MINUTES: Minutes of the February 8, 1989 Zoning Administrator Meeting were
approved.
REGULAR AGENDA ITEMS:
USE PERMIT NO. 88-63/ENVIRONMENTAL ASSESSMENT NO. 88-48
Applicant: City of Huntington Beach/Water Division
This request is covered by Negative Declaration No. 88-48.
Staff member, Thomas Rogers, reported that this is a request to construct a 10,000 square
foot warehouse, a blockwall exceeding 42 inches within the front yard setback along
Garfield Avenue (replacing existing chainlink fence), and other yard improvements located
at 19001 Huntington Street. He stated that a Use Permit is required for any alternation
an industrial site adjacent to residential and constructing a wall over 42 inches high within
the front setback. He stated that the eight (8) foot splitfaced block wall approved to be
painted to match the existing operations building. He stated that the gates are proposed
to be eight (8) feet high and constructed to defuse visibility into yard areas. The Storage
building is proposed to be 10,000 square feet. He stated that the applicant is also
relocating fuel pumps and adding a covered meter wash station to meet State Waste
Discharge standards. He stated that parking is over code requirement but the applicant is
short handicap spaces. Mr. Rogers suggested that the applicant use the extra parking
spaces to meet handicap parking requirement. Staff is recommending approval.
The public hearing was open and Jeff Renna, Water Superintendent, representing the City
of Huntington Beach, was present and spoke in support of the request.
Kathy Leighton, resident of Huntington Beach, was present and requested to see the
design of the plan. She was not for or opposed to the request.

There was no one else present to speak for or against the request so the public hearing
was closed.
USE PERMIT NO. 88-63/ENVIRONMENTAL ASSESSMENT NO. 88-48 WAS APPROVED
BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND
CONDITIONS:
MITIGATION MEASURES REQUIRED FOR NEGATIVE DECLARATION 88-48:
1. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters,
and central heating units.
2. Low volume heads shall be used on all showers and/or faucets.
3. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable
material, shall be disposed of at an off -site facility equipped to handle them.
4. If lighting is included in the parking lot and/or recreation area energy efficient
lamps shall be used (e.g., high pressure sodium vapor, metal halide). All outside
lighting shall be directed to prevent "spillage"onto adjacent properties.
S. Existing mature trees in the public right-of-way shall be retained if feasible. Any
existing mature tree that must be removed shall be replaced at a 2:1 ratio with 36"
box trees which shall be incorporated into the project's landscape plan.
6. If foil -type insulation is to be used, a fire retardant type shall be installed as
approved by the Building Department.
7. An engineering geologist shall be engaged to submit a report indicating the ground
surface acceleration from earth movement for the subject property. All structures
within this development shall be con- structed in compliance with the g-factors as
indicated by the geologist's report. Calculations for footings and structural
members to withstand anticipated g-factors shall be submitted to the City for
review prior to the issuance of building permits.
8. Prior to the issuance of permits, a grading plan shall be submitted to the City's
Department of Public Works. A plan for silt control for all water runoff during
construction may be required by the Director of Public Works if deemed necessary.
9. Information on equipment or facilities which may generate air pollutants shall be
submitted to the South Coast Air Quality Management District staff for their
review prior to the issuance of a Certificate Of Occupancy for any use within the
building.
10. If any hazardous materials are to be used on site, the business must comply with
Chapter 1758 of the City's Municipal Code which requires any business that handles
or stores hazardous materials, including waste, to inventory the hazardous materials
on site and prepare a business emergency plan in case of an accidental release of
toxic material. Additionally, all hazardous materials, including waste, must be
handled and stored in accordance with the Uniform Fire Code. Waste oil is
considered a hazardous waste.

11. During cleaning, grading, earth moving or excavation, the applicant shall:
a. Control fugitive dust by regular watering, paving construction roads, or other
dust preventive measures.
b. Maintain equipment engines in proper tune.
12.
During construction, the applicant shall:
a. Use water trucks or sprinkler systems to keep all areas where vehicles move
damp enough to prevent dust raised when leaving the site,
b. Wet down areas in the late morning and after work is completed for the day,
c. Use low sulfur fuel (.05% by weight) for construction equipment,
d. Phase and schedule construction activities to avoid high ozone days (first stage
smog alerts).
e. Discontinue construction during second stage smog alerts.
13.
Construction and grading shall be limited to Monday - Saturday 7:00 AM to 8:00
PM. Construction shall be prohibited Sundays and Federal holidays.
FINDINGS FOR APPROVAL - USE PERMIT NO. 88-63:
1.
The establishment, maintenance and operation of the use will not be detrimental to:
a. The general welfare of persons residing or working in the vicinity. The
improvements will create a safer, quieter environment.
b. Property and improvements in the vicinity of such use or building.
2.
The granting of the Use Permit No. 88-63 will not adversely affect the General Plan
of the City of Huntington Beach.
3.
The proposal is consistent with the goals and objectives of the City's General Plan
and Land Use Map.
4.
The location, site layout, and design of the proposed use properly adapts the
proposed structures to streets, driveways, and other adjacent structures and uses in
a harmonious manner.
5.
The combination and relationship of one proposed use to another on a site are
properly integrated.
6.
The access to and parking for the proposed use does not create an undue traffic
problem.
SPECIAL CONDITIONS OF APPROVAL:
1.
The site plan, floor plans, and elevations received and dated December 14, 1988
shall be the approved layout with the modifications described herein:

a. The propane tank shall not be placed above ground unless specifically approved
by the Fire Department.
b. A minimum of three handicapped parking spaces shall be provided per state law.
2. Prior to issuance of building permits, the following plans and items shall be
submitted and/or completed by the applicant:
a. Landscape and irrigation plan to the Department of Community Development
and Public Works for review and approval.
b. Rooftop Mechanical Equipment Plan. Said plan shall indicate screening of all
rooftop mechanical equipment and shall delineate the type of material proposed
to screen said equipment.
3. Installation of required landscaping and irrigation systems shall be completed prior
to final inspection within twelve (12) months.
4. Special architectural treatment shall be provided on building walls as shown on the
approved elevations. Any change in the architectural treatment is subject to
approval by the Design Review Board.
5. On -site fire hydrants shall be provided in number and at locations specified by the
Fire Department and Water Department.
6. An automatic fire sprinkler system for the warehouse and canopy shall be approved
and installed pursuant to Fire Department regulations.
7. Service roads and fire lanes, as determined by the Fire Department, shall be posted
and marked.
8. Fire access lanes shall be maintained. If fire lane violations occur and the services
of the Fire Department are required, the applicant will be liable for expenses
incurred.
9. The above -ground propane tank shall not be installed unless approved by the Fire
Department.
10. Driveway approaches shall be a minimum of twenty-seven feet (27') in width and
shall be of radius type construction.
11. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable
material, shall be disposed of at an off -site facility equipped to handle them.
12. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters,
and central heating units.
13. Low -volume heads shall be used on all spigots and water faucets.
14. If lighting is included in the parking lot, high-pressure sodium vapor lamps shall be
used for energy savings. All outside lighting shall be directed to prevent "spillage"
onto adjacent properties.

15. The existing Eucalyptus tree along Garfield shall be replaced with a 36 inch box
Canary Island Pine in front of new wall.
16. The gates along Garfield shall be eight (8) feet high to match the new wall and be
constructed to prevent direct visibility into the yard.
17. The existing six (6) foot high block wall shall be increased to eight (8) feet high to
match the new block wall.
18. The new wall replacing the existing chain link fence shall be made out of splitfaced
block as shown on the plans and have a maximum height of eight (8) feet as
measured from the curb.
19.
Intensified landscaping shall be installed and maintained between the new wall and
Garfield Avenue.
20.
All applicable Public Works fees shall be paid prior to issuance of building permits.
INFORMATION ON SPECIFIC CODE REOUIREMENTS:
1.
The development shall comply with all applicable provisions of the Ordinance Code,
Building Division, and Fire Department.
2.
The applicant shall meet all applicable local, State, and Federal Fire Codes,
Ordinances, and standards.
3.
The applicant shall obtain the necessary permits from the South Coast Air Quality
Management District.
4.
Development shall meet all local and State regulations regarding installation and
operation of all underground storage tanks.
5.
A detailed soils analysis shall be prepared by a registered Soils Engineer. This
analysis shall include on -site soil sampling and laboratory testing of materials to
provide detailed recommendations regarding grading, chemical and fill properties,
foundations, retaining walls, streets, and utilities.
6.
A grading plan shall be submitted to the Department of Public Works and approved
prior to issuance of building permits.
7.
Landscaping shall comply with S. 960 of the Huntington Beach Ordinance Code.
Intensified landscaping shall be provided along Garfield Avenue.
14.
The Zoning Administrator reserves the right to revoke Use Permit No. 88-63 if any
violation of these conditions of the Huntington Beach Ordinance Code occurs.
USE PERMIT NO. 89-4

This request is covered by Categorical Exemption, Section 15305, Class 5, California
Environmental Quality Act, 1986.

Staff member, Thomas Rogers, reported that this is a request for a three (3) foot side
yard setback in lieu of the five (5) foot setback requirement for a single family residence
located at 739 Alabama. He stated that the property is located on the south side of
Hartford Avenue. He stated that staff is recommending approval and that the Fire
Department has reviewed the request and the setback was not found to be a safety hazard.
Mr. Strange requested Mr. Rogers why they could not make the houses smaller. Mr.
Rogers stated that it would create a 17 foot wide house which is not practicable. In
addition, the garage is required to have a minimum interior dimension of nineteen feet
necessitating encroachment into the setback.
The public hearing was opened and Eric Mossman, applicant, was present and spoke in
support of the request.
Mr. Leslie Cushing, resident located at 19562 Pompano Lane, Unit 101, spoke in opposition
of the request stating that the setback would create a fire hazard because the houses
were closer together and the fire would spread faster.
There was no one else present to speak for or against the request so the public hearing
was closed.
Mr. Strange responded to Mr. Cushing concerns, stating that the request for the setback
was reviewed by the Fire Department and that they did not feel the request would cause a
safety problem.
USE PERMIT NO. 89-4 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE
FOLLOWING FINDINGS AND CONDITIONS:
FINDINGS FOR APPROVAL:
1. The establishment and maintenance of a three (3) foot setback will not be
detrimental to:
a. The general welfare of persons residing or working in the vicinity. No safety
hazards are created by the granting of a three (3) foot setback.
b. Property and improvements in the vicinity of such use or building. Most
dwellings in the immediate area have three (3) foot setbacks.
2. The granting of the Use Permit No. 89-4 will not adversely affect the General Plan
of the City of Huntington Beach.
3. The location, site layout, and design of the single family dwelling properly adapts to
streets, driveways and adjacent structures and uses in a harmonious manner.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated December 5, 1989 shall
be the approved layout.
2. Prior to issuance of building permits, a landscape and irrigation plan shall be
submitted to the Department of Community Development and Public Works for
review and approval.
3. Installation of required landscaping and irrigation systems shall be completed prior
to final inspection.

4. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable
material, shall be disposed of at an off —site facility equipped to handle them.
5. The water easement shall be maintained according to Public Works standards.
6. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters,
and central heating units.
7. Low —volume heads shall be used on all spigots and water faucets.
8. Prior to issuance of building permits, the property owner shall sign, notarize, and
record with the County Recorder a "Covenant" assuring that the single family
residence will be maintained as one (1) family dwelling unit.
9. All applicable Public Works fees shall be paid prior to issuance of building permits.
INFORMATION ON SPECIFIC CODE REOUIREMENTS:
1. The development shall comply with all applicable provisions of the Ordinance Code,
Building Division, and Fire Department.
2. The applicant shall meet all applicable local, State, and Federal Fire Codes,
Ordinances, and standards.
3. The structures on the subject property, whether attached or detached, shall be
constructed in compliance with the State acoustical standards set forth for units
that lie within the 60 CNEL contours of the property. Evidence of compliance shall
consist of submittal of an acoustical analysis report, prepared under the supervision
of a person experienced in the field of acoustical engineering, with the application
for building permit(s).
4. A detailed soils analysis shall be prepared by a registered Soils Engineer. This
analysis shall include on —site soil sampling and laboratory testing of materials to
provide detailed recommendations regarding grading, chemical and fill properties,
foundations, retaining walls, streets, and utilities.
5. Landscaping shall comply with S. 960 and 913 of the Huntington Beach Ordinance
Code.
