WAIVER OF FINAL MAP
TENTATIVE PARCEL MAP NO. 87-338
Applicant: Marty and Janet Piontkowski
This request is covered by Categorical Exemption, Section 15305, Class 5, California
Environment Quality Act, 1986.
Staff member, Thomas Rogers, reported that this is a request for Waiver of Final Map for
Tentative Parcel Map No. 87-338 located at 928 loth Street. Mr. Rogers stated that the
waiver meets all conditions of approval except two which must be completed prior to
releasing the plat map for recording purposes, and these conditions are listed below. Staff
is recommending approval.
The applicant was not present.
WAIVER OF FINAL MAP FOR TENTATIVE PARCEL MAP NO. 87-338 WAS APPROVED
BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND
CONDITIONS:
FINDINGS OF APPROVAL FOR WAIVER:
1. The proposed consolidation complies with the requirements as to area,
improvement and design, flood and water drainage control, appropriate and
approved public roads, sewer and water facilities, environmental protection, and
other requirements of Article 992 of the Subdivision Section of the Ordinance Code.
CONDITIONS OF APPROVAL:
1. All previous conditions of Tentative Parcel Map No. 87-338 shall be completed
prior to releasing the plat map for recording purposes.

2. The plat map shall be revised to show the required alley dedication.
TENTATIVE PARCEL MAP NO. 89-117
Applicant: William Morehouse
This request is covered by Categorical Exemption, Section 15305, Class 5, California
Environmental Quality Act, 1986.
Staff member, Thomas Rogers, reported that this is a request to combine two lots and a
portion of a third lot into one parcel located at 1107 Pine Street.
William Morehouse, applicant, was present and spoke in support of the request.
TENTATIVE PARCEL MAP NO. 89-117 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS:
FINDINGS FOR APPROVAL:
1.
The proposed consolidation of three (3) parcels into one (1) parcel for purposes of
residential use is in compliance with the size and shape of property necessary for
that type of development.
2.
The General Plan has set forth provisions for this type of land use as well as setting
forth objectives for implementation of this type of use.
3.
The property was previously studied for this intensity of land use at the time the
land use designation for low density residential allowing residential buildings was
placed on the subject property.
4.
The size, depth, frontage, street width and other design and improvement features
of the proposed subdivision are proposed to be constructed in compliance with
standards plans and specifications on file with the City as well as in compliance
with the State Map Act and supplemental City Subdivision Ordinance.
CONDITIONS OF APPROVAL
A.
TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL(S) FOR
ANY PURPOSE:
1.
The Tentative Parcel Map received by the Department of Community Development
on 1/27/89 shall be the approved layout.
3. The alley shall be dedicated and improved to City standards prior to final building
permits.
4. Water supply shall be through the City of Huntington Beach's water system at the
time said parcel is developed.
5. Sewage disposal shall be through the City of Huntington Beach's sewage system at
the time said parcel is developed.
6. All utilities shall be installed underground at the time said parcel is developed.

7. Compliance with all applicable City Ordinances.
8. The applicant shall file, through the Huntington Beach City Clerk's office, and
have recorded with the Orange County Recorder's Office, A Covenant To Hold The
Property As One Parcel in conjunction with the approved plat map. A copy of the
recorded covenant and plat map shall be filed with the Department of Community
Development prior to issuance of building permits on the subject property.
9. All vehicular access rights along Pine Street and the alley shall be dedicated to the
City of Huntington Beach except at locations approved by the Zoning
Administrator.
USE PERMIT NO. 89-9
Applicant: Huntington Harbour Anglers
This request is covered by Categorical Exemption, Section 15311, Class 11(c), California
Environmental Quality Act, 1986.
Staff member, Thomas Rogers, reported that this is a request to conduct the 18th annual
charity bazaar in the northwest portion of the Huntington Harbour Mall parking lot on
May 6, 1989 located in the Huntington Harbour Mall. Mr. Rogers stated that the bazaar
was for only two days so it did not require a public hearing and staff is recommending
approval.
Tom Stroud, representing the applicant, was present and spoke in support of the request.
USE PERMIT NO. 89-9 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE
0 FOLLOWING FINDINGS AND CONDITIONS:
FINDINGS FOR APPROVAL:
1. The establishment, maintenance and operation of the bazaar will not be detrimental
to:
a. The general welfare of persons residing or working in the vicinity;
b. Property and improvements in the vicinity of such use or building.
2. The granting of Use Permit No. 89-9 will not adversely affect the General Plan of
the City of Huntington Beach.
3. The proposal is consistent with the goals and objectives of the City's General Plan
and Land Use Map.
SPECIAL CONDITIONS OF APPROVAL:
1. The conceptual site plan received and dated February 21, 1989 shall be the approved
layout.
2. Sidewalks shall be maintained at a clear width of four feet (41).
3. Signs shall be prohibited within the public right-of-way.

4. Fire access lanes shall be maintained. If fire lane violations occur and the services
of the Fire Department are required, the applicant will be liable for expenses
incurred.
5. The applicant shall obtain clearance from the Public Liability Claims Coordinator,
Administrative Services Department, and/or shall provide a Certificate of Insurance
and Hold Harmless Agreement to be executed at least five (5) days prior to the
event.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The use shall comply with all applicable provisions of the Ordinance Code, Building
Division, and Fire Department.
2. The applicant shall meet all applicable local, State, and Federal Fire Codes,
Ordinances, and standards.
USE PERMIT NO. 89-12
Applicant: Bill Hurd
This request is covered by Categorical Exemption, Section 15311, Class 11(c), California
Quality Act, 1986.
Staff member, Thomas Rogers, reported that this is a request for a temporary outdoor
event on March 18 and 19, 1986 for the use of flags across the front of the parking lot and
a large balloon on top of the building located at 18862 Beach Blvd. Mr. Rogers stated that
the applicant would only be using these temporary signs, flags and balloons for two days so
a public hearing was not required and stated that staff is recommending approval.
Bill Hurd, applicant, was present and spoke in support of the request.
USE PERMIT NO. 89-12 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE
FOLLOWING FINDINGS AND CONDITIONS:
FINDINGS FOR APPROVAL:
1. The grand opening event will not be detrimental to:
a. The general welfare of persons residing or working in the vicinity;
b. Property and improvements in the vicinity of such use or building.
2. The granting of the Use Permit No. 89-12 will not adversely affect the General Plan
of the City of Huntington Beach.
3. The proposal is consistent with the goals and objectives of the City's General Plan
and Land Use Map.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated March 3, 1989 shall be
the approved layout.

2. The flags and balloon shall be removed on March 20, 1989.
3. The balloon shall be attached to the structure per Building Department standards.
4. A Cash Bond in the amount of $100.00 shall be posted to insure the removal of the
flags and balloons.
5. The applicant shall obtain clearance from the Public Liability Claims Coordinator,
Administrative Services Department, and/or shall provide a Certificate of Insurance
and Hold Harmless Agreement to be executed at least five (5) days prior to the
event.
USE PERMIT NO. 88-54
Applicant: Nigel Reynolds
This request is covered by Categorical Exemption, Section 15303, Class 3, California
Environmental Quality Act, 1986.
Staff member, Thomas Rogers, reported that this is a request to establish and operate a
restaurant, including beer and wind sales located at 16107 Bolsa Chica Street. He stated
that this is a tenant improvement for the proposed restaurant. He stated that the use is
correct for the zoning and there is adequate parking per Huntington Beach Ordinance
Code. He stated that staff is recommending approval.
Zoning Administrator, Mike Strange, asked Mr. Rogers what the hours of operation are.
The applicant stated that the hours of operation would be 10:00 a.m. to 12:00 p.m. Monday
through Friday, and 10:00 am. to 2:00 p.m. Saturday and Sunday.
The public hearing was opened. Nigel Reynolds, applicant, was present and spoke in
support of the request. He explained that the restaurant would be an English type pub
with food. He stated that the restaurant was 1,980 square feet. He stated that a dress
code would be enforced.
Rick Zastrow, manager of Carls Jr. Restaurant in the Center, spoke in opposition of the
request expressing concern about the clientele the restaurant and bar would bring into the
center.
Kechen Change spoke in opposition of the request expressing concern about the clientele
and questioning the parking situation.
Naomi George, owner of Giovani Restaurant located in the Center, spoke in opposition of
the request expressing concern about the existing problem in the Center stating that the
restaurant/bar would intensify the problem. She also expressed concern about the parking.
Tony Bartoli, whose daughter owns florist shop next door, spoke in opposition of the
request expressing concern about the safety of his daughter and employees dealing with
intoxicated clientele coming and going into the restaurant/bar.
There was no one else to speak for or against the request so the public hearing was closed.

The Zoning Administrator stated that after hearing the concerns expressed by the tenants
of the shopping center, he would deny the applicant's request for a restuarant including
beer and wine sales based on the following findings and conditions.
USE PERMIT NO. 88-54 WAS DENIED BY THE ZONING ADMINISTRATOR WITH THE
FOLLOWING FINDINGS.
FINDINGS FOR DENIAL:
1. The establishment, maintenance and operation of the Restaurant/Bar will be
detrimental to the general welfare of persons working or residing in the vicinity.
Customers from the proposed Restaurant/Bar may generate undesirable activities
within the shopping center parking lot which would result in disturbances to
residents and business owners within the shopping center and the apartments to the
south.
2. The establishment, maintenance and operation of the Restaurant/Bar will be
detrimental to the value of the property and improvements in the neighborhood.
The proposed Restaurant/Bar is not compatible with existing commercial uses
within the shopping center and the apartments located to the south. Existing uses
include a Flower Shop, Veterinarian, Dry Cleaner, Fast Food Restaurant and other
retail businesses. Customers from the proposed use may generate excessive noise
which could be detrimental to adjoining tenants and residents in the area.
USE PERMIT NO. 89-8
Applicant: Dean Smith Construction
This request is covered by Categorical Exemption, Section 15311, Class 11, California
Environmental Quality Act, 1986.
Staff member, Thomas Rogers, reported that this is a request for site preparation for a
Mobile Magnetic Resonance Imager (some minor parking lot alterations) located at 7677
Center Avenue. He stated that there is adequate parking and three handicapped parking
spaces. Mr. Strange asked staff why this was not located in the main building. Mr.
Rogers responded that this Imager is on a trial basis to see if it is a money maker. He
also stated that under this application the applicant can only have the trailer located
there for a maximum five years and staff is recommending it be approved for two years.
The public hearing was opened. The applicant was not present. There was no one present
to speak for or against the request so the public hearing was closed.
Mr. Strange stated that he would approve the request for 18 months.
USE PERMIT NO. 89-8 WAS APPROVED FOR 18 MONTHS BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS:

FINDINGS FOR APPROVAL:
1.
The establishment, maintenance and operation of a Magnetic Resonance Imager will
not be detrimental to:
a. The general welfare of persons residing or working in the vicinity;
b. Property and improvements in the vicinity of such use or building.
2.
The granting of the Use Permit No. 89-8 will not adversely affect the General Plan
of the City of Huntington Beach.
3.
The proposal is consistent with the goals and objectives of the City's General Plan
and Land Use Map.
4.
The location, site layout, and design of the proposed use properly adapts the
proposed structures to streets, driveways, and other adjacent structures and uses in
a harmonious manner.
S.
The combination and relationship of one proposed use to another on a site are
properly integrated.
6.
The access to and parking for the proposed use does not create an undue traffic
problem.
SPECIAL CONDITIONS OF APPROVAL:
1.
The site plan, floor plans, and elevations received and dated February 8, 1989 shall
be the approved layout.
2.
Prior to issuance of building permits, a cash bond in the amount of $500.00 shall be
posted per Huntington Beach Ordinance Code requirements to insure removal of the
coach.
3.
Approval of the coach is for eighteen (18) months and shall be removed prior to
September 25, 1990 unless an extension of time is granted by the Zoning
Administrator.
4.
Fire access lanes shall be maintained. If fire lane violations occur and the services
of the Fire Department are required, the applicant will be liable for expenses
incurred.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:

The development shall comply with all applicable provisions of the Ordinance Code,
Building Division, and Fire Department.

3. The Zoning Administrator reserves the right to revoke Use Permit No. 89-8 if any
violation of these conditions of the Huntington Beach Ordinance Code occurs.
