MINUTES: Minutes of the October 5, 1988 meeting were continued to October
19, 1988
REGULAR AGENDA ITEMS:
CONDITIONAL EXCEPTION NO. 88-40
Applicant: Rick Moreno
This request is covered by Categorical Exemption, Section 15305, Class 5, California
Environmental Quality Act, 1986.
Staff member, Thomas Rogers, reported that this is a request for an addition of a garage
with a 17 ft. driveway in lieu of the required 22 ft. driveway located at 6112 Medford
Drive. He stated that the applicant would like to take the existing garage and turn that
into a living room area and construct another garage. Staff is recommending denial as the
plan stands because there is not adequate room within 17 feet to provide two on -site
parking spaces.
The public hearing was opened and Mr. and Mrs. Moreno were present and spoke in support
of the request. Applicant, Mr. Moreno, stated that there is a home in the same tract who
previously did the same adjustments to his home with the city's approval.
Discussion ensued with applicant and staff for an understandiong of the recommendation
of denial. Mr. Strange asked applicant if they would be willing to move the garage over
two feet making the driveway nineteen feet. Mrs. Moreno stated that this adjustment
would not be becomming of the house giving the walkway to the house a tunnel effect.
There was also discussion regarding moving the drive to Medford Drive.
There was no one else present to speak for or against the request so the public hearing
was closed.

Mr. Strange stated that he would approve the request for a 19 foot driveway in liue of the
request seventeen foot driveway. He stated that the applicant could still appeal the
application to the Planning Commission.
CONDITIONAL EXCEPTION NO. 88-40 WAS APPROVED FOR A 19 FOOT DRIVEWAY IN
LIEU OF THE REQUESTED 17 FOOT WITH THE FOLLOWING FINDINGS AND
CONDITIONS:
FINDINGS FOR APPROVAL:
1. The establishment and maintenance of the reduced driveway approach from
twenty-two feet (22 ') to nineteen feet (19') or more will not be detrimental to:
a. The general welfare of persons residing or working in the vicinity.
b. Property and improvements in the vicinity of such use of building.
C. Parking for the residence since this property is a corner lot and three (3)
cares can park on the street at this residence.
2. Granting of reduction of driveway length will not create an unsafe backing
condition due to the relocation of an existing block wall to allow for the sight
distance necessary to see oncoming traffic and walkway users.
3. The granting of Conditional Exception No. 88-40 is necessary in order to preserve
the enjoyment of one or more substantial property rights, including the
lawn/landscape which can be maintained in place.
4. The reduced driveway length of nineteen feet (191) will provide the code intended
two (2) onsite parking spaces.
5. The granting of Conditional Exception No. 88-40 will not be materially detrimental
to the public welfare or injurious to property in the same zone classifications.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans, elevations received and dated September 26, shall be
revised and resubmitted depicting the modifications described herein:
a. Indicate a minimum nineteen foot (19') direct driveway
b. Provide automatic roll -up door(s)
C. Relocate existing wall a minimum of ten feet to accommodate the ten foot
(10') corner cut-off
2. The proposed addition shall be architecturally compatible with existing structure.
3. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters,
and central heating units.
4. Low -volume heads shall be used on all spigots and water faucets.
5. All building spoils, such as unusable lumber, wire, pipe, and other surplus or
unusable material, shall be disposed of at an off -site facility equipped to handle
them.

6. Prior to issuance of building permits, the property owner shall sign, notarize, and
record with the County Recorder a "Letter of Agreement" assuring that the single
family residence will be maintained as one (1) dwelling unit.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions of the Ordinance Code,
Building Division, Fire Department, and Department of Public Works.
2. If foil —type insulation is to be used, a fire retardant type shall be installed as
approved by the Building Division.
3. All applicable Public Works fees shall be paid prior to issuance of building permits.

Applicant: J.M. Peters Company
This request is covered by Categorical Exemption, Seasonal Use, Class H, Section 15311,
California Environmental Quality Act, 1986.
Staff member, Thomas Rogers, reported that this is a request for a proposed site for a
Sales Models and a Sales Trailer for Tract 13656 located on the Southwest corner of
Atlanta Avenue and Bushard Street. Mr. Rogers referred to the map showing Mr. Strange
the proposed locations for the Models and Trailers. He stated that the Fire Department
and Public Works department have requested a couple of conditions listed in the
Conditions of Approval.
Mr. Strange questioned the applicant on the handicap requirements. Gene Hibrao,
representing the applicant, was present, and stated that the Trailer is buried in the ground
and making the entrance at grade for access for the handicapped.
ADMINISTRATIVE REVIEW NO. 88-24 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS:
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan received and dated September 22, 1988, shall be the approved layout
subject to the following modification:
a. The rear setback for the sales trailer shall be a minimum of 10 ft.
2. Prior to issuance of building permits, the applicant shall submit and have approved
the following plan:
a. Landscape and irrigation plan (for models and parking area) to the
Department of Community Development and Public Works for review and
approval.
3. Installation of required landscaping and irrigation systems shall be completed prior
to final inspection.
4. All building spoils, such as unusable lumber, wire, pipe, and other surplus or
unusable material, shall be disposed of at an off —site facility equipped to handle
them.

5. All applicable Public Works fees shall be paid prior to issuance of building permits.
6. Subdivision directional signs shall comply with Section 9610.9 (c) of the Huntington
Beach Ordinance Code, and shall be installed prior to final inspection.
7. All roads (including fire access) shall be of hard surface, all weather construction
meeting Public Works and Fire Department requirements, and shall be installed
prior to combustible construction.
8. All water lines and fire hydrants shall be installed and approved by the Fire
Department prior to any combustible construction.
9. The sales office shall not be converted or expanded into a general business office.
10. The office use shall be discontinued and trailer removed within thirty (30) days
following sale of the last on —site unit. A surety bond of $1,000.00 shall be posted
with the City for the sales office and for each model home to guarantee
compliance with all provisions of the Huntington Beach Ordinance Code and
Building Code. Such model homes shall only serve the tract specified in subject
Site Plan Administrative Application.
11. Handicap access to the sales office and model homes shall be provided per Building
Division requirements.
12. Setbacks shall comply with approved plans for Conditional Exception No. 88-78.
All applicable Conditions of Approval of Conditional Use Permit No. 88-27 and
Tentative Tract No. 13656 shall also apply.
INFORMATION ON SPECIFIC CODE REOUIREMENTS:
1. The development shall comply with all applicable provisions of the Ordinance Code,
Building Division, and Fire Department.
2. The applicant shall meet all applicable local, State, and Federal Fire Codes,
Ordinances, and standards.
3. Security fencing, gates, locking devices, and ingress and egress from streets and
parking areas shall be reviewed and approved by the Fire, Police, and Development
Services Departments prior to issuance of building permits. The parking area shall
comply with Article 960.
4. The Zoning Administrator reserves the right to revoke Administrative Review No.
88-24 if any violation of these conditions of the Huntington Beach Ordinance Code
occurs.
