ZONING ADMINISTRATOR: Michael Strange STAFF MEMBERS: Thomas Rogers REGULAR AGENDA ITEMS: CONDITIONAL EXCEPTION NO. 88-52 Applicant: William C. Morgan This request is covered by Categorical Exemption, Class 5, Section 15305, California Environmental Quality Act, 1986. Staff member, Thomas Rogers, reported that this is a request for reduced amount of open space (850 square feet) located at 15402 Hanover Lane. The public hearing was opened and William C. Morgan, applicant, was present and spoke in support of the request. There was no one else present to speak for or against the request so the public hearing was closed. CONDITIONAL EXCEPTION NO. 88-52 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS: FINDINGS FOR APPROVAL: 1. That the granting of Conditional Exception No. 88-52 will not constitute a grant of special privilege inconsistent upon other properties in the vicinity and under an identical zone classification. 2. That because of special circumstances applicable to the subject property, including size, shape, topography, location or surroundings, the strict application of the zoning ordinance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classification. At the time the structure was built, a 20 foot setback was required for the side entry garage placing a disproportioned amount of yard area into the front of the property. 3. That the granting of a conditional excepetion is necessary to preserve the enjoyment of one or more substantial property rights. The conditional exception is necessary to add a second bathroom to the three bedroom house. ZA Minutes 1/18/89 -1- 4457h 4. That the granting of conditional exception will not be materially detrimental to the public welfare or injurious to property in the same zone classifications. The addition is not visible from the street and does not encroach into any setbacks. The addition shall not create an unsafe situation in relationship to adjacent properties. 5. That the granting of a conditional exception will not adversely affect the general plan of the city of Huntington. 6. Although the entire 900 square feet of open space required in the rear yard does not have a minimum dimension of twenty (20') feet, (850 square feet does meet minimum dimension requirements), the rear lot configuration meets the spirit of the openspace requirement and provides 900 plus square feet of useable openspace area.. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated December 20, 1988 shall be the approved layout. 2. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off —site facility equipped to handle them. 3. Low —volume heads shall be used on all spigots and water faucets. 4. All applicable Public Works fees shall be paid prior to issuance of building permits. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. USE PERMIT NO. 89-2 Applicant: City of Huntington Beach This request is covered by Categorical Exemption, Class 3, Section 15303, California Environmental Quality Act, 1986. Staff member, Laura Phillips, reported that this is a request to place a modular office building for temporary relocation of downtown merchants located at 305 and 307 Main Street. She stated that the purpose of this office to help merchants with temporary quarters for displacement. She stated that the office will meet all building code requirements and meet all expectations of the Downtown Specific Plan. She stated that the City will place four parking spaces on the lot and other parking spaces required will be 75 feet to the north. Staff is recommending approval. Mr. Strange asked Ms. Phillips if there was a time frame for this request. Ms. Phillips replied that the city had an 18 month lease. The public hearing was opened, and Jim Koller, adjacent business owner, spoke in opposition stated that the office would create competition for his office space. USE PERMIT NO. 89-2 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS: FINDINGS FOR APPROVAL: 1. The establishment, maintenance and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of the Use Permit No. 89-2 for temporary modular units will not adversely affect the General Plan of the City of Huntington Beach. 3. The proposal is consistent with the goals and objectives of the City's General Plan and Land Use Map. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated January 10, 1989 shall be the conceptually approved layout. 2. All building spoils, such as unusable lumber, wire, pipe, and other, surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 3. Low -volume heads shall be used on all spigots and water faucets. 4. If lighting is included in the parking lot, high-pressure sodium vapor lamps shall be used for energy savings. All outside lighting shall be directed to prevent "spillage" onto adjacent properties. 5. The development shall comply with all applicable provisions of the Downtown Specific Plan, Downtown Design Guidelines, Building Division, and Fire Department. 6. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and Standards. ADMINISTRATIVE REVIEW NO. 88-23/TENTATIVE PARCEL MAP NO. 88-447/ENVIRONMENTAL ASSESSMENT NO. 88-40 Applicant: Pacific Coast Corporation Staff member, Thomas Rogers, reported that this is a request to subdivide one (1) lot into five (5) lots and construct concrete tiltup industrial buildings on each (approximately 74,000 square feet total) located at 17852 Gothard Street. Mr. Rogers stated that the applicant was not present and he recommended that that this item be continued for one week because the applicant was not present to agree to the conditions of approval for the tentative parcel map.
