MINUTES: Minutes of the October 19, 1988 meeting were approved.
REGULAR AGENDA ITEMS:
CONDITIONAL EXCEPTION NO. 88-41
Applicant: Rufus L. Turner
This request is covered by Categorical Exemption, Class 5, Section 15305, California
Environmental Quality Act, 1986.
Staff member, Thomas Rogers, reported that this is a request to allow the off -site
landscaping of 4,560 sq. ft. to be credited towards the required eight percent (8%) of the
net site area (3,424) sq. ft., and to allow a seven (7) ft. high fence at 17552 Goldenwest
Street. He stated that the applicant is taking an area that belongs to the city and
applying eight percent (8%) requirement. The applicant has agreed to provide a contract
to landscape maintain the area. The fence is a perimeter rod iron fence. Staff is
recommending approval of the request.
Mr. Strange, Zoning Administrator, asked staff if there were any letters of opposition
submitted to the City against this request. Staff stated no.
The public hearing was opened and Rufus Turner was present and spoke in support of the
request stating that the plan reflected recommendations made by the Design Review
Board.
There was no one else present to speak for or against the request so the public hearing
was closed.
Mr. Strange asked staff if the Design Review Board suggested any additional conditions.
Mr. Rogers stated that a materials pallet had to be submitted and approved by the Design
Review Board.

CONDITIONAL EXCEPTION NO. 88-41 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS:
FINDINGS FOR APPROVAL:
1. Because of special circumstances applicable to the subject property, including size,
shape, topography, location or surroundings, the strict application of the Zoning
Ordinance is found to deprive the subject property of privileges enjoyed by other
properties in the vicinity and under identical zone classifications. The property sets
back thirty feet from public streets on both sides. The thirty foot buffer will be
landscaped and maintained by the applicant meeting the intention of the landscaping
requirements.
2. A seven foot fence is required to maintain security for the nursery. The fence is to
be constructed of wrought iron thus allowing visibility into the site.
3. The granting of a Conditional Exception is necessary in order to preserve the
enjoyment of one or more substantial property rights.
4. The granting of Conditional Exception No. 88-41 will not be materially detrimental
to the public welfare, or injurious to property in the same zone classifications.
5. The granting of the Conditional Exception will not adversely affect the General Plan
of the City of Huntington Beach.
6. The location, site layout, and design of the proposed use properly adapts the
proposed structures to streets, driveways, and other adjacent structures and uses in
a harmonious manner.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated October 10, 1988 shall
be the approved layout.
2. Prior to issuance of building permits, the applicant shall submit the following plans:
a. Landscape and irrigation plan to the Department of Community Development
and Public Works for review and approval.
b. Rooftop Mechanical Equipment Plan. Said plan shall indicate screening of all
rooftop mechanical equipment and shall delineate the type of material proposed
to screen said equipment.
3. Installation of required landscaping and irrigation systems shall be completed prior
to final inspection.
4. Prior to the issuance of building permits, the applicant shall submit and have
approved by the City Attorney an agreement to maintain the thirty foot landscaping
buffer adjacent to Goldenwest Street and Slater Avenue.
5. On —site fire hydrants shall be provided in number and at locations specified by the
Fire Department.

6. An automatic fire sprinkler system shall be approved and installed pursuant to Fire
Department regulations.
7. Service roads and fire lanes, as determined by the Fire Department, shall be posted
and marked.
8. Fire access lanes shall be maintained. If fire lane violations occur and the services
of the Fire Department are required, the applicant will be liable for expenses
incurred.
9. Driveway approaches shall be a minimum of twenty-seven feet (27') in width and
shall be of radius type construction.
10. There shall be no outside storage of vehicles, vehicle parts, equipment or trailers.
11. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable
material, shall be disposed of at an off -site facility equipped to handle them.
12. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters,
and central heating units.
13. Low -volume heads shall be used on all spigots and water faucets.
14. If lighting is included in the parking lot, high-pressure sodium vapor lamps shall be
used for energy savings. All outside lighting shall be directed to prevent "spillage"
onto adjacent properties.
15. A grading plan shall be submitted and approved by the Department of Public Works.
All drainage and/or hydrology is subject to Public Works review and approval.
16. All applicable Public Works fees shall be paid prior to issuance of building permits.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions of the Ordinance Code,
Building Division, and Fire Department.
2. The applicant shall meet all applicable local, State, and Federal Fire Codes,
Ordinances, and standards.
3. The applicant shall obtain the necessary permits from the South Coast Air Quality
Management District, if applicable.
4. The Zoning Administrator reserves the right to revoke this Conditional Exception
No. 88-41 if any violation of these conditions of the Huntington Beach Ordinance
Code occurs.

This request is covered by Negative Declaration No. 82-2.

Staff member, Thomas Rogers, reported that this is a request for a temporary occupancy
for a sales office and two (2) models located on 430 Lake Street. He stated that there is
currently a trailer there which was previously approved by the Zoning Administrator. He
stated that the parking will be down underneath with an elevator to take customers up to
the office. Staff stated that the trailer must be removed within two weeks of opening the
new office. Staff recommended approval with conditions.
Mary Borgia, representing Newcomb Development, was present and spoke in support of
the project.
ADMINISTRATIVE REVIEW NO. 88-25 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS:

be the approved layout.
2. Service roads and fire lanes, as determined by the Fire Department, shall be posted
and marked.
3. Fire access lanes shall be maintained. If fire lane violations occur and the services
of the Fire Department are required, the applicant will be liable for expenses
incurred.
4. All Fire Department conditions for the subject models shall be met prior to
temporary occupancy.
5. The existing sales trailer shall be removed within two weeks of occupancy of the
models and sales office.
6. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters,
and central heating units.
7. Low -volume heads shall be used on all spigots and water faucets.
8. All applicable Public Works fees shall be paid prior to issuance of building permits.
9. The office use shall be discontinued within thirty (30) days following sale of the last
on -site unit. A cash bond of one thousand dollars ($1,000) shall be posted with the
city for the sales office and for each model home to guarantee compliance with all
provisions of this code and the huntington Beach Building Code. Such model homes
shall only serve the tract specified in the administrative review application.
10. The administrative review permit may be subject to review by the Zoning
Administrator one (1) year after issuance to insure compliance with all city codes.
11. No sales office shall be converted or expanded into a general business office for the
contractor or developer.
