ZONING ADMINISTRATOR: Michael Strange STAFF MEMBERS: Thomas Rogers REGULAR AGENDA ITEMS: USE PERMIT NO. 88-62 - Continued from January 4, 1989 Applicant: Luis M. Lopez This request is covered by Categorical Exemption, Class 5, Section 15305, California Environmental Quality Act, 1986. Staff member, Thomas Rogers, reported that this is a request to permit a six foot high wall at a ten foot front yard setback located at 17122 Sims Street. The request was continued from January 4, 1989 to correctly notify surrounding residents. Mr. Rogers stated the surrounding residents were correctly notified and there were no complaint. Staff is recommending approval. The public hearing was opened and Luis M. Lopes, applicant, was present and spoke in support of the request. There was no one else present to speak for or against the request so the public hearing was closed. USE PERMIT NO. 88-62 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS: FINDINGS FOR APPROVAL: 1. The establishment and maintenance of the wall will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. The wall will not create an unsafe situation. b. Property and improvements in the vicinity of such use or building. Existing structures on that property to the north have a ten (10') foot setback off Sims Street, ZA Minutes 1/11/89 -1- 4455h 2. The granting of the Use Permit No. 88-62 will not adversely affect the General Plan of the City of Huntington Beach. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan and elevations received and dated December 1, 1988 shall be the approved layout. 2. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off —site facility equipped to handle them. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. USE PERMIT NO. 89-1 Applicant: Oshman's Sporting Goods This request is covered by Categorical Exemption, Class 4, Section 15304, California Environmental Quality Act, 1986. Staff member, Thomas Rogers, reported that this is a request for a temporary outdoor event for a one day tent sale on Saturday, January 14, 1989 located at 15021 Goldenwest Street. He stated that this is the same as the event that took place last year with no reports of problems from the Police Department or the Fire Department. Staff is recommending approval. Bret Silvert, representing the applicant, was present and spoke in support of the request. USE PERMIT NO. 89-1 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS: FINDINGS FOR APPROVAL: 1. The establishment, maintenance and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity, similar sales have occurred in the past without negative results. b. Property and improvements in the vicinity of such use or building. The tent is temporary. 2. The granting of the Use Permit No. 89-1 will not adversely affect the General Plan of the City of Huntington Beach. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan and floor plans dated January 11, 1989 shall be the approved layout. 2. the applicant shall provide for clean up of the area after closing of the event. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. 4. The applicant shall obtain clearance from the Public Liability Claims Coordinator, Administrative Services Department and/or shall provide a Certificate of Insurance and Hold Harmless Agreement to be executed at least five (5) days prior to the event. 5. Provide a minimum of thirty (30) feet back up area for parking space bay located to the south of the tent. 6. Sidewalks shall be maintained at a clear width of four feet (4'). 7. Two (2) parking spaces adjacent to the north side of the tent and two (2) parking spaces adjacent to the south side of the tent shall remain clear for turn around purposes. 8. If merchandise is to be left in the tent overnight, a security guard shall be provided. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 2. The applicant may erect the tent and have the sale provided that all conditions of approval have been met. 3. The Zoning Administrator reserves the right to revoke Use Permit No. 89-1 if any violation of these conditions of the Huntington Beach Ordinance Code occurs.
