. He said the traffic is intolerable. He was concerned that the school had violated their previous conditional use permit by exceeding the allowed enrollment. Donna Keller, 14220 Willow Lane, spoke in opposition of the request. She said parents continually block the intersection of Maple and Willow when delivering and picking up students. She also felt that in the event of an emergency at the school, fire trucks would not be able to access the site. PC Minutes - 8/16/88 -6- (1170d) 77 L 1 Clifford Watson, 6251 Glacier Drive, said he did not object to the, school but was concerned with the parking of automobiles and busses. Trudy Gibbons, 6231 Chinook Avenue, spoke in opposition of the request. She expressed concern relative to the parking due to the fact that the school was designed for K-6; however, enrollment consisted of pre-school through high school. Richard Cota read a letter from Mr. and Mrs. Smith who live on Willow Lane but could not be present. The letter stated the Smith's opposition of the request due to problems with traffic and trash. There were no other persons present to speak for or against the request and the public hearing was closed. Commissioner Leipzig stated he would have difficulty voting for the variance request for parking because the site is large and flat and it would be very easy to expand the parking to meet code requirements. Conditional Use Permit No. 88-29 for replacement of modular units, caretaker's unit and maximum enrollment of 400 as part of the Hebrew Academy is compatible with existing and proposed uses. 2. The granting of Conditional Use Permit No. 88-29 for replacement of modular units, caretaker's unit and an expanded enrollment will not adversely affect the General Plan of the City of Huntington Beach. The proper maintenance and operation of.the Hebrew Academy will not be detrimental to property and improvements in the vicinity of such use. •�� • • ••;• # 4•�� • • 1. The site plan and floor plans received and dated August 3, 1988, shall be the approved conceptual layout with the following modifications: a. Sixty three (63) parking spaces and two oversized parking spaces for busses are required -on -site and provide for secondary loading/unloading zone for parent vehicles, subject to review and approval by the Departments of Public Works and Community Development. b. Depict trash enclosure area. c., Provide floor plans of caretaker's unit. d. The applicant shall submit a landscape plan and a landscape maintenance program to the Department of Community Development for review and approval. 2. Replacement of the modular units shall -comply with all applicable provisions -of the City's Ordinance Code and Building Division. The caretakers's unit must meet a11.Code requirements. 3. The school enrollment shall be limited to no more than 400 students. Any expansion in number shall require approval by the Planning Commission. 4. This conditional use permit shall apply to the modular units identified on the site plan (as "proposed buildings"). Any expansion of school facilities shall require approval by the Planning Commission. 5. All employee vehicles, student vehicles and school buses shall be parked on site or in the Seventh Day Adventist Church parking lot off of Maple, and not on any public street. Bus parking shall be on the expanded parking lot. 6. The loading and unloading driveway at the entrance to the Academy shall be used for bus loading and unloading only, no parking. Once students are off or on the buses, the buses shall be moved so that area shall remain clear for emergency vehicle access. PC Minutes - 8/16/88 -8- (1170d) 7. The Academy is required to have an operational fire alarm system and accessible and operational fire extinguishers. 8. The Academy must follow California Administrative Code Titles 19 State Fire Code and 24 State Building Code. 9. Prior to occupancy of the five new modular units the following shall be complied with: a. Improve the parking lot expansion area, shown in the site plan, Attachment No. 2, which is adjacent to and just west of the 32 space parking area pursuant to Condition No. 1. b. Repair and restripe existing parking lot surface. c. Install a minimum six foot high wall with a view obscuring gate around trash area. d. Remove existing modular unit from nine space parking lot on south side of school buildings. e. As the new units are brought on site (in total or in phases) the existing modular unit or units will be removed from the Academy property including the camper/trailer currently used as living quarters. The current living quarters for the caretaker will be removed when the modular unit/mobile home is brought on site as a replacement. f. Any inoperable vehicles associated with or belonging to the Academy shall be removed from the property. g. Bicycle racks shall be relocated and screened subject to the approval of the Director of Community Development. 10. The Planning Commisson reserves the right to review/revoke this conditional use permit approval in the event of any violations of the terms of this approval, or violation of the applicable zoning laws, or upon receipt of complaints from surrounding residents; any such decision shall be preceded by notice to the applicant, a public hearing, and shall be based on specific findings. 11. A review of the use shall be conducted six (6) months after the date of this approval to verify compliance with all conditions of approval and applicable Articles of the Huntington Beach Ordinance Code. If, at that time, there is a violation of these conditions or code requirements, the approval may become null and void. The granting of Conditional Exception (Variance) No. 88-86 to allow meeting the.deficit on -site parking of 22 spaces at the church across the street from the Academy will be materially detrimental to the public welfare, and injurious to property in the same zone classification. During the school day, staff and buses should be parked on the school site to relieve on -street traffic. 2. Because of lack of special circumstances applicable to the subject property, including location or surroundings, the strict application of the zoning ordinance is found not to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classification. The lot is adequate in size and can accommodate additional parking. 3. Granting of Conditional Exception (Variance) No. 88-86 for off -site parking would constitute a special privilege inconsistent with limitations upon properties in the vicinity. C-4 CONDITIONAL USE PERMIT NO, 88-28 APPLICANT: TEXAS LOOSEY'S A request to establish dancing to recorded music (Disc Jockey) seven nights a week and lunch hour fashion shows five days per week, Monday to Friday, in an existing restaurant. ENVIRONMENTAL STATUS: The proposed project is exempt Class 1 Section 15301 from the provisions of the California Environmental Quality Act. RECOMMENDATION: Deny Conditional Use Permit No. 88-28 with findings. THE PUBLIC HEARING WAS OPENED Ron Walton, President of Texas Loosey's, spoke in support of the request. He said Texas Loosey's was primarily a restaurant and the recorded music draws a mature age group. PC Minutes - 8/16/88 -10- (1170d) Bob Riedesel, President of the Merideth Gardens Homeowners Association, spoke in opposition of the request. He said the majority of the Directors concurred with the findings in the staff report which recommended denial. Sterling Colthurst, Vice President of the Merideth Gardens Homeowners Association, spoke in opposition of the request. He expressed concern over noise which could result from emergency vehicles and helicopters overhead as it had been with a similar use in the past. Jay Goodin, 20031 Lawson Lane, spoke in opposition of the request relative to noise disturbances for the adjacent residential. Deann Gutowski, 10206 Ascot Circle, spoke in opposition of the request. She presented a petition (65 signatures) from neighbors in her residential complex directly across Adams Avenue from Texas Loosey's opposing the request due to noise and traffic. Joanne Johnson, 10219 Disney Circle, spoke in opposition of the request. There were no other persons present to speak for or against the request and the public hearing was closed. A MOTION WAS MADE BY LIVENGOOD AND SECOND BY LEIPZIG TO DENY CONDITIONAL USE PERMIT NO. 88-28 WITH REVISED FINDINGS, BY THE FOLLOWING VOTE: AYES: Livengood, Silva, Leipzig, Ortega, Higgins, Kirkland NOES: None ABSENT: Slates ABSTAIN: None MOTION PASSED FINDINGS FOR DENIAL: 1. The establishment of the restaurant with seven nights a week of dancing to recorded music operated by a disc jockey, will be detrimental to the general welfare of persons residing in the vicinity due to potential noise impacts from customers leaving the premises after 10:00 PM. 2.. On -site parking and circulation are inadequate based on the parking ratios and distribution as shown in Attachment No. 7, for the proposed lunch-time fashion show and have the potential of creating a congestion and circulation hazard. Ingress and egress to the site has the potential of creating additional traffic impacts to the intersection of Adams Avenue and commercial center entrance because of traffic impacts generated by the proposed lunch hour fashion shows. 4. The proposed dancing/live entertainment use does not conform with the Huntington Beach Ordinance Code in terms of buffer area; the restaurant building is approximately 180 feet from residential uses to the north (across Adams Avenue). 5. The proposed dancing/live entertainment use is not compatible with the existing 24-hour market within the center. C-5 CONDITIONAL USE PERMIT NO, 88-31 APPLICANT: MARK F. O'DONNELL Conditional Use Permit No. 88-31 is a request to permit exterior alteration to an existing single family dwelling that is nonconforming with regard to setbacks, parking and building separation. ENVIRONMENTAL STATUS: The proposed project is exempt Class 1 Section 15301 and Class 5 Section 15305 from the provisions of the California Environmental Quality Act. SPECIFIC PLAN: The site is located within the Oldtown Specific Plan -District 1. The following is a zoning conformance chart comparing the applicant's proposal to Oldtown Specific Plan standards: STAFF RECOMMENDATION: Deny Conditional Use Permit No. 88-31 with findings and conditions. THE PUBLIC HEARING WAS OPENED Les Hartley, attorney representing the applicant, spoke in support of the request. He said that the applicant's request meets the requirements under the old zoning code for a conditional use permit and that stopping the work has created an eyesore in the neighborhood. Mark O'Donnell, applicant, spoke in support of the request. He said the improvements to the residence would enhance the lot even though it still would be a small cottage. He further stated that there is , a lot of diverse architecture in the neighborhood. Tom Van Tuyl, Pier Realty Group, spoke in support of the request. PC Minutes - 8/16/88 -12- (1170d) Dennis Mahood, 213 Portland, spoke in support of the request. He said the property is an eyesore and the addition is a big improvement. Charlie Unger, 8442 Springhurst, reported his concerns with the request. He said the garage for the subject property adjoins his property and is on the verge of falling down. He requested the garage be rebuilt within the proper setback requirements. Natalie Kotsch, 220 Main Street, spoke in support of the request. There were no other person present to speak for or against the request and the public hearing was closed. A MOTION WAS MADE BY SILVA AND SECOND BY KIRKLAND TO APPROVE CONDITIONAL -USE PERMIT NO. 88-31 WITH ALTERNATE FINDINGS AND CONDITIONS OF APPROVAL, BY THE FOLLOWING VOTE: Commissioner Higgins expressed concern with quality of the construction of the remodel and suggested that the entire structure be demolished. He further expressed his frustration with the applicants misrepresentation of interior repairs instead of a major remodel. Commissioner Leipzig stated he would not support the motion as he felt the remodel would not enhance the property or neighborhood. The proposed structure will not be compatible with adjacent properties because it encroaches within the front yard and exterior side yard setbacks, as well as in the public right-of-way at the corner or Delaware Street and Joliet Avenue. Substantial alteration as proposed will be detrimental to the general welfare of persons working or residing in the vicinity because the structure will preclude improvements within the public right-of-way, and will impede sight distance at the corner of Delaware Street and Joliet Avenue. 3. Although the property is irregular in configuration, the size of the lot satisfies the minimum size of 2,500'square feet and exceeds the minimum frontage of 30 feet. Therefore, the conditional use permit is not necessary to preserve a substantial property right. 4. Encroachment into the required setback is not compatible with setbacks established for properties to the north, south, east -and west and would constitute a special privilege inconsistent .with limitations upon those properties. C-6 CODE AMENDMENT NO, 88-8 APPLICANT: CITY'OF HUNTINGTON BEACH A request to amend Section 9101 of the Huntington Beach Ordinance Code to allow specific temporary uses within the Residential Agriculture (RA) district subject to conditional use permit, and to amend Section 9510.15.1 to allow temporary recreational vehicle storage within the Restricted Manufacturing District,(M1-A) subject to conditional use permit. ENVIRONMENTAL STATUS: The proposed,code amendment is categorically exempt from the provisions of the California Environmental Quality Act. STAFF RECOMMENDATION: Approve Code Amendment No. 88-8 and recommend adoption by the City Council. DISCUSSION ITEMS E-1 PLANNING COMMISSION BY-LAWS The Commission discussed amendments to the Bylaws. It was requested this item be placed on the next agenda for action. E-2 RAILS TO TRAILS Commissioner Ortega, on behalf of Citizen's Advisory Committee, requested staff to discuss the Rails to Trails concept. Staff informed the Commission of a previously prepared Master Plan for Bikeways which concluded that there is adequate bike trails along Lake Street. After further discussion, it was decided to schedule a study session for further information. F. PLANNING COMMISSION INQUIRIES Commissioner Kirkland announced that this was probably his last meeting since Commissioner Bourguignon is expected back on September 1, 1988. He expressed his thanks to the Commission for having the opportunity to work with them over the last couple of months.
